"fox & friends" starts right now. see you back here next week. steve: this is a fox news alert. 6:00 here in new york city. president trump reportedly made a last-minute decision to stand down, call off military strikes against the country of iran overnight. jillian: the big question now is what happens next after iran's unprovoked attack on an american drone. brian: this story is going to be love that throughout the show and it's already moved since we prepared for the show. benjamin hall joins us live in studio as the president prepares for his options. what took place or could have taken place last night. benjamin, what do we know? >> first thing to say is president trump has used tomahawk surgical strikes once before in the middle east. this was not a empty threat. it was a last minute decision to stand down. this is the report fing the "new york times" it. all stems from the drone that was shot down wednesday

evening around 7:00 p.m. that was the rq 4 global hawk drone that came down. president trump, after that, then approved military strikes against iran and it's reported was underway in early stages. planes in the air and ships were in position. no missiles had been fired when word came to stand down all day yesterday president trump giving nothing away. >> iran made a big mistake. they made a very bad mistak mistake. >> [inaudible] >> you will find out. >> are you willing to go to war with iran. >> you will find out. you will find out. >> at early as 7 p.m. expecting a strike after intense discussion and debate at the white house among the president's top national security officials and congressional leaders. it's not clear if this strategy or logistics or whether the strikes might go ahead,.

>> look i said i want to get out of these endless wars i campaigned on this. this is a new wrinkle, new fly in the ointment what happened shooting down the drone. this country will not stand for it. >> on thursday, president trump insisted the u.s. drone was flying over international waters when it was shot down by a surface-to-air missile. iran's government continuing to insist, in fact, the american drone headed straight into american airspace. look, either way, this is a clear warning. the steady increase in attacks that we have seen from iran, the tankers first back in may and then as recently as last week the increased uranium enrichments all leading up to this. steve: that's right. breaking overnight, you know, you wonder why we stood down if we had the planes in the air and the ships were in position there is a story on that apparently iranian officials told reuters that tehran received a message through the country of oman from the president of the united states. and his message was, he was against any war and wanted

to talk to tehran about various issues. and he, jonathan, apparently -- benjamin, rather, he gave a short period of time to get our response but any response was up to the ayatollah, a second iranian official said the leader is against any talks. so it sounds like he told iran let's talk, we have got a lot of stuff on the table. let's work it out. in the meantime he looks reasonable. >> time and time again president trump has said is he open for talks with iran he has tried to deescalate this in the past. this seems to have been one last attempt and yet it seems to have had no response. i mean, they just pass it onto the ayatollah. it reminds you that iran is very conflicted dough mess schtickly. you have the ayatollahs and hardliners many who may want to go to war and many want to continue the dialogue. until you know who is calling the shots in iran it's hard to deal with. ainsley: the president is not afraid. doesn't want to go to war. we were getting word they

were going to do this strike buff dawn because they didn't want to risk hitting civilians, children, iranian military what do you think the reason is that he pulled back last night? >> it's hard to say. it does seem as if maybe there is the opportunity for more dialogue, perhaps. i think also he would want to speak to allies. get some sort of a coalition behind him. i think that first and foremost it's important to protect oil tankers traveling through the strait of hormuz and have other allied navies come on board with that whether there was pressure from other countries to avoid. this many countries rely heavily on the this oil in a way the u.s. doesn't anymore. china, japan heavily reliant. 68%, 70% of their oil comes from this parts of the world. interesting actually that it comes just before president trump meets with president xi in china. this puts the pressure on them more than it does on the u.s. brian: north korea is watching. all our enemies are watching. of course, assad is

watching. nothing but provocations. there is a price to pay for inaction and that says a lot we have put suffocating sanctions on them. every day that passes by they get weaker. every day that passes by when they blow up four tankers and we do nothing and they blow up a drone that costs $130 million and we do nothing. it's not going to end there at some points in the middle east no action looks like weakness. weakness begets more attacks. >> i suppose you could flip that on its head and say all the actions we have seen from iran suggest that the u.s. actions are working. brian: economic actions? >> yes. and perhaps this is iran really backed into a corner. president trump has made it clear he wants to come back to the table and talk about a better deal a deal which involves a lot more than the vcpoa did. brian: thanks for coming. >> in thank you.

steve: we are getting words the strikes were called off as light 7:30. the targets were radar, military installations, things like that. in the meantime, we played one of those 10u7bsd bites this morning with the president in the global room with the prime minister of canada yesterday where he said, you know, somebody made a mistake. why would he say that. general jack keane thinks that's party of the president's strategy. >> the president may be revealing the strategies when he said it's a mistake in the sense that he would exercise r restraint to sure up our ally's support for a coalition to keep the shipping lanes oil. japan is dependent on the gulf oil. the country most dependent is china. i'm cavuto they are talking to all of them. i think they want to eventually shape a coalition that will be able to protect shipping it goes through this main artery of oil in

the world called the persian gulf and the gulf of oman. i think that is an objective. brian: the "new york times" had the story that says we are looking for radar. missile batteries. something to send a message not necessarily pick up tragedies. the people that pushed back was the pentagon. we have an outgoing acting secretary of defense. we have an incoming acting secretary of defense. doesn't really take over until sunday. and the pentagon says listen, there is some danger getting involved in something iran could come back with something else. also noteworthy there was surprise that the drone was susceptible to the anti-aircraft missile from iran. they didn't know they were capable of that. so democrats are criticized the president saying he is escalating tensions in iran. brian: which is unbelievable that they would do something like this. the president is not

responsible for this. ainsley: is he meeting with the folks who are the experts on this. is he meeting with his top security officials. bolton, gina haspel and so was pompeo. steve: take a look at some of the thing to people like to be president of the united states elizabeth warren says he has pulled out of a deal that was working and instigated another unnecessary conflict. kamala harris said this president is making america weaker and less safe. joe biden, the form everywhere vice president said president trump's iran strategy is a self-inplaintiff' inflicted disaster. nonetheless the news is they have stood down at this point even though the planes were in the air, the ships were in position because the president sent a note through oman to the leaders of iran look, somebody made a mistake, i want to talk about it. i don't want to escalate this thing. obviously behind the scenes what the president is trying to do is try to get some am lies on board too. ainsley: they hate us. death to america they yell.

brian: a fox news alert. president trump putting iran on notice and giving them an all at this may tu ultimatum caf strikes. is this a good strategy? former commanders david perkins coming to us from israel. first off, general, the series of events over the last seven weeks, what does it show you about the state of iran? >> i have got to tell you having spent this week here in the region, the sanctions, especially the new economic sanctions are really putting a stranglehold on iran, the overall reduction and the price of oil, it's really hitting into their resources which attacks not only iran but the activities they conduct in gaza, lebanon, syria, the west bank, it really binds their hands regionally. brian: you don't get to be a four star general in the army without accounting the

coolest and calmest under pressure. seems like we are being tested by this country. what else the proper response you? know the mind set of the middle east inaction is interpreted oftentimes as weakness. >> exactly. and i think they would be mistaken to determine that we are not acting. we just have to make sure we don't react the way they want us to. because, obviously, they have been poking us in the eye, very overtly, the tankers, shooting downtown drone, and they probably suspect us to do something tactically right away. therefore, if that's what they expect, it's probably not to our advantage. i know some of your previous speakers talked about getting the allies together. getting others to apply pressure. many more countries depend on the oil through the straits of hormuz than does the u.s., so we can actually leverage this and when we do react, if we do react kinetically, we have got to have second, third, fourth, fifth order things ready to

follow up so that we are actually executing a long-term strategy not just a tit-for-tat tactic. brian: general, i give you the keys to the reaction. what's the best reaction from what you know and from law feel in the middle east, how should the middle east respond? >> you know, we have got to make sure we are not playing checkers with the iranians. they are great at checkers. you know, change one piece for another. we have got to play chess. i think we have got to continually box them into a corner. so i think keeping all the military options on the table, they know that with the decision of the president a lot of their military resources can disappear. they know that we are applying economic sanctions and they need to know we have got other things we can do and there are other ways we can warn them so they know thes into is tightening around their neck. brian: you fought in iraq. there during the thunder run. 20 seconds. do the iranians have american blood on their hands? >> without question.

the many years we were in iraq some of our most destructive weapons came from the iranians. the iranian influences i have been this week in the mid east. that's all anyone talks about. non-arab countries their maligned influence all over the region, hezbollah, hamas, the irc -- irgc quds forces they have a lot of blood on their hands. i that's why i think getting folks on a coalition should be one of our priorities it won't that hard in many ways. brian: of course, you are in the right country to understand what a threat is in the middle east. you are you ar. >> thanks, brian. brian: what if one city paved peoplwants to pay people o

concept. gun deaths are down 60%. most of the fellows who went through the program 84, 85 of them did turn around their lives in the sense that they haven't been suspected in any gun-related crimes. they are still alive and doing well. this is about giving those who are our most sort of at risk in terms of violent behavior, giving them an opportunity to succeed by giving them access to resources that will help them get a job, help them get on the right path. something worth trying especially in an area racked with gun violence and efforts to this point haven't worked. steve: dr. porcher, what do you think? >> i disagree. i was a lieutenant in the nypd. i have seen many instances where people were paid for information and in many cases we had the same informants going out and committing additional crimes. i think the goal is to grow the tent and reach out to the franchise population such as you the students, people to that effect. and that's how you can gain intelligence for what's

actually happening in these communities. if you have that comprehensive push from the community that is going to drive down the crime. it's atrocity stool budgets, infrastructure budgets and pay criminals. the truth of the matter is we can come together as a community and police community relationship that gains that information that does bring down the numbers. steve: kevin, i read in some of the local reporting out in fresno, somebody said what's more redick lulls for me is it cost more to house a prisoner than it does to spend a small stippen. and that makes your point. you negotiation spend some money upfront and you wind up not putting somebody away in prison for a very long and expensive period of time. >> right, exactly. and the money that the city is putting up primarily goes to services on that surrounds the fellows. the trainings, the counseling, i think the analysis conducted by local

universities. those types of services. but the money that is actually provided, the stippen to the fellows would come from private donors. it's not really taxpayer money that's funding that stippen. it is a small amount. like you said it costs almost $30,000 to house a prisoner and the average homicide trial tore proceeding in california is over a million dollars. steve: it's a lookout. >> that is a lot of money. this is a drop in the bucket compared to what is usually spent on criminal justice issues. steve: indeed. but, dr. porcher, it just doesn't seem right to a lot of people. wait a minute, we have to pay people, you know, regardless of the sources of money, we have to pay people to do the right thing. >> i have an issue with that and i think if we do decide to finance these types of endeavors, we need to start at the ground level with the youths in the middle schools and grammy schoolgrammar schools the population we need to address to show them right from wrong. the truth of the matter is

reportedly in the air. ships in position when they were told to stand down. the u.s. defense official confirms reporting to fox news telling our pentagon producer lucas tomlinson the strikes were called off around 7:30 last night. targets included the radar install lations and surface-to-air battery used to shoot down the american drone. the official said it is not clear why the strikes were called off. the white house has not commented. according to reuters president trump sent iran a message via oman overnight warning of an imminent attack. president trump said we don't want war but talks. a deadline to start them. iran reportedly replied to oman that the supreme leader is against any kind of talks with the u.s. but that he would be given the message. steve, ainsley, brian? steve: all right, ellison, thank you so much. in other words the president has said hey, before i do anything, iran, let's talk a little bit and iran is

brian: we begin with a fox news alert. hence the noise. president trump calls off military strikes against iran at the last minute overnight. steve: apparently it happened at 7:30 last night. the president still weighing his options after iran's unprovoked attack on an american drone, shot it right out of the sky we say in international spare space. ainsley: benjamin hall is live in the studio. we are hearing these strikes were so close. the president had the ships in place. the planes were in place. no missiles had been fired yet and then he calls it off at 7:30 last night. any word why? >> no. it's the big unknown at the moment. there are a few possibilities. we know that president trump has wanted to speak to iran before attacking them for some time now. whether or not this gives them a little bit more opportunity to do that could be one option. this all began a couple days ago on wednesday when this drone was brought down, this rq 4 global hawk drone and,

in fact, this is video here that was shown on iranian state media. they have wreckage, we can't confirm if this is indeed the drone. shot down and approved military strikes against iran and reported that the operation was underway in its early stages as you say, ainsley, planes were in the air, ships in position. no missiles had been fired when word suddenly came to stand down. all day yesterday president trump though was giving nothing away. >> iran made a big mistake, they made a very bad mistake. [inaudible] >> you'll find out. >> are you willing to go to war with iran? >> you will find out. you'll find out. >> as late as 7:00 p.m. military and diplomat officials were strike intense discussion and debate at the white house the top national security officials and congressional leaders. the targets including the radar installation surface-to-air battery used to shoot down the high

pulls back that could be, according to reuters, part of the strategy because apparently at the same time, he was sending word through the country oman to tehran, hey, somebody made a mistake over there i want to talk. i don't want war, he said. and he wanted to talk to tehran about various issues. he gave them a short period of time in which to react. so maybe that was just part of the overall strategy. >> well, perhaps. and i think iran certainly will be on high alert at the moment. even if this attack didn't go through. we have seen thousand troops sent out there. we have seen the president has struck in the middle east twice in the past tammaro hawk missiles in syria. you certainly get the sense that if iran was to do anything else. brian: how much are they going to push us? they are bombing the commercial vessels of our allies. they just shot down a drone we didn't think they were capable according to some reports of shooting down. we were in international waters. their explanation is farcical. people have to wonder.

north korea is watching, north korea is watching. what's it going to take for america to actually act. david perkins a four star general in israel joins us this morning for his interpretation of what we can do. >> we have got to make sure we are not playing checkers with the iranians. they are great at checkers. you know, change one piece for another. we have got to play chess. and i think we have got to continually box them in to a corner. so i think keeping all the military options on the table. they know that with the decision the president resources can disappear. they know that we are flying economic sanctions and they need to know we have other things we can do and other things we can warn them so they know the noose is tightening around their neck. ainsley: he went on to talk about sanctions and says it's a strangled hold. hurts their resources and binds their hands. you said it looks like we are not acting it's no it's

not that we are not acting. they expect us to hit back immediately and it's not to our advantage to do it. he is a general. these are the experts. there is a reason he pulled back at 7:30. maybe it was to get iran's attention or allies saying if you don't strike we will help new this matter. steve: the president called in top members of congress yesterday and they had a meeting in the situation room and the president and his team explained what was going on. mitch mcconnell said there will be a measured response. the big question is what would that be? ainsley: there will be a response. steve: of course there is going to a response. brian: there hasn't been one yet. ainsley: sanctions? brian: the sanctions have been in place before. this is iran's response to the sanctions. where is america's response to iran's belligerence. ainsley: just because he called it off last night doesn't mean he won't do something. brian: seven weeks. steve: the president said somebody made a mistake in iran. didn't say the country of iran made a mistake. is he giving them essentially dialing down the

tension by saying okay. some sort of mistake. i want to talk to them. let's see what happens. he gave them a very small window of time. ainsley: i remember when we were talking with a war and lea gabrielle who used to work here now at the state department she served our country. we were talking about it on air. our conversation was let the generals handle. this let the executives handle. this let the cabinet members and president handle. this they're the experts. they know what's happening. they have the secrets we don't. let's not rush to judgment. see stopped me after the set thank you for saying that i served our country some people pass judgment and they don't know what's happening behind the scenes. brian: part of the story is that secretary of state pompeo, former director of the cia, military guy for years and graduate of west point was for a strike. john bolton with as much experience as anyone in capitol hill for a strike. pentagon without a full time secretary of defense were the ones pushed back worried about the next wave and the response. and the result was somehow, some way we will get the answer shortly, i hope, the

president decided to pull back with the planes in the air. steve: what does it say to you if the pentagon is saying don't do it, it would just spiral out of control at this point. ainsley: start a war. steve: fred fleitz is a former chief of staff to john bolton who was for the strike. he said that the president is hand links this exactly the right way. >> i don't want a war with iran and i know that this president was elected to get us out of wars and not to start new wars. i think the president was right to pull us out of fraudulent nuclear deal with iran. there is people saying right now that the president is responsible if iran responds with violence because we withdrew from that deal. well, that's a fraudulent argument, too. we don't stay in agreement because the other party threatens to respond with violence. the president has responded with restraint. he has given an opportunity to deescalate the situation. i think he handled it right today. brian: i think by not doing something, there are consequences for nonaction

and consequences for action. in the middle east a nonaction is looked at in many cases as weakness. and the one quote that just sticks out with me. and it still holds up today. thomas jefferson to john adams he says if you don't punish the first insult more are sure to follow. what we have seen is we didn't punish the first insult and more are to follow. steve: i think the president did take action yesterday. brian: which was what? steve: he ordered the strike. the planes were put in place and planes were in air and ships in position. at the last minute he says hey, iran, i'm giving you one last chance. let's talk this through. essentially the message is i can call somebody right now and there will be a response. apparently the raid, which was to happen this morning, iran time, would have targeted radar installations and missile battery. but. ainsley: missile battery that shot down our drone. steve: exactly. how they figured out the sur

fas-to-air missile. brian: that's a mice message. steve: president is trying to dial down the tensions at the same time he has made it very clear i have the stuff right here we can go and blow you up. ainsley: excuse me, just a minute. the reason he was going to do it at dawn he didn't want to hit civilians, children. brian: make this political, watch. >> when you don't have a jim mattis there at the department of denges, for example, who is running this place? is it bolton? >> here we are in precisely the place john bolton wanted us to be in where we are in a box where no matter what we do there is a high risk of escalation in military conflict. >> we are worried that he and the administration may bumble into a war. brian: unbelievable. you would think a united front would be in our national interest. they could do it behind the scenes. he was in the situation room. anything he wanted to say to the president he could have done and got his point across. instead, they are trying to score political points that's inexclusive. steve: we need united front

when it comes to allies. behind the scenes the secretary of state is trying to rally the world to say, look, iran, you should not have done that keep in mind, iran says the drone was 8 miles off the coast. we say it was 12. 12 is international airspace. so, essentially is iran willing to go to war over four miles? brian: the key is the enrichment. if they go and start enriching again. then that is all bets are off. steve: they said last week they're going to do it this week. brian: the president has to make that clear. guess who cares even more than us? israel. they will not wait for consensus. steve: that's why the pentagon is worried. if we do something to iran, vaughn going to do something immediately to israel. brian: which is why john bolton is heading there. marc thiessen on. speech writer, bestselling author war on terror. he weighed in on this situation and who is to blame. >> the fact is the reason

ainsley: here to weigh in is toxicologist dr. reynolds panteri thank you so much for joining us. >> good morning. ainsley: good morning. you are an expert at this. what do you think happened? >> well, it's very interesting the fact that over some period of time here, relatively short period of time there were 11 deaths. some of these individuals, couples dying with no pre-existing illness really suggested a potential talks can't exposure. now that can be topical. ingested in the case of alcohol or inhaled. and so the absolute cause of this is still an enigma. i think the fbi toxicology reports are going to be very important. >> they are far more substantive or than what we would do in toxicological testing in a hospital. right now we are really waiting for the results.

this really hearkens to the fact 2015 when there was a family exposed to a pesticide in the u.s. virgin islands when devastating consequences of pulmonary edeemna. inhaled talks is i can'ts could be odorless and colorless. you wouldn't know. we need to find the answers. brian: the answers of the dominican say it's a coincidence. i'm not guying that. so commonality, heart attacks, pulmonary, he deem that, respiratory enlarged heart. accumulation of fluid in the lungs okay this all be the same thing? >> it certainly is plausible. pulmonary edema is really caused by many things. no need to go into all of that a toxin could easily cause pulmonary edema. that occurred in world war i with the mustard gas

exposure where fluid fills the lungs. you have got to recognize some of these patients or some of these individuals had no pre-existing illness. so, it's very strange that suddenly out of the blue they would develop respiratory or cardiac failure. certainly heart attacks could occur, don't get me wrong. the fact that they're clustered in this manner is quite concerning. ainsley: when you look at their pictures, so many of them are so young. isn't that very rare for a 30-year-old, a 40-year-old to have a heart attack? >> well, it does happen but the clustering of multiple cases in the same area really speaks to possibly an inhaled toxicant or inhaled ingestion. brian: how long does it take to find out the results. if i were to give you this case, how soon until you start giving me answers? >> well, some of these tests are very, very sophisticated.

scientifically. not just words. and they made a very bad mistake. >> so far the white house this morning radio silent on all these developments overnight. we know president trump is slated to get his intelligence briefing at 11:30 a.m. followed by a sit down lunch with secretary of state mike pompeo. an hour later pompeo obviously being a key player in all of these developments. brian, ainsley, steve? brian: thanks, gillian. pompeo along with john bolton we got a strike. we haven't answered in seven weeks. they took out our drone. we told them not to. steve: the pentagon said let's not do it right now. pete hegseth "fox & friends weekend" army vet as well, what do you make of the fact that it sounds like the president ordered the planes. they were in the air. the ships were in position at the last minute said don't go and now we are learning that apparently iranian officials got a message from the president through the country of oman hey, let's talk about what's going on. i don't want a war. let's figure this out? >> well, president trump

doesn't want a war either. part of what he got elected to do is restrain us and pull us out of middle eastern war that's a big part of this context. he also takes the threat of iran very seriously. getting out of the iran deal was central to promises american people. bad deal iran can't get nukes. iran can't get nuclear weapons what's the best path. >> there we increased maximum sanctions that's important. they are hurting at home. they are lashing out abroad. at some point you can't tolerate them lashing out everywhere, especially at our assets so we have to strike them back at some point. but that strike needs to be driven toward getting them back to the table on our terms so they never get a nuclear weapon. ainsley: how do you do that without killing civilians and starting a major war? pete: that's what the pentagon does that's what mike pompeo and john bolton are there to do. if you say, i mean, the reason we have international waters and international airspace in the world today is the united states navy and the united states air force. if we allow our drones, manned or unmanned to be

shot down and we don't respond, that's going to create a world where those spaces are contested. you cannot allow this to happen. this has got to be -- we have got to strike back. brian: i 100 percent agree with you. you know the region and the area and the risks. but america's prestige is on the line and our enemies are looking to see how we will react if we react. flip it over. if it was president obama, they pulled back, if this story is true and hasn't been pushed backs on. pull back an attack at the last minute after we had our ally's tankers struck and own drone worth $130 million shot out of the sky, every republican would be losing their mind. i think people have to be consistent here and be concerned about america's image and our strength. brian: it's truth. our strength in the image in the worlded image are the iranian very much so. they are making a calculation. i don't think they doubts after seeing what happened in syria whether this president will strike. they know he will.

they also want to provoke him into something that puts him in a tough spot. ainsley: don't you think he found something out at 7:30 because we have attacked before. we attacked syria twice 2017, 2018. >> i don't know i wasn't in the situation room. ainsley: he is not afraid to strike. >> he is not afraid to strike. the question is when and how and at what level? pete: i do believe inside the white house today there has to be a belief that you can't do nothing. you can't allow your drones to get shot down. a u.s. navy assets and do nothing. there will be something to come. brian: enemies are watching. north korea is watching. china is watching. they want to know next time they go by tijuana, are we going to be willing to do anything? next time north korea shoots off a rocket what's going to be the ramifications. pete: that's why it matters. if the u.n. doesn't have a navy or air force, that ain't happening: mitch mcconnell yesterday after he had the briefing in the situation room, you weren't there, but he was. he came out and he said there is going to be a

measured response to your point. but the president appears measured and reasonable in saying, okay, you know what do anything, we are going to try to talk to them one last time. we're also going to try to get as many allies on our side, people who have an interest in that region to say do you know what? pete: china and russia are not -- they are on the opposite side. steve: putin already said a big mistake. brian: and so are the europeans. pete: they are like the iranian deal slow motion iran. this only makes sense if it's part of a concert you had strategy to truly get them back to the table on our terms. otherwise, they are playing us and we're not responding and we look weak and that's not okay. ainsley: let's talk about eddie gallagher the navy seal war crimes for killing teenage isis fighter. yesterday, big bombshell news. steve: bombshell. ainsley: because another guy, first class corey scott reveals in

cross-examination. steve: the medic. ainsley: that he was actually the one who killed that isis fighter because he says gallagher actually stabbed the kid but then he held down his artery so that he couldn't breathe i believe, or his air pipe so he couldn't breathe. he said he is responsible not gallagher. pete: yet another reminder when you look at these cases what you hear in public is not always what happened in the fog of that situation. i followed this case very closely. i was not surprised by this at all from what i have sort of gathered and heard. there were other people that said other things about what happened at that time. there is a reason why the defense attorneys here for eddie gallagher felt confident going to court. they felt like crois examining some of these other navy seals, other navy seals who feel pretty bad about the fact eddie gallagher plight go to prison for life for this. steve: this particular medic wound up for immunities prosecution. he was a prosecution witness and drops his bombshell yeah, did i it. unbelievable. brian: here is what the navy said the government will not be dropping premeditated

murder charges against chief petty officer gallagher despite petty officer scott's testimony. the credibility of a witness is for the jury to decide. pete: that's because the navy in this case is on a witch-hunt against eddie gallagher. he didn't kill isis the way they want him. to say at the end of the day he gets his day in court. we will see what happens. ultimately, remember, this is annual isis fighter who lost their life. i'm not saying that you should put a finger in the breathing hole of someone when they're dying. most of us have never been in this situation don't know what these navy seals are facing that day or any other day. brian: i'm with you. ainsley: go back there and try to deliberate this they will say we don't know yard. wbeyond a reasonable doubt. >> we sent eddie gallagher and navy seals to do things we can't imagine and then second guess them when he gets home. he will have his day in court and we will see what happens. brian: 8 hours. pete: no concert series but we will have a lot of fun. brian: you know jillian.

ainsley: here to react is kristin day pro-life democrat. what's your response? >> this is a politically unpopular move to try to overturn hyde. when you look at polls across the country, a majority of americans do not want public funding of abortions and particularly when you look at low income women who they are more likely to say that we don't want public funding of abortion. so, it's a very bad move by democrats to be pushing this and pleased that they continue to keep it in the house bill. steve: okay. of course, this was all support of a larger spending bill so it wasn't as if they were voting on the hide amendment per se. ainsley: right. steve: for them to go out and say we have got to get rid of it, get rid of it and voting for it has people scratching their head. >> it's a bad political move to have a vote on the hyde amendment and overturn it because it is so unpopular. so, they really put themselves in a situation where they are limiting the

number of people who want to support democrats. i heard from numerous people yesterday who said that they don't feel -- they can't vote democrat anymore because of the abortion extremism and the real hypocrisy here is that we are looking for ways to spend more money on abortion and at the same time, cutting programs that would actually help women choose life. in massachusetts, for example, they are actually trying to promote abortion, get rid of all health and safety regulations and then also, use money to pay for abortion from a program that is aimed at helping maternal mortality and poor women have their children. steve: something everybody is talking about. kristen basis thank you for joining us. >> thank you so much. steve: straight ahead all-american concert series brought to you by sandals. ainsley: charlie daniels, we will talk to him next. ♪

>> complete gratitude. one of the big thing about our vets is to let them know we care about them. ainsley: yeah. >> that goes service wide veterans or active duty that we really do care about them. brian: would you worry too, charlie somebody who loves this country and knows its history that we are losing that history with the next generation? brian: what do we do about it. >> i don't know. one of the things that's happening when i go i was in school i got all that history about american war civil wars. i don't think that happens. kids nowadays we talk about socialism all the time. i don't think they even know what it is. i don't think they know the history of it. i don't think they know the harm that's that it's done. why? how can you ignore what happened in the soviet union and all these places over the years? steve: charlie, as you travel across the country, are you shocked at how many people after you have been on the road, what 60 years? >> um-huh. steve: they still come out to see you even though they have seen you for 60 years?

>> i get better looking all the time. [laughter] ainsley: tell us about your life story? where did you grow up? >> i was born in weu78gton, north carolina. once i learned three cords on a guitar. i could play a whole country song at least. i never wanted to do anything else. steve: what were those cords. >> g, c and sometimes d. steve: really just two? >> i would hit and miss. two and a half something like that. that's all i ever wanted to do. i took advantage of every opportunity that came along that i could advance my career. brian: country music has changed are you okay with it? >> no. brian: florida georgia line? what don't you like about the new country. >> not necessarily because when i say something like that people think i'm being critical and i'm not. we were considered pretty radical when would came around. all i'm saying from my point of view i can't tell one song from the other. i can't tell one artist from the other. -- i mean, you know. and i don't mean it in a critical sort of way because

enormous military assets we have in the persian gulf. it would have ignited another conflagration that would have been tragic. what is the united states getting from this? i think president in moment of sober reflection, said wait a second. let's see where this thing really was when it was shot down. that is a scientific fact that is not an opinion. brian: pentagon told him. >> i see what the pentagon has put forth so far, everyone, european union, every significant country in the middle east, they all have the satellite technology to track an aerial vessel. we'll find out where this aircraft was when it was shot down. ainsley: what do you say to folks like pete hegseth say if we don't fight back, they will take advantage of our airspace, other countries will do that too? >> i love major hegseth. i think it is time united states take a deep breath, use the occasion, now we come to the brink of war. what should we do with the

opportunity? in every crisis there is opportunity, the opportunity is what is the problem here? the problem is the united states withdrew from the nuclear agreement. brian: it was terrible. it was never approved. >> president withdrew from nafta, they went renegotiate it. what is the big problem with the iran nuclear deal? without getting into the soup, it was 15 year sunset provision whereby in 15 years, iran to remake a bomb. make a 25 year moratorium or 50 year moratorium. you go back, brian, negotiate a deal. where have these wars in the arab world generally and south asia, middle east, where have they gotten us? where has afghanistan gotten us? steve: what the president said when he was running. keep us out of unnecessary war. would be great to use this opportunity as benjamin told us, apparently the president has sent word to tehran i want to talk to you. ultimately there is a small space of time, a small window, but this could ultimately, the

interspersed across the fruited plains. the supreme court took a look at that it is perfectly acceptable to have this kind of thing, to recognize the historical nature of these kind of symbols. the fact that they invoke religious is nothing to be concerned about. the constitution permits that. justice alito went so far these kind of memorials are presumptively constitutional. that is a huge win for religious liberty. >> alito said government roams the land, tearing down monuments, scrubbing any conotation to the divine will strike many as aggressively hostile to rouge. >> i'm grateful for the ruling that the cross will stay there. as a veteran it's a great win for us. steve: it's a great win for your side. american humanist association jeremy said this, we're disappointed by the court's decision important to recognize

this decision will not allow rampant religious intrusion into public life. the lemon test protecting the establishment clause will stand. is that what that was, religious intrusion into public life? >> well, look, i think there is going to be a lot of litigation left over here, but one thing is very clear, when it comes to religious symbols, religious monuments, religious memorials like this, longstanding practices like in god we truth on currency, saying prayers before public bodies that lemon test they're referring to, that is dead. if you read the justices correctly, that test has been used so often to excise anything religious in the public square, that is going away as well. what i think the court has done here, done rightly to say look, wee not allowing state agencies, state officials, state governments to simply wipe the landscape of any kind of religious imagery. it is perfectly acceptable for us to recognize our historic tradition of religion.

school campuses. critics say this could allow the church to cover up criminal activity. ainsley: shocking twist in the case against navy seal eddie gallagher charged with killing an isis terrorist. steve: prosecution witness, fellow navy seal, cory scott, took the stand and confessed to killing detained isis fighter in iraq, not navy chief eddie gallagher, but the u.s. navy refusing to drop war crime charges against gallagher despite the stunning bombshell admission. brian: here we go to discuss it, former marine, judge advocate general, andrew mckenna. this seems like a blockbuster revelation. are you surprised the defense, prosecution doesn't view it that way? >> >> this: is an absolute nightmare for any prosecutor trying a case. first of all they already had problems with the case to begin with. their witness's testimony was all over the place. the there were contradictionses

and defense put up a good, plausible explanation as to why. that is because the seals that served under chief gallagher didn't like him. back in vietnam there was a term called fragging. an officer that you worked for you didn't like, you put a round in his head. this is a modern-day fragging. this case should have never been brought. chief gallagher is an american hero. picture this, guys, prosecution already has problems with their case, the jury, from a jury standpoint there is already reasonable doubt. then the witness takes a stand, the government's witness, admits to the killing. it is unbelievable. for absolutely not surprised that the navy prosecutors are continuing on with this. nobody wants to lose. this is a career case for the prosecutors. they can't just walk away from it. they're betting off having acquittal than dismissing the charges. but here's another quick point. now the prosecution, their own

witness admitting to murdering, now they have to cross-examine their own witness. when you have to do that, treat your own witness as hostile, it makes it very uncomfortable in the courtroom. the jury is picking up on that. the jury is picking up on on that. ainsley: for folks that aren't familiar with it, cory scott gets up on the stand i was the one who killed this man, this isis guy. gallagher stabbed him in the neck, i held my thumb over breathing tube inserted into his mouth. what would you do, if you were on that jury? >> i would acquit. there is no way, you can't unhear the testimony. now my concern is, you know, the difference between a stabbing wound and incision, let's not forget, chief gallagher responded, started to treat the wound. we had another seal to testified that he held the guy down by his chess with his foot. gallagher was treating for collapsed lung from the airstrike. the incision was to insert a

breathing tube to bypass the lung issue. and that is really, that is what scott testified to too. he said the injury in the neck wasn't life-threatening. it wasn't life-threatening. then scott, unusually, you know, put the isis fighter down. there was testimony that scott said, where he said, well he is, gallagher has wife and two kids, he shouldn't go to prison for life. that can cut both ways. scott came out of collusion created by these other seals, he came clean. there was big deal made, well he had immunity. immunity is designed to have people come to tell the truth. effective cross-examination. we'll see if the prosecution can pull it off. i don't think they can. steve: a mess for the prosecution. the navy put out the statement, saying the government will not be dropping premeditated murder charges against chief petty officer gallagher, despite petty

war with you, let's talk about it. it is up to the ayatollah. apparently eyetoy ayatollah said i don't want to talk about. >> who is involved in the conversation is the other idea. the other idea i want to look at tensions between us and iran. that is a global issue. there are a lot of players involved. it will work out. the other issue how we treat incidents when it comes to international airspace and international water. china is constantly provoking international water. they do not recognize international water the same way we do. there are incidents along for 20, 30 years. we need to set a precedent with president trump who is very good setting precedents, what we will tolerate, what we won't. they make a distinction first thing in the morning, this was definitely in international airspace. that dictates what we do for the rest of the incident. brian: understand from senior administration official, president is taking information on ongoing basis throughout the day, throughout the night, meaning some things are changing. >> listen, i was deployed to

afghanistan, i deployed to iraq. i don't want to see anyone deployed. if iran provoked us to that point it would be pretty quick and easy war. i believe that. i believe israel has a lot of firepower, would be right there with us. but i think that is not the obvious solution. the obvious solution can we pressure them. their currency down 60%. things like groceries an medication are up 60%. when you wound an animal, i'm a hunter, when you wound an animal, it doesn't lay there, please kill me, but it tries to bite but it can't. we see in iran, they do not have the power to do what they want to do. they're lashing out. hopefully the last fleeting bite. ainsley: many are happy that the president was showing restraint. we interviewed a general this morning, general david perkins, it is not that we're not responding, that we're not reacting. he said that, they expect us to hit them pack immediately. he thinks it is to our advantage not to do that. do you agree. >> listen, if you immediately retaliate, you're a war hawk, a

warmonger, if you're not weak, that is domestic politics of it. i voted for this man, majority of this country did, majority of the electoral college did, policy he keeps in place will do what it needs to do. steve: joey, when he was running for president, he made it clear if i become president of the united states i will not get us into a war. he is in a pickle. because he has to the the provocations but at the same time, you've got to have a response. he made it clear there will be a response. but the big question is when, and how large? >> on behalf of the men and women may have to fight whatever the response is, i hope it is measured, calculated, we have a plan that foes beyond the next step in the chess game. biggest problem in iraq and afghanistan we never felt there was actual endgame mission at hand. what do we keep the fight going to win today, not what we can do to win tomorrow. whatever the president decides to do, the cabinet decides to do i hope they have tomorrow and next day in mind. brian: you guys won in iraq with the surge.
