eddie gallagher is a freeman this morning, found not guilty of murder and isis fighter. he will face a sentencing today for a lesser charge. jillian: gallagher's family and veterans across the nation. >> reporter: gallagher's lawyer called the 2-year nightmare and following the verdict the navy seal and his wife reacted to the nightmare being over. >> happy and thankful, happy and thankful. >> i was feeling like we are finally vindicated after being terrorized by the government my husband fought for for three decades in the war on terror. this vindication i hope will be a lesson learned for everybody. >> reporter: the 19 year veteran deployed eight times found not guilty of numerous charges including premeditated murder, attempted murder and trying to obstruct an investigation following the death of a captive isis fighter.

he was found guilty of posing with a corpse which carries a maximum sentence of four months in prison but in light of the fact he spent 9 months in prison in advance of his trial the 40-year-old was expected to go free. he will be sentenced on that charge today. one of the key moments of the controversy filled case, a key prosecution witness said he had not chief gallagher killed the captive by covering his breathing to. a seal and a navy officer in combat experience and two weeks hearing testimony, celebrating eight hours before reaching their verdict. eddie gallagher and his wife will be on "fox and friends" this morning in their first national interview since the verdict to talk about where their lives go from here. keep in mind gallagher could face administrative punishment. rob: sounds like he will get time served. thank you, appreciate it.

something to get that cleaned up. jillian: we will see what he ends up doing or not doing, you say he should not get involved. one of the changes to city ordinances is decriminalize homelessness. do you think that in itself needs to be done? >> know. i don't agree with that. we have seen in california the hands-off approach by police, some has been four quartered as it led to the problem. the easier you make it the more you cater to the homeless and decriminalize and provide service, one of the big ideas in los angeles is to start paying the homeless for picking up their own trash. and providing showers for the man's trash collection and bathrooms to make it more comfortable for them. these liberal policies are assuming it is okay to live on the streets. it is not okay for people on the street and not okay for the neighbors.

local solutions are required here. communities gather around here need to one by one approach these homeless people, find out their situations and get them placed. rob: the palisades in los angeles, your neighborhood has increased homelessness and it has gotten worse in other parts of the city. what did the palisades do? >> reporter: that is why i'm making this point about local communities because i'm seeing it in my own community. i used to have to step over homeless literally to walk to the beach and they aren't there anymore. we are down to 60% over the last 3 years, then without any government solutions. it was all done locally through local contributions in our community. they raise $200,000 a year to handle this, they had two full-time employees, they make it clear the way to address this is engage homeless people on a daily basis, not a monthly basis, daily basis, they were connected homeless with family members, got them in permanent shelters and this one by one approach in the community has

worked and surrounding communities look to the palisades to copy what they have been doing it this is without government assistance. jillian: you saw that number of half-million homeless people in the us. look at this tweet from governor greg abbott slamming the ordinance saying, quote, look at this insanity called by austin's reckless policy? all solutions are on the table including eliminating local immunity for damages and injuries like this caused by a city's homeless policy, the horse stories are piling up, final word and we've got to go. >> we have to recognize their two issues, the homeless need help and neighbors deserve a safe community with sidewalks free of homeless people. those are the two goals set side-by-side and it is okay to pursue those goals. rob: that tweet was talking about a car accident that caused

country, thanks for coming on. what did you make of yesterday today? >> reporter: the military justice system works. this jury, 7 battle hardened marines and a navy officer listened to the judge and the evidence and rendered a verdict that remember, they had to prove this case unanimously, only 6 out of 7, 3 quarters of the jury were required to find him guilty beyond a reasonable doubt. the prosecution failed. they found him guilty of posing with a corpse which is a federal conviction which he will have on his record the rest of his life. the system worked. jillian: what did we learn going forward? >> reporter: a few things. you need to move to the point where you have career prosecutors and career defense counsel. i am a captain in the navy

reserves, defenders around the country have career tracks and having a lieutenant try this case would be a misdemeanor prosecutor in most da offices and whether inexperienced prosecutor brought these charges is something to think about but the fact is government font they could prove this beyond reasonable doubt and failed. senior chief gallagher is acquitted of the most serious charges but has a federal conviction. the military can now try to fire him administratively so his challenges to stay in the navy are not over. rob: let's look at what he was found not guilty of. as we look at those over, it does seem there was

prosecutorial, real mistakes made. they didn't have the evidence they needed and there was that moment the guy on the stand says i am the one that killed him. how does the prosecution make a mistake like this? seems really irresponsible? >> lack of experience. when i was a federal prosecutor, if you had a cooperating witness and got to the point you wanted to give that person immunity, you would do a 360 ° wraparound discussion with the person to make sure there was no wiggle room so they could say something favorable to the other side and they did not debrief petty officer scott thoroughly. to say what he said on the stand. the government said he did not tell the truth or consistent statement with what he said during the debrief. they say they are looking at perjury charges. if that is the case they might be.
