makeshift pens. a man holding a sign that said "help, 40 days here." agents describe it as a ticking time bomb.ki that is according to the wording from this report. inspectors deemed it dangerous and call for immediate action. reading from part of the report quoting, we are concerned that overcrowding and prolonged detention represent an immediate risk to the health and safety of dhs agents and officers, and toh those detained. meantime, dhs responding to the report citing acute conditions seen across the southwest border. and calling for more action by lawmakers. however, our challenge is that we have so many people that we're apprehending, for which we weren't designed to hold these people. time in custody is longer, we can't hand them over to i.c.e. and health and human services. >> growing number of protests seen across the u.s. calling foe

out flairs to mr. booker and other 2020 candidates with radical immigration policy saying that's tantamount to saying that we have open borders. it's unworkable, unwise, does not have the support of the majority of the american people or congress f we had such a policy instead of 100,000 apprehension as month it will be multiples of that. joining me now is art, national border patrol council vice president and francisco hernandez, immigration attorney. francisco, all of us are appalled at what's going at the border. it is something that the president has been warning about, begging for money for. we also know that's infectiousor disease issues, it is the migrants themselves particular risk, on the trek through here the experience trying to cross over here. this is something that's a all of our minds. if we're demanding there be work from congress to solve this problem.

our favorite guys, there's news today that city council in charlottesville, thomas jefferson's hometown, voted to do away with his birthday. what is that story about? >> this is just like that washington mural we've been talking about, they're taking the mural out of the san francisco high school. jefferson's birthday has been struck from his hometown's calendar because he owned slaves. they replaced the day with something called liberation and freedom day, tammy. that marks the moment when union troops took charlottesville in 1865. we have to be honest, most of the founding fathers owned slaves.fa that doesn't make it right, but to my mind it's only a matter of time before monty sell owe and mount vernon go the way of the kate smith statue in philly. they're going to strike everything. the sin is slavery is a horrible stain on america's conscience and its soul. but it's not all of our story. a

how offended are you of any version of the american flag? >> does zero count as an optionh >> tammy: that is an option. >> i love the american flag. this you come to my house you will see one flying out on my house right now. >> tammy: you know, on this obviously an issue for us on the fourth of july, but we're a nation that looks to the flag we're a nation that was borne of an idea. for this protest, it seems this is just like unlocking a door that the idea of america itself is the thing that's under attack. would you agree? horace? >> absolutely i agree. i think that's exactly what is going here. either we're watching a fairly elaborate ritual or publicity stunt, or out and out hate being manifest. there isn't any way to look at

how some one can say they are offended by the idea that as we approach the fourth of july, the day that this american concept came into being, a concept that has impacted the planet for good. if you are offended by that, you either are part to hate or it's a publicity stunt. i don't see any other option. >> tammy: so anthony interesting point when it comes to publicity, you're also involved in sports and a lawyer. do you think that this is serious? because the flag has been around for a while. president obama of course embraced all have the flags. what's your take on this, are these serious complaints or is it really look at how often we've been talking about nike mr. kaepernick is back in the news again, what's your take on this from the sports perspective? >> well, from the sports

perspective, as someone who worked with a lot of athletes, i can tell you that this is a new generation. this is a different generation. this generation is the generation of lebron. nike is a product of champion. lebron speaks out against lebron speaks out against his generation doesn't feel comfortable with anything that is attached to a history where black people were treated very badly or black people were in chains, or slaves.ai when horace makes these points we all love the american flag. not that flag. but we all love the american flag that is currently our flag and we all like to salute it and respect it. this is a different generation. >> not collin kaepernick. >> nike is smart, driven by the market. the market is urban black people who buy these products. >> tammy: look, both, i knowbo this a big conversation, i appreciate your points of view but i have to quickly get your thoughts on what msnbc guest michael eric dyson said. >> why don't we wear a swastika for july 4? that makes a difference. the cross burning on some one's lawn, have a nike, you know celebration of the cross.
