[laughter] >> melissa: let's get down to business. as we keep an eye on the president this hour, attorney general william barr says he sees a legal way for it on in a citizenship question to the 2020 census. after the administration hit a roadblock in the supreme court last week. barr telling the reporters he expects them to rep discussions on the new appeal to the nation's highest court in the next few days. senator ted cruz says this should not be open to debate. speak out this is just common sense. the constitution gives to the federal government the responsibility to do a census every ten years. that census is to be an accurate count. virtually every census for over 100 years has asked the question. this dispute is whether to include it on the short form census, as well. it's been on the long form for a long time. >> melissa: meantime, fox news finds democrats plan to hold a

vote soon on holding barr and william a ross in contempt over their handling of the citizenship question. this speaker pelosi since the push to ask about citizenship is racist. >> this is about keeping -- you know this had, make america white again they want to make sure that certain people are counted. it's really disgraceful. and it's not what our founders had in mind. >> melissa: let's get to nancy pelosi in a minute. first i want to ask you about what ted cruz said. i thought that was interesting, about it being on the long form. i did some research on that and i was talking to judge andrew napolitano. it was on the long form on selected long forms. i thought this was really interesting, not on the short form. in 2000. the census bureau would target certain inner cities and ask some people the citizenship

question. i never heard people screaming about it at that point in time. were people dealing about it back then? you only have some people in some cities being asked that question? >> lawrence: we are in a different climate right now. the question should be asked for everyone. i think of a country has a right to ask who the people are living in this country, all kinds of different questions. this is for research purposes. people should not be targeted as a result. we have a right to know. nancy pelosi's response to this, somehow calling this racist, as part of the problem. the demonizing of people, the moment they start asking the question, i think the country is quite fed up with that. i think it's a tool historically that democrats have used it to shut down the debate of this conversation. be to just shut it down. >> harris: that's how we got the term "deplorable spirit" >> lawrence: it backfired. >> harris: just a couple things, you said that, i'm

looking at the resource part. you argue they have to and it was in the country. they don't want to do it this way but they need to know how to allocate funds, so on and so forth. i had on hogan gidley, white house press office, yesterday. he said what you were saying, that everyone has a right to know was in the country. he said, "i think the president understands what most american wants." and he goes on to say, "we've been doing this since the 1800s." not only has it appeared, it's appeared for a long time. you talk about long form, short form, wherever it is. my question is, why block this? if democrats really believe people will feel targeted or whatever the argument is, they just won't answer. but they were already doing that in some cases now. right? it's not like they will lie. if they are, they should know that's illegal. >> leslie: we had this for so many years, and the demographic of our nation has changed greatly. during the obama administration when this question was removed, to put it back, even the

supreme court says basically "come back to us with better rationale." that's what i and many democrats are saying. what's the motive for this? honestly, whether you are a citizen or not doesn't matter when you enter an emergency room. whether you are a citizen or not doesn't matter when you call 911. whether you are citizen or not, it doesn't matter, whether democrat or republican, representing you in your district for funds that we need. >> melissa: you know when it doesn't matter? i will ask this question. she said, and i quote, after she said "make america white again," which is really pouring gasoline on the fire. she said republicans only want people who will vote with them. last time i looked, he did have to be a citizen to vote. so what is she saying there? republicans only want people who will vote with them, or they only want people who will vote legally? >> kristen: from a research perspective, with the census does is different from -- with

the long form census became is the american community survey. which is something the department of labor administers do a lot of a lot of these research questions and find out, what percentage of the population is documented versus undocumented. >> melissa: i'm sorry to interrupt but we are looking at the president right now. he's getting ready to greet the qatar amir. let's see -- i believe the vice president is supposed to attend as well at the white house now. one of the reasons we are watching this event so closely is not just for the event itself, they are going to be talking about security issues between the two nations, and no doubt the issue of iran will come up between these two leaders. but we are also going to be listening closely to see if they are going to talk about -- when he gets asked questions, if he's going to be asked about the citizenship question and make comments about labor secretary acosta as well. you know, that call has been for

him to resign. we look here at the president going into the white house with the emir now. >> harris: the qatari emir is visiting. a couple things coming up on the schedule. the president will participate this hour, we are told. in a bilateral meeting, with the emir in the oval office. we see that traditionally when world leaders come to visit. if that's an open event, it should be, we are told. we will show you that. and we will move on. some of those topics, no doubt, from the american media, will come up. >> melissa: they will be shouted out and we will see what happens. another topic they might talk on is the resigning's over the handling of jeffrey epstein. he's in jail now after making his first appearance in a courtroom on sex trafficking charges yesterday. epstein pleaded not guilty to accusations that he prayed on dozens of victims as young as

14. and now the two top-ranking democrats in congress, speaker nancy pelosi and senator chuck schumer, are calling for labor secretary alexander acosta to resign. acosta was a u.s. attorney in miami back in 2008, and he helped epstein secure a plea deal on similar charges that resulted in an 18-month sentence. he just tweeted in the last short period of time -- we just saw this come up -- "the crimes committed by epstein are horrific and i'm pleased that new york city prosecutors are moving forward with a case based on evidence." adding, "with the evidence available more than a decade ago, they insisted epstein go to jail, register as as a sex offender, and put the world on notice that he was a predator." several democratic senators also weighing in. >> it is now impossible for

anyone to have confidence in secretary acosta's ability to lead the department of labor. if he refuses to resign, president trump should fire him. >> there should be congressional oversight, and my hunches he will soon no longer be serving as secretary . he cut a sweetheart deal for a powerful person at the expense of vulnerable people, and we shouldn't have him in an enforcement position with this administration. so i think he needs to step down. >> melissa: 's on capitol hill including senator lindsey graham standing by acosta. for now, at least. watch this. >> i would like to know the basis of the plea deal, why it was set aside. i would like to know more. this thing was fairly vetted. he just didn't do it by himself, a lot of people had eyes on the original plea deal. now it's been set aside. that sounds like there is more misconduct. so let's find out what's going on and then i will get back with you. >> melissa: what do you think? there's an investigation, an ig

investigation, going on into how exactly he got the steel in the first place. you heard there, secretary acosta trying to make his case. what are your thoughts? >> kristen: when senator graham says, "i want and i to know why that he was made in the first place," i share that question. i want to know why he was able to do what he did in the government was able to say, "18 months in jail," and reduce it ultimately down to 13 months. you have instances in this country of, say, a mom registering her child in the wrong school district and she does jail time? and yet someone can do what epstein didn't get a sweetheart deal from the government? it's unfortunate that this has become wrapped up in partisan politics, but it shouldn't be. we need answers about why someone who is a monster like epstein was able to get away with such -- >> melissa: i don't know how partisan it is. we hear people on both sides thing we need to take a closer look. >> leslie: right now on our own network, jason chaffetz, steve hilton are examples of

some who are not democrats. i don't think it's partisan as well. as a mother, this sickens me. he spent hours a day outside of prison. he wasn't in prison. we have to look at how many children allegedly -- children -- were sexually abused. allegedly, by this man, during the time. after that deal, if he had had a stricter sentence or been in prison this would never happen. if, in fact, these charges are true. in addition, we are people out there who have been abused by clergy coming up. there are victims beyond the scope of what just this man is alleged to do that are horrifying. >> melissa: this hedge fund billionaire, and his title. how has he been making money since then? there's the investigation, sex trafficking has become such an enormous and horrible industry. that's one avenue. >> harris: taking the politics out of this, christine pelosi, daughter of nancy pelosi, warned quite likely that some of our

faves are implicated in the orphic, obscene case. this is about power, access, money. when you look at the pictures of epstein, the one component they seem to share his power. >> lawrence: i think it's also important to realize this is not specific to this case. this is the judicial system. this is what happens when you have behind-closed-door deals. i've spent a period of time investigating this type of stuff, when i was on the cps board for dallas county. a lot of these times, when they get behind close doors and they don't have sufficient evidence to make a case -- when the feds go after you, they are going after you. and these are career people that make these decisions. but mostly, when there is insufficient evidence, they try to get people to get on the registry. in the case that there is a potential -- if mark evidence comes in, they can retry you for different case. i do think there is politics involved with it. because this is just not acosta.

this is the judicial system at large that cuts these type of deals. >> harris: one thing i've had legal experts tell me is the door was left open for there to be that bifurcation of state and federal law. >> lawrence: exactly. >> harris: that's actually very good thing, because he wouldn't be seeing the case we are seeing right now. you would see calls for double jeopardy. and we are not. but you do have to take a total look at how acosta handled this. the nonprosecution part of it, the deal that was struck to label him a sexual predator. there were some things that were -- that needed to be done. and he was part of it. with their special treatment? we better look at that, i agree with kristen. >> melissa: another captor in the ongoing feud between alexandria ocasio-cortez and nancy pelosi. whether the feud beyond them is beyond repair. plus, elizabeth of warren putting bernie sanders on the rest of the democratic field on notice.

♪ >> harris: presidential candidate elizabeth warren putting her democratic competition on notice, raising a massive $19 million in the second quarter of this year despite swearing off fund-raising events. she also out-raised bernie sanders, her main progressive rival. the average of more intonation? $28, suggesting she could keep going back to those donors time and time again. i've heard you say you like the grassroots. >> lawrence: you know, look -- bernie, i've always said, he's an authentic guy. he believes in the craziness that he believes in. even though i disagree.

but there has to be just a tad bit of bitterness, because he is the grandfather of this progressive movement. he introduced a lot of these ideas. medicare for all. the day i thought the democrats to be bashing obamacare and say that's not far enough? you could only dream of some insanity of that happening. and now elizabeth warren has officially taken that from him. bernie has become a no-name right now. >> harris: it's interesting, leslie, what lawrence is alluding to. in my opinion, it isn't just a topic. it's, "can you sell it?" why can she sell it better than bernie sanders right now? >> leslie: a couple of things. i think you are seeing that, first of all, over 80% of these donors are first-time donors. that's big. >> harris: and $28. >> leslie: yes. >> harris: she can go back, obama-style. >> leslie: in the last 90 days she is killing it financially. this speaks to debates but it also speaks to her having specific policies that she has

outlined compared to other people, saying -- one of bernie's problems as he will say medicare for all, he doesn't have a plan or a way to pay for it. she says, "this is my plan, this is how i'm going to pay for it." like it or not, it's there in black and white. i think that obviously is -- >> kristen: there are also to think she is going for her that bernie doesn't. one, she tries very intentionally to avoid the label "socialist." she come out and says, "i'm a capitalist, but..." >> harris: why does he do it? >> kristen: he's been into socialism from the cold war era. he can't walk away from that. but i think elizabeth warren understands that the label, even within the democratic party, it's not terribly popular with voters. the second thing, if you were a hillary clinton supporter in the democratic party and you thought bernie took a little too long to get the hint last time around, you might not be a bernie support this time around. but if you like his progressive

economic agenda, by and large elizabeth warren gets you a way to get on with a pretty far-left progressive economic agenda without having to sign onto the big s word and without having to sign on with the guy and maybe didn't sit down fast enough last time around. >> melissa: from an academic point of view i think she's not a capitalist. you look at her policies strictly from having studied textbooks and what is the outcome and what is it she's lamenting, she's not a capitalist. but i do think one thing that's really interesting is she was criticized early on because she was putting out a lot of proposals but she was saying she was going to do the big fund-raising. at the same time she was spending a lot of money on hiring a lot of people. it was a huge gamble, as she continued to put out these policy papers. i'm shocked that it has worked out for her. even though i don't agree with her policy, it speaks well for the american people because it says that rather than focusing on raising money and catering to individual groups, she sat there writing policy and putting it

out. based on that, it has shown returns. it speaks well of our system, for once. >> lawrence: she is grassroots, as well. >> harris: i know you're a fan of that! that's the people. >> lawrence: and she is specifically targeting black women, as well. which is the heart and soul of the democratic party right now. >> harris: can i just see a quick thing? i heard the word "debate" come up. remember, she was basically on the stage by herself with all those other people. i don't mean to be indelicate by saying this, but they didn't have the name recognition, most of them. maybe except for bill de blasio, i'm not sure. but they didn't. those on that stage. i see you nodding. that made a difference for elizabeth warren, perhaps, this time around. >> lawrence: i was there at the debate and she was definitely the main person that night. she got the to highlight her policies and she didn't suffer any attacks. >> harris: correct me if i did get a the players right. there were a lot of people. >> melissa: it was mostly bad think she was on the first

night. >> lawrence: it was actually good, though. >> harris: people talk about it is a different level. but for her, she got to finish her sentences. >> leslie: she's the biggest fish in the bowl. it could work for you or against you. i think she started strong and finished a bit weak with this money is showing a lot of her supporters don't agree with me on that. >> harris: interesting. we will move on. democratic congress woman alexandria ocasio-cortez taking aim at nancy pelosi again after pelosi criticized ocasio-cortez and three over five and left democrats for voting against the border bill. plus, and i have an opening government watchdog report on the impact of raising federal minimum wage to $15 an hour. as 2020 democrats step up calls for that. ♪ to look at me now,

>> reporter: [and distant question] >> president trump: i met secretary acosta at this first time. when i made the deal, i can tell you that for two and half years he has been just an excellent secretary of labor. he's done a fantastic job. part of it is our economy is so good, our numbers at record lows paid so many good things happening. the fact is he's been a very good secretary of labor. what happened to over 15 years ago with respect to when he was a u.s. attorney, i think in miami -- is a miami? if you go back and look at the decisions, whether it's a u.s. attorney or an assistant u.s. attorney or judge, you backed over 15 years ago or 20 years ago, look at their past decisions, i would think you probably find that they would wish they may be did it a different way. there are a lot of people involved in that decision, and not just him. i can only say this, from what i

know. and what i do know is he's been a great, really great secretary of labor. the rest of it, we will have to look at. we will have to look at it very carefully. but you're talking about a long time ago. again, it was a decision made i think not bye and bye-bye a lot of people. so we are going to look at it very carefully. we will be looking at that very carefully. okay? anybody else? >> reporter: do you think he is a terrific guy? >> i knew him like every buddy in palm beach in them. people knew him. he was a fixture in palm beach. i had a filling it with a long time ago. i don't think i've spoken him for 15 years. i wasn't a fan. a long time ago. i would say maybe 15 years. i was not a fan of his, that i can tell you. i was not a fan of his. i feel badly for secretary acosta, because i have known them as being somebody who works so hard and has done such a great job. i feel badly about that whole

situation. we will be looking at that, and looking at a very closely. we are also going to be signing a big contract and a little while. so we will see you in a little while in a different move, and a different part of the white house where we will be signing a big deal with boeing boeing. we will see you in a couple of minutes. [reporters shouting questions] >> harris: the present making a lot of news there. first on what he described as a very large transaction to purchase a lot of boeing jets, by qatar. you see the spacing emir there. he said, "we trust the american economy." i want to bring in chief white house correspondent john roberts now. john roberts, the last few questions were on domestic issues. one in particular, jeffrey epstein on the case against him. >> the outcome of that and alex acosta. because alex acosta is connected with jeffrey epstein. there've been calls in congress most recently this morning from senator chuck schumer and also from the speaker of the house

nancy pelosi for the president to ask for a cost of his resignation. if acosta does not hand in his resignation, the president should fire him. this all goes back to when acosta was the u.s. attorney for the southern district of florida, and cut a deal with jeffrey epstein, which so i'm going to jail for 13 months on charges rather than face federal charges of child sex trafficking. now acosta has asked when himself, saying it looked like epstein was going to get off in the federal charges, so at least we got him on something. but that certainly isn't enough for democrats who are saying that he's got to go. the president they are offering him a measure, that he has been an excellent secretary of labor. the decision made, it was 11 years ago. it was 2008, a decision that he made back then based on the evidence that he had. the president saying if you went back and look at every u.s. attorney's decisions or other attorney decisions they made during prosecution's, maybe there are some things that you'd like to have a do over with.

but for the moment, standing by acosta, he did add, "we are looking at this very closely and we will see what happens." the president also talking about jeffrey epstein himself. you will remember back in the early 2000s, 2002 i think it was, he said that epstein was an admirable person. he liked women who were on the younger side, but on the president is saying, "i knew him like everybody else in palm beach knew him. i had a falling out with him, i was never really a fan of his. i haven't spoken to him in 15 years." so there is the signing ceremony going on now, the pool is going to try and get to the nature of a falling out between the president and epstein that he's talking about. we will see if he goes into more detail about that. speed when i have two immediate follows. i picked up on the language, too, at the very end with acosta. that they are looking at it. so that's not just a simple, "we are going to leave him in place," or move and pray they are looking at that situation. i would like to know more about

what that process looks like and who they are talking to you if it simply acosta, so on and so forth. there were some things in terms of the deal that was cut for jeffrey epstein, that he got labeled a sexual predator. there were some things for future prosecutions, some meat on the bones, if you go. keeping the state and the federal separate means this is not a double jeopardy. so you've got to look totally at what acosta did, and i would want to know more. then that falling out with epstein. do you know anything about that? is of the first time publicly that we have seen it? >> is the first time the president has commented publicly about it. as i said, the pool will try and go back at them to find out with the nature of the following it was. whatever the deal was that was cut in miami -- and i haven't read through the whole thing -- it shielded up scene from federal. again, as acosta said, he believes that epstein probably would have walked on the federal charges and at least they got them on something. but now that you go back and look at what was going on during

that time, in the indictment that was handed down in federal court in new york city yesterday, you got to wonder what it was that acosta missed. the allegations -- the suggestion is being made here that this was a sweetheart deal for a very wealthy, well-connected guy to shield him from federal prosecution, not to try and get him on something else. >> harris: john roberts, appreciate it. i know you've got to scoot to that signing with a very large deal now, qatar buying boeing products. so i've got to let you go to do that. but we will bring you back as the news warrants. thank you. a couple of things there, and i so you kind of perk up, lawrence, just in terms of what went on and the situation down in florida with acosta. just taking a total look here. or, with epstein, excuse me. >> lawrence: well, i don't think people are taking a total look at this. there's a lot of things that go into these decisions.

a, when that someone like this involved, it does not skip washington. that means that age he knew about it, that means the investigative agency, the fbi, bob mueller -- >> harris: as pelosi says, there are on a list somewhere. >> lawrence: it's not just a cost of making a this. other factors. if there was corruption, every investigative agency that was involved with it, including the attorney general's office, knew something about it. >> harris: yeah. leslie? >> leslie: that sickens me. this to me is not and should not be political. this -- >> harris: it does appear to be now. >> leslie: something that we have that right now, especially as we head into an election year, which is inequality. whether it's income inequality, justice and equality, because we all know if this had been a poor person of color that was accused of this, they were not going to get out of jail ten hours a day and get an 18 month sentence reduced to 13 months. this is for the rich white

people of this nation and it's sickening and it needs to stop. >> kristen: i think there is something that i'm not an attorney but i'm a pollster. when talk to people about what they feel is broken in america these days, since wood furnace prayed that people who work hard and play by the rules don't get ahead. but people who do not play by the rules are able to be shielded by the system. it's something that cuts across party lines, and something i hear all the time. >> harris: americans don't like it. the president moments ago, melissa, was seen to step away from jeffrey epstein. >> melissa: i mean, in a big way. trying to put on the record, i guess it was, that they had some huge falling out on the haven't been friends 15 years. i don't know why he would address this at all, especially in the setting. it seems unwise. obviously there are these older comments surfacing that have been everywhere, of him saying that they both liked women,

comments that have been requoted and are horrifying in the light of day now given what's going on with epstein. but i don't know but this was the right place or time or way to try and clean that up. especially when you're connecting it with acosta. there needs to be a massive investigation into what happened there. if it was corruption afoot. i don't know if it's rich white people necessarily, when you say it like that. this system of justice, for people who are connected in some way. that could be money, it could be race, it could be a lot of -- >> harris: it could be a lot of things. go ahead, lawrence. >> lawrence: it's also about effective counsel. most people of color don't have effective counsel. if you can pay a good lawyer to go and blur the lines and say to the united states government, "y'all don't have enough evidence," and they cut a plea deal, that's a different thing. that's the argument that is better than saying it's just a

rich white guy. that was a rich guy paying lawyers to cover the set. >> harris: we've been talking about it, running around it. i will read that quote from zen-citizen donald trump. still a citizen but also very powerful one of the white house now.
