administration has not announce where had the new section of wall will go up and the contracts to build it, those still need to be signed as well, arthel. arthel: garrett, thank you. eric: congressional reporter for politico, so melanie, how big a victory do you think this is for the president or is it premature? >> make no mistake, this is a huge victory for the president and he struggled to implement immigration policies on capitol hill, he had to find ways to go around lawmakers, he can start using 2.5 billion of those unspent funds, now, this is just an early ruling, they did not rule on the merits but certainly bodes well for the president and i really want to highlight two reasons why this is a victory for trump, number 1, of course, he can go on campaign trail and say he's fulfilled a very key campaign promise that up until now has largely gone

unfulfilled. this will make the base happy and supporters were looking for him to do this. number 2, offers him the opportunity to highlight another key achievement which are supreme court nominations. in this ruling two of his appointed justices, kavanaugh and gorsuch ruled in favor of the trump administration, so he can really take that and show voters what's at stake at the election and what he has done for voters in first term. >> yeah that was fascinating hillary clintoning those two with those two issues exactly. still it has to go through lower court and could potentially, could it be reversed because this is only temporary. >> right, it could be, they said he can start construction and like i said they did not rule on actual merits but the fact that they thought it was strong enough case where they might actually succeed on the merits in the future i think is a good sign for the president. and another point that i would like to make is that this probably takes the threat of government shutdown off the table, the congress and the trump administration just this week negotiated a budget deal to cut spending levels but still need to come up with the actual

funding bills to fund the government and now that the president has this victory i think it takes some of the pressure off of him to pick a border fight with congress. i know capitol hill is probably breathing a sigh of relief right now, that being said, the president is pushing for other things, asylum reform, fixing the so-called flores settlement, in terms of family separation. those are things that we will be keeping an eye on months ahead. eric: ols congressional power n june the original judge ruled this about the case, it's wise or unwise, it is not about whether the plan is the right or wrong policy response to existing conditions at the so you -- southern border of the united states, instead legal questions for funding border barrier construction exceeds the executive branch's lawful authority, where do you think melanie, that could go especially, if you have to look

back at president obama, blatantly issuing executive order after executive order trying to get around congress. >> but look, shows that the court has given to executive branch and the president especially when it comes to national security issues and also this could set a precedent for future presidents, something that republicans were concerned about. you look at the ruling, they are questioning whether the challenges have the legal standing to bring the lawsuit, a couple of conservation groups and environmental groups as well as democrats have tried to challenge this. this is certainly big win for trump and a good week for him especially after last week when you know, he was coming under fire from left and right after house democrats. eric: guatemala will accept asylum seekers coming from honduras and el salvador.

what does that mean and how important is it, will that stem some of the flow across our border? >> it might, the president has been trying to push the third-country agreement with méxico as well. has to seek asylum there before they get to the united states that could stem the flow of migrants, but even though they did come to this agreement there are already critics who are going to challenge it. they say guatemala does not offer safe haven, we will have to wait and see, but at least for now it is another thing that the president can say, he's doing to fulfill campaign promise of securing the border and stemming the stem of migrants that we have seen at the border, really a huge influx this past couple of months. eric: we will see how that goes as well as the other case as it winds through the courts. >> thank you. eric: maria bartiromo will sit down exclusively with acting secretary kevin mcaleenan and weigh in on the two victories of

suspects driven away from own police station of detention hearing earlier today. it is understood that one of the two americans is thought to be the main suspect in this investigation. italian media claims this person who thought to be around 19 years old has confessed to the crime, i must emphasize that reports are not confirmed. speaking after the hearing today a lawyer for this client refused, said his client refused to answer questions during that detention hearing. the suspect is accused of fatally stabbing an italian policeman, according to reports was trying arrest two people who had stolen a bag from a possible buy earlier friday after drug deal supposedly went wrong. a second police officer was injured in this incident and that happened in an area very popular with tourists in rome and these suspects.

president has been conducting his presidential duties completely above board? >> it's pure politics, and it's clear for anyone to see, look, let's remember what's occurred over the last couple of years, we had a 22-month investigation, mueller spent nearly $30 million, unlimited resources, team of investigators by the way that included 14 democrats and zero republicans, they came up with a very solid conclusion, he was tasked with investigating whether there was a conspiracy or collusion as people say with russia and clearly shown that there was not, that's what mr. mueller found, now the democrats on the house judiciary committer, speaker pelosi and the rest of them are unwilling to accept that conclusion, they want to drag this out into the election cycle because they think they've made a calculation that somehow this will help them. i don't think it's going to. i think the american people's patience is running thin and this is ultimately fool's error.

arthel: you made points in closing summary, i want to get to that now. closing summary at 4 minutes and mr. mueller tried to interject, 14 democrats and zero republicans on his team, although you wouldn't let him speak and towards the end there was a 20-second exchange and you made pretty damming assertions in closing summary, did you not want to here mr. mueller's rebuttal? >> well, by the time we got to close and my job was to close and summarize the republican side, we had already sat there for almost 3 hours, it was very clear and everybody watching could tell mr. mueller did not really come to answer a lot of questions. he mostly evaded questions, he had avoided over 150 times by that point. so there was no point in my doing the same thing that all my colleagues had done, i tried to tie a bow on it and wrap it up, i think what he was interjecting that he didn't know the

political affiliations -- arthel: i don't know that. >> i don't know that it either. i don't know, at the end i asked him the all-important question, mr. mueller, does your report or are you recommending impeachment and you saw how he responded, he wouldn't. >> we knew that going in. let me ask you this, are you concerned that all by the assertions of potential obstruction of justice as layed out in the special counsel report, are you interested in investigating that for the sake of the country parting politics aside? >> well, of course, we are all interested in the integrity of system, election system and all the rest, some of that is implicated, russia tried to intervene. arthel: and they did. >> they are going to do it again. arthel: you guys don't do something about it. >> no, that's exactly the point, arthel, exactly right, we need to do that but we can't as long as chairman nadler and the democrats are -- we need to get

down to the real important issue here and that is russia trying to intervene in our elections, i think everyone acknowledges it's a problem but we can't solve it as long as we are mired in all of this mess. arthel: excuse me, are you concerned at all about the assertions layed out in the mueller report that the president obstructed justice? >> here is what we know and what i tried to summarize, we know that the president vented, he was frustrated about the investigation that drug on for almost 2 years. arthel: i'm asking you, we've heard from the president throughout the entire process, he's tweeted about it. i want to know from you, are you concerned about those assertions >> of course, we all would be, i don't think we had examples of obstruction here, we had the president venting his frustration, he's the president of the united states, the commander in chief, the most powerful man in the world if he wanted to end the special counsel's investigation, he could have, he didn't, that's

the point. mr. mueller admitted at the hearing and he does in the report he was unimpeded. 1.4 million documents and over 40 witnesses directly associated with the administration. arthel: a lot of witnesses testified before congress and they've pled the fifth or didn't have anything to say but i want to move on because, you know, you made a point out the gate that the democrats had their agenda and for those of us americans watching, it appeared that both sides went into this thing with their own agenda, separate agenda if all of this, the entire process congressman has been boiled down to party politics and has our democracy been jeopardized, what do you say to the american people watching and just kind of in -- >> of course, they are right to be disgusted and so are members of congress. the house judiciary committee has one of the broadest

jurisdictions in congress, we are responsible for the entire administration of justice and things so important as border security, immigration, we can't get to those substantive issues because we are spending so much time precious time, precious taxpayer resources on the endless investigations. arthel: right. >> i'm sick of it as well. we need it to come to an end. >> the fish rots from the head as they say, so without getting into what's in the head, whether it's a clean head or rotten head, nothing gets done and that's why i keep circling back, do you not want to find what in fact, the president do in terms of potential on obstruction of justice? >> that's the point. that's what the special counsel did -- arthel: he pointed out 10 examples, at least 10 examples of potential obstruction of justice. >> of course, he wouldn't say that was obstruction, that's what i'm saying, that's your job to investigate that.
