"shepard smith reporting" ." we now know that two children are among the dead in the shooting in a small town garlic festival in northern california. police say gunmen, culling an assault type rifle cut through a fence and sneaked into the festival and opened fire on the crowd yesterday evening. it happened in gilroy, california, 30 miles south of san jose. police say the shooter killed six people, a 6-year-old boy, 13-year-old girl and a man in his 20s and hurting for coothers the police chief

identify the suspect as a 19-year-old man and says the motive is still unknown. federal agents urging the man's home earlier today, reporters saw them carrying out evidence and what appeared to be a camouflage rifle bag. witnesses say the festival was winding down when gunshots rang out. >> the man said they are playing one more song and that was the end of the show and that is when the gunfire started. >> when i turned around i saw the guy that looked like a sheriff and i thought he hit the trigger by accident. >> it started and there was a burst and it stopped for ten seconds. >> when i saw him loading the gun and pointing, i knew he wasn't the police. >> the guy was coming.

calling it an expansive scene that they could not have anticipated. the first shot rang out after 5:30 p.m. local time. investigators say there were metal detectors, but the gunman snuck in to get inside and once that happened witnesses say in the shooter hit anyone who was moving. some reported hearing as many as 50 gunshots, others feeling very fortunate to be alive. three were killed including a 13-year-old and a boy who was just six years old. >> we will get through this. this morning our prayers are with the families of those injured and killed in this senseless shooting. we stand with you and we will be providing whatever assistance we can in the days and weeks ahead. >> the big unknown at the moment is the motive. police have no idea why this happened but they say they are looking into any association

accused of going on a killing spree. door to door 60 miles from the spot where police found a truck they say the suspects were using. that truck torched and abandon. police say the two teenagers are suspects in the three killings. among the killings, she and her boyfriend were on a road trip on their van apparently broke down on the side of a highway in british columbia. dan springer reporting live with more. >> police in canada are calling it a credible tip but not a confirmed sighting, they are forced to divide their resources. yesterday at 5:00 p.m. two people on neighborhood watch patrol spotted two men match the suspect's description. they were rummaging through a landfill and took off running as soon as they realize they were being watched, 55 miles west where the search has been concentrated for a full week.

last monday the 19-year-old and 18-year-old were caught on store surveillance cameras, police located a stolen vehicle the pair drove and set on fire. they are suspected of killing a professor at the university and a couple traveling through canada. she and her australian boyfriend were last seen alive at a gas station and their van broke down and they were found shot to death next to it. police are trying to confirm the tip. >> our officers are on the ground and they have not made contact with the individual and so we are not yet in a position to confirm that these are the wanted suspects. >> so far the search has encompassed 3,000 miles of canadian wilderness. >> dan springer, thank you. >> shepard: the royal canadian police come alive in british columbia. thank you for being here.

safety investigators say on average in the united states a vehicle at a train collide nearly every 90 minutes. there is word an american teenager said he killed a cop because he thought the officer was going to strangle him after a drug deal gone wrong. that is according to a court order in italy, , and order obtained by the associated press. arrested these two teenagers from san francisco, they say the two americans try to buy some cocaine but that somebody sold them crushed aspirin. investigators say they went back and still has his backpack demanding a ransom and he called the cops who tracked on the two teenagers. some sort of struggle broke out and that is when they say they 19-year-old stabbed the officer, not once, but 11 times while his friend punched the other officer at the scene.

the laws are quite different individually than they are in the united states. for example, police can hold somebody without officially charging them for a year. also anybody involved in a murder can be charged with murder, meaning you don't have to have the weapon. you don't have to have committed it. you can be charged. they could both face life behind bars and a italian prison. let's turn to brian claypool, a criminal defense attorney involved in many homicide investigations and studied italian law extensively during the amanda knox trial. can they be held for a year with nothing? >> my legal tip of the day is don't go to italy and run a foul of the law. in the united states we enjoy a presumption of innocence and there is a search for justice but under italian law, it's more like a presumption of guilt and that's more of a fact finding

emission by the prosecutor in conjunction with the judge to collect evidence to convict of guilt so there is a big difference in the process and like you said, can you imagine being detained for up to a year before you are indicted in italy? in the united states you only have 72 hours of your questioning for a suspect to charge them or release them, absent a court order. the deck of cards is stacked against these two teenagers. >> shepard: nothing happens in a vacuum, there is always context. that said, if these two -- one stabbed a cop on the other beat a cop by the scene of a crime, the clients have a problem. >> here's the problem with that and by the way come under italian law as well, it's staggering to learn that the judge in the case actually participates with the prosecutor in the investigative stage so

much like amanda knox once you get to trial the judge has already made up their mind, but getting back to the 11 stabbings, my experience has bad when you have that number of stabs on a person it's usually either a crime of rage that you were doing against somebody, a crime of passion or like they will argue in this case, self defense. some critical facts we don't know. these were two plane closed officers. did they identify themselves clearly to the two teenagers that i am a police officer? if they didn't than all the sudden they teenagers getting strangled, it's not unreasonable for those teenagers to then defend themselves. >> shepard: how would you begin a defense here? >> great question. the first thing i would do is hire a united states lawyer to go to italy to work with a local

italian lawyer. why? this is the home town for the italian authorities. they have already proclaimed when one of the suspects was blindfolded. what is more important? blind folding or making sure they go to jail? you have to start with legal counsel, not afraid to take on the italian authority that will try to develop evidence that will show potential self-defense. for example, try to interview witnesses around the scene on what was disclosed by the police officers. to work up any forensic or physical evidence, to put up a defense and try to convince the local authorities that this truly was not a murder. >> shepard: brian claypool. thank you so much. >> thanks for having me. >> shepard: a russian doctor says he thinks somebody poison vladimir putin and his biggest nemesis, one of them.

russia's most prominent opposition figures. he has been a longtime vocal critic of president putin and he is called for free and fair elections repeatedly. it's not the first time he's been attacked with chemicals in this manner. navalny was released from hospital and returned to the same prison cell where he claims to have been poisoned, against the advice of his doctor. russian authorities have since suggested he suffered an allergic reaction but his own dr. say he has never suffered ay allergies before. they are convinced he was exposed to a toxic agent, his skin flaring up with symptoms consistent with chemical poisoning. mr. navalny had been jailed for 30 days last week after calling for protest. some of the biggest and recent history with about 10,000 russians taking to the streets last saturday to demand fair elections. they were planned after 30 opposition candidates were barred from standing in local elections this september. nearly 1400 people were arrested, as the police crackdown after russian officials said the political candidates had failed to connect

-- collect enough valid signatures. opposition groups arguing that the borrowing was political motivated and yesterday we had e journalists as they were waiting outside the hospital for news of navalny. navalny has been a constant thorn in the kremlin side. authorities knelt there with president putin's personal ratings falling, this charismatic anticorruption activist has the ability to really mobilize anti-kremlin sentiment. this is not the first time critics of vladimir putin have been poisoned in this manner. last year, sergei skripal was poisoned in salisbury along with his daughter. in 2006, another poisoned in a london restaurant. this is something the putin government has used on a few occasions before. it remains to be seen how alexei navalny recovers. >> shepard: benjamin hall, thank you. a surfer who got bitten by a shark says his elbow must not have tasted too good. >> i was laying on my board
