rob: all right, just hours before the deadly shooting in dayton, ohio, 20 people were killed in a mass shooting in el paso, texas. that suspected gunman is now facing capital murder charges. we continue with our fox team coverage with garrett tenney in el paso this afternoon. garrett, you've been there since just after those shots were fired, and you've spoken to a lot of witnesses. what do you have for us today? >> reporter: police are still trying to identify some of the 19 bodies that are lying on the floor of this walmart, and the mayor tells us they are hoping they have that process completed by tonight so that they can begin informing all of the families who are deceased. those families, as you can imagine, they have been desperately searching for answers and holding out hope for

the last 28 hours now. and at this point, though, many of them are forced to face the increasing likelihood that their loved ones are gone. we saw some of that desperation last night when three women came here searching for answers about their 87-year-old mother, and it was just absolutely heartbreaking, seeing them as they were trying to find some reason to hold out hope. >> i got tired of waiting and waiting and waiting, and i just want to know where my mom is. i want to just find my mom. somebody needs to tell me where she is. i want to know if she's dead or alive or if she's still in walmart. >> reporter: just tears at your heart strings, hearing that. we are starting to learn more about some of the victims from the families who have been notified. one heartbreaking example of that is the mother of three, jordan. her sister tells the associated press that jordan and her

husband had just dropped off their 5-year-old daughter for cheerleading practice before they came to walmart to shop for school supplies, carrying with them their two-month-old son. doctors told the sister that jordan likely died protecting her baby from that hail of gunfire based on the baby's injuries. the baby is now being treated for broken bones. in terms of the investigation, officials are moving ahead very aggressively in prosecuting this case. the department of justice on the federal level said they are treating it as domestic terrorism, and they are seriously considering pursuing federal hate crime and firearm charges. that would carry the potential of the death penalty on the state level. the 21-year-old gunman is also looking at potential death penalty-level charges as well. the sheriff said that he is cooperating, the suspect is cooperating with authorities, he is telling them everything they need to know, and they are moving closer towards being

certain that this was a hate crime case. of course, that suspect came all the way from across the state to carry out this attack. we're e hoping to get a little bit more later on this evening. rob? rob: all right. yeah, some of the victims, garrett, that you have shown to us over the last couple of days, it has absolutely broken our hearts. we appreciate your time, thank you. molly: and the u.s. also reeling from its second mass shooting in less than 24 hours, this one in dayton, ohio. a gunman in body armor opened fire early this morning in a crowded area downtown killing at least nine people before being shot and killed by police. among the victims, the suspect's sister. just witnessed a remarkable press conference with a lot of new information. mike tobin has been reporting on all of this live from dayton. mike? >> reporter: and let me start running down some of the bullet points we got out of the latest update from chief richard biel of the dayton pd.

one of the things we learned earlier in the day, the time frame from the first shot to point where the gunman was killed was less than a minute. the chief of police shortened that time frame to 30 seconds from the time the first shot was fired til police made that very accurate, high-pressure life and death decision to take the life of that gunman, therefore, neutralizing them before he got inside of the crowded bar where the bloodshed would have been much greater. we have updated the information about his weapon. it was an ar-15 firing preponderate 223 rounds -- .223 rounds, but it was equipped with drum-type magazines capable of holding 100 rounds. there was no indication that the gunman reloaded, but he wouldn't necessarily have to because that particular weapon held so many rounds. he also wore a mask, he wore body armor according to the chief of police. there were early reports that a bystander had attempted to grab his rifle and the gunman had pulled out a side arm and kept on firing. that information was not accurate.

there was only one weapon used in the attack, he never had to reload because there was so much capacity in that drum-type magazine. he had two weapons, but only one weapon was used. we learned that one of the victims was the sister, the 22-year-old sister of the gunman, her name was megan best. she was not the first -- betts. the family home in fellbrook, ohio, about 21 minutes away, has been searched by the fbi. the parents are there. they're said to be distraught, understandably. not only did they get the news today that they lost a daughter, but they lost a daughter because their son committed an incomprehensible act of violence. the sister, the gunman and an unidentified acquaintance all traveled to this location in the same vehicle. at some point they separated. they don't know exactly what the gunman did when they separated, but he came back loaded with body armor, with a mask, with a loaded weapon and went on his

deadly ram page. and, again, police officers killed him before he entered a crowded bar called ned peppers, and the chief of police indicated the bloodshed likely would have been much, much greater had he been able to enter that bar. back to you in new york. molly: mike tobin, a remarkable rundown. the police also not giving in to motive in that case, that's something we're expecting to hear more about in the weeks ahead. we're following both of these events closely as well as dayton. we'll bring you update as we get them. rob: jon scott will have more at 6:00 easternis used to create ts where these -- this shooting sub culture thrives and where young angry men can get together and -- and share information. >> are you suggesting that that should not be allowed? >> i think it's not just banning people from the sites, it goes further than that, we live in an environment which corporations make a lot more determinations

about the way that we live and what's allowed in different platforms and servers that they have than anything that congress can do to change the laws in different respects, is it possibility, silicon valley in a sense to say certain things that you're not going -- you will have to build your own server to make this thing happen as oppose to allowing this stuff to foment, everyone in favor shutting there's places. >> certainly worth debating. america victim being of white nationalism than victim of isis islamic white -- >> when it comes to any breaking news coverage particularly of mass shootings, much of it is wrong and mistaken, so if there's one thing i always tell my students it is that you must

reserve judgment. much of the coverage of that was proven incorrect, you go to gabi shooting, steve scalise, blame is placed mistakenly and you have to reserve judgment and talk about real policy issues. >> wait for the facts. now in the days leading up to these two mass shootings and in texas and ohio the news was dominated on the trump's attacks on city of baltimore. >> embracing telling us he plans to run a racist reelection campaign. >> for someone like me proud baltimorean, born in baltimore, still call that area home. >> once again the media call president trump racist this time for exposing the obvious that

baltimore's democratic machine has failed their city. my friends it's not trump who has given up on urban america, calling him a racist have. >> seems to be a turning point that we didn't see after charlottesville. he sends racist tweets rather than, you know, use language like -- the media seems to be taking a stand on president trump on this volatile issue. >> okay n a single week you had the cincinnati rally, right, he did not necessarily call out the squad of the four women of color who were serving in congress on the democratic side but he did talk about they were out there and they are now the face of -- of being against everything that americans hold dear and he takes on al sharpton and elijah cummings, if you look at the four corners, president trump is doing what he does, comes out swinging, it's almost like he's

color blind if you're simply looking at the action, however, he does not help his own cause when it turns out that every single one of these people is either african american or brown, had some type of color to their skin and therefore it gives people an easier path twie say in -- pathway he takes on black or brown people. >> al sharpton has history of what some call record ambulance. light woman in up state new york claimed to have-black teenager by 6 white man and has platform on msnbc and ends up covering himself to stage protests. >> sharpton has long history and questionable behavior within the states.

i agree with you, howie, on that point, to me the larger conversation here is one that i think is really worst than by the media aggression about the president, how does -- how do we have these kinds of scenarios with urban decay, baltimore last year being the homicide capital of the country and not have that be a bigger front page subject within the media until the president gets into a political scrum with elijah cummings, this is what the media should be covering, how we reached this circumstance, are we going to ignore what's going on in san francisco just because it's another city in which democrats and policies have failed. i think that the conversation about this and the willingness of the media to say the president is racist in every circumstance where he's going after with whom he has political disagreement is overblown and if you think he only does this kind of aggression toward people of color, i'd like to introduce you to someone named john mccain.

>> but it is true that by in large media don't cover much of the problemses of -- problems of cities, he's very good at it and some people say they are too quick too follow. >> let's be honest, the media wants a fight and donald trump is great at bringing them the conflict, what they don't do is follow up to your point what is the root of the problem, why are these cities suffering, why the endless cycles of poverty, why the housing problems, we don't hear about that why because i will tell you when you go out and give policy talks, it's boring, people don't click and watch and listen and the media will not cover it for that reason. >> before we go i want to turn to cnn's don lemon, one to have moderators and president trump called him dumb. here is what happened.

sections here in new york and in washington and in chicago and elsewhere where you have ramping crime. >> a lot have goal, some political agenda in some way, they see a story, how can this be used to support that agenda and further -- further, you know, promote it and so people see it that trump makes the comments about cummings, they say, oh, look racist just like we have been saying that trump is racist and more focused on angles than reporting let alone actually caring about the people who are suffering and, you know, pressuring people for solutions. >> in fact, kathy, when the president was accused of racial attack for calling baltimore disgusting, rat-infested, no human being would want to live there, at least in certain sections, defenders look at statistic, baltimore has high poverty and sections of cummings district which are much better off.

but saying the things that terrible in some parts of baltimore, does that neutralize the president's attack because now we have to circle back to, yeah, but in every administration many administrations have failed to do much about it, including the obama administration. >> but often reporters can't control what they are going to do, the reporters give it angle. >> what do you mean they give angle? >> the story is how secretary grew up. i worked in washington post, how did the hud secretary grow up, what's the background, how did he become hud secretary. i had to talk about his growing up. i had to stay an angle and create story and get people interested about the feelings behind it, jimmy carter addressed trying to address cities and poverty and that was fascinating story, i was able to write about that and he made it

horrific shootings that we've had, you know, there's nothing that's absolutely perfect but the media would do well to start focusing on congress, certainly because right now on the twitter verse, folks are saying at least some members come back off vacation now to deal with this 2 in 13 hours is ridiculous, howie. >> shows you how out of control things are and seems to me, though, the question will be even if congress did come back what would congress do that could be signed by the president because obviously the many, many shootings like this and i'm also wondering, you know, the typical formula on television they go on and say it's president trump's fault, he created the climate and others will say that's ridiculous and i don't think ultimate their argument gets anywhere, it's the fault of the people that pull the trigger in these situations and i think the media ought not to play a deinflammatory role but unfortunately that has been track record on the past.
