12:00 am
rob: all right, just hours before the deadly shooting in dayton, ohio, 20 people were killed in a mass shooting in el paso, texas. that suspected gunman is now facing capital murder charges. we continue with our fox team coverage with garrett tenney in el paso this afternoon. garrett, you've been there since just after those shots were fired, and you've spoken to a lot of witnesses. what do you have for us today? >> reporter: police are still trying to identify some of the 19 bodies that are lying on the floor of this walmart, and the mayor tells us they are hoping they have that process completed by tonight so that they can begin informing all of the families who are deceased. those families, as you can imagine, they have been desperately searching for answers and holding out hope for
12:01 am
the last 28 hours now. and at this point, though, many of them are forced to face the increasing likelihood that their loved ones are gone. we saw some of that desperation last night when three women came here searching for answers about their 87-year-old mother, and it was just absolutely heartbreaking, seeing them as they were trying to find some reason to hold out hope. >> i got tired of waiting and waiting and waiting, and i just want to know where my mom is. i want to just find my mom. somebody needs to tell me where she is. i want to know if she's dead or alive or if she's still in walmart. >> reporter: just tears at your heart strings, hearing that. we are starting to learn more about some of the victims from the families who have been notified. one heartbreaking example of that is the mother of three, jordan. her sister tells the associated press that jordan and her
12:02 am
husband had just dropped off their 5-year-old daughter for cheerleading practice before they came to walmart to shop for school supplies, carrying with them their two-month-old son. doctors told the sister that jordan likely died protecting her baby from that hail of gunfire based on the baby's injuries. the baby is now being treated for broken bones. in terms of the investigation, officials are moving ahead very aggressively in prosecuting this case. the department of justice on the federal level said they are treating it as domestic terrorism, and they are seriously considering pursuing federal hate crime and firearm charges. that would carry the potential of the death penalty on the state level. the 21-year-old gunman is also looking at potential death penalty-level charges as well. the sheriff said that he is cooperating, the suspect is cooperating with authorities, he is telling them everything they need to know, and they are moving closer towards being
12:03 am
certain that this was a hate crime case. of course, that suspect came all the way from across the state to carry out this attack. we're e hoping to get a little bit more later on this evening. rob? rob: all right. yeah, some of the victims, garrett, that you have shown to us over the last couple of days, it has absolutely broken our hearts. we appreciate your time, thank you. molly: and the u.s. also reeling from its second mass shooting in less than 24 hours, this one in dayton, ohio. a gunman in body armor opened fire early this morning in a crowded area downtown killing at least nine people before being shot and killed by police. among the victims, the suspect's sister. just witnessed a remarkable press conference with a lot of new information. mike tobin has been reporting on all of this live from dayton. mike? >> reporter: and let me start running down some of the bullet points we got out of the latest update from chief richard biel of the dayton pd.
12:04 am
one of the things we learned earlier in the day, the time frame from the first shot to point where the gunman was killed was less than a minute. the chief of police shortened that time frame to 30 seconds from the time the first shot was fired til police made that very accurate, high-pressure life and death decision to take the life of that gunman, therefore, neutralizing them before he got inside of the crowded bar where the bloodshed would have been much greater. we have updated the information about his weapon. it was an ar-15 firing preponderate 223 rounds -- .223 rounds, but it was equipped with drum-type magazines capable of holding 100 rounds. there was no indication that the gunman reloaded, but he wouldn't necessarily have to because that particular weapon held so many rounds. he also wore a mask, he wore body armor according to the chief of police. there were early reports that a bystander had attempted to grab his rifle and the gunman had pulled out a side arm and kept on firing. that information was not accurate.
12:05 am
there was only one weapon used in the attack, he never had to reload because there was so much capacity in that drum-type magazine. he had two weapons, but only one weapon was used. we learned that one of the victims was the sister, the 22-year-old sister of the gunman, her name was megan best. she was not the first -- betts. the family home in fellbrook, ohio, about 21 minutes away, has been searched by the fbi. the parents are there. they're said to be distraught, understandably. not only did they get the news today that they lost a daughter, but they lost a daughter because their son committed an incomprehensible act of violence. the sister, the gunman and an unidentified acquaintance all traveled to this location in the same vehicle. at some point they separated. they don't know exactly what the gunman did when they separated, but he came back loaded with body armor, with a mask, with a loaded weapon and went on his
12:06 am
deadly ram page. and, again, police officers killed him before he entered a crowded bar called ned peppers, and the chief of police indicated the bloodshed likely would have been much, much greater had he been able to enter that bar. back to you in new york. molly: mike tobin, a remarkable rundown. the police also not giving in to motive in that case, that's something we're expecting to hear more about in the weeks ahead. we're following both of these events closely as well as dayton. we'll bring you update as we get them. rob: jon scott will have more at 6:00 easternis used to create ts where these -- this shooting sub culture thrives and where young angry men can get together and -- and share information. >> are you suggesting that that should not be allowed? >> i think it's not just banning people from the sites, it goes further than that, we live in an environment which corporations make a lot more determinations
12:07 am
about the way that we live and what's allowed in different platforms and servers that they have than anything that congress can do to change the laws in different respects, is it possibility, silicon valley in a sense to say certain things that you're not going -- you will have to build your own server to make this thing happen as oppose to allowing this stuff to foment, everyone in favor shutting there's places. >> certainly worth debating. america victim being of white nationalism than victim of isis islamic white -- >> when it comes to any breaking news coverage particularly of mass shootings, much of it is wrong and mistaken, so if there's one thing i always tell my students it is that you must
12:08 am
reserve judgment. much of the coverage of that was proven incorrect, you go to gabi shooting, steve scalise, blame is placed mistakenly and you have to reserve judgment and talk about real policy issues. >> wait for the facts. now in the days leading up to these two mass shootings and in texas and ohio the news was dominated on the trump's attacks on city of baltimore. >> embracing telling us he plans to run a racist reelection campaign. >> for someone like me proud baltimorean, born in baltimore, still call that area home. >> once again the media call president trump racist this time for exposing the obvious that
12:09 am
baltimore's democratic machine has failed their city. my friends it's not trump who has given up on urban america, calling him a racist have. >> seems to be a turning point that we didn't see after charlottesville. he sends racist tweets rather than, you know, use language like -- the media seems to be taking a stand on president trump on this volatile issue. >> okay n a single week you had the cincinnati rally, right, he did not necessarily call out the squad of the four women of color who were serving in congress on the democratic side but he did talk about they were out there and they are now the face of -- of being against everything that americans hold dear and he takes on al sharpton and elijah cummings, if you look at the four corners, president trump is doing what he does, comes out swinging, it's almost like he's
12:10 am
color blind if you're simply looking at the action, however, he does not help his own cause when it turns out that every single one of these people is either african american or brown, had some type of color to their skin and therefore it gives people an easier path twie say in -- pathway he takes on black or brown people. >> al sharpton has history of what some call record ambulance. light woman in up state new york claimed to have-black teenager by 6 white man and has platform on msnbc and ends up covering himself to stage protests. >> sharpton has long history and questionable behavior within the states.
12:11 am
i agree with you, howie, on that point, to me the larger conversation here is one that i think is really worst than by the media aggression about the president, how does -- how do we have these kinds of scenarios with urban decay, baltimore last year being the homicide capital of the country and not have that be a bigger front page subject within the media until the president gets into a political scrum with elijah cummings, this is what the media should be covering, how we reached this circumstance, are we going to ignore what's going on in san francisco just because it's another city in which democrats and policies have failed. i think that the conversation about this and the willingness of the media to say the president is racist in every circumstance where he's going after with whom he has political disagreement is overblown and if you think he only does this kind of aggression toward people of color, i'd like to introduce you to someone named john mccain.
12:12 am
>> but it is true that by in large media don't cover much of the problemses of -- problems of cities, he's very good at it and some people say they are too quick too follow. >> let's be honest, the media wants a fight and donald trump is great at bringing them the conflict, what they don't do is follow up to your point what is the root of the problem, why are these cities suffering, why the endless cycles of poverty, why the housing problems, we don't hear about that why because i will tell you when you go out and give policy talks, it's boring, people don't click and watch and listen and the media will not cover it for that reason. >> before we go i want to turn to cnn's don lemon, one to have moderators and president trump called him dumb. here is what happened.
12:13 am
>> as a man of faith, as a christian you are saying he attacks anyone, sounds like you are condoning attacks, is that christianly or godly? >> i'm stating statement of fact, i'm not condoning anything. >> in that conversation don lemon and the pastor it was odd as soon as the pastor wasn't going along with what lemon wanted to do the cnn underneath sends it with controversial pastor. i worked in the same region, same part of baltimore that freddie gray under the john perkins civil rights pastor and we worked there on the house, first politician i met and there's a willingness on the part of african-american pastors to reach out across partisan lines to work with people to better their communities, that's exactly the kind of leadership
12:14 am
that i think we need in the communities to make things better and for lemon to posture and criticize someone who is willing to meet with the president on these issues is ridiculous. >> right, if you're providing another point of view and you start questioning christianity, i question that. at the debate lemon was the opinion guy called president trump bigot. let me get a break, when we come back we will talk about the democratic debates and more on mass shootings straight ahe one of the benefits we as a country give our veterans is eligibility for a va loan for up to 100% of your home's value. thank you, admiral. so if you need money for your family, call newday usa.

12:18 am
>> vice president biden you're simply inaccurate on what you're describing. >> the good news for joe biden was maybe the bad he can do and the bad news is maybe that's the best he can do. >> the bar is low for joe biden. >> joe biden was the party's one real hope and after last night it seems pretty clear conclusively clear that uncle joe is heading for a well-reserved retirement. >> it was not against one, 500% better than previous debate, energetic, combat i have to take on rivals' records. the best he can do, not so great, all right. >> the media is tired of joe biden, i think they are tired of covering, they are more interested in some of the newer candidates. >> absolutely. >> ready and eager to cheerlead for kamala harris in particular but for other candidates on the shaij and to be honest biden's
12:19 am
performance was perfectly serviceable, it was much better than what we did before and to be honest we have to keep in mind this is knocking the rust off for him, as long as he's been in politics he hasn't really been in the day-to-day debates and i think that was a good performance on his part. >> you hear in terms of -- >> he keeps underestimating and has big lead. they would rather have more younger liberal challenger. >> case of media objectivity, i'm not sure that vice president biden deserved much more credible praise here. we are talking about stumbling for words, he wasn't crystal clear and therefore he got kind of a b minus which is not very exciting and the old expression
12:20 am
when people cheer and clap for a dancing bear it's not because the bear is dancing well it's because the bear is dancing at all. i think they were looking for somebody, whether bernie coming out swinging, doesn't matter if they have gray hair and been around for a long, the media wants to see somebody who is on the point. >> i think there's ideological component. biden is center-left guy promising incremental change. compared to bernie or kamala he's not liberal enough. >> yeah, i think there maybe an idealogical component. first debate where people did so awful, the polls dipped a little and came right back. the media doesn't want a front runner the whole time, they want to mix it up. >> it's not antibiden --
12:21 am
>> who is going to watch the debates if joe biden is so far in the lead that it doesn't almost matter and he is very much in the lead. >> now growing scene for the press, kamala harris and cory booker who were attacking biden by attacking the record of the obama administration is that why are democrats when obama has popularity among democrats going after two-term president. >> popular as barack obama personally, policies are far less popular. you don't get to a point where essentially almost the entire field is running against your signature domestic policy obamacare want to go either replace it for all or dramatically change it and have a circumstance where you can't talk about it, this is a core issue, health care is always going to be a core issue for democrats and no way for them to get around the fact that obamacare didn't deliver on its promise from the perspective of many democrats that didn't go far enough and even if the fact -- even the fact that policy has become more popular since obama
12:22 am
left office does not change that. >> this is a crazy strategy for every democrat on the stage to have adopted, he'll got a 90% positive rating with democrats when it comes to president obama . look at the stock market, we covered over president obama's 8 years, recovered by more than 100% gains for the dow and nasdaq, it was very impressive, he didn't bring up that, he didn't bring up a whole bunch of other issues whether it was the fact that he was commander in chief when bin laden was killed. he did not operate on that level and therefore the other democrats pounce and seemed counterproductive for him. >> for all obamacare is for now actually fairly popular and yet, you know, they don't really grapple with the fact that even though the democratic party love the idea of medicare, abolish
12:23 am
private health insurance, full campaign, that's going to be pleasing to them and some have focused on policy of the moment. >> makes no sense of taking 150 people off of health care, that's not a winnable strategy, but we also have to look at who got the most out of the first debate, it was kamala harris because she attacked biden, every one of those candidates that came back for second debate, learned if we want press coverage we darn better attack biden which means attacking obama, that's why they are attacking obama in the debate, they come the next day and take it back. >> well that may be great for ratings but i will not attack any of you as a result even if it's good tv. [laughter] >> see you later. nice to have you on the panel. ahead president trump versus some prominent members to have press and more on the tragic shooting from el paso and dayton

12:33 am
>> fox news alert, we are getting reaction from lawmakers and the white house in the wake of those two shootings that have left at least 29 people dead in texas and ohio, mark meredith is traveling with the president in new jersey and has the latest, mark. >> howie, president trump expected to make his way a little this afternoon, 4:00 o'clock, possible that president can speak to reporters boarding air force one or deplaning when he makes his way in dc, we have heard from the president on twitter, i want to read you the tweet from 8:00 a.m., quote, fbi, local are working today in el paso and dayton ohio, information is rapidly being accumulated in dayton, much has been learned in el paso, law enforcement was rapid in both instances, updates will be given throughout the day, we've also heard from the president's acting chief of staff mick mulvaney defending the president after some of the 2020 democratic hopefuls have blamed the president's rhetoric and word choice as possibly contributing to this weekend's
12:34 am
violence. >> i don't think it's fair to try and lay this at the feet of the president, there are people in this country this morning thinking president trump was happy about this, that's sad, he's angry, he wants it to stop. >> former texas congressman beto o'rourke, he's in el paso this morning, he was having campaign events earlier yesterday, he canceled those, flew back to previous district, the congressman also spoke with cnn this morning and said he believes there's obvious links in what happens shootings. >> when he says that white supremacists and neo nazis are very fine people, the commander in chief is sending a very public signal to the rest of this country about what is permissible and encourages to happen. >> we will see if the president responds to that in the latest developments when he heads back to washington later today, howie.
12:35 am
>> thanks very much for the update, minutes before the mass shooting in el paso, a manifesto appeared online that attacked hispanics and immigrants, authorities are work to go confirm whether the gunman is, in fact, the author. joining in new york kat tempf, kathy, publisher of catalina and washington post editor. kathy, the new york post has antiimmigrant terrorist. now inside the story says we don't know if this manifesto is in fact, tied to this person but i want to ask your reaction to manifesto, whoever is responsible for it. >> right. >> attacks hispanics and attacks immigrants talking about how the state of texas is being overrun and so forth. >> right. >> someone who came -- someone born in the country but your parents brought you here from cuba and supposed to be here temporary. >> political asylum. >> so personally and as a journalists what's your reaction to this sort of rhetoric?
12:36 am
>> as a journalist all the facts have to come out and i was watching the news nonstop for 5 hours and i watched the english news, they didn't mention anything about immigrants, they didn't mention anything about the shooter, when i turned on spanish news stations, they interviewed people who were there, got coverage of the shooting and they said he made protrump statements and antiimmigrant statements when he made the shooting, when the shooting happened. >> telemundo. >> spanish station was reporting within an hour, even bbc had not reported that there was antiimmigrant statements that were yelled. journalist tons spanish side got the story but the american and bbc and english stations did not get the story. >> do you think that the american networks held this back because of deemed to be speculation or question of speaking the language. >> it could be a language -- >> exactly. could be a language barrier when i worked for people i was one of 30 reporters in dc that spoke
12:37 am
spanish for people in espanol, i was the only spanish speaker for spanish magazine. >> we heard beto o'rourke on cn, in that president trump actually encouraged this sort of thing, after charlottesville and i knew this was coming, pattern often gun control. i understand that the president's actions and the verbiage he uses will be part of this debate but to suggest that he's responsible, he's encouraging, he's condoning the actions of a crazy gunman seems to be horribly unfair on the media's part, politicians can do it, they are running for office. >> unfair is exactly the word that i would use here and i say as someone who has had problems with some of the things that trump has said about immigration in the past, i certainly don't agree with president trump on immigration, however, i've seen a few columns basically same think that beto is saying that rump is responsible for this.
12:38 am
that's just unsane, obviously trump doesn't want to see all the people murdered, nobody wants to see somebody like this, these are craze lunatics. i would call it domestic terrorist and white supremacist terrorism, antiimmigrant terrorism but to blame president trump, that's just -- it's i logical in addition to being unfair. >> the president issued statement calling this a hateful act and act of cowardliness and at the same time i have a sense of dejav, during obama administration when police officers were killed, conservative commentators said that antilaw enforcement policies, he did not and president trump did not. it is fair to challenge rhetoric and handle immigration issue but to suggest that he would be condoning the shooting of so many innocent people, it's something the media needs to really be careful about.
12:39 am
>> they were careful, they weren't saying -- they were stating the facts, this is what he said, this is what he did, this is what he said when he was doing it, this is what we found, we interviewed these people and basically judge for yourself. the journalists gathered the information. they gathered information. >> remember the shooting at the congressional baseball game, that was a bernie supporter and nobody brought that up. >> he loved rachel maddow. >> had nothing to do with that. >> i agree with you, kathy, if he yelled things -- all kinds of people can invoke the name of governor, mayor they don't like, doesn't mean it's the fault of the public official. >> journalism 101, you give the facts to the viewer, to the public and they take that information and do with it as you will, it's not for us to give our opinion, i'm not giving my opinion about immigrant, how i feel about the situation but the spanish media reported what happened, gave it to the viewers, do with it as you will, same with english media, do with
12:40 am
it as you will. >> brief comment. >> it's completely unfair to actually suggest that this is what trump wants, i think that's really sick, it's really unfair and we need to have honest conversations about the issues if we ever hope to solve them and not just focus and not laying blame. >> unfortunately he said protrump statements, unfortunately. doesn't mean that's what trump wants. >> yes, they are, people are saying that. >> i am for beto, he didn't say i'm doing this for marian williamson and unfortunately trump's name is tied to shooting. >> sometimes liberal shooters, like you said a bernie sanders sanders -- killing or trying to kill members of congress. i know you would both agree, more from new york in a moment, we will look at the president pretty much declaring war on major american cities or at least we would -- would like to
12:41 am
least we would -- would like to see them run differently. the weather's perfect... family is all together and we switched to geico; saved money on our boat insurance. how could it get any better than this? dad, i just caught a goldfish! there's no goldfish in this lake. whoa! it's pure gold. we're gonna be rich... we're gonna be rich! it only gets better when you switch and save with geico. i was on the fence about changing from a manual to an electric toothbrush. but my hygienist said going electric could lead to way cleaner teeth. she said, get the one inspired by dentists, with a round brush head. go pro with oral-b. oral-b's gentle rounded brush head removes more plaque along the gum line. for cleaner teeth and healthier gums. and unlike sonicare, oral-b is the first electric toothbrush brand accepted by the ada for its effectiveness and safety. what an amazing clean!

12:44 am
>> president trump didn't mention any minority lawmakers by name, several other major --
12:45 am
>> the conditions in nancy pelosi's once great city of san francisco are deplorable. they are deplorable. look at los angeles with the tents and the horrible, horrible disgusting conditions, look at san francisco, look at some of your other cities. >> and kat that was an excerpt of the president's rally, now that his broaden political assault most have democratic mayors and members of congress, i've seen few people maybe a sense here or there is he offering any solutions. should the media be more focused on that a little on the political rhetoric. >> i absolutely think so. people aren't asking the question which i have the same issue, what do we do about it because i think the things he said about baltimore are facts based on statistics and everybody we wanted to focus on whether they were appropriate,
12:46 am
nar tifer on the left these are racists, as you mentioned before don lemon called him racist when he was supposed to be a moderator, supposed to be completely nonbias, neutral which i had a problem with, i didn't see him that way. but i think that him and ben carson should be coming out and talking about this, what do we do about the issues, if the democrats don't have the solution, what is the solution. >> since you mentioned ben carson, kathy, president trump might go to baltimore, he didn't, sent ben carson was world-renown baltimore surgeon who said we want to work with local leaders, he also mentioned cummings and runs housing urban development department. >> right. >> the media ought to ask not just white house or members of congress, what are you going to do that. >> what a missed opportunity because i interviewed the former secretary of hud martínez.
12:47 am
>> bush administration. >> he had the wonderful points and policy and what they were going to do and wonderful things, that wasn't my topic, always ideas, and we just don't see that much anymore and we need that and some in the united states, mississippi, red states that are suffering right now with red governors, let's talk policies, let's clear up america, we have so many issues and so many poor cities across the entire united states, the secretary of hud, what a great opportunity for the conversation but people don't want to talk policy it sounds like. >> as reporter i have to ask, does the media really care about tinner cities because these are not the viewers and the readers who are most priced by advertisers and exhaust of decades in efforts to help the city going back to lbj's great society and i wonder whether or not because problems are never going away in cities and not just baltimore, there are
12:48 am
sections here in new york and in washington and in chicago and elsewhere where you have ramping crime. >> a lot have goal, some political agenda in some way, they see a story, how can this be used to support that agenda and further -- further, you know, promote it and so people see it that trump makes the comments about cummings, they say, oh, look racist just like we have been saying that trump is racist and more focused on angles than reporting let alone actually caring about the people who are suffering and, you know, pressuring people for solutions. >> in fact, kathy, when the president was accused of racial attack for calling baltimore disgusting, rat-infested, no human being would want to live there, at least in certain sections, defenders look at statistic, baltimore has high poverty and sections of cummings district which are much better off.
12:49 am
but saying the things that terrible in some parts of baltimore, does that neutralize the president's attack because now we have to circle back to, yeah, but in every administration many administrations have failed to do much about it, including the obama administration. >> but often reporters can't control what they are going to do, the reporters give it angle. >> what do you mean they give angle? >> the story is how secretary grew up. i worked in washington post, how did the hud secretary grow up, what's the background, how did he become hud secretary. i had to talk about his growing up. i had to stay an angle and create story and get people interested about the feelings behind it, jimmy carter addressed trying to address cities and poverty and that was fascinating story, i was able to write about that and he made it
12:50 am
interesting. >> real people. >> by the way, it's not just a question of throwing federal dollars. single-family households, generations of poverty that breed more generations of poverty and complicated issues in the media but don't get much attention unless the president is on political attack. >> i don't know because people don't know what to do, we have tried to throw money at the problem, federal government has given so much money to baltimore and clearly hasn't been used in -- in the best way or maybe they're not sure what to do with it or who knows, the problem is no one is asking that question, people are asking instead what was trump's rhetoric, how is this politically, people are not asking the question, okay, so what do we do about it because statistically there's real suffering. >> we have to go, but you just asked the question and the media should be asking more of such questions, that's part. great to see you in new york. when we come back final thoughts on the twin tragedies, the shootings in ohio and texas.
12:51 am

>> fox news alert, el paso police department expect today give update to the media at the top of the hour, we will bring it to you live at fox news channel when it happens, the media has a choice right now, we can focus on politics, finger-pointing, inevitable blame game or cover the mass shoot negotiation a way that ask difficult questions, is there any way, can't really ever completely stop them but to perhaps minimize them, deter them, what do you think liz claman. >> trey gowdy was on the sunday morning futures show a few hours ago and he specifically said any right he's ready to give up if it can promise no more shootings like parkland, like, of course, sandy hook and all of the
12:55 am
