prisoner hopped a tractor to make his mistake and he might have murdered a corrections employee. and a shark taking a diver by surprise. the man said he could have died if it wasn't for a couple of nurses that happened to be nearby. we'll talk to the heros that didn't hesitate to help. i'm rick leventhal in for shep. the suspect in the el paso massacre confessing he's the killer and admitting to authorities that he was targeting mexicans. that's according to a sworn statement from a detective. the detective writing that the admitted killer waived his right to remain silent after surrendering near the scene. jeff paul is reporting live from el paso. jeff? >> yeah, rick. we knew on the day of the shooting the suspected shooter got out of his honda civic and gave him self up to a motorcycle

officer that was nearby on the scene what is new to see in writing, that according to his affidavit, he admitted to the shooting but he said that he was in fact targeting mexicans. that would go in line with the idea that the authorities are considering filing federal hate crimes charges in addition to the capital murder charges and that the alleged shooter faces. we're learning more about the phone call that the suspected shooter's mother made to the allen police department in late june, weeks before this mass shooting. we're told the suspect's shooter's mother made this call. it wasn't to 911 or to call for service. it was more of a call to the main line to get some information. she didn't leave her name and her son's name. the way that we're able to confirm that this call happened is by going through manually and looking at the security camera footage and listening to the conversation on their end. the suspected shooter's mother called about owning an ak-type

rifle. the concern was about her age, experience and maturity in regards to owning this gun. >> she was fearful that he would injury himself with this type of a weapon. so after that, the public service officer comes around and says, is your son suicidal? has he made any threats against others or has there been any dramatic change in his behavior recently that would cause alarm? the answer to those apparently was no. the suspected shooter faces capital murder charges. they're considering pursuing the death penalty and now with this in writing saying that he was targeting mexicans, it would make sense that authorities are heavily considering filing the hate charges as well. >> and we're hearing from some of the first responders? >> yeah, the first responders obviously showing up to a scene like this, they're already

considering heros by many people, especially those that survived this terror attack. now we're learning more about what happened during and after. authorities say they got here within six minutes. many of them broke protocol and went inside without having any backup. >> i wendt back to my office. i was like i'm beat, tired. i was mentally drained. other officers that were there also that have reached out to me, i reached out to them. just talk it out a little with it. that's how you get through it. i'm not going to let one bad individual mess things up for our city. >> that spirit on full display behind us here at this memorial that continues to grow. the focus for many folks coming out here to pay their respects for 22 victims of this domestic terrorism attack. the funerals are well underway. we'll continue through the weekend and what will be a

somber week of saying good-bye, rick. >> thanks, jeff. president trump pushing for stronger background checks for people that want to buy guns in the wake of last weekend's mass shootings in texas and ohio. the president says he can convince republicans and democrats in congress to get it done. >> background checks, we have tremendous support for really common sense, sensible, important background checks. i have a greater influence over the senate and the house. >> [question inaudible] >> i think we can get something really good done. we can have some really meaningful background checks. >> president trump saying that he spoke with the head of the nra and that he thinks he can get the gun rights group on board part of the way as well. >> in the end, wayne and the nra will either be there or maybe will be a little bit more neutral. that would be okay, too.

>> the president stopped short of calling lawmakers back to capitol hill to take up legislation. rich edson reporting live from new jersey where the president is set to arrive this afternoon. rich? >> the president said this time can be different, that congress can pass legislation after two mass shootings last weekend. that on top of congressional democrats and republicans and the national rifle association, he says he can convince his base. >> we passed background checks a number of times, meaning the democrats. everybody knew they weren't that strong. i think meaningful background checks are a real positive. politically i can't tell you. i don't know. good bad, indifferent. i don't care politically. i don't want to have crazy people having guns. >> top congressional democrats, nancy pelosi, chuck schumer say

they have spoken to the president. he says the best way forward to address gun violence in our country is for leader mcconnell to let the senate take up and pass the house-passed universal background checks legislation and for the president to sign it into law. the senate majority leader, mitch mcconnell, told a louisville race station that he's for conversation about potential bills moving forward. he made it clear the senate won't be back early. and for the nra, he said that they're opposed to any type of proposal that would limit access to firearms for law-abiding americans and the proposals that are discussing now would not have stopped either of the shootings last weekend, rick. >> chris, the president defending the mass immigration arrests. >> yeah. massive immigration raids and arrests in mississippi. about 680 people were arrested.

the associated press says these are the largest of these types of raids that the u.s. government has put forward basically in about a decade. president trump defending the raids. >> if people come into our country illegally, they're going out. they're not coming in illegally and staying. we have laws. they may get in. may be tough, they may get in but it doesn't matter. they're going out. when people see what they saw yesterday and like they will see a long time, they know that they're not staying here. >> officials had planned these raids for months. the associated press reports 600 officials have spanned out across mississippi seven different chicken processing plants were the targets, this is a major issue upcoming in the 2020 election a big issue in the mid-term elections. immigration. not only immigrations and customs enforcement and the removal proceedings but also about migrants showing up to the

what's around the corner could be surprising. ask your doctor about eliquis. >> rick: a man hunt underway in tennessee for an extremely dangerous escape inmate. investigators warning folks that curtis watson may have changed his appearance after escaping prison. happened at the west tennessee state penitentiary in henning about 40 miles north and east of memphis. investigators say the con might have killed a prison administrator in her home on the prison grounds and escape on a tractor. david roush is the director of the tbi. what do we need to know about this guy? >> i think you stated it, he's extremely dangerous. he's on the run. at this point we believe he's probably still in the area. we have -- following a lot of leads and information. at this point, we're pretty

confident that he's in that area right now. it's still possible that he has gotten outside of the tennessee area. at this point, it's still -- very fluid man hunt, very fluid search. >> rick: we're looking at at toos on screen right now. this is obviously an identifying feature. he put on weight behind bars? >> he has. >> rick: tell us what people should be looking for. >> more than anything right now is obviously the pictures that we have put out. he may or may not have altered his appearance. you know, look for -- look at the pictures. anyone that resembles that, let us know if you see that individual. if you're in the area, if anything is disturbing around your property, call law enforcement immediately. we have local, state and federal law enforcement on the ground in west tennessee. we're responding throughout the country right now on tips coming in.

>> rick: how many hours has he been on the loose? >> he's been out there we believe since early on wednesday morning. so he's moving in three days now. >> rick: he was a trusted inmate? is that how he got out? >> he was in the minimal custody. he was working, had a job where he worked on the farm outside of the prison walls. >> rick: so you have your state agents out there looking for him. i would imagine federal agencies as well are involved? >> absolutely. yes. we have the local sheriff's office, the local police departments, the state highway patrol. our agents. we have the atf, the u.s. marshall service and the fbi are all involved in the search. >> rick: the primary message here, folks should stay clear of this guy. >> absolutely. the message is very clear. we don't want anyone to engage him. he's extremely dangerous. we do believe that he's the

suspect in the murder. he is who we're looking for for that murder. absolutely -- nobody should approach him. call law enforcement. >> rick: and we have a phone 91 on the screen. that's the best number. >> yes, 1-800-tbi-find. >> rick: thank you, dade i have. >> thank you. >> rick: the estranged husband of the a missing mother of five is in court this morning. the judge says he needs more time to consider a gag order and the defense's motion. fotus dulos and his girlfriend have pleaded not guilty to tampering with evidence in connection with jennifer dulos' appearance in may. laura ingle has more from stamford, kentucky. laura? >> hi, rick. a lot of ground covered today from requests for a gag order in this case. a request by the defense to have personal and private medical information about the missing mother of five revealed.

fotus dulos appeared in court with his missing monitoring device around his ankle. two people matching the description were seen on video the night his estranged wife vanished. items in bags had bloody items matching the dna of jennifer dulos. fotus dulos says his client was billed for her tests and they want access to the records to see what she was being tested for, which could help support a defense theory that she disappeared on her own if she was seriously ill. >> she's gone. we don't know why. i think we're entitled to discover information that leads us, especially given the state's refusal to give us any information about what is in the

warrant. >> the judge today did not rule on the state's motion for a gag order in the case saying he will make a written ruling at a later time. fotus dulos will be back in court the 14th. >> rick: any effort on the results of the search for jennifer dulos. >> while police have been very tight lipped on this case, they ask that the evidence in this case is starting to come back from the lab with interesting results. today the judge also ordered third parties not to talk to any of the dulos children on fotis' behave and ordered fotis dulos not to contact jennifer's mother who has been taking care of the children since their daughter disappeared. the grandmother has temporary guardianship and seeking sole custody. that issue to be decided.

you can see this is the inside of an insurance agency. one of the stops on a gruesome crime spree. the guy fumbled with something in his jacket and takes out two huge knives and started stabbing her. she tried to fight him off. she got away from him. her hands bloody. she goes to the back of the store where she grabs two chairs for protection. no doubt she thought the guy would kill her. he grabs some cash before heading out the door. police say the perpetrator should never have been out on the streets. >> this person should have been in prison and not allowed to be in our community committing the violent acts. based on his prior arrest record, he's a violent individual who should have never been considered for early release based upon assembly bill

109. >> assembly bill 109 passed in 2011 in california. it was aimed at reducing the prison population and also called for a certain nonviolent felon to serve time in county jails rather than state prisons. today the california attorney general told fox news that we should always be prepared to reevaluate laws but noted it's never easy. >> rick: has he done that before? what else do we know about it? >> he has a long criminal rap sheet. he's 33-year-old zachary castanada, a documented gang member with a long criminal history including weapon and drug convictions. the crime spree was chaotic. it lasted two hours. at the end, four people were dead, stabbed to death and two others injured. you can see her the time line. he's alleged to have killed two people at an apartment complex and then made a number of stops

robbing stores and attacking men at a gas station, nearly cutting off his nose before killing two more people. a customer at a subway sandwich score and a security guard at a 7-11 before police were finally able to apprehend him. now he's not been cooperative with police and they have yet to determine any motive here. he has an arraignment and no word if prosecutors will see the death penalty. rick? >> rick: thanks, anita. an off duty firefighter getting credit for stopping a guy carrying a loaded rifle at a walmart. police in springfield, missouri, say the guy was also wearing body armor and walking around inside the store. witnesses say when he walked out, the firefighters stepped and held him at gun point until cops aarrived. they say the man didn't fire any shots. nobody got hurt. the suspect caused chaos as you might imagine since this comes days after the shooting at an el paso walmart that left 22

people dead. matt finn live with more what was the guy doing? >> right now police are holding back a lot of details until charges are formally filed. it's not clear what the suspect's intent was or how bad this could have been. police did arrest him on a first degree terrorism charge. police say that 20-year-old surrendered outside the missouri wal-mart. he entered wearing body armor, military fatigues and fully loaded tactical weapons. he began recording himself on a cell phone walking around the store. eye witnesses said a loud alarm went off. people feared the worst running and hiding. >> this lady was screaming saying get out now. yelling. it's like oh, my gosh. i don't smell a fire. >> police say the armed man went out of an emergency exit where a former firefighter stopped and held the suspect at gun point. the firefighter says the suspect was compliant.

>> rick: a fall court releasing thousands of pages of documents related to convicted sex offender jeffery epstein. they're part of a defamation suit, one of his accusers filed against the millionaire's former girlfriend. the girlfriend accused of wrangling underage girls for epstein. analysts say the documents could contain explosive new information on abuses by some very powerful people. david lee miller is looking through the documents and has more. >> rick, the documentation has numerous allegations by epstein virginia guifre. she said she was forced to have sex with mexico governor bill richardson and attorney alan dershowitz. all have denied the allegations. richardson's office released a statement saying the allegations are false. mitchell said that i have never

her. dershowitz has stated he believes the paperwork would exonerate him and he has denied any wrong doing. other court documents said that when asked about sexual abuse in a deposition taken in 2016, epstein took the fifth. a reference to the constitutional right against self-incrimination. with the documents are photographs including one released showing epstein acquaintance prince andrew with his arm around the west of virginia guefre. she claims that maxwell made her have sex with prince andrew. other photos were released that were taken at epstein's new mexico ranch. there's also a photo of a young girl partially naked which she says that was found in epstein's palm beach home. rick? >> rick: david lee, a couple thousand pages today. many more documents being filed or possibly being released? >> that's right. this is just the beginning of

what will be many documents coming forward. what is notable here, these documents were part of a 2015 lawsuit. epstein's close friend, maxwell, called virginia guefre a liar. guefre sued for defamation. a federal appeals court released the documents. but they kay shunned because of the supporting paperwork is part of a lawsuit, everything contained in them is not necessarily true, rick. >> rick: thanks, david lee. police in hawaii investigating a string of arson cases which causes hundreds of thousands in damage at three high rise resorts. cops say they have a person of interest. jonathan hunt is reporting live with more. jonathan?

>> rick, we're talking here about three fires in three days targeting three hotels full of tourists. sunday evening, 10:05 p.m., alarms sounded. two fires started, damaging the hotel, but not causing any injuries. then around 7:45, a fire broke out at the outrigger hotel. guests were evacuated. someone went in two separate rooms and stole luggage. 8:30 tuesday, another fire was intentionally sill at the hilton hawaiian village and tower. police say security cameras recorded the same person at all three locations including footage in which he is carrying backpacks that match the description of the stolen luggage. >> we're asking the community and the public to rally together and identify the people. this is hawaii.

it's a small island. everybody knows everybody. >> while no one has been hurt in any of these fires, officials have advice, too, for tourists that may be frightened by the spate of arson attacks. >> let's be vigilant. be aware of our surroundings and vicious people. maybe if you see somebody that doesn't belong, report them. >> the fires, by the way, have so far caused around $2 million in damages. rick? >> rick: looks like they have promising leads. thanks very much. a flight attendant now facing charges after officials say she got drunk and then got on a plane. her name, julie ann march. happened on a flight from chicago to south bend, indiana. passengers say she slurred the security announcement. they said she was bumping into seats and passengers after she walked up and down the aisle to check the overhead bins. once the plane taxied to the

runway, she sat down in the jump seat and passed out. passengers had to buckle her up. after the plane landed in indiana, she started crying and asked what city she was in. a breathalyzer said she was five times over the legal limit for flight attendants. air wisconsin was the operator. the company fired the woman and she apparently didn't even get through the probationary period. we reached out to the former flight attendant. no response. not clear where she has a lawyer. losing a game is never fun. probably stings more knowing the loss wasn't because of anything you did on the court. that was the case for argentina's women's basketball game. the players were forced the forfeit after showing up wearing navy blue june fors. their opponent wore dark blue. as the home team, argentina was supposed to wear white. they had 15 minutes to change into the correct jerseys. couldn't meet the deadline.

>> rick: police say a former u.s. olympic horseback rider shot another rider at his farm in new jersey. this just days after the woman wrote on facebook that somebody was bullying her and told her to sleep with one eye open. jacqui heinrich reporting live. jacqui? >> the olympian is facing two counts of attempted murder, plus weapons charges and the woman he allegedly shot is fighting for her life. police have not confirmed the victim's identity but friends say it's lauren tannarack that was living on the property. the shooting happened in washington township, new jersey, wednesday afternoon. police say when they got there, they found a woman with multiple gunshot wounds, another man with minor injuries and former olympian michael barrasone. they also found a handgun. according to court documents,

tannarack called 911 after being shot twice in the chest saying that michael barrasone shot him. the article goes on to say that barrasone repeatedly said "i had a good life" as police took him into custody. police had been called to the property several times in the days leading up to that shooting. rick? >> the victim had said that her life was in danger prior to this? >> so investigators would not confirm the details with fox news. several outlets posted screen shots of lauren tannarack's account saying a she feared for her life. according to "the new york times," tannarack said i'm being bullied by a 6'3" man bullied to the point that i'm afraid. and tannarack said that her and her fiance kept horses at barrasone's form and barrasone

wanted to evict them. some in the equestrian community have rushed to defend barrasone. he was a member of the 2008 beijing olympic team and the 2009 sportsman international horseman of the year. no word yet on when barrasone is due back in court, but police say this incident is still under investigation. rick? >> rick: thanks, jacqui. sheriff deputies in georgia making sure a little boy showed up to school like a boss. nearly one month after his dad died a hero. hall county deputies escorting kay den dickson to his first day of fourth grade. last month, somebody shot and killed his dad after he was chasing down a stolen vehicle. the officers wanted to give kayden encouragement as he started classes. the entire community is proud of them. if you're going to get attacked by a shark, a best scenario would be to have a boat full of
