heather: trump administration releasing a new rule that would announce the time migrant families could be detained. jillian: what does it mean for overcrowded facilities? the president of the national border patrol council brandon judd, thank you for being here. you were on late night with shannon, appreciate you waking up this morning. let's look at this breakdown, this requires miners to be held in facilities to meet certain standards to prevent children from being held longer than 20 days. that is a couple things to note. with what we are expecting to hear today how do you think this will change? will it be the answer?

>> the main driver that fuels illegal immigration into the united states is the catch and release program, being released once you violate our laws to disappear into the shadows of society. a couple facts nobody can dispute. one of those facts is the vast majority of these individuals want their release and to the united states, never show up to court appearances and then we can't deport them at a later date so as long as we can hold those individuals pending asylum claims or deportation proceedings illegal immigration will go down to next to none. all we have to do is look back in march 2017 when we had 45 year lows. the reason we have those 45 year lows is everybody thought they would be held in detention facilities pending proceedings but because illegal immigration skyrockets. and that would drive illegal immigration back to lows we have never seen before.

todd: how do you expect the response? >> critics will say the floors decision is ingrained in law. and what the lawsuit is going to be, you look at the immigration law and give the secretary of the department of homeland security latitude on how he or she will implement those laws or rules and that is a cool that allows us to hold those individuals, based on sound principles as long as we have detention facilities that gives these children, and including schooling. as long as we do that, the courts will uphold this rule.
