charleston, south carolina where conditions are getting worse. the storm is 80 miles from you and inching closer. >> i can feel it hitting me hard. every now and then i feel that big band of gusts and powerful rain but i'm standing in the middle of one of dozens of flooded streets in charleston and you can see it is coming up to my ankles. is going to keep rising in the next couple hours. this is a triple threat storm, storm surge, flash flooding, the warning going out a moment ago and wind gusts we are bracing for, 40 feet in front of me is the water. we are expecting it to breach and come into the street at flood them even more. people have been sandbagging all day yesterday and the day before. a lot of people say it is a category 2, we are going to be

okay but category 3 now. listen to one man we talked to about how he was trying to protect his home. >> if you take a look at that event it will get above that. i don't think it will get as high as this top step but we are ready because a couple years ago we were swimming in the street. >> reporter: the storm has been so unpredictable, you have to take the advice of government officials and hopefully got out. people riding it through will probably be without power shortly. every now and then the sky turns green because transformers keep blowing out around this bad, 34,000 people already without power in the low country area. we are bracing, several miles away near the eye wall of the hurricane but look how bad it is already.

>> they call it low country for a reason. it floods regularly. rob: griff jenkins live in south carolina preparing for a possible landfall. jillian: it looks pretty bad. >> reporter: getting some outer bands here. it is very wet out here. not only high winds, we had a reading a little bit, 61 miles an hour. it will continue because we are 90 miles from the center of the eye but this is a barrier island, we are 50 or 60 miles from the outer wall bands. the storm surge, we expect roadside at 7:00 which means all

morning it will build. the combination of 5 to 8 feet of storm surge with these wins and 12 inches. and entire foot of rain. it is going to be difficult for the auto-parts of charleston and surrounding areas where there is mandatory evacuation. we see power for most of the island but people who haven't evacuated, we will stay and keep working on our gear. it is a wet and windy situation. we are at the p a are --pier which flooded in hurricane matthew. along with irma which caused a lot of beach erosion and we will see how things fair. rob: great job with the iphone and we will get back to you.

jillian: janice dean is tracking the storm. it is still moving slowly but it is a category 3. >> we were shy of 5 miles yesterday, strong category 2. they upgraded to category 3. the next couple hours the south carolina shoreline is taking a directed and impact from this category 3 storm. not only dealing with the storm surge but tornadoes which cause structural damage with these outer bands coming on short and you see the lightning strikes as well. not only potential of a tropical system but the potential for severe storms as well. in and around atlantic beach we had another tornado in oak island.

this is turning out to be a dangerous impact from this storm even though it has not made landfall. the closest brush we will see his this time tomorrow morning for north carolina, the outer banks. here is future radar, approaching hatteras, this time tomorrow friday as point of landfall. landfall is the lowest pressure when the center comes on shore. the effects of this are going to be widespread for the carolinas. here's the tropical models in very good agreement, the storm in the last 3 or 4 days has been spot on from the national hurricane center. they've done an excellent job of the forecast. we all knew the carolinas would potentially take a direct hit from the storm. additional rainfall we could see upwards of 8 to 10, isolated amounts of a foot of rainfall in this area is vulnerable to flash flooding. here is the latest track, category 3, we anticipate a

little bit of weakening as it approaches the shoreline and the quickest approach, the approach to land for landfall will be across north carolina we think sometimes tomorrow perhaps during this show and we will keep you posted but this is a dangerous storm. that is what we have been warning folks for days. rob: hopefully it hits and moves on it doesn't linger like it did in the bahamas. a man overnight, built and sold a gun to the shooter in odessa, texas. the wall street journal reports the unidentified texas man. a police officer, people lining up to give zachary owens a round of applause, receiving a new gun to use after he recovers. the husband of a missing

jillian: joining us is the leader in a fight against the greenlight law, michael kearns. thanks for being with us this morning. explain why this would protect workers who don't want to give illegal immigrants drivers licenses? >> governor cuomo's greenlight legislation is asking not only the clerks of the state of new york but those who process drivers licenses to violate federal law. we are hopeful this shield those workers and give them protection. rob: cuomo, democrats, people fighting to give them licenses say they are already here, already driving. if we give them licenses and check them out we will be safer on the roads. how do you response? >> that is not true.

they are violating federal law. they are here illegally. the clerks, the workers are asked to conceal and shield and asking us to violate federal law. when i was sworn in as erie county clerk, all the clerks are putting in the untenable position of violating federal law. this is a good first step. we are going to court on october 23rd and asking the court for a tougher injunction. as you stated this will become law on december 14th. jillian: this new bill republicans proposed will protect clerks by allowing them to have attorneys if they don't want an illegal drivers license and protect them from getting fired. do you know any clerks that would help somebody who is saying i don't want to give an illegal immigrant a driver's license? >> i have 180 employees, we are agents of the state and put in the untenable position of do we

violate federal law, under the state constitution? any clerks who does not follow the law can be removed by the governor. we are put in the untenable position of what are we going to do? i thank senator flanigan but our challenge is to the court. this goes into effect the summer 14th but we have people facing criminal liability. this is a serious matter. we have people who are here illegally, violated the law but it is putting the clerks in an untenable position. rob: it rolls out in the summer, you have a few -- how does it roll out? >> it will be messy. we have eight states that filed an amicus brief in the district of columbia. i am an underdog, clerks were underdogs. we are fighting powerful people.

wind gusts pick up here. the main concern, flooding is one concern. the other concern is storm surge. 40 feet away from these historic homes is the water. if we can hopefully you can see, the water is so high, we have high tide a couple hours ago and it is expected, locals have been telling me it is expected to come over and into this neighborhood onto those streets which is why we have a curfew in place and evacuation orders. it is a cat 2. it was a cat 3. it is a cat 3 now and you can't leave anymore. rob: it is a beautiful city. jillian: many historical buildings could get flooded. stay safe. at the coast people in north carolina making last-minute preparations.

rob: todd pyro in wilmington where hurricane dorian could make landfall in a matter of hours in the next 24 hours. >> reporter: we are expecting storm surge. right now the big concern is lightning. we have seen this lightning get closer and closer. i am worried about the 6 am hit for "fox and friends". if this gets closer we will not be standing out in it. that is a concern. until 5:45, if units from now, a tornado warning for the county in which we are standing. expecting that to dissipate. lightning and tornado watch and warning is what we are concerned about. you can see this video from

higher amounts, upwards of a foot of rainfall depending where you live and hurricane force windss coming on shore. severe weather, flash flooding towards the central part of south carolina's coastline and the severe storms. these are weak tornadoes in myrtle beach, west of atlantic beach and oak island northeast avoca island south of wilmington, several storms. you can see i will bring that back to show you a link because it is very dangerous. a lot of lightning strikes with these outer bands. there is the forecast in excess of 70 miles an hour. the closest brush we get to a landfall where the center comes on shore, the lowest pressure point for statistical purposes

will be around this time tomorrow in the north carolina area in the outer banks but that is the whole coast of south carolina and north carolina taking a direct hit from this storm. and storm surge accounts for half the deaths since 1970. >> this area very vulnerable. if this hurricane made landfall as a cat 3 we've not had a category 3 hurricane make landfall in north carolina since 1996. rob: we have been looking at this forever. >> very happy when it is over. rob: other news, refusing to back the badge, gavin newsom of california signing a bill making it legal for citizens to refuse to help police officers when they make an arrest. >> reporter: the billy can i knew concerns over a tense relationship between police and citizens. here to react is brandon tatum.

legislation is not only between the police versus citizens but citizens versus police. when a police officer is making an arrest they cannot trust the citizens on the side that will help them in that situation. the opposite is occurring when you have citizens who see police and are told they cannot help them and it is the right thing to do. this is very dangerous and another example of what these liberal leftists are doing and showing their hatred toward citizens and that is one of the reasons i left the police department and there is no chance of me going back and putting myself in an environment where they take my freedom for doing the right thing. jillian: this loss is every able-bodied person above 18 years of age refusing to aid in arresting any person required by any peace officer is punishable by fine.

some of the people who say this law should have been repealed say this is a really old law passed in 1872 and it doesn't really have anything to do with how police officers work right now because police officers would never ask the public for help in a dangerous situation. what do you say to that? >> it is false. the state of arizona it is on the law books that when a police officer needs your assistance you should assist them. we have seen plenty of videos online. eyesight a video today where police officer got the crap beat out of him by a suspect with a gun. if a person is able to assist and we have seen people do it, struggling to make an arrest it is your duty as a citizen to help not only the police officer but your community. people should do it and in the direction of a police officer that is knowingly, intentionally doing something they know will not get you killed.

bands, 50 or 60 miles, we are getting some gusts. we were able to get our camera out briefly but conditions are very wet, an average of a foot of rain mixed with these gusts in excess of 60 miles an hour and storm surge. we moved to the other side of the apppier, we are getting all sort of debris like palm trees making the situation difficult. the power has been flickering on and off. it is a barrier island outside charleston. mostly you have people who evacuated. we have yet to see another person out here. we've not seen law enforcement at all. we will see how it goes. with the storm surge, on the ocean side, high tide later today around noon, that is the time they really get tested to
