i would say if you forced me to pick two winners and did you, that's what your producers did earlier today. i think biden and warren come out pretty good. the media narrative for a long time and amongst other competitors of biden's have believed for a while that he is going to crater. w that he is going to stumble and that will be the end of his -- that did not happen last night and, in fact, i think he acquitted himself very well. warren, i think she set her several apart from bernie sanders ohio think is a nonentity. doesn't seem to matter. this is the third debate. bernie sanders keeps thaty. base of support but it doesn't improve.at and i think while he shouts, the statistics at you all the time. >> brian: every day. >> elizabeth warren says letet me tell you a story. let me explain why i'm here. i think that's why the two -- biden and warrenry probably come out the best out of the debate. >> brian: the decision by the warren camp not to go after biden and visa versa.

>> interestingly warren and bernie didn't go after each other either. the three frontrunners basically you think they were saying okay we are still going to be in the lead and while others might have had a better debate, i think booker had a fine debate. klobuchar did better than usual. beto o'rourke he had a better debate but i also think he closed off any future elected office for himself with his position on guns. >> brian: we will go into beto o'rourke in a lot of detail in a while. real quick, a push back on biden just a little bit. when he was asked about slavery and his comments he made earlier i'm not goingwh to be held accountable for the sins of my fathers and grandfathers and he ends up talking about schooling and playing records. >> dana: um-huh. >> brian: the difference between iraq and afghanistan? >> dana: i'm not saying he had a great debated. he didn't crater or crumble. i don't believe that his base of support is going ton' go down after last night's debate. i think it will actually go up. >> brian: you mentioned nonentity.y. bernie sanders says the same thing over and over again. >> dana: you heard it all on

2016. he just is not going to get any more support. >> brian: so then we move to what you think are the losers. t she had the best rollout of anyone certainly with the most promise with the most interesting background thehe former attorney general of california now the senator from california kamala harris. you would say she did bad. >> dana: her answers weree bad. her lines didn't land. it seemed inauthentic. what i read today she is having a hard time with big money donors thinking that she can go the distance. and i imagine that they willg probably start thinking, you know, maybe biden is actually going to be the one that we support. i think she is having a lot of trouble. i don't see how she gets back out of it. >> brian: the question is, if she is not going to get back out of it, how does she kiss up to joe biden again sorry about that first debate. >> dana: there was a lot of vice presidential timber last night on the stage. >> brian: if i get the nomination i will eliminate

myself as the number two. what do you think the tactic? >> dana: somebody was eventually going to raise this question of has joe biden lost a step and julian castro decided it was going to be him. the thing is he went after joe biden and the audience felt like it was a low blow. it wasn't even correct. that isn't what biden actually said and it looked mean. and that's not what the democrats seem to want this time around. >> brian: theory? can i share it with you. >> dana: i love a theory, yes.de >> brian: i don't have much time buoy do you think people in the obama camp think biden lost his fast ball and gave him a wink and nod go for it and prove it. >> i think that was one of those things i'm thinking of running for president. you don't have to do that okay. we wish you the best kind of thing. and that they probably realize that there is not a lot they can do to try to help them. i don't think that the obamas will endorse before the convention. t this could go all the way to a contested convention next

planned ahead of time. as for beto's promise briscoe cain tweeted this my ar-is ready for you robert francis closed quote. beto very brave when promising to take away constitutional rights. immediately this is a death threat representative. clearly you shouldn't own an ar-15 and neither should anyone else. game on. o twitter took down kaine's remark a little bit later. beto bragged on cnn. >> you know i think twitter took it down because you have somebody with a weapon of war threatening to use it against somebody who is talking about gun violence in this country. that's exactly why briscoe cain should not have an ar-15. >> brian: really representative briscoe cain joins us now to explain. briscoe, have you had quite a day. are you rethinking your tweet or underlining it?t? >> we got to underline it

for sure, brian. you know robert francis, of course, the one who made the threat. he wants to rob millions of americans of their property. all right. he threatened to tropical depression on my property and the property of others or to kick down our door and take from us. what i wrote really is just another way of saying come and take it. many are familiar with that flag with the cannon calledd the gonzalez flag from 1835 here in texas. when we stood up to a radical federal government who demanded we give up our arms. and, again, all that was was saying come and take it. you mentioned that he made t-shirts and, of course, he is trying to fund raise off of this. he wants to maybe send a remark. actually go to my website briscoe cain.com and pitch in 15 bucks for ar-15 to let beto know he may have been in d.c. a little long. >> brian: of course i'm very familiar with that cannon. mexicans decided to wanted to take it back. mexicans wanted to take it back. they earned it and ended up keeping it. that's what you are referring to.

>> yes, absolutely. >> were you astounded orin were you expecting him to make a statement like that because in texas, the most pro-gun state in the union, perhaps, although very concerned about mass shootings, obviously, were you wondering why a former congressman in that stateng would make that statement or were you expecting it? >> well, he actually made a statement similar to that recently. i tweeted something similar on september 5th. twitter didn't take it down. and it's just amazing. because really he is the one making the threat, flight all we are saying if someone wants to take it from us, they will have to, right, do it and maybe we could say from our cold dead hands. and you do recall the flip flop, right? people keep pointing it out in his failed senate race he was saying no one wants to take your guns. people are trying to say americans are panicking and freaking out.. now here we have a presidential candidate wanting to rob us and steal our rights. disgusting. >> brian: so far it's been -- according to what we use as a criteria four plus

dead in a public setting without any underlying crime. a i asked since 2009, protect day, how many assault rifles, ar-15s or ak 47s were involved in mass shootings there has been 44. and they were involved in 11. so, do you blame the rifle, the handgun, or the shooter? s. >> well, it's of course the shooter. we need to be going the correct way on firearms, right? and protect -- we need to at least reform laws that allow for women, you know, under threat of violence to be able to carry for their own personal protection.r i have to ask the government for a license or jump through hoops. it's safer. i know you know that and your listeners know it as well. of course it's the guy. you know what? it's the driver. remember beto's when he tried to flee from police. we should be taking his license away and not the guns from law-abiding citizen. >> brian: if you are saying if you look at his writings in high school and track record maybe he would be -- fall under the red flag law? >> hey, i'm not going to go

there though. i actually don't like red flag laws. i care more about due process.ik as much as i may not like beto o'rourke his constitutional rights should be protected just like everybody else who doesn't agree with me. >> brian: finally just to underline it, were you threatening him today? >> no, absolutely not. it's come and take it. their threat was against americans. >> brian: okay. lastly, el paso, he says, changed him. odessa, of course, is horrific. how do you process both of those issues. >> those are sad things. and but what beto has done by the way, my family is under police protectionan right now. there is g.p.s. out -- state police force house and death threats that have come against us. i process it? d look, we need to heal, but the way to stop violence is not to take guns and property away from people. >> brian: your family sunday death threats? you have gotten death threats? >> yes, yes. all day long. very disgusting things. and being docked. i was docked. my business partners were doxxed. making threats against my d

children and family think are so tolerant the left, right? >> brian: i get the sarcasm. he says he didn't know your name before this briscoe cain, he knows you now. thank you so much. >> thank you, brian. >> brian: knowledgeable about gun rights or gun laws as anyone i have ever met. dana, he made that statement last night that t-shirt is ready to go. you mentioned -- briscoe just mentioned he had flip flopped i had forgotten that from his senate run. - where is this conversation heading? >> brian, i'm so glad you are talking about this. everybody knows briscoee cain's name now. the t-shirt, i am absolutely amazed that a lawmaker that someone running for the highest office in the land would actually try to raise money off of a threat to the public. and i want to be really clear about this.

when you tell law abiding americans that you are going to forcibly steal their lawfully owned and responsibly usedd property, that is a threat. and saying that no you are not, i want to be able to defend myself in return. that is not a threat. telling someone like beto o'rourke had been doing is a a threat of promised action. and i mean, i want to take everyone back to one of the earliest attempts at mass confiscation of firearms in the united states. and this was wounded knee. so i don't know if that's what democrats and beto o'rourke are trying to move us towards. i sincerely hope not. i hope they respect the law of the land. i hope they respect the constitution. but, i just find this talk reprehensible. i think that the party needs to show where they are with americans and condemn it. >> brian: so i will use the word trigger and, of course, it's appropriate here. it's a trigger for republicans in pro-second amendment which everyone should be if you endorse the bill of rights. they say it's a slippery slope.

when you want to contain, when you want to curtail and dance around the edges, it's the beginning of taking the guns away. when he comes out andd actually says it, what does that do to the debate? h >> yeah, i know. well, exactly, what does that do to debate. the talk that i have been hearing from this particular party is not one of good faith. i mean, these are individuals who are purposefully conflating terms. brian, when they use phrases like weapons of war they are talking about all semiautomatics. let me ask this question and i hope mr. o'rourke can answer. when he is talking about going out and confiscating all ar-15s. what about k wars sks or all the other platforms or specifically the ar-15 platform or specifically the lower 223, 356 caliber but yet is he totally fine with 3006 and 308. if you are going to talk about these issues you need to demonstrate a working knowledge of these issues. otherwise it, would be like me, brian, regulating the nfl. i know nothing about football.e i would say something to the effect of well let's ban all pastel colors on the field because i don't like pastel

did you make a mistake with i those deportations? >> the president did the best thing that was able to be done. >> how about you? >> i'm the vice president of the united states. >> brian: okay.. it was just one of many episodes that made you scratch your head a little bit. i thought it was a long night for the democratic front runner as you know earlier dana perino thoughtg it was really good. let's find out what lisa booth thinks fox news contributor and joins you now. lisa, first off, was this good or bad for joe biden? >> so i think it's -- t remember david axelrod said after the second debate for joe biden basically the goodai news is for joe biden this is the best he can do. the bad news is for joe biden this is the best he can do. i think it's sort of the same. he has not had any stellar standout performances in anyny of these debates. >> brian: right. >> he has kind of glided by. here's the thing he can. p because he is tied to the obama legacy. i think you cannot under estimate how important that obama legacy is for him. that is essentially what is propping up his candidacy and what protects him from

all these gaffes and mistakes he has made. >> brian: he can't have it both ways and say i was just the vice president and when they like something that president obama did and well i was with him every step of the way. and 100 percent right. >> that's what vice president biden is doing, right? he runs an ad in iowa, basically touting, being tied to the obama administration vice president. he ran a pre-debate ad yesterday also doing that with him and obama hugging. and so but then he divorces himself on the deportations thing and this is what castro had to say about that. >> but my problem with viceca president biden and cory pointed this out last time is every time something goodod about barack obama comes up, he says oh, i was there, i was there, i was there.ou that's me,he too. and then every time somebody questions part of the administration that we were both part of he says well, that was the president. i mean, he wants to take credit for obama's work but thought have to answer to any questions. >> and he is right. so when asked about mass

people that could secure the border? >> absolutely not. and, look, brian, this is not -- i'm not a politician. i don't want to be a politician. as you said, i've been in law enforcement for a long time.ou and i have been involved in thisn issue. this immigration issue for a long time. this is not a manufactured crisis. we are not turning people away who have legitimate asylum claims. and if they want to talk about what's going on right now w because of a broken asylum laws, the only people that are benefiting from those loopholes are the cartels. they are a multi-billion-dollar industry. because of our laws and because congress fails to dodo what they need to do to change those laws and protect this country, it's the cartels who are getting rich. they are the ones exploiting this vulnerable population. that's the truth. that's what the american people need to understand.ul >> brian: so people whoo say wow, have you got to have an t open heart. you know, president trump,p, and the people that work for the trump administration, these people are walkingg thousands of miles. they wants a better life.

why be so hard-hearted. what do you tell them? >> so there is two things. first of all, we have a legal system, brian. this country allows more individuals to become citizens and into this country than any other nation in this world. that's a fact. and the other thing, we care about this vulnerable population because we are saying don't mortgage your house. don't give thousands of dollars to cartels and be taken advantage to have make this journey. if you are truly seeking asylum and truly being persecuted what we want you to do is seek relief from the first country you get to. that's what they would should be doing. they shouldn't be taking this dangerous treknt cost multiple countries risking their lives to come to this country. seek asylum and seek it from the first country. >> brian: if certain people get their way they will give free healthcare to illegal immigrants. what will that do for the flood at the border then? >> brian, that's a great

point. and this is what the american people need to know. we always are talking about pull factors and incentives. with each additional element such as that, driver's license, free education, a free healthcare, it only continues to add to the pull factors, add to those incentives to risk their lives, to pate cartels, to make this dangerous trek. we know the majority of individuals are economic migrants. what we want to tell them is do this in the right way. do this in a safe way. when we continue to do this, we're actually incentivizing these individuals to risk their lives. >> brian: you have.zi >> anna: recidivism if you watch any more debates. i'm forbidding you to do it. you were the right person for president obama and you are the right person for president trump. thank you so much mark morgan. >> thanks, brian. >> brian: jorge ramos made it very clear last night how he feels about president trump and politics. why wasn't he a debate moderator? shouldn't he be fair and balanced so to speak? we will discuss it next. ♪

of view we are getting from the guy asking questions. >> i wasn't so much shocked because we have known, brian kilmeade, that this is jorge ramos. this is who he is. he is not a journalist. he is an activist. is he a partisan. here's what he had to say in 2016 before the presidential a election. he said donald trump is thee most divisive, polarizing, and disrupting figure in american politics in decades and neutrality is not an option for journalists when covering him. so if you are abc news and you see and hear the things that jorge ramos has said in the past and then you say you know what? let's make him a moderator just like msnbc put rachelt maddow in the moderator seat. just like cnn put don lemon in the moderator seat. this is why the american public isn't learning too much from these debates because they are being asked questions that are really speeches being given by activists and partisansed and we are not getting to the core issues. even ramos last night asked senator warren should american foreign policy be

based around the principle of climate change? this isn't journalism this is a joke, brian. >> brian: it is. a couple other things, joe. i'm very curious when rahm emanuel opens up on the sunday show this week with george stephanopoulos and says what are democrats doing insulting president obama and decriminalizing people crossing the border and offering free healthcare he says that's not what democrats believe. it just so happens that abc never asked any of those questions. never said do you believe that decriminal saling's of the border? do you believe that all immigrants illegal should get healthcare answered yes and went right back to insulting the previous president. buff they avoided all of that. >> it's amazing the questions that weren't asked last night, brian. you look at any poll, whether it be from reuters and up sews. whether it be from gallup. when you ask the american voters what issue is most important to you when going into a presidential electionhet we didn't get companies it's the economy stupid for nothing back in 1992. it's the same election cycle every time.

what happened? >> appearing before a judge huffman was nervous and tearful, brian. apologizing to the students, parents and colleges impacted by her actions saying she was deeplynt ashamed and did more damage than she ever imagined. w huffman attributed her actions in part to the bewilderment of being a mother. the prosecutor shot right back saying motherhood does not make you a cheat and a felon. a the judge agreed that trying to be a good mom was no excuse saying the college system is already distorted by money and privilege and, yet, for huffman that doesn't enough. she took one more advantage for her child. judge also noted that huffman admitted responsibility. has apparently regained her moral compass. she will now serve two weeks in federal prison. pay a $30,000 fine. and perform 250 hours of community service. the jump noted without this sentence the community around hutchman would ask why she got awith it. the actress is hoping to serve her time at alll
