riding into my studio to talk about it. all that coming up but first my opening statement. for the longest time many of us were convinced there was a two-tier ji justice where how we and not what you did was a deciding factor on whether you were made to account for your actions. as i crisscrossed this country there was one overriding question. when will someone be charged with a crime for the actions we have watched play out in washington, d.c. at the highest echelons of power. i will try to reassure them. but more often myself, that justice will be coming and i had not wasted 30 years fighting for that equal justice to tomorrow find out in the end that the system was rigged.

so now news that the first to fall will be jim comey's deputy director of the fbi and then acting director of the fbi for lying to both the inspector general's investigators as well as the fbi investigators, not once, not twice, but three times under oath. he lied to make himself look better. but he was even given the opportunity to recant his statements. something three-star general michael flynn was not. andrew mccabe knew full well he was the target of the inspector general and the fbi. thus he was on his guard. something michael flynn was not. >> something i probably wouldn't have done or probably not gone the away with in a more organized investigation -- more organized a-mile-an-hour straition, the george w. bush pore obama administration.

in both those administration there was process. if the fbi wanted to send agents into the white house itself to interview a senior official you would work through the white house counsel and there would be discussions and approvals. and i thought it's early enough, let's just send a couple guys over. judge jeanine: cardinal comey, you are so proud of yourself. are you proud that you violated white house protocol as well as flynn's constitutional rights, telling him he didn't need a lawyer? flynn, a man who spent 30 years defending this country. even though fbi agents themselves didn't think flynn was intentionally misstating the facts. i long said that bill barr is a serious guy. he's a no nonsense straight shooter who could give a dam about what people say or think about him. he's not looking to be famous for his next advancement.

he's good with who he is. now the department of justice has refused andrew mccabe's pleas to not be indicted. the grand jury of hearing evidence against him is being recalled after an extremely long day. so what happened during that delay. calendar-wise christopher steele, so central to this coup spoke to the fbi it appears more witnesses are now willing to talk. and just as i redictd in my book, the rats are jumping ship. who will rat on whom? who will points the finger and when? mccanes giement will be the first of many in the attempted overthrow of the president and you will remember it was andrew mccabe who began the counter intelligence investigation against our president regarding that old fake russia collusion. an investigation of someone at

the fbi is the kind of thing we don't hear about very often because that agency is one that is ground in its motto of fidelity, bravery and integrity. and it took someone like james comey, andrew mccabe and their cabal that bill barr noted unusually handled an investigation at the upper echelon that would normally be handled in field offices to make it clear that he thought something was wrong. for those of you who say what mccabe did was not such a big deal, i would ask, how many times did andrew mccabe recommend prosecution in its official capacity not being swayed by the it's not a big deal argument? you know, lady justice is blindfolded for a reason. the symbolism is clear. the law and its consequences must be delivered equally

without fear or favor. lady justice doesn't care about party affiliation, color or gender. she scares about corruption. she scares about law and order. when people at the highest level of government choose to change the rules, violate the law, leak information, unmask ininnocents and seek warrant based on unverified political opposition papers, lady justice will see through her blind folds. because america cannot afford to forget crimes that are a blueprint to frame a president of the united states. those who use power as a weapon because they hate the outsider president need to feel the justice that they tried to impose upon an innocent man for their own selfish purposes. the comey crew and the upper echelon of the fbi worked to prevent donald trump from

appears mccabe is going to be charged with, that the department of justice has refused to give him a pass on. are there other charges you think he will be facing in this particular indictment? >> well, i mean, who knows. we'll have to wait and see. what i do know is your opening statement was right on target. we know andy mccabe lied. our entire justice system is built on people under oath telling the truth. andy mccabe didn't do that. we know he lied three times. we found out he lied because of whom in the inspector general, michael home winds. the guy who was respected in this town. he heads up the inspector general's association. i am looking forward to the inspector general's next report to give a full understanding of what took place when they tried to go after the president of the united states. i want to talk about mccabe. ways amazing about mccabe, he and comey had a plan to take advantage of the chaos in the

trump white house to make sure that he didn't need -- tell him he didn't need a lawyer. not to warn him he could be charged for lying. he lied three times under oath. and the amazing part is this guy gets the opportunities to take it back where michael flynn, they said, no way we are going to give him his rights. they agreed to that ahead of hide. in addition to the clear lie, that he's going to be charged with. it appears that there are more things that might be coming from durham. durham is investigating in connecticut. and the way it's done is durham would keep his indictments if he has any under steel until all the indictments are ready. this is just to me -- this suggests to me durham may be done with mccabe if they are going to out mccanes indictment. but they haven't. so it may be sealed. do you have any idea what's

going on? >> i don't. when you reference what jim comey says about how they tried to trap michael flynn. think about this. just one month prior to that. just a few peeks prior to that they tried to do the same thing to the president of the united states. mr. horowitz points it out in his most of recent report. they go up to the trump tower meeting and james comey tries to trap the president while's telling the president he's not under investigation. jim comey, the guy who allowed the dossier to be used to get a warrant to spy on the trump campaign. jim comey who leaked memos to get the special counsel tried to trap michael flynn and the president of the united states while telling the president, you are not under investigation. these guys are problems and it's great to see what they heard from the justice department. judge jeanine: the other thing

is the fracture created because of comey and mccabe. >> you are exactly right. but for comey leaking this nonsense to his buddy richmond to give to the "new york times," a special counsel wouldn't have been appointed and we wouldn't have gone through the hell we went through. >> the first memo he wrote was immediate lid after that trump tower meeting when it's president-elect trump. on a secure laptop starts typing out what he and the president were talking about. they were trying to set up the president-elect of the united states while they were telling him he wasn't under investigation. this is the scary part. when they wrote the letter to the attorney general, if they can do it to a president, imagine what they can do to you and i. when you talk about blind justice and equal treatment, you are right. that's what's at stake here.

judge jeanine: that shows the clear intent, the intent james comey don't seem to understand. they know the rules. they knew weren't supposed to lie. they didn't want to protect a three-star general or give him his rights. i don't want them protect anyone. but you give them their constitutional rights. last night the i.g. sent a letter to house and senate judiciary saying my report is done. this is i call it the big a hundreda. this is the big one. this one, barr let comey liking, this is where combative gets the inspector general to say comey you swore to a judge and you chief frauded the fisa court. you were the head of this cabal that was to bring down a president. what do you think it's going to say? >> we'll have to wait and see. a couple things i hope happens.

i hope chairman cummings and chairman nadler at least allow us to have a hearing on the findings. i hope we have a hearing. spec we'll just have to wait and see. i know this. bill barr, the attorney general, he's look at what needs to be classified and what doesn't. bill barr starts from the right premise. remember what he said to the senate finance committee. he said there was a failure of leadership at the upper echelon of the fbi. then he used two terms that should scare us to death. he talked about political surveillance and unauthorized surveillance. so he starts from the right premise and we look forward to that investigation and that report at some point in the future as well. judge jeanine: i have to thank you, congressman jordan. if not for you and the freedom caucus we might not have known about this ourselves.

joining me with more reaction on all of this, host of the dan bongino show. dan bongino. i will let you have your two cents on mccabe before i go into what they are doing with impeachment. talk to me. >> mccabe is in a world of trouble. he brought up a great point. you are not going to be able to rely on a jury saying let's let mccabe go. i don't want to impugn a jury mccabe's leaks are direct at hillary clinton he's in a world of trouble if these allegations turn out to be true. he's not endearing himself to a jury by having called his supervisors in new york and washington, d.c. knowing he was the source of the leak and blaming them for it. it makes him look like a bad character person.
