hunter biden had been cleared by investigators of any wrongdoing and the president -- vice president calls it a spear by the trump campaign. >> the trump campaign wants this issue to be talked about in the news, even though all of the accusations have been debunked or -- there hasn't been any evidence found to be behind them but the president is great at finding weaknesses or promoting weaknesses of his opponents and hammering over and over again, at the same time this is something that raises an issue of the president's conduct once again of him using office for own political gain that could certainly cut against the president and the biden camp is pushing back very aggressive and more aggressively than we saw hillary clinton push back in 2016 when her e-mail scandal became something that hung over her campaign for pretty much the entirety of the race. eric: we are looking at the former vice president speaking live in iowa out in the campaign, you're right, maybe they are taking a page from what

hillary went through and at the same time you mentioned the president man oman, the democrats are going after him in the phone call with the ukrainian president acting him as the vice president said abusing power to try to get the ukrainian president to interfere politically by investigating biden's season, of course, the president said what he talked about was totally appropriate. do you think this could boomerang on the president? >> it could. democrats have made the case that he has abused his power, he has abused it for his own political gain, his own financial gain, and members to have military, vice president stay at his golf resorts, the one thing where i'm not sure whether it will affect the president is that i think that there are a lot of people who dislike the president's behavior and they've decided on this and so i don't know how much additional incidents -- how many people are left to sway when it comes to the president's behavior, a lot of people have decided whether they like him or don't like him and i'm not sure

one more controversy, how many views that changes. eric: as we said earlier senator cory booker sent out tweet, he's been raising money, at some point the democratic field has to windle down, here is the tweet from the senator, this isn't end of quarter stunt, under the hood of campaign of level of transparency unprecedented and presidential politics, they need money, if they don't get more pun like 9 days they say they are running out. look, in new jersey, look, the incumbent senator from new york, joe biden way ahead of elizabeth warren and bernie sanders and incumbent senators want to hit 9%, maybe they want him to stay as senator, do you think he's a real scare, he says it's not a stunt, do you think he could be one of the next to drop out, if the money isn't coming you can't keep up campaign?

new york state assistant attorney general and former senior investigative council for the house oversight and reform committee and former u.s. attorney in georgia and partner in a law firm. let's talk about the law, guys. let's go down the line here and michael, i will start with you. is it legal for the doj or the white house to block the whistle-blower's information from getting to congress? >> i think that's going to be a tough road for them to go down. you've got to realize that apparently there was some determination made that there was some urgency with the report, and that means that it needs to be shared with congress. and so we'll see if in fact that information is put out. this administration has used to their full advantage claims of executive privilege. last week we had testimony about conversations with a candidate that was cast in terms of executive privilege. that's what they are trying to do here. they have done that to some success in all candor because

perhaps we hadn't had the will to call their hand on it. so they should be turning over the information. this is something that the house does have overnight in, and they need to look deeper into the allegations of the whistle-blower complaint. arthel: chris, if the president of the united states is not directly involved or implicated, is the info provided by the whistle-blower protected under executive privilege or does the law prevent the release of a transcript of a conversation that the president says was totally appropriate? >> well the transcript part of your question is a good one, and that depends really -- the president of the united states is the ultimate classification, the person who determines classification. obviously he's the person who is allegedly involved. i actually think and i agree with michael in terms of this is not an entirely clear area, but i think the way around this and i heard congressman schiff, congressman schiff, the intelligence committee, or the oversight committee, could issue a subpoena for the individual who allegedly made this complaint, not even necessarily

and this is an important distinction, i have seen it discussed i have heard it discussed about the report itself, what does this person actually allege? one way you can also get that information is subpoena the person who supposedly made this complaint and talk to them about it. the house intelligence committee could subpoena the individual and possibly get at the information that way as well. arthel: would his id be revealed at that point, and really thus far, subpoenas, congressional subpoenas haven't really produced anything, chris? >> you're absolutely right, arthel. congressional subpoenas to the administration, they've fought them. but this would be a subpoena to this individual who allegedly made the complaint, so he would be the recipient of the subpoena, and in some ways it could be considered a friendly subpoena, where they would subpoena him, and he would cooperate. so in terms of the identity of the whistle-blower, congress can't guarantee that they could protect that person's identity, no, but ultimately i don't think anybody could in the long run. arthel: michael, so the ig,

michael at kinson is appointed by president trump, he met with the house intel committee on thursday, and the inspector general told lawmakers that the complaint was based on, quote, a series of events, but he declined to provide the substance of the complaint or whether it involved the president. so does this follow the law? >> i think that's going to be a question of how hard the intelligence community wants to push the envelope here. we're in unchartered watters. think about how incredible it is we can repeat this to ourselves that is the president of the united states has asked a foreign power to investigate a political enemy. if you just say it out loud, it sounds absolutely ridiculous so i think you have to recognize that the congress is in the same position. we haven't had a situation where we have had to come out and look and basically look at an executive who has used the law as a shield, as opposed to a guide, on how to act while in office. and so these are new times for

them, but i do think at some point, they will be able to move forward. chris has a great idea, subpoena the whistle-blower. i represent these people. they're patriots; right? i represent whistle-blowers all the time, these are patriots who want to go forward and talk about fraud, talk about endangering, the national security issues, obviously this person is concerned about the well being of our nation. arthel: is it okay going after as michael is calling it a whistle-blower? >> setting aside the law, the right or wrong of it, nobody should go after a whistle-blower. to answer your question arthel specifically i'm sure it would be prohibited and it could come under a number of different laws. a lawmaker cannot attack a whistle-blower simply for blowing the whistle. that's the whole purpose of the whistle-blower laws in the federal government.

arthel: i want to share now some information i got from our research department, our brain room. here is one coming from fact check.org. it says quote however there is no evidence that hunter biden was under investigation or that his father pressured ukraine on his behalf, end quote. and from another, quote, we found no evidence to support the idea that joe biden advocated with his son's interest in mind, as the message suggests. it is not even clear that the company was actively under investigation or that a change in prosecution -- or prosecutors benefitted it. so michael, has joe biden broken the law? >> i don't hear anything in there that makes me think he's broken the law. i think this is classic spin by the administration here. so this idea that somehow they need to go back and look at biden strikes me as a red herring. i didn't hear anything that you said that -- as a matter of

for a change. see you in the flesh and blood. eric: absolutely. you were here for the u.n. events this week >> yes. eric: what do you make of the fact that we're sending more troops to saudi arabia? >> i think it is a perfectly appropriate response, the sort of typical thing you would do in a foreign policy tool box is send some troops. why? i mean, it is hundreds, not thousands of troops, and so one purpose is to reassure our allies, saudi arabia, to send the message that we have their back. maybe to work on their air defense system, which it looks like it needs some improvement. eric: what happened to that? if these were cruise missiles, wouldn't they have -- what would they have to protect them from that and why didn't it not work? >> those are the big questions. you will notice still now, whatever, a week, i lose count, we're still some days after this has happened. we still don't have a full inventory and accounting. it started off as it was ten drones. and then it's drones and cruise missiles. if it is cruise missiles, that

does implicate iran much more directly. i really hadn't heard anything suggested that the houthis had cruise missiles. i thought they only had drones. we haven't had a full accounting and the pentagon has yet to come out where they will detail what happened. still a lot of things unclear. eric: do you think it is really unclear? look, they almost know everything. they've tracked the flight path from iran, but they are not showing us that evidence or wherever it came from. >> yeah. i think it's still murky. i mean, i'm following it pretty closely. and people have been reluctant to say it came from iranian territory. could it come from iraq? could it come from iranian supporters in saudi arabia? if you look at the photos that were revealed some seemed to be short range missiles or rockets. i think there's still some questions. until they put out the evidence, it is hard to speculate.

eric: it could be a saudi issue. >> they have had domestic issues with the shiite population for decades, yeah. eric: sending a few hundred troops we think as well as defensive equipment against missiles and this sort of thing. here's what joseph dunford chairman of the joint chiefs of staff said about all this. >> the saudis asked for enhanced defensive capabilities. we will take the president's decision. i will talk over the weekend. we will talk with our saudi partners and we will work the details of deployment and be able to share that with you next week. not thousands? -- >> not thousands? >> that's fair to say, not thousands. eric: here's what was also said. >> why would this be an effort to deter iran from further attacks >> we have to continually assess that. we think for now that would be sufficient. it doesn't mean there could be additional deployments as needed based on the changing situation. eric: talking about a few hundred, as you said, is that enough, or is it just enough that we are sending them as a message? >> whether it's enough or too

little depends on what your objective is. i think the objective here is again reassure the saudis and also partially deter iranians or others who might strike again. they're not going to intentionally strike where there are u.s. troops stationed because that would really raise the level of conflict that might tumble into something bad. so both reassurance and deterrence, but probably only on the spots where there aren't u.s. troops. there could be other facilities or other things in the region that if the conflict intensified, they might still strike out at, but they are not going to strike americans on purpose. eric: for now do you think it's been quelled? >> i do. when you look at -- yes, the iranians are saying we will destroy you if we attack us, but the key word in that is if we are attacked. the president doesn't seem -- he talked about restraint today. i don't really get the feeling that either side, the u.s. or iran is anxious to have a shooting war right now. eric: quickly this week at the u.n., the president will likely

exclusive interview with our ed henry. according to the washington post, the administration may be planning to divert more funds from the pentagon to pay for the wall's construction. let's bring in a congressional reporter if politico. -- for politico. what can you tell us? >> the administration is planning to divert more pentagon funds towards the wall which is a top priority for the president ahead of 2020. the administration has already tapped some of these funds a few weeks ago, something that has caused some anger on capitol hill among democrats, and they are looking to fight this, when the up coming spending bill comes up on capitol hill. so, you know, we're not sure exactly whether the administration is going to push forward through this. the washington post has reported this first they want to ask congress to fill the money, the and they want to ask congress to fund the department of homeland security and fund the wall, and if democrats don't give them that, then they will tap funds

once again from the pentagon. arthel: so the moneys that we're talking about right now, these additional moneys, is this in addition to the 3.6 billion already pulled from military projects to pay for the wall? >> that's exactly right. so this would be in addition to those funds that were already taken from elsewhere in the budget. essentially they would be doing that again. i think that shows that the administration is not worried about the potential backlash to tapping these funds from the pentagon. of course the pentagon has said that there could be dire consequences if these projects aren't funded, if there is schools that need repairs. there's housing for the troops, but they could ask congress to sort of backfill it in the up coming spending bills to sort of make up for those losses that the funds are being moved around for the wall. arthel: but you already know and i'm sure the president knows that that's a fight waiting to happen. so -- >> uh-huh. arthel: how is that going to play out? is it to show -- for the president to show he keeps fighting for that wall that he promised his supporters when he

campaigned for his run for the white house? >> you are right. democrats have already signalled in the up coming spending fight which will now be pushed back to november, they are not going to give a single dollar for trump's wall. they are not going to be inclined to sort of bail him out by backfilling these pentagon projects and they will fight for other things like less detention beds for i.c.e. and also be fighting for more standards of care for migrants at the border. we are barrelling towards a showdown in the fall over the wall. as you said, the president wants to show that he is fighting for the wall. he wants to show his base he's doing everything in his power. congress has refused to fund his wall. he is under a lot of pressure to get it done and he's had to bypass lawmakers in any way he can to get progress done here. >> time is on the president's side. if he stone walls, if you will, however he's able to do that work a fight from congress -- fight with congress, i should say, that's going to start in

the fall. by the time we know, it is thanksgiving and christmas and nothing happens. then you know we're into 2020 and the beat goes on. >> yeah, you're exactly right. these things tend to drag out on capitol hill. they tend to kick the can down the road. already the next time is september 30th. they are going to do a stop gap spending bill which keeps the current levels kick that down to november before thanksgiving, you could easily see this again being kicked to christmas and potentially even into 2020. arthel: one final question because of course the supporters back president trump, his staunch supporters. do they realize that they're paying for the wall and the u.s. military is paying for the wall and not mexico? >> the president campaigned on building a wall and having mexico pay for it. now the president is saying it's going to come from taxpayers' dollars and it is going to come from the pentagon. that could be a problem at least in some of these districts that

roberts, her two children and six grandchildren. eric: she will be missed. wal-mart announcing it will stop selling e-cigarettes as the number of deaths linked to vaping grows. the fda is launching a criminal investigation into what's making people sick across the country. mark meredith has more from washington. >> the centers for disease control and prevention says the number of people getting sick from vaping is on the rise, this as officials in missouri announced a new death believed to be tied to vaping. the fda says it's also launched a criminal probe into the matter. the missouri case brings the total number of vaping-related deaths nationwide to eight. the cdc says they have 530 confirmed and probable cases of lung injuries and this is impacting at least 38 states and one u.s. territory. health officials say so far there is no one single e-cigarette vaping product or brand that has been tied to this health emergency. the cdc calls it a complex
