allegedly said, the allegations in that report. the issue, the people, whoever they were who were present, why didn't they come forward? the fact is they haven't. i am an attorney, former united states attorney, federal prosecutor. you judge the witness by his or her credibility and what the person knew firsthand. we know this whistleblower had no firsthand knowledge of what allegedly took place. todd: this reminds me of a felony -- fellow attorney of a summary judgment, everyone agrees on the main facts but how the fact apply to what in this case isn't law, it is more political law if you will. everybody on the democratic side is saying this is impeachment. everybody on the republican side is saying it is not. how is there such divergence among these individuals, these

groups? >> i think you have to pull way back and fly over 30,000 feet and ask yourself, the allegations, do they rise to high crimes and misdemeanors? that is in your judgment but the fact of the matter is again you talk about summary judgment, you think about the allegations, who made the allegation? what the witnesses actually know of their own volition, their own authority in this whistleblower knew nothing because that person wasn't in the room and wasn't privy. obviously going back to our legal glossary, is hearsay. todd: understood. this is not going away anytime soon.

directly about the phone call the president made to the ukrainian president saying in no uncertain terms he might withhold aid unless the ukrainian president could offer some assistance in the investigation -- todd: what exactly is the high crime and misdemeanor committed by the president? >> we don't know -- let me phrase it this way. we don't know what has been committed but if i'm arguing articles of impeachment have already been set forth, what we would be talking about is a crime of bribery or extortion. anytime you offer something in exchange for the other party to do something as in this case you hold up $400 million worth of aid to the ukrainian people in order for the ukrainian president to investigate that would be a case of extortion if presented. >> a response? >> as was noted we don't know

what happened. we know what the allegation is but impeachment is not a legal process in the traditional sense. there is not a legal standard the prosecution has to meet. high crimes and misdemeanors in this context is whatever the house of representatives says they believe it is and intentionally designed as a political process so those who voted on it would be held accountable by the voters. they can impeach someone because they don't like the color of his tie. the real issue is one of politics. there is no legal standard either to convict or for someone to object to that appeal. the underlying issue people are talking about is the nature of the telephone call between the president and a foreign leader, a number of issues, generally speaking those would be considered among the most privileged conversations. we will see how that plays out

but a long way between here and there. rob: the closing arguments? >> there is a long way to go. nothing is ever quick. what i will say, not just a phone call we are looking at. we are looking at events with rudy giuliani and once those pieces are put together with that phone call what we will find out in the american people here there is a case that has been made for high crimes and misdemeanors, extortion and bribery. >> conversation took place between the two world leaders and the president appropriately raised the issue of corruption in that context. it is not an impeachable offense. todd: we are nowhere near close to figure it out and i'm glad i'm not a judge. thank you for being here.
