president and violating oath of office and constitution, your reaction. >> nancy pelosi and her squad made up their mind in november of 2016 that they wanted to take our president down, that they wanted to ensure that they null and voided 62 million american votes, this isn't impeachment inquiry, they've already made up their mind, what they want to do, they've been acting on the last 3 years and americans are paying the price, are we reducing the cost of health care r we empowering the american future r we empowering this economy moving forward, no, washington is no more than a political theater today because of what nancy pelosi did on tuesday. eric: are you bothered by what the president did in the call, clearly inferring although it doesn't mention exactly the -- the 391 million that was held up a month before that, are you bothered at all that that apparently was what the president was saying in that call to get them to investigate joe biden?

>> look, our president in his campaign said i intend to drain the swamp. i hear from hoosiers in the state of indiana, that's what they want to see done and when the president asked the president of ukraine to investigate, he's doing so this he can drain the swamp on the careered politicians and political theater that's exactly what's going on, it's not serving the american people, it's not empowering the american people, it's not helping americans live better lives, it's just furthering the careers of career politicians in this political theater and so, no, i believe the president is draining the swamp in washington and ensuring that that gets done with efficacy. eric: affidavit from the prosecutor who was fired, in front of the council of foreign relations proudly boasted that they held up a billion dollar plus for ukraine and this is what this affidavit, the prosecutor was fired, his name

stonewalling the investigation could result in articles of impeachment, the president's attorney rudy giuliani saying he might testify before congress if the president directs him to do so. >> would you cooperate with the house intelligence committee? >> i wouldn't cooperate with adam schiff, i think adam schiff should be removed, remove adam schiff, put a neutral person. >> that's the answer, you're not going to cooperate. >> i didn't say that, i will consider it. >> you said you wouldn't do it, you would not cooperate with adam schiff. >> i will consider it, i have to be guided by my client, frankly, i'm a lawyer, it's his privilege and not mine. arthel: let's bring in john decker, attorney and fox news radio white house correspondent, john, does mr. giuliani have a choice to cooperate if he is subpoenaed? >> well, if he's subpoenaed as an officer of the court he will show up, he will show up before whatever committee in the house of representatives subpoenas him whether it's intelligence committee or the judiciary committee, the question is the answers that he gives, the

questions that are posed of him, mr. giuliani could potentially on questions asked of him cite attorney-client privilege, he's the personal lawyer of president trump and the white house can invoke executive privilege in same way it invoked the executive privilege for corey lewandowski when he was called to intelligence committee. arthel: does it appear that they seem to be distancing from president trump's personal attorney and ukraine scandal? >> what it appears to me that certain members are saying of the administration are saying that they did not authorize the trip that rudy giuliani, the president's personal lawyer made to madrid on behalf of the president, the president, of course, is personal client of rudy giuliani, the state department senior members to have state department saying that, of course, rudy giuliani

citing a cell phone text message that he received from the u.s. special representative to ukraine putting him in touch with an individual who was top aide to president zelenski. arthel: of course, attorney general william barr is reportedly not happy that he is being cited by mr. giuliani as having cooperated with this in any way. >> that's true, as soon as this transcript of this call was released, there was a statement put out by the justice department denying that attorney general william barr in any way reached out to ukraine, spoke to ukrainian authorities about anything that the president mentioned in that phone call conversation, if you call that, you might be right, i consider clarification in terms of what was said on that call the president had with president zelenski and correcting the

record of what the attorney general's involvement was in the aftermath of the phone call. arthel: let's get back to impeachment inquiry, could lack of information drive to articles of impeachment and should it come to that should it come to that, speaker nancy pelosi have complete support from other house democrats? >> well, she does, i mean, you see the numbers and the numbers picked up last week with the release not only of the -- the phone calls, transcript, as well as whistleblower complaint, you have the number of members to have house of representatives who are democrats urging an impeachment inquiry well above 218, so, yes, i mean, unanimity right now in the democratic party, as far as another article of impeachment if there's not cooperation from the white house, there's always possibility of obstruction of justice being one article of impeachment that the democrats could add to the mix as they go through the process of

impeachment inquiry, arthel. arthel: i want to get to that in a second, you say that speaker pelosi will have complete support from the house democrats, are there any republicans who secretly side with democrats and their impeachment inquiry, and if so what would drive them to be open about their position? >> i haven't seen a break among republicans right now, arthel, we heard from congressman holli hollinsworth, he speaks for the vast majority of the republicans, 100% behind the president, they see nothing illegal in the transcript of the phone call that was released last week, nothing that rises to the level of illegal behavior that would require an article of impeachment being brought against the president. arthel: so let's get back to concerns that the white house and the trump administration might try to stonewall and not comply with the subpoena power behind impeachment inquiry, if president trump's team does not

fully cooperate, i mean, could that backfire on the president, would that be obstruction of justice? >> well, what we've seen just in the past week is full cooperation, the president released that transcript of the phone call that he had with president zelenski in july, released whistleblower complaint as well that came out in august and so you can certainly argue that's pretty transparent on the part of the president, so i think it's jumping the gun to say that there will be a lack of cooperation, thus far in a week or so. arthel: it's a hypothetical question. >> right, hypothetically, you know, anything the possible. i like to as an attorney to speak on the facts as we know them. as we know them right now, we see complete cooperation on the part of the white house as it relates to the inquiry. arthel: yeah, well, you're using your attorney skills there as white house correspondent, and you also covered the impeachment of president clinton, so you

colonel, author of rally point, there you see his new book right there, mr. gibson, could this backfire on the iranians? do you think that the europeans finally will start to get tougher after they saw this ratcheting up, escalation of type of attacks blamed on iran? r well, i think it's actually encouraging we are hearing from europe, they are key piece of this as you reported last year, rouhani is saying he doesn't want to sit down directly with president but working with europe and where we are right now, maximum pressure is working, that's why we are seeing this behavior from iran, but it's not sustainable, time is of the essence, this is meant to get them into a corner, something they said they are willing to do and we want to be clear on what we want, no nukes, no terrorism. with regard to nukes we want them to renounce a nuclear weapon program and with regard to verification, we want to go

anywhere any time to ensure compliance. and with regard to terrorism, we don't want to continue export violence, hezbollah, the houthis, we want them to stop that, we want verification of that and if they do those two points, well, not lift some of the sanctions, all of the sanctions and welcome them to community of nations and we worked before and we can actually pivot to the challenge which is china, europe can play a key role in this. >> yeah, you know this is in the in their nature, it's bureaucratic dictatorship and you heard the saudi minister say, civilized nation state that abides by the rule of international order. they will never give up nuclear quest in my view and i don't think they will ever give up terrorism because that's the whole point of spreading revolutionary philosophy across the globe. >> here is the reality of it, eric, maximum pressure is backing them into a corner, we

will see one of two things happen, one of three, we are either going to see them agree to a new deal, that's why leadership is key in stipulating what we want in the new deal or that regime is going to fall as you reported last hour, they're under enormous pressure and the possibility of that regime falling is real. the third possibility concerns i would hope everyone and that's before they fall, if they're not going to agree, then we could end up in war, that's something president trump doesn't want, rouhani doesn't want, both parties want to work on a new deal, this is why leadership and diplomacy is key to where we are at this moment. eric: is it because president trump's tough sanction policies and iran freezes them out that will cripple economy and could that cause regime to finally fall as we have seen other, you know, dictatorships like the soviet union and others in

history? >> i think it's a possibility, as you reported last year, the fact that europe skirted those sanctions, billions of dollars with trade is concerning, i certainly want to see us close the loopholes, what europe said this past week towards is encouraging, but that should be the real focus for our diplomacy with europe right now, two fold, closing the loopholes and getting europe particular macron to sit down with rouhani, not only is what president and the administration offering fair terms, it's actually in their interest because if they don't do it, there's a real possibility that that regime is going to fall. >> there was a call for the regime to fall down with the regime protests at the united nations, the largest antiregime group, the opposition group national council of resistance of iran, they held a rally, we have video, we covered the rally outside of united nations, you can see there were protesting and calling for the regime to call, here is the leader to have group not only should the regime
