republicans have been denied due process. this senate republicans say house democrats are hiding behind speaker pelosi. >> it's imperative that democrats vote to open up articles of impeachment inquiries and not just talk about it. don't hide behind nancy pelosi prince very important that the house vote on whether or not we should go forward on impeachment. that's a democratic way of doing business. arthel: meanwhile democratic foreign affairs chairman eliot engel questioned the need for his party to go on record with an increased love. >> the republicans are not being quiet. they are not acting out. they are just rallying around the president. it's absolutely disgraceful so now he keeps throwing things into the next day. the democrats should do this and the democrats should do that. but we should all do is make sure the integrity of our elections are fair. arthel: we have fox team

coverage with molly hibberd standing by in our washington bureau that we begin with kevin corke who is live at the white house with the very latest. >> arthel plenty of back-and-forth about how we ended up in this particular circumstance. this is a theory you've probably heard about that the energy secretary for a phonecall with the president of ukraine. white house officials say that's not uncommon. officials say and let me share part of a segment you'll find constructive. lays out this idea that it's not about the fact that the president is blaming rick perry or somehow suggesting the call was untoward. you heard the president say on numerous occasions that there was nothing wrong with the call. here's the statement i was telling about from the d.o.e. press secretary. secretary perry supported and encouraged the president to speak to the new president of ukraine to discuss matters related to their energy security and economic development. as we all know by now that

conversation went in many other directions as well. that call is now as you know the center of the building march questions about the content of the call. it could have been put to rest with this transcript but it's not only not the case but exploded into numerous allegations from democrats and whistleblowers that maybe suggesting him teachable offenses. speaking of the so-called whistleblowers there's more than one. fox "fox news" has confirmed in the attorney representing them is tweeting this afternoon, let me share part of the tweet from andrew precollege. i see whistleblower update and i can confirm that my firm and my team represent multiple, whistleblowers in terms of the underlying august 12, 2019 disclosure to the icy ig. no further comment at this time. what do we make of the role of the bidens and all of us? frankly their role in the story is inescapable. was a corruption? was a pay-for play or just there

whistleblower has come forward or is about to come forward i believe again with t. someone who sees wrongdoing and here's wrongdoing and wants to do something about it. >> representative deming says the first whistleblower has laid out a quote abuse of power that is quote so detailed and appropriately laid out. republicans are not impressed. the possibility that someone else may have listened to the president's july 25 phonecall with the president of ukraine according to one gop member of the house intelligence committee quote doesn't matter. >> this person is going to come forward and say the president had this phonecall and yep that's the transcript. why should i care at all what his opinion or judgment of this transcript is? you and i can read it. congressman stewart says lawmakers have known for a little while this individual's probably going to come forward. he says democrats are quote giddy over the possibility of

impeaching the president but he says it's quote terribly divisive for the american people. eric: molly thanks so much. arthel: the supreme court kicks off a new term tomorrow but several justices gearing up for the big day attending the annual -- there's a lot on the agenda including cases involving gun rights and abortion regulation. garrett tenney is following it from washington. reporter: right now they are almost four dozen cases on the supreme court's docket for this term and it's filled with hot-button issues. one of the most closely watched cases is with daca. the high court will decide whether the trump administration is able to move ahead with his plans to end the obama air protections for nearly 800,000 people who are brought to the country illegally as children pay that case is one of several dealing with immigration and executive power and despite a string of set backs from the lower courts ruling against the administration publicly the white house believes the high court will rule in its favor.

>> they are playing the long game. i think they are those in the white house and the justice department admitted the justice department made a calculation say we can absorb all these losses and lower court because we are going to end the endgame. another hot-button issue will be abortion regulation with the challenge to controversial abortion law in louisiana which requires doctors performing abortions have admitting privileges in a nearby hospital and civil rights protections for lgbtq workers and whether employers can be sued for job discrimination. these are expected to come down in june in the thick of the presidential campaign and like the last election the high court is expected to be a major issue in 2020. >> is a huge issue in 2016. helped get president trump elected. voters said they want to be able to pick the next justice. it will be again precisely because it's an important part of our system. >> we could see more hot-button issues this term to the high court is expected take up to does more pills on gun control

looking at protesters on one street there. we have seen a lot of tear gas. police are trying to put them back but just in case we are looking at the line of riot police on the overpass ready to act. >> the police did move in with tear gas and a whole bunch of other tough tactics. protesters they were also fighting as strongly as well. most were in fact wearing masks and that is aimed at hiding their identity from the authorities. well over a dozen people it is reported were arrested. we saw a few detained and now as legal efforts stall they try to fight the spam on congress speaking out. take a listen. >> i see you have a face mask on. >> that's to protect my face. >> you don't care, you're going to take the mask off. you don't care what the

president erdogan accuse the white house not doing enough to expel the u.s. backed kurdish forces close to its border. more in this developing story from the mideast bureau. >> good afternoon aircrew trick as president to erdogan did say yesterday his forces will soon launch an air and ground operation in northern syria business turkish military personnel and equipment were spotted this weekend near the syrian border. their u.s.-backed kurdish fighters near the turkish border and a spokesperson ordered syrian democratic forces said that any unprovoked attack that turkey could lead to an all-out war. the kurds spent the past four years helping to guide states fight isis but maintained a tense relationship with turkey through the summer to end a bad state that agreed to create a safe zone for civilians in northern syria. with millions displaced following the defeat of isis and the ongoing civil war the development that appeared to be a positive sign for the warring region. while turkey in the united states of start working on this project by carrying out six air

doors. he was mentioned in text messages regarding ukraine. all this as a second whistleblower is reportedly coming forward and i'm joined now by "fox news" legal analyst mercedes collins and a member for the republican trial lawyers association richard st. paul. good to have both of you. mercedes i'm going to start with you. in order to bolster their position while the lawmakers on each side want to hear from the u.s. ambassador to mr. gordon sunland? >> it will be riveted by the overtures that long last we will have someone who might have firsthand knowledge. a lot of individuals that were critical of the inquiry were saying there wasn't anyone who has come forward with the actual knowledge. now there is some indication and course it will all be shown if proven if it does in fact exist

through the course of the investigation whether or not they are individuals who can come forward with firsthand knowledge of the phonecall in the circumstances surrounding the president's call with ukraine. it really depends on part of the reason it is closed doors is because the investigation is taking place and there hasn't been a determination made into evidence and is still ongoing as we speak. >> look at the end of the day what's was important to hear is there has been no evidence that the president even with the release of the transcript has broken any law. the illusion that he has influenced the ukrainian president or the training government to take action to get to his presidential opponent there's nothing in there that's a high crime or misdemeanor. obvious he was happening here as democrats are trying to get extra footing funding in the 2020 election because they are offering a weak candidate. this is all partisan politics and has nothing to do with american jurisprudence.

>> will that's what's reported there were overtures made by the president seeking it for me. you are seeking that information for a foreign government. how is that not something that's problematic and at a minimum has to be investigated to see if there has been a crime? >> you and i are both defense attorneys and i think the world of you as a defense attorney but when something quacks like a duck and walks like a duck, it's a duck right now they are some indication that there were overtures made through if foreign governments seeking information on the political rival. this is frankly wrong with all due respect. there has to be an investigation. >> is not an issue of an investigation. the investigation is a unfair investigation. the democrats have not voted for an impeachment inquiry that's

been done in the past with richard nixon and bill clinton. they are playing partisan and not allowing the president to give it an explanation. >> the president has provided a lot of information. he provided a summary of the readout of the phonecall. >> not only that in addition the congress is subpoenaing more information up from the president staff and the president said i'm happy to give the information but at least to vote for the impeachment angry. arthel: mercedes i'm not sure what you are going to savor richer to your point of the president president and the republicans are urging nancy pelosi and the house to hurry up and vote for impeachment despite what you are going to did they will turn around and say you were rushing it. they are already saying they are rushing it so which way is it? >> honestly it might be premature at this point that the investigation, think we are all

in agreement and investigation has to be done. hazlitt deeply into what the allegations are. they are certainly serious at first blush. no one can say that this isn't serious. and we are seeking information. >> i'm not talking about impeachment. i'm talking about the impeachment inquiry. the judiciary votes for articles of impeachment. impeachment inquiry will show the house members support this impeachment inquiry and then it goes to the district committee to determine the articles of impeachment which then goes into the trial. the bottom line is the overt overtures. there should be an overt act. you know as well as i do mercedes you have to have an overt act. the democrats have the same type of procedure when they talked about coats the fbi director and the fact that the were trying to get him to drop the

investigation. arthel: mercedes e. of 15 seconds. after wrapped. >> we are to the iceberg and we will have to delve very deeply into exactly what took place and frankly we are not at that point yet but with the second whistleblower coming forward and saying that he or she has first-hand knowledge of that call is certainly problematic. >> it's a waste of time after the mueller report. arthel: thank you both of you. eric: democratic candidates are on the campaign trail traveling from arizona to campaigning in south carolina. a new fox poll shows former vice president joe biden in bernie sanders and elizabeth warren are the front-runners for the democratic nomination. mr. biden happens to have expanded his lead in south carolina. he is 41% support now followed by senator warren with 12% and sanders attend. in wisconsin the democratic candidates holding leads over the president in each of the matchups tested.

arthel: a manhunt in kansas city kansas after four people were shot dead and five others were wounded overnight in a crowded art. kristina is live with the latest. >> the 5 people who survived the shooting are expected to be okay. they suffered minor injuries. police say this is -- the dispute and something in the bar led to the shooting that the shooting that they are looking at surveillance video to get to the bottom of it. the shooting happened around one 30th clock at a bar located along the strip of businesses. businesses that may have multiple cameras to see who went to that establishment last night but a spokesperson for the kansas city kansas police department tells me a sirs

does bend to the pressure first of all if there's a full house vote like something that occurred or in the nixon impeachment during the impeachment of hillary clinton. the issue here will be replacing freshman democrats guys who in 2018 went to their constituents and said vote for me. we are not just here to start the president did i care about these kitchen table issues and if you hold that vote you will be forcing those freshman to come down on this issue. they also will raise the question if you hold that vote about what rights the minority party will get. what happens right now is minority leader kevin mccarthy wants subpoena power and wants to have everything at his disposal to fight back. eric: republicans are criticizing the democrats saying they don't have subpoena power. they say it's a one-sided process in their view. is there any truth to that? >> right now the argument coming from kevin mccarthy and other republicans in the house as well as the white house is nancy

pelosi is the speaker of the house and yes she has that authority but she is still just one elected member of congress. the u.s. constitution requires the entire body to agree to move forward and that's the debate right now. they want to rights that were afforded to pass minority parties during past impeachment and this is a sort of technical thing. this is the nitty-gritty that the voter can say wait a minute i'm all for oversight but there's something to due process and it seems like the political fight not one that is based on holding the presidency standards. eric: you talk about due process. democrats calling on ambassadors to the questions behind closed doors. is it possible that they would subpoena joe biden himself and hunter biden and ask them these questions about the ukrainian context? >> this is a can of worms that

we are getting ourselves into because when it comes to this experiment in self-government it's almost limitless about what powers can do without violating norms and without violating standards that are put in the u.s. constitution. love republicans at this point don't just want to see a text message here or text message their peer they want to see the entire evidence than that is chairman schiff want to see the entire body of evidence and they say he you should take a play out of the playbook of the president to release the entire context. erred the biden family was paid off. there's no way in these transactions uses sleepy joe won't get into the starting gate and is family probably extorted. you would think the republicans would raise this issue. here is rudy giuliani talking

there's some as a no it wasn't that the same time it is unseemly. the american people do not like to see children of presidents or vice presidents trading off of their parents name. might not be illegal but it's a story of crony capitalism and again and again it shows voters just don't like it you. this is certainly liability for the biden campaign and i imagine we will see the white house continued to talk about corruption even if there's no illegality found. i think this has been a slow burn. nancy pelosi has been doing everything she can to hold back her caucus for just long enough that we saw with the mueller investigation, there were some things that were him seemly but there is no there there to force them peach mint issue. with ukraine with the transcript we just saw is much more simple. both arguments, both sides have good arguments to buttress their

turkish troops on its border and we were glad to hear about the possibility of trump and erdogan talking. there are a lot of issues to work out. their u.s. forces assisting the kurds in northeastern syria and the u.s. and turkey are doing joint military patrols in that area. this is the problem. will erdogan crossed the border to tamp down the kurdish threat even though there joint patrols going on there right now. arthel: you have that border with turkey and syria more than 3.6 million syrian civilians have fled the syrian war and moreover is you make a point earlier turkey wants to kick out the syrians kurdish forces, the u.s. backed forces from exporter.

look, the turkish president erdogan have a valid point on that level to move forward with military action clicks this phonecall and would prevent anything from happening today potentially but it's all there. it's like a landline anybody could make the wrong step and something could blow up or does erdogan have any nefarious underpinning here to this? >> keep in mind a few things. erdogan just had to speak to his big ak party conference so he had to talk really tough. i'm sure the phonecall goes to trying to clear up some of the issues. turkey wants a big buffer zone and the kurds wanted to be a little bit smaller. there are a lot of technical issues but the u.s. and turkey have some real common ground here in number one it's not leading isis rejuvenate in that area. that's what the patrols are supposed to do. the bigger picture turkey remains a very important nato allies and it's really time for

the u.s. and turkey to begin the repair their relationship a little bit after the problem with russian air defense systems purchased the summer. think they need to move forward on a bunch of issues beginning with the issues on the ground in northeastern syria but extending it to alliance issues as well. arthel: turkey is accusing the u.s. of redrawing the regions map. if that is true how would that benefit the united states? >> turkey's united states? >> turkeys point of view is a couple of things. five years ago isis was that the gates of baghdad and we almost lost iraq to isis. turkey was extremely helpful in permitting us to work with them and resupply kurdish forces through their country. we have some real issues and the situation is little dangerous because he has a history of making kurdish groups in syria. they don't want to see a kurdish

eric: cooler temperatures are coming this week and that means the fall foliage is upon us. meteorologist adam klotz is tracking at all. >> most spots across the country still summer in one place and i'll show you more on that but largely temperatures in the 50s and 60s along the east coast the 70s. it feels fantastic. we will -- have been dropping temperatures in last weekend to do that some of the fall colors beginning to shift. this is your fall foliage forecast. anywhere you are seeing the reds particular areas with higher up nations along the appalacian and across the rockies are beginning to see the shifting colors with the typical orange is coming up
