the president. all of you know your constitution. the way that impeachment stops is when the senate majority with me as majority leader. rob: mitch mcconnell pledging to protect the president from the escalating impeachment battle. jillian: what power does it have and is it possible for the republican held senate to stepping? robert driscoll, a lot of people at home constantly hear the word impeachment and people wonder where this will go, is this a possibility and if it goes to the senate floor does mitch mcconnell have that power? >> thanks for having me. it is a two step process. the house has to vote to impeach the president and if they do that the constitution requires a trial in the senate. the way that trial works is not specifically defined. impeachment is an inherently political act and senators decide whether there is high crime or misdemeanor and whether they want to remove the president from office. the majority leader has a lot of discretion in terms of setting

up how the procedure will work so certainly mcconnell is right, the way it could end is in the senate with him in charge of the senate majority. rob: let's look at options mcconnell has. the first one is granting the majority the power to hear live testimony. how is that utilized by mitch mcconnell? >> they took the star report and had managers present the case to the senate but you can have a full trial situation, the chief justice presiding and have a like a trial on law and order or something like that with witnesses questioning in the senate. with republicans in the majority they would control, have more control over questioning the witnesses than the minority would and that is something of the we would consider but

frankly would be more of a circus than you would want if you want to defend the president. >> how does impeachment work? >> one of the senators could bring forward a motion in the majority leader can essentially, the equivalent of a motion to dismiss in the civil trial where he could bring the matter of impeachment up to the senate and say assuming what is alleged has happened we don't think it is an impeachable offense and we will not spend much time on it. the majority leader has been clear there has to be a trial in the senate and will follow constitutional obligation unless the rules are changed but he also said the amount of time we spend on that is another matter so certain ways to short-circuit the process if that is what he wants to do but all of these are political decisions in terms of what he thinks the american public want that would protect his political interests. rob: to go to trial in the senate is what he can make

happen and says taken up. one last question. mitch mcconnell forced the identity of the whistleblower to keep it under wraps, he forced the person to be out? >> i don't think it will go that far. i have read the stories that the reality, keeping someone's identity secret and talking about something as serious as impeaching a president, the notion that you are going to do this on secret evidence, testimony somewhere offsite, i don't think will sit well with the american people and basic notions of due process at some point that witness will have to be identified. if they want to take steps to protect them, that is fine but anonymous complaints will take that president, not consistent with any notion of due process. jillian: thank you for joining us with that information. three patients die in an

but no mention of what the person might have done. >> a lot of things are not factual. a lot of us want to revisit solitary confinement. but she doesn't note the toilet is connected together in prison. just -- doing this, not really being factual. jillian: she says i know the term prison abolition is breaking people's brains, the right is freaking out yet us incarcerates more than anywhere in the world, we have more than enough room to close prisons and explore alternatives to incarceration. >> a lot of us are fighting the good fight but we can't have violent offenders roaming the streets. jillian: there's a way to make progress. those are different thoughts.
