that is clearly the way this should be done. every member of the house should be on record for the voters as to whether or not they believe this is justified. jillian: a couple statements, the house committee chair, mike pompeo as direct intervention to block appearance before the committee, we are left with no choice but to compel your appearance at a deposition pursuant to the subpoena. the white house goes on to say, quote, in order to fulfill his duty to the american people the constitution, the executive branch and all future occupants of the office of the presidency, donald trump and his administration cannot participate in your partisan and unconstitutional inquiry under these circumstances. one of the questions people ask is if the white house and president have nothing to hide, why not just let someone go up there and talk? >> because what the house is doing is trying to interfere in the president's conduct of

foreign policy including his discussions, negotiations with foreign leaders was the constitution gives the president very broad powers in this area and if congress, if everything the president does in the foreign-policy area can be disclosed to congress it will be impossible for any president to conduct foreign policy and the president has the constitutionally recognized doctrine of executive privilege. he can protect all the communications and advice he receives from senior diplomats and his closest advisers. rob: with this thing being so politically divided on party lines and the senate being in republicans favor the democrats must know they are probably not going to get donald trump out of office. it seems like this is purely politically motivated almost as a way to harm the president to make his job harder to do. >> it is looking that way particularly because they won't hold a vote. the transcript of the phone call

that started all this between trump and the ukrainian president, there is no violation of any federal law in that phone call. so far they don't have any evidence the president somehow broke the law or gave serious misconduct. that is what impeachment is for. it is not to be used as a partisan tool. jillian: you have an op-ed talking about this that nancy pelosi haven't started the process yet so you say she needs to give up or do it. >> i think they are doing a disservice to the republic and the american people if they don't go through the formal process of holding a vote. the power of impeachment is given to the house of representatives, not the speaker of the house. you need the entire house authorizing this, or a lot of people besides the president will raise questions about the legitimacy of starting this inquiry.

rob: what happens if she does call the vote? it probably does pass, democrats could lose 19 and still get in impeachment or get the inquiry started. will that change anything about the process? then these people can testify and we will give you the documents? >> that may not necessarily happen but here's the other thing. without a vote, we don't know the rules under which this impeachment inquiry is going to be conducted. if you look at the resolutions for bill clinton it set out how the ranking members of the minority party be able to participate. can they call subpoenas? can they object to subpoenas? we don't know any of that because there has been no vote. rob: republicans should've walked out at this point. jillian: thanks for your time.
