heather: donald trump calling out democrats and the refusal to legislate at the dallas rally saying they would rather do in impeachment witchhunt. brian babin joins us with his fox on what it will take for the left to move on. your take on the crowd last night. what did it feel like being there? >> it was tremendous. i've been to several of these things and that was the biggest thing i have seen out of four. i heard the estimates a while ago and there were at least 25,000 inside and there were probably 10, 15 or 20 outside. and to the president. >> anticipating 80,000 people there inside and outside the rally.

on the deck of impeachment, what will it take for democrats to move on? >> democrats have nothing to run on for next year. the lowest unemployment rate in history in the great state of texas, 3.4%. we suddenly found our oil and gas industry empowered and we have got a booming economy. we are the largest producer in the entire world and to the state of texas, i represent southeast texas, have more petrochemical reclining facilities than any other district in the country so that is the epicenter of our oil and gas industry in southeast texas. we loved donald trump,

the free syrian army and that is a group of former syrian offices linked up with the turks quite a long time ago. to me this picture shows me this is not turkish regular forces, it will be a lot more bombing and smoke if this was turkish tanks or aircraft but looks like it may be the free syrian army making trouble in that disputed region. heather: we have a portion of this joint statement on northern syria which the camera is looking at which is where the bombing, shelling is happening. both countries reiterate the commitment to the political unity and territorial integrity of syria and you and led political process which aims at ending the syrian conflict. doesn't make any difference at all the syrian free army is involved in this and not as far as we know direct turkish forces, does it matter?

we know proxies of the turkish army? >> it does matter. nobody thought the cease-fire would be perfect but it is not direct turkish regular military forces. it means the basics of the agreement between erdogan and mike pence for a few days of cease-fire is still in tact at the moment. heather: that is important to clarify and a lot of people will go to that as soon as mike pence and mike pompeo land as well. they are still in the air. there hasn't been a lot of time at all. the cease-fire was supposed to be a 5-day pause. i heard last night it described as an opportunity for kurdish troops to withdraw. >> an opportunity for them to pull back. what turkey really wants is not to have heavily armed kurdish

forces in that area. the incursion is in a small sector 70 miles wide, the part we saw the bombing was the eastern section. the ideal outcome is to bargain hard to get people to stop shooting and get the kurds to give back some of their heavy weapons and turkey to police that area to make sure it doesn't flare up again. it is a pretty tall order. heather: turkey views the kurds as terrorists. it is a matter of perspective even when it comes to the definition of the cease-fire itself. what happens next? where do we move from here? >> what happens next is we want to see more discussion of the security mechanism in that region. that is where the talks broke down. the us and turkey had been dismantling some of the curd fortifications in that area and we want to see going back to getting a security mechanism, turkey is going to want a buffer

zone. there is no question in the world recognizes they have legitimate security concerns. on the other hand we can't see this level of violence. another key ingredient will be turkey getting the free syrian army under better control. heather: our concern includes controlling isis and not letting them grow again and the kurds help us do a lot in terms of fighting isis. thank you for joining us. we will monitor the situation. let's go to extreme weather, tropical storm warnings in effect for the gulf coast as a disturbance grows in the gulf of mexico. people from louisiana all the way to central florida bracing for heavy rain and wind as soon as tonight and look who is here. janice dean tracking the storm and has what we need to know. >> this is not going to be a hurricane but i want people to be on alert. i don't want to have folks caught off guard with this tropical system.

it could be named today and if it is we will be dealing with a tropical system. it doesn't have a closed low, center of circulation so hurricane hunters are assessing the situation. it doesn't need to get a name, the impacts are going to be the same whether it is a tropical system or a subtropical system. we have tropical advisories, tropical storm warnings in effect from louisiana through the florida panhandle. we will see this storm system make landfall tomorrow. some much needed rain to drought stricken areas but in the meanwhile we will still see the results of storm surge, heavy rainfall, gusty windss over the next 24 to 48 hours over parts of the gulf coast towards the southeast. here's future radar as we go further out in time, we think the system makes, quote, landfall tomorrow morning and moving quickly to the northeast so here is the track. if it will get a name it will be today and it will move north and

heather: andrew cuomo put the end to new york's double jeopardy loophole making it legal to prosecute anyone already pardoned by a president. joining me is the man who voted against that law, thank you for joining us. why did you vote against this? >> a terrible precedent. double jeopardy clause is an important protection that keeps us free. for more than 100 years in new york state our law has said of a federal government tries to prosecute, putting you in double jeopardy, you have been through enough, been acquitted. that makes a lot of sense. the civil liberties union, from governor cuomo, this was a bad idea.

if you have gone through the difficulty and pressure and stress of having your liberty almost taken away by the government it shouldn't have to come again at the state level. what we have said is even if the president pardons you, given you a federal pardon we will try to prosecute you. this stems from the fact the powers that be in new york state -- julie: like the president. >> i didn't like the last president, i like this one, that will change in the future depending on who is in the white house. the reason it is a problem is the law now says you are going to target a specific group of people that only applies to people close to the president. our founding fathers warned 200 years ago, the bill of attainder. the united states constitution says no build a teenager. you can't pass laws to punish a certain person. that is what this does. heather: let's look at what

cuomo has to say about ending double jeopardy. i just signed legislation closing new york's double jeopardy loophole authoring the state to -- no one is above the law and new york will not turn a blind eye to criminality no matter who seeks to protect them and let t-shirt james said this. new york closed a gaping loophole in the double every protections so now president can abuse the presidential pardon power to grant a pardon to a family member or close associate. i introduce this bill because no one is above the law. that speaks to what you were talking about. >> no one is above the law but no one is below the law. people who work for the president were happen to be

related to the president are now below the law. they get less protection because of their association. think of the effects of that. somebody who would work in the white house is not going to work in the white house now because new york state is targeting people associated with this president. heather: not treated equally. >> i don't want to be the target of a investigation. it is very dangerous. 1-party rule in this state, there is no more checks and balances, making provisions in our capital. if going after political enemies or prosecutors it is a dangerous precedent. maybe you don't like the president now but the big picture is it is a terrible precedent that will hurt people in the future. heather: other states are watching for sure. closing rikers island, thousands of criminals free to roam the streets. is that an overstatement? what will happen? >> rikers island is not a pleasant place but it is literally an island that holds

heather: the us brokered cease-fire broken overnight as fighting continues in northern syria. they show shelling and smoke still billowing into the air. trey yates joins us from turkey with the latest. can you update us what is happening? >> reporter: after meeting with turkish president erdogan for five hours we saw mike pence in ankara announcing a cease-fire agreement has been brokered, we are getting reports and new

images indicating the cease-fire has already been broken. they tried to broker the cease-fire yesterday and it appeared most sides were interested in coming to the table and pausing things for 120 hours but that information today indicates turkish showings are taking place in curtis control areas. there is a 5-day pause in fighting. if it does hold it would turn into a permanent agreement if the united states can convince the kurds to treat from a safe zone along the border. there are questions how the us will facilitate the withdrawal of kurdish forces since donald trump pulled all us troops from northern syria. the kurds were taking directions from the united states, now under the orders of a russian brigade operating in syria. early indications the kurds rejecting the cease-fire yesterday but as the evening developed there was an announcement by kurdish generals that they accepted the terms. secretary of state mike pompeo was in jerusalem meeting with

heather: a new video showing the moment helen hunt was involved in a scary crash. you can see her black suv flipping over after a car slams into it in a los angeles intersection. hunt was in the backseat at the time. there is video of her being loaded into an ambulance on a stretcher. she suffered no major injuries. we don't know the conditions of the other people involved. a missouri man missing for a week found inside his crashed car at the bottom of a ravine. he was spotted by a dirt bike rider in the wreckage.
