strategic locations, the border patrol identified as where we need it. that allows us to dictate where traffic takes place. it is not just human smuggling we are trying to control. we are talking drug trafficking as well. we have an opioid crisis. suburban america is reeling with this opioid crisis and we can control where narcotics are coming in we could be a lot more effective in saving our children and protecting the public. that is what walls allow us to do, walls in strategic locations, they are in strategic locations which allow us to be more effective. it is an intelligent way to go about this. jillian: people question if it is certain strategic locations, will that create problem areas in other places where folks are not prepared to deal with that because they haven't before? >> when we talk about that, that is the first thing to come to people's minds but when we look

at the way our operations are set up it allows us to deploy more resources to those areas. we want to create traffic in certain areas so we can deploy our resources to be more effective. we will not create the gaps people might think and we will be able to target specific organizations driving facility go traffic. rob: the numbers are down month after month or the summer months when it is hot. how do you think the numbers at the border are going to look as we get into the wintertime when it is easier to travel and do this migration and how critical was the deal with mexico and the threat of tariffs and reducing those numbers? >> that deal donald trump struck with mexico was a deal any of his predecessors would have loved to have. when we talk about a wall, about

jillian: juul being blamed for a girl at nicotine addiction. the family claims she got hooked on vaping because juul aim social media marketing at kids. it is one of 30 lawsuits filed against the company for vaping related illnesses. juul stopped selling flavored e-cigarettes last week, the company denies all lawsuit allegations. rob: the band will remain in effect in massachusetts but i without changes. it would have made all vaping sales illegal in four months. the state must hold a public hearing, court in oregon and michigan have overturned the temporary ban. and they died from vaping

related illnesses. >> new report reveals amazon is shipping expired food through third-party vendors. rob: tracy carrasco here with a nasty discovery. >> reporter: the report from cnbc found shoppers going to the amazon marketplace grocery section were finding a number of items being shipped the number of items like beef jerky, baby formula, they had been expired, past their sell date and in some cases were spoiled. according to cnbc's data analyst who looked at amazon's 100 best-selling food products found 40% of the sellers had more than 5 customer complaints about this, about selling bad products, things that had

trillion per year over ten years and that is an initial estimate and the number could go up. when you look at a cost like that what do you say to americans, these numbers don't make sense anymore. >> they don't make sense and there is disagreement among the candidates for president on the democrat side, they are shouting at each other about the cost because you are looking at almost $33 trillion in the first ten years. we can't afford that. the worst part for americans is taking away insurance money. rob: what kind of tax increase would that entail? it would have to be a dramatic hankering -- tax increase on all levels. >> upon the middle class who cannot afford it. healthcare costs are the largest cost for most families even more

constitution applies to persons in the united states. it does not exclude illegal immigrants and does not limited to us citizens. he is entitled to miranda rights and a statement or confession is illegally obtained without any miranda warning then it should be excluded and is inadmissible. >> look at the timeline when we are told miranda rights were read to him and you can see he was arrested at 11:30 p.m. and 6 hours later, more than 6 hours later at 5:50 a.m. the miranda rights are read. what does the timeline say to you? >> even the prosecution conceded that part of the evidence collected during this time may be thrown out by the judge. it is unfortunate but there were two elements here. once he at that time was interrogated, once he allowed to leave, at those times, the

prosecution -- the miranda rights were read by 50 instead of when he was detained. jillian: let's look at information from this case. the suspect is charged with molly tibbetts's murder, believed to have resided in iowa for 7 years. what does this do to the case? how much harder does it make it? >> it makes it harder when you have an alleged confession you want to get it before the jury but when you're dealing with police officers you have to give miranda warnings when an individual is in custody and there's an interrogation. the prosecution is not disputing either of those. there is an interrogation but they did not give him his miranda warnings. it is inadmissible. jillian: you said it is similar to the kate steinle case.

>> when illegals -- by the courts, not the constitution, have been granted rights by american citizens, when we are arguing they didn't understand their miranda rights or due process is not applied properly it is unfortunate that this is one of the cases the prosecution may lose because of liberal court interpreting the constitution, applying to noncitizens, illegal immigrants. i hope it will wind up in the supreme court to get a clear definition as to who the miranda rights apply to in these cases and uphold a different interpretation of the constitution. american citizens are subject to constitutional rights and going ons. jillian: at the end of the day people who stand to lose the most from this if that the proper way to put it, molly
