fox news reporting begins with investigating the investigators. president trump weighing in on new developments in the probe of how the russia investigation started. top house democrats accusing the white house of turning the justice department into a vehicle for political revenge. sources telling fox news the investigation into possible misconduct by officials in the fbi and justice department has turned into a criminal case. that means the u.s. attorney overseeing the investigation, john durham, can now subpoena witnesses filed charges, and impanel graduates. chief white house correspondent john roberts reporting live. >> good afternoon. fox news was told a couple weeks ago the prosecutor prosecutor john durham was expanding the scope of this investigation based on what he had found, adding staff and extending the timeline beyond election day.

the fact that this is now a criminal investigation really does take it to a new level. as to why this investigation has now morphed into a criminal investigation, fox news was told the upcoming department of justice inspector general's report into possible fisa abuses will shed some light on it. in a letter to judiciary and government oversight committee chairman in the senate and house, the inspector general michael horowitz saying that his draft report is lengthy and will be ready soon and that he anticipates it will be released publicly and with the redactions. on his way out the door, president trump waited on the new direction of the durham investigation. >> i think you're going to see a lot of really bad things. a lot of people think and they know they have problems because they were very dishonest. i leave it all up to the attorney general. i leave it all up to the people

i want to pick up where john left off. bill barr and john durham appear to be pretty straight shooters. >> well, i think john durham certainly is a straight shooter and he's investigated, as john mentioned, you get more of an argument about william barr. but the key here is who's being targeted? you have now the democrats upset about the investigation of the russia investigation and so they are objecting to it and saying this is using the justice department for partisan purposes. on the other hand, when it's the democrats conducting their impeachment inquiry against the president, you've got the republicans saying that they are using this process for partisan purposes. so it's a perfect case of washington hypocrisy. investigations are good as long as it's you conducting them against the other guy, not so good when the other guys conducting them against you.

>> trace: you know what i found fascinating, i was reading into this and we really don't know yet what they have found. nobody is saying they found a smoking gun but the deeper you read in, it sounds as if john derman bill barr at least have discovered some sort of probable cause. what's your assessment? >> ion't think it's probable cause. i don't think that's the legal standard. that's for a search warrant. to conduct a criminal investigation, there is reasonable cause or reason to believe. and it's worth pointing out that when durham conducted the investigation about possible torture, possible abuses of prisoners during the bush administration when he was asked to do that by the obama administration, he conducted a criminal investigation and ended up bringing no charges. there is no certainty that i agree it's been an administrative review since last may and suddenly durham and barr have decided it should be a

criminal investigation. they certainly found something that raised it to a different level. doesn't necessarily mean that there's going to be criminal charges brought about if they hadn't found anything, they wouldn't of done it. so they clearly have found, don't know how serious it is. if you are the people who've been accused of abusing power, whether it's james comey or andrew mccabe or peter strzok or lisa page, you're probably not resting too easy tonight. >> trace: we are expecting the doj inspector general michael horowitz, his reported come in. he says largely unredacted. texas g.o.p. congressman john radcliffe thinks the horowitz report is connected to what's happening with barr and durham. >> i think these two things are related. the work done by michael horowitz could result in criminal referrals even though the report hasn't been released. >> trace: what do you make of the timing, one wrapping up on

one getting going? >> i don't know. the answer is i don't know whether or john durham u.s. attorney investigating and is now going to have a criminal investigation, whether he's been able to see the ig report or not. clearly the inspector general michael horowitz who was very critical of james comey and the fbi and the way they handled the hillary clinton email investigation. he's been going on for months now. it seems highly unlikely that he is now finally going to issue this report and it's going to be a clean bill of health of how the fbi and the justice department handled the investigation of donald trump. whether that was directly related to the durham decision and the barr decision to escalate to a criminal investigation, i don't know. but i'm gonna say as reporters, as far as i'm concerned, whether it's investigations of the president, investigations of the fbi and the justice department

one of the things that struck me today was how few guards there were. the sds have been clear they need more support. take a look at what we saw. >> like everyone else in this room here, trying to explain why he joined isis. while he was an isis fighter. they claimed they were here for humanitarian reasons and they've all turned their back on this terror group. speaking to the guards in the prison authorities, they say that's not true. these people are all dangerous. they don't want us moving much further into this room. for our own safety. this is the story that you hear time and time again from these people. they were cooks. they were cleaners. they didn't commit any atrocities. that being said, we know that there are prisoners trying to breakout of these places. we do here there are others who seek to rejoin isis. that's the great threat. that's a great threat to the u.s. and the west, particular way if the turkish invasion takes place in the north. half the guards in this camp have had to move north to try to repel that.

quickly with winds whipping it over a highway early this morning. we will have more on that fire limited. this video is from the kincade fire which is scorching northern california's wine country. somebody driving down the highway. you can see the fire burning on both sides of the road. this is in sonoma county. 60 miles north of san francisco. the fire has more than doubled in size since yesterday morning, covering now more than 21,000 acres. the areas power company, pg&e, admitted some of its equipment may have sparked the fire. the company has been shutting off power to tens of thousands of people to lower the risk of flames spreading and now it's warning the biggest blackout yet could be on the way. pg&e reports it may have to shut off power to nearly all of its northern california customers because forecasters they winds could be the strongest they've been in years over the weekend. we are talking about winds that go through the canyons.

in northern california, they call them the diablo wins. that means they come off the central valley. you may have heard in southern california they call them santa ana winds. either way, they are firefighters worst enemy. let's get to our senior correspondent, claudia cowan. she is reporting live from geiser vale. >> burned out houses and blacken trees lines the roads in geyserville. the kincade fire continues to grow. it's burned more than 34 square miles and it just -- it's 5% contained. it's taken out 21 homes and some 2,000 people remain evacuated. fortunately everyone has been accounted for and no one has been hurt. right now governor gavin newsom is getting briefed by first responders. promising financial support to help with the ongoing firefight and the recovery. better weather is giving fire crews a window of opportunity before the winds pick up again. crews are attacking the leading

edge of the fire from the air so that ground crews can get in there and build containment lines. more than 1,000 firefighters are in a race against time. >> we are really concerned about saturday and sunday for the next round of offshore wind events come through because the forecast is for either as strong or not stronger winds to come across the area. we will have a big impact on the fire. >> dangerously strong winds forecast to move into northern california and last through monday and will almost certainly trigger the biggest round of these blackouts that we've seen so far. as many as 2 million customers could be in the dark. a lot of fire damage to report in southern california. let's go to jonathan hunt some 450 miles to the south. >> claudia, we are in an area known as canyon country. it's about 40 miles north of downtown los angeles.

40,000 people remain under evacuation orders. 10,000 homes and buildings remain under threat. six have been reduced to rubble. this is one of them that firefighters were simply unable to save. as we walk over here to the side of the house, you can see exactly why. look over the side of the fence. that's the valley and these are the slopes that those flames came roaring up, burning everything in their path, going into this house. the embers driven by the fear santa ana winds that trace was talking about. the problem is the firefighter simply cannot get to every house quickly enough when those embers land on a roof and set it ablaze. just to give you a sense of the capricious nature of these fires, this house completely destroyed, 20 feet away, their neighbors not a mark on that house.

>> trace: a nationwide shortage of a life-saving cancer medicine putting kids around the country at risk. forcing some to skip doses or go without altogether. the drug is called vincristine. it stops cancer cells from dividing but now it's hidden very short supply across the u.s. after one of the two companies making the drug stopped production. in a statement, that company,
