michael flynn. >> the case against flynn stems from fbi interview with kislyak. he pleaded guilty to making false statements regarding those conversations during his interview as part of former special counsel robert mueller's investigation. >> they exonerated him completely of being an agent of russia by the end of january. and, yet, mr. comey still runs to the white house on february 14th and conjures up the entire obstruction of justice narrative against the president when flynn had been cleared of everything long before that. >> flynn is scheduled to be sentenced december 18th, guys. ed: lucas tomlinson live in washington. thank you. we were joking around about deep state and who is playing in the swamp. this is serious business. this comes what lucas was just reporting the fbi manipulating the situation with general flynn we just learned in the last 24 to 48 hours this review of the justice department fbi behavior how the russia

probe started has now morphed into a serious criminal investigation. there is going to be a grand jury, subpoenas. people like james clapper, maybe james comey, john brennan all these obama era officials are under the microscope this will add to the drip drip of all of that. jedediah: you can bet they are all nervous, too. what warranted this being shifted from a criminal investigation. if you see clapper in introduce. he is stumbling and looks terribly nervous about the whole situation. it's funny. this was first labeled as a conspiracy theory. people would bring up issues of the deep state and what was going on and why this investigation into collusion with russia started to begin with and what the justification walls. everyone said oh, you know, right wing conspiracy theory going on. now when you see what's going on and allegations against members of the fbi and what they were doing and how they had this agenda driven mission potentially from the beginning, a lot more people are jumping on board saying wait maybe what they were say guilty about deep state weren't crazy after all. pete: that's a problem with the media.

if you haven't told the story and suddenly becomes a real story, educate your viewers who never knew about this from the beginning. if you go back strzok to page text from that time period, nows that the dossier is out use as it a pretext to go interview some people. ed: pretext? pete: pretext to interview people. next couple weeks a bunch of meetings to talk about flynn. if you listen to what attorneys for flynn are talking about, this was entrapment. this was an attempt to set up flynn to make him look like the russian agent to create the pretext that the whole thing was about russian collusion. and if you get -- if they are able to prove that there was manipulation of official documents, which is what the lawyers are alleging here. ed: by fbi officials. pete: play right and left field for the washington nationals. if we know that, this is as bad as it gets from your own government. that's why the president yesterday at the white house was out there talking about

the investigation of the investigators. listen. >> looks like it's becoming very serious, from what i'm hearing. investigate the investigators. whether it's strzok and page, whether it's clapper and whether it's comey and all of these people, because terrible things went on for our country. and we have a great attorney general, highly press tinge just man, a very honorable man, and they have been looking at it for a long time. i leave it all up to the attorney general and i leave it all up to the people that are working with the attorney general, who i don't know. but i will say this. i think you will see things that nobody would have believed. this was the worst hoax in the history of our country. ed: you know, it's interesting. the president mentions the attorney general at the end. and you have members of the media and some democrats who for two and a half years or so we need to get the facts. we need to figure out this russia collusion thing you find out there really was no collusion and they move onto

the next thing, ukraine, talking about that all morning. okay, so they do that now all of a sudden we hear there is a criminal investigation of you who that investigation of russian collusion started. and they say this is political payback. president trump, they allege, is using his justice department politically to go after his political opponents. isn't that what may have happened in 2016 with the obama administration where the obama administration used their justice department to go after their political opponents as in donald trump and his team to actually potentially spy on them? that's what we are trying to get ought. the same people in the media spent two and a half years saying we need to know everything about alleged russian collusion. why don't they want the facts on this. pete: immediately political payback. first paragraph in every article. before they even get comments from democrats is this is bill barr, president trump using bill barr to get pay back on a political opponent. ed: launch a investigation. this may be payback by bill barr and donald trump.

immediately framing it that way. we have this funeral yesterday for elijah cummings, a member of congress who just passed away. people should be coming together. in fact mark meadows and jim jordan and other conservatives were at that funeral. senator mitch mcconnell. vice president pence were saying, look, this was a civil rights leader. somebody that we should all celebrate his life and legacy. and, yet, hillary clinton goes to the podium and decides to maybe take a little shot at president trump. watch. >> elijah cummings shared a name with an old testament prophet. like that old testament prophet he stood against corrupt leadership of king ahab and queen jezebel. jedediah: interesting. once again hillary has to politicize. she is disgraceful. she has to be front and center all the time. she has to put herself front and center all the time. it's always about her. it's all about the election. a dig at trump. you think she would recognize that you were trying to commemorate someone, whether you agree with elijah cummings or not,

he was someone vastly committed to what he believed in and who had done great service in the causes he believed in. this was a moment to celebrate him. this was not a moment to dig at president trump and she just -- she is politics as usual all the time. that's why she lost the election. pete: you have been spot on about hillary clinton from the beginning. jedediah: i don't take any garbage from her. pete: you don't. a bunch of senate democrats who agree with you who think it's not time for hillary even if she wants the rematch. dick durbin said i believe it's time for another nominee. jon tester i don't think it would be good tore her and that would be a mistake from another senator whose last name i can't pronounce and then joe manchin, absolutely not. ed: they don't want her. pete: she may want the rematch. jedediah: i don't even know that she wants the rematch. she wants people to want her like oh, hillary, please. we need you. joe biden has been a disappointment. please come in and make the same mistakes over and over again? no, they are not doing that people recognize that she is

ed: lawyers filing explosion motion fbi agents actually manipulated official records that led to charges against him. this comes as we learn more about the investigation into the origins of the russian probe. here to react live former u.s. attorney -- good morning, good to have you. >> good morning. ed: explain to our viewers. explain what happened with michael flynn, what is the allegation that his legal team is making? how important do you think it is to his case? >> it's very important. michael flynn, he is so far of o a federal agency. it's what we call 1001

violation. what's interesting about that crime is the government has to prove it was knowingly and willfully a misrepresentation by flynn. you know, so now what you have are allegations that may suggest this couldn't have been how is it willful if he thinks is he having a conversation that is not an interview by a federal agency. ed: doesn't this get at what the president has been talking about for a couple of years? democrats, many in the media have been saying investigators out to get the president. just as we're hearing from john durham the u.s. attorney overseeing the review of all of this, he now has a criminal investigation. it's a gransd jury, he has subpoena power. what does this mean in the grand scheme? >> well, not a lot of people know that conspiracy itself is an actual crime in the united states. it's section 371.

it is a crime to conspire to either defraud or to harm the united states it was created or fabricated from comey to strzok and page and those manipulating, that itself could be a crime what did and perpetrated. ed: filing from general flynn's team where they're alleging that basically there were people who went to david ignatius, the columnist for "the washington post." and that james clapper or people on his staff went to him and basically said it's time to take out general flynn. there needs to be a kill shot, basically. clapper people saying he was the director of national intelligence, of course. the president has attacked him. saying he didn't quite use those words. wondering if this is a weevilly way out.

was james clapper there when he used the word conspiracy. were he and others out to get general flynn. >> it's chilling. it should give us a concern whether we are democrat or republican in this country that those with the most powerful tools we grant our investigators you may have operatives or intelligence community working with the fbi to come up with and to conspire to take down either a sitting president or those in his campaign, to do that with the laws that we have should concern all of us. >> so last question then, who should be concerned? i mentioned james clapper, in this latest allegation, that he wanted a quote, unquote, kill shot to take out general flynn. we have heard the name john brennan who, of course, was cia director under president obama and that maybe john durham, the prosecutor here, wants to talk to him. who should be concerned? >> anyone that may have assisted in manipulating,

fliers without tickets. wait for arriving loved ones. could this test program put people's safety at risk. joining us now with insight former deputy assistant secretary of transportation oliver mcgehee. thanks for joining us this morning. after 9/11 everything changed. you needed to have a ticket on a flight to go through security. is this a worrisome change at all? >> well, not necessarily. but you and i, pete, you are a military guy. i'm an aviation safety and security hawk we're a little bit more inclined to be more conservative in such test pilot programs like these gate pass programs. this was really, as you said, done pre-9/11. but we're living in a post 9/11 era where i like to call airports national security installations. so, you and i want to see belts, buckles and suspenders on in these airports so that we can make

sure that we have security from the airport curve through the passenger checkpoints onto the tarmac. and also, in the baggage claim and cargo facilities and maintenance facilities as well. so we don't have any type of event because we can't turn airplanes into weapons of mass destruction. pete: oliver, so the program, you have to apply for it the day before and all applicants can screened through tsa secure flights. when you look at detroit, the fbi has pointed out in the past that most of 28 international terrorist groups have recently identified by the state department representative michigan. large muslim population in michigan. most of which are peaceful. we are not making some broad-sweeping accusation at all. but ultimately, there have been problems there. does that make this concerning? >> well, i am sure that the detroit airport officials are looking at this very closely as well as the national security

officials -- officials as well. we really do have to be visionary and vigilant. that's really what you are describing. in making sure that airports are safe and secure in the post 9/11 era. there is some concern in this particular airport and this is also being test piloted in tampa and in pittsburgh. but they're going slow, pete. they are going slow. they really limiting to about 75 passengers. and ultimately, i don't think the revenue driver for shops and eateries is really the key. i think they are watching it to make sure that all belts and centers, buckles are on in this particular new program. we can't have any, any problems that are going to bring us back to 9/11 which we had all of these safety protocols to ensure that we do have a safe and secure airports and also aircraft. pete: that's right. vigilance is what is required. you let your guard down and that's when you have problems. oliver mcgehee, thank you so much for your time this

the key parts is to whether to keep a small u.s. force on the ground there. it appears the president wants to do that in northern syria to help secure the oil that he is concerned iran, isis, other bad actors could get their hands on. what's your thoughts this morning. >> i think what's most frustrating for republicans on capitol hill and those of us voting that support the president is that the overall strategies is fairly defensible it. makes sense now that we spent three or four weeks hashing it out. i think the president and his team did not do a good job controlling the communication and narrative around this. and it seems very reactionary. as we are explaining what we are doing and why we are doing it. you know, you have the president saying we are taking our troops home. but then you have the defense department sending more troops into syria to guard oil wells and oil tankers and so really what it comes down to is that we are going to have a contingent of troops in many places around the world. the best way to keep our country safe is to keep an eye and a finger on those that would do us harm. that's not the same as

regime change. it's not the same as 100,000 troops in afghanistan. i think it's the right policy. pete: joey, let's bring it here at home. the campaign is in full swing as you know, and the 020 democrats are trying to make headlines. beto o'rourke has done so by talking about how he wants to take guns. famously back from people, including ar-15s. he was in iowa, talking to the folks. and someone in the audience had a different view. take a listen. >> i am a hunter myself. i have used an ar-15. what about those people who use that as a way to, you know, get dinner, who live down south. >> address a legitimate concern for me is to ensure that those who have or want to use an ar-15 are able to keep it at a hunting club or at that time a gun range. so there is some control and safeguards still placed on that firearm. ultimately we take some action to save the lives of those who are being taken.

and then to protect against the kind of fear these acts of terror are inspiring. pete: so i have got to take my ar-15 and send it to a gun club? >> we can make funnel of this and we should, we really should. beto should be made fun of because this is such an important issue, and he has no information, no authority no idea what he is talking about. that is almost a kid that called him out on a very simple thing. i am a disabled hunter, right? both my wrists are fused. my shoulders are fused. i need a pistol grip and semi-automatic gun to go hunt. guess what that is that's an ar-15, ar-10. sporting rifle. the truth is beto doesn't understand what he is talking about. he needs this shiny october, this flash point to try and stir a controversy and get votes. it's just not happening for him. >> even if you take out the issue of hunting, that question happened to be related to hunting, but many people talk about the ar-15 in terms of self-defense.

they live in rural areas. they use that weapon as a meth of self-defense. they know if they pick up the phone to call police it, will take a very long time for the police to get. there is he completely unaware that there are people around the country that utilize that weapon to protect themselves and their families? >> well, he is not unaware. he just thinks that his best chance at getting people to support him right now is to have a controversial issue that he can get 49% of people to agree with the one thing i will say is that i disagree that we have to go all the way to the constitution. my license to own that gun exist in the rotunda of the national archives if nhs hasn't stolen it already illusion to a really bad movie. the think the defense of owning these guns doesn't have to go that far. they are in common use and they're not in common use against one another. in a country that's free, that matters, we don't ban alcohol. we don't ban things that can harm us just because they

don't save lives in hospitals. so the idea that guns are used in self-defense or hunting or for sport or as an ornament in my safe, those are all equally justifiable reasons that i should be able to own them because i'm a law-abiding citizen. and that's important in this country. beto uses the number 40,000 when really only a few hundred people are killed each year by rifles in general, to mention just ars. maybe less than a few thousand. that's not to say that we should accept it. we don't fix it by simply banning something that is so commonly used legally. pete: well said. joey jones, thank you so much for your time this morning. we appreciate it? >> thank you all, i appreciate it. ed: meanwhile the victim of the slender man attack speaking out for the first time. peyton was 12 years old when she was stabbed 19 times by two classmates. now she is detailing the trauma she still deals with. >> i still sleep with like a broken pair of scissors underneath the pillow next to me just in case.

you are a racist. whereas if you can do whatever to me, or to now ben carson and that's fine. you are not really black because you are not doing what we expect black people to do. jedediah: joining to us discuss clerk to supreme court justice clarence thomas carrie serino. thank you for being here. >> thank you. jedediah: what do you think about that sound by the different set of rules for a black conservative? >> that's from an amazing new documentary coming out. i understand it's going to be on parkways in the spring. i'm so excited because you get to see a side as justice thomas as a clerk for him i got to see and most people don't. it's him in his own words, really. i think he is absolutely right no. one could have put it better than anita hill herself who told meet the press in 1998. maybe there is a double standard. isn't that the nature of politics. she was defending bill clinton with serial sexual misconduct. he is good on other women's issues i like let's give him

a pass. that's outrage jugs. that is the kind of thing that justice thomas has experienced his whole career. they have been trying to block him the whole time because he is that articulate principled conservative voice on the court. and you know what? i think he has shown them because he has been one of the most influential supreme court justices of our generation. jedediah: there was an excerpt from time magazine on thomas and the modern day liberal that really struck me. i want to read it to you and get your reaction. thomas says his experience in the hearings made him realize that he had been expecting a certain type of person as he described the bigot, clansman and rural sheriff to held him back over the course of his life. the confirmation hearing changed his mind. quote. it turned out through all of that, ultimately the biggest impediment was the modern day liberal, he says. what do you make of that? that's a pretty impactful statement. >> in this documentary, he tells a story of his whole life part of which he really was that liberal. he was a very radical young

man. answered talks about how that -- i learned that was really keeping him caught in a cycle of anger and rage. saw people who attacked him most in his life ultimately were the ones that could not september idea that he came to agree in a conservative philosophy, which he actually got from his own grandfather. so this is really going back to his roots. and they just couldn't abide the idea of a man who put the lie to their identity politics who said that all black people have to think the same way. jedediah: pretty fascinating stuff. justice 24078s is set to teach a course at the university of florida on religion and first amendment. of course there is a lot of outrage about that. this a student's letter to the campus newspaper in part. explain how the celebration of clarence thomas' presence on campus will help the effort to address the culture at uf that has led to increase in campus sexual assault in the group actually, cair, believe survivors has come out.

this is obviously in response to the charges that were made against anita hill in the 1990s. what do you make of that statement? >> these students don't know what they are talking about. they should be thrilled to have justice thomas on campus. it's a real opportunity for them. i think the problem is they have been only listening to the 30 years of propaganda campaign, not even because they are probably even not old enough. they weren't here at the time of those hearings. the people who watched those, who heard the testimony on both sides two to one believed anita hill over thomas because her story was so inconsistent. jedediah: thank you for being here. i look forward to seeing the documentary and appreciate your take. thank you so much. while you were sleeping, president trump just picked a new fight with the iphone and astros pick up first win in the world series. jillian mele is live in washington. we will check in with her right after the break. don't miss it ♪ ♪ i wish i could shake your hand.

democrats continue this closed door testimony. it's going to be happening all weekend. that's on ukraine. you have got that track going on. meanwhile, you also have this criminal investigation of you who the russia probe all began. there's new information about general flynn, his legal team saying that he was basically set up. we're going to get into that. and there are these new emails between strzok and page. jedediah: also what warrants it being a criminal investigation. we will find that out. clapper looks worried. everyone seems to be saying wait a second. what did they find out that suddenly enabled them to bring this up to a level of criminal investigation. everyone is waiting to see that. this is what we have been talking about for a long time. investigating the investigators. how did the whole investigation into president trump begin? what was the cause and justification for this look into collusion? was there a deep state component to this? hopefully we will get some answers to all these questions we have been asking. pete: bill barr is not messing around. at the end of the day, to announce a criminal investigation means you've found something. they've expanded the probe. and some folks that are worried about it might be peter strzok and lisa page,

left fielder and right fielder respectfully. an email from them on february 10th of 2017 says this: i made your edits and sent them to joe. i also emailed you an updated 302. i'm not asking you to edit this weekend. i just wanted to send it. now, what is a 302 and what might that mean and how might that pertain to michael flynn. ed: 302 is the official fbi document after you interview a witness, basically. this is a very important document that records what was said. and so general flynn's legal team is basically suggesting the records of his interview were manipulated in some way to make it look worse for him. one of his attorneys, sydney powell was on hannity last night, guest hosted by our friend jason chaffetz. here's how he framed it. >> we also have information that the agents did minute manipulate the 302. long and dealershippive state as they called it, which is highly unusual in and of itself. people can go to the actual document and read it and see the document for themselves:

it's extremely conservative and misconduct. the agents delicately calculated and medicine to plan how to ambush general flynn without letting him know he was officially under any kind of criminal investigation. ed: the aforementioned jason chaffetz is on the couch with us this morning. good morning. >> good morning. ed: how huge is this. >> it's huge. general flynn is trying to get out from under a guilty plea. his new attorney sydney powell has unearthed a lot of information. that's going to be pivotal when she goes to a judge and says this man should not have had to plead guilty. the fbi manipulated how they interviewed him. they used the precursors that were not there and then they actually edited it. one of the key things really important, that really gets to me. michael horowitz, the inspector general, went to go get these text messages and the fbi said oh, we can't find them. he had to go to the pentagon

to write an algorithm to go get these text messages which now reveal this interaction between these fbi agents that really does look like nefarious activity. ed: sounds like somebody was trying to cover up text messages. >> that's the thing. and what sidney powell told us last night on hannity was if you put the 302 one day and the next day, you see how it's changed. and the heart of that is did michael flynn lie to the fbi? that's what he is charged with. but there is nothing in the original 302 that says that he did not -- he wasn't claiming that he didn't meet with the russians. he was just saying he didn't know. went to dozens of countries and talked to a number of people. i don't know if i did or not. pete: fbi set him up to make him feel comfortable. not an investigation. just share how might know and who you might have met with. for a lot of regular folks, you think a 302, a transcript of what you interviewed someone would be black and white, straightforward. in this case, one change of a line or a word changes the the entire thing.

>> and you are backing up with the text message between peter strzok and lisa page. lisa page, in which whole scenario is the one that actually edited the 302. that's the allegation from sydney powell. jedediah: i want to ask you about john kerry who has weighed in on all of this. is he suggesting that the evidence against president trump. the evidence is more powerful than what we saw in the impeachment of richard nixon. take a listen to what he had to say and get your reaction. >> the evidence is powerful. some of it more powerful already than what we saw in the impeachment of richard nixon. and and what's more, the evidence at this point in time certainly merits the inquiry that is taking place. jedediah: crazy talk or no? >> i don't know how he would know that everything has been done in secret there have been selective leaks. i think it is based on pure speculation. i don't see the type of evidence. when the president released the actual transcript of the

interaction with the ukrainian president, even adam schiff couldn't take the actual verbatim verbiage and spiel that in front of the world. he had to make it up. so, i don't know where he is coming from on this. i don't know how he would think he would even know it. pete: literally breaking into your opponent's headquarters to steal information is what happened. and all the tapes and secret conversations erased. how does one draw a parallel between that and basement secret hearings that republicans are not allowed to even see? >> my own personal theory is i think the left is panicking. i think brennan and clapper and comey and a host of other people know that the horowitz report, which is a serious report, and john durham, the u.s. attorney out of connecticut, are doing a serious investigation and i think this unearthed pit is a tantrum or distraction on the side. i really do. jedediah: you say people are panicking. do you think joe biden or president obama are

panicking. if you are talking about obama era officials, joe biden is running for president right now. he is worried about what he asked about this what he knew and did not know. >> the way this works the inspector general will actually show a snippet. if you are mentioned in a inspector general report. they will see a snippet. when you see clapper and brennan and some of these other people trying to get out of it ahead of it and give a spin, it's because in part they know what's coming. not that they can change it. they may have actually seen their little snippets of it. and if you aren't looking, clapper, brennan, this is the director of national intelligence. this is the head of the cia. and you are going to have an interesting choice for joe biden. walls he involved and engaged in the day-to-day operations of the white house? or was he just oblivious in showing up at funerals? he has got an interesting choice there. ed: really interesting. the president, there is some in the media saying he needs war room. he needs more advisors, communications team. he says, look, i'm taking care of the impeachment strategy. watch. >> everyone is talking about the team.

i'm the team. i did nothing wrong. this was the insurance policy was strzok and page. we did nothing wrong. what strzok said oh, she is going to win, she is going to win. but if she doesn't, we have an insurance policy. so this has been going on since before i got elected. and people are angry about it. and do you know who is angry about it? the republican party is angry about it. because this isn't a take down of the president. this is a takedown of the republican party. and, frankly, the democrats should be ashamed of themselves. ed: there is a message there where he is basically trying to say democrats are trying overturn the last election. >> they are playing offense. nancy pelosi, go back to the january 20th "the washington post" story where it says impeachment proceedings have begun. in 2017. the day the president is sworn in. now, part of it was tongue in cheek but a lot of it is reality of what they were trying to do. nancy pelosi, think about it, she stands up before the world and says formal impeachment proceedings have

begun, even though they hadn't talked to the whistleblower, she hadn't read the underlying document. i don't believe that by the way. it's really quite stunning. pete: what more should republicans do, can they do to have the back of a president they feel like is being targeted? >> i think when they finally started playing offense, the republicans, the republicans are usually out there apologizing and trying to justice. but when they actually tried to say hey, we should be able to go in and sit in on these meetings, i thought that was a great thing to do. they can do a lot of things against adam schiff. they can file an ethics complaints. how is it that adam schiff still has a security clearance let alone head of the intel committee. there are a host of other things they can continue to do. play offense. jedediah: we are going to turn to headlines for you. this is a fox news alert. california's largest utility company admits it may have sparked a massive wildfire, despite cutting power to prevent one. new video revealing the moment that kinkade fire broke out in wine country near a high voltage power

business. it's two sides for most of america of the same coin. if we are going to get into little slight bits and differences and variations, that's not the way you play the politics, if you are explaining you are losing, isn't that the expression as it goes? she can't explain away her differences from bernie sanders and for america there is no difference between the two. pete: the democratic party, they are scheduling their debates, they have had a bunch of candidates on the stage. they had 12 last time. barely gave them time to talk. they made it more difficult in december for democrats to qualify for upcoming debates. you have to get 4%. ed: 4% in four polls. pete: if you don't have 4% by december you are in trouble. are they going -- what does this mean as far as the candidates that they have? >> this has not been fun for them. this has been a clown show for them on a lot of the levels. having 12 people up there prevents people from talking and you don't get to control who is talking. it's clear they want to keep tulsi gabbard out of this. they don't want her throwing a wrench into the works. it's clear they don't want other people engaged in these conversations. they have their favorites, like they did just four years ago. and so they are trying to

keep some semblance of control, which is what these polls are about. keep the numbers smaller to be able to engage more of a debate. the problem with that is they are all debating basically the same subject. the difference between medicare for all and medicare for all who want it as pete buttigieg wants is about speed. not about where they are eventually wanting to go. they have the same vision for the country. that's one of their biggest problems. pete: they want to block the gang and tulsi gabbard. ed: worked out well the last time. >> a dream come true. they want to be able to gain some control and for those establishment democrats they are trying to figure out what do do because joe biden has failed them in every way. take a look at the poll numbers. we have discussed this before on the radio, ed, we have discussed the fact that biden simply can't connect. he goes four sentences in and he fails in the debates and they can't trust him against trump. ed: tony katz appreciate having you here on the couch. can you hear him on the radio all around the country.

>> well, that's the beautiful thing about portsmouth. it's the people there. and the people care. and for far too long the narrative has been negative for us. and so what we did is we opened up a gym. and that gym led to follow-on opportunities. one of which was a partnership with the area's only nonprofit dug addiction treatment center called the counseling center. we piloted a brand new innovative program where we started bringing cross fit classes to people going through recovery. and what they did for me personally is i used to just judge these people negatively. every day i would see them walk by my building and just cast judgment upon them. and that wasn't solving the problem. and it wasn't until i began offering these classes to people that i got to know them on a one-on-one basis and realized that the problem isn't the people. the problem is the addiction. and small business has the power to solve that issue. pete: dale, talk to me about one of those people, andrew

wright who is now a big part of your organization. what's his story? >> >> andrew is an unbelievable man. a year ago. he was homeless. when i asked him when he was graduating what he was going to do he said he was going to check himself into a homeless shelter. and i didn't even know where the homeless shelter was in my area. i said hey, man, come to the gym tomorrow morning. i will give you a broom and mop and you can start working for my other company doc spartan. that was a year ago. today he is a coach at my gym. he is a head of fulfillment for doc spartan and more importantly he has a car. he has his own apartment. and is he working to gain custody of his children. he has gone from a tax paying liability all the way to a tax paying asset. pete: and your overall message is you can wait for the federal government. you can wait for these big ideas to trickle down or you can do something yourself. >> no one is coming. it's up to us. small business is the backbone of america. and we have, through compassionate commerce, the ability to fix this problem if you care.

thinking that a right they don't like shouldn't be protected by the constitution. that's where it starts. pete: lawrence, isn't the speech we don't like that needs the most protection? isn't that the point? are they just not learning that very idea that the idea of what speech you like or don't like could depend on hot majority is, which is against the whole idea? >> well, they are learning about hurt feelings. and if something hurts their feelings, they feel like it should be prosecuted in the court of law. look, there is a lot of hateful people out there. i just don't like. there is a lot of point of views that i don't like. i believe that there is a free marketplace where the people get to decide what they like and what they don't like. we don't need the federal government to shun these people. i think i have more faith in humanity than shun those people. jedediah: criticism of the first amendment. you now have colleges and universities that are teaching their faculty to steer away from grading just on merit and instead do this ths

inclusive grading. what will that look like? going to look like going into a professional training where people aren't prepared for the job they were supposed to be prepared for. i understand when you bring down the races in this country, people don't do well in math or science and all of that you it's a failure on the local level when it comes to the secondary education of people not getting the quality education when they are in high school or when they are in elementary school. this is an easy fix. if people would just go for school choice where kids don't have to go to failing schools based under zip codes. then when they go to college, they will be prepared for a lot of these courses. pete: boise state, which has good football team and blue football field. they held an event this week. they called it. this they said inclusive teaching means inclusive grading as well. so, does that mean -- here's part -- additional part from

american university in february. they said grading isn't just grading. rethinking, writing assessment ecologies towards anti-racist ends. so we are not grading people based on how they do. we are basing it on who they are and how we think they should do? >> let me tell you it's going to be very scary if i go to my doctor's office and he is not prepared to operate on me. or i go it my dentist or my lawyer is not prepared to defend me because he was inclusive in some inclusive course didn't get the solid education to defend me in a court of law. like, i mean, this is -- look, it's one thing to be accepting in our culture. right? and talk about different cultures. it's another thing -- you know, it's actually insulting. what is essentially said people of color cannot cut the mustard. and i contend that we are ready and prepared to do just like every other american to take those courses. jedediah: i remember when school was just school.

we are today on china? >> the deal will sound big, but, in reality, it will be very small. it will essentially serve u.s. farm interest well. which will help the president in his reelections. the treasury department wants liberalization for the banks. that's all steven minute new jerseyen is interested in. president xi is playing this division in the administration mnuchin wing that basically wants to paper this thing over and the lighthizer wing that wants a comprehensive deal. we will get a partial deal. it's going to look big, but it's really not going to resolve our basic problems. moreover, most of the tariffs will remain in place and america will continue to disengage from china. pete: you are saying a lot of the tariffs will remain in place. things like intellectual -- forced intellectual transfer. theft of intellectual property, the things that china does that slants the playing field, you don't think this will fundamentally change that. >> china is changing its rules. but it's doing it in a way that it can basically orchestrate its private sector to implement the

discrimination. instead of saying the government saying go ahead and negotiate a joint venture that exdistracts intellectual property from an american company. it will identify those that are targets and turn a blind eye while private companies do it on their own. in reality, i mean, a lot of american companies are already starting to complain about what reforms are being proposed and implemented in china. they are complaining very vehemently this is not a solution. i'm afraid they are right and essentially steven mnuchin, the treasury secretary,as we have seen since the canada u.s. free trade agreement the treasury department has been very powerful and provincial in protecting its interest and in this case it's doing so at the expense of most of the private sector. but i will say this: the private sector that's affected, understands this is going on. they have heard it from people like me for a long time. but just like they are to segue to the lebron james thing, they are unwilling to raise their voices and call him out.

and all of these -- all of the people who participated in the complete set-up of general michael flynn. >> the case against flynn stems from the fbi interview about conversations he had with former russian ambassador sergey kislyak. flynn ultimately pleaded guilty to making false statements regarding those conversations as part of former special counsel robert mueller's investigation. powell alleges the fbi manipulated the summary of those interviews and claims ex-fbi agent peter strzok was involved. >> they exonerated him completely of being an agent of russia by the end of january. and, yet, mr. comey still runs to the white house on february 14th and conjures up the entire obstruction of justice narrative against the president when flynn had been cleared of everything long before that. >> flynn is scheduled to be sentenced on december 18th, guys. ed: all right. lucas tomlinson live in washington. is he a nationals fan by the way. he is probably routing for them tonight. in the meantime this big, big story. the president has been saying for a long time that the investigators were out

to get him and that he was set up. he was framed. here was his national security advisor michael flynn who has long-argued that he did not lie to the fbi. which is what they got him on. we talked to brett tollman in the last hour. he is a former u.s. attorney for utah. he says this is a big deal that is shedding light on what went wrong and may really set things up for this criminal investigation that's going on. watch. >> it's chilling and it should give us a concern whether we're democrat or republican in this country that those with the most powerful tools we grant our investigators, our agencies that you may have operatives or intelligence community working with the fbi to come up with and to conspire to take down either a sitting president or those in his campaign to do that with the laws that we have should concern all of us. pete: talk about this 302. a friend of mine very wired in on the legal world says

302 is a compilation of agent's notes. not a transcript. so the notes can be manipulated. a bunch of people in the meeting decide what was said and what was not said: think about the fact that they set the meeting up at the beginning of the trump presidency because they thought there was some -- there was irregular processes. get in and there make flynn comfortable. they have already sent russians to meet with him to set the pre-text. what did you know and what didn't you? then they minute the notes? it all looks like a set-up. when you look at durham and barr and their now criminal investigation. man, what did they know and when will we hear it? that will have huge implications. jedediah: tolman used the word telling. this is something you should care about. if you have a story about the fbi manipulating people's quotes. manipulating potentially their records, this is really disturbing on many levels. you have to think if that can happen under one administration toward one president, it can certainly happen under another administration towards another president.

this should be something universally condemned. unfortunately in media so much you see it utilized as a talking point because they don't like trump. suddenly it's the doj, don't like trump, this isn't a real story. this is highly highly disturbing. pete: if you watch elsewhere other networks, they all say this is political revenge. that's the lead stoferred as opposed to what's going on. jedediah: they should care about. ed: let's follow the facts and see what john durham finds and see whether it's a conspiracy theory or they really were out to get the president. we may finally find this out. meantime the president on offense about impeachment a few moments ago tweeting out about nancy pelosi charging she is spending more time on impeachment than actually taking care of her district back in san francisco. jedediah: here is this tweet. i can't believe that nancy pelosi's district in san francisco is in such horrible shape that the city itself is in violation of many sanitary and environmental orders causing it to oh th owe the federal government billions of dollars. and all sheet workers on is impeachment. we should work on these

hazardous waste and homeless sites before the whole city rots away. very bad and dangerous conditions. also severely exacting the pacific ocean and water supply. pelosi must work on this mess and turn her district around: good point all they focus on is government. we forget these people are elected to represent people. like nancy pelosi is elected to represent people of her district. those issues should also be front and center. all she seems to care about is impeach donald trump, impeach donald trump and people in her district sitting at home what about us? ed: that's why they are rushing to do it by thanksgiving. they want to tell their base we impeached him. we did that move back to the other issues, economy, healthcare. they might not be able to get away with that it will be throughout they were focused on impeachment. pete: it's tough to be the manager of the swamp. spending all that time caucus totally out of control. committee chairman lying and incompetent. adam schiff and others. you can't pay attention to that she is so invested in the failed policies that fail these inner cities,

sanctuary cities, the homelessness problem. the dependency problem. the drug problem that she can't take it on. she couldn't speak truth if she wanted to. that's the president's point. jedediah: she has to oppose her own policy. ed: jason chaffetz was on the couch with us last hour. he said this is a big, big problem for the democrats. it might boomerang on them. watch. >> go back to the january 20th "the washington post" story where it says impeachment proceedings have begun. ed: in 2017. >> 2017, the day the president is sworn. in part of it was tongue in cheek but a lot of it is reality of what they were trying to do. and nancy pelosi, think about it, she stands up before the world and says formal impeachment proceedings have begun, even though they hadn't talked to the whistleblower, she hadn't read the underlying document. i don't believe that by the way. and it's really quite stunning. ed: this is a big, big story. another one out on the campaign trail in 2020. remember when beto o'rourke thought he would get energy on the left by going all in on taking away second amendment rights and said basically the government wants to come get your guns

and even democrats like chris coons the democratic senator said this is not so good for the party to be that far left on this issue. beto is backtracking a little bit after a young hunter, a young guy in iowa said, you know, i actually use some of these weapons to hunt. you may not understand, this congressman. and now is he backpedaling, watch. >> i am a hunter myself. i have used an ar-15. what about those people who use that as a way to get dinner. who live down south. >> you address a legitimate concern or need is to ensure that those who have or want to use an ar-15 are able to keep it at a hunting club or at a gun range. so there is some control and safeguard still placed on that firearm. ultimately, we take some action to save the lives of those who are being taken and then to protect against the kind of fear these acts of terror are inspiring. jedediah: this guy is so condescending. can you believe the audacity listen.

he deserves the respect that the office itself is. so, if johnson disagrees with him, i can understand that and if you don't see eye to eye with him on a lot of things, i understand that, also. but he is still the president of the united states. he still has that level of respect that's due to that president. if he does say something derogatory about chicago, johnson has the ability to respond or to walk out. the office of the president still needs to get that respect. pete: so the police union in chicago held a vote of no confidence for the superintendent eddie johnson after he decided not to go to the speech. here is how eddie johnson responded to the vote. today's decision from the board and not the from active f.o.p. manipulate membership. i understand and respect the lodge is upset about the decision to not stand with the president.

form was manipulated? what do you make of that and its potential implications? >> you know, jed, this is, of all the things i saw this week, i rarely use explicatives on twitter. this one blew my mind when i saw it. think about what happened here with the allegation is. just to be clear with the audience. fbi 302 is a documented summary of an interview they conduct. we didn't have to do those in the secret service formal forms afterwards the fbi does. the interview flynn, the allegation now, after they interviewed this dedicated american patriot, an unquestioned military hero when they interviewed him, there was no evidence, none, that mike flynn lied to the fbi. fbi even said that, people on the record, that there was no evidence of deception. it now -- this allegation has surfaced that the form they used to document the interview of mike flynn where they indicated he wasn't deceptive was changed to indicate that he was deceptive when he wasn't. so let's just sum this up for a second. a dedicated american patriot

chosen by donald trump to be the national security advisor, right? a military hero, is being investigated and interviewed for a crime that isn't even real. the logan act is the unconstitutional mess that has never been prosecuted successfully in the history of the united states. so he is being interviewed for essentially a fake crime. he gives an interview where the fbi acknowledges he is in no way deceptive about a conversation he had with the russian ambassador which is perfectly ethical. he is then sent to jail for lying when the fbi said he didn't lie and now there is some evidence surfacing that they manipulated evidence to get this american patriot locked up. this is a cosmic level disgrace, ladies and gentlemen, that even the left should be asking questions about. but they won't. because the tier ran any streak is strong with them. ed: dan, it's happening in a broader context. disgrace if this was the only incident. it's happening in a case where maybe the president was framed. maybe there was a whole

series of events that is now being investigated by john durham, this prosecutor, his review of what happened and how the investigation started has now become a criminal investigation. and it looks like some obama officials are nervous. watch this. >> well, you know, very curious, since presumably i guess i'm one of those under investigation. >> do you have any idea, even, i mean, what they might think may rise to a level of a criminal offense? >> no, i don't. that's obviously an item of great interest to me. what i is that any of us did that would rise to the level of a criminal infraction. i just don't know. ed: dan, in fairness, halloween is coming up. looks like james clapper saw a ghost or something. did you see how he reacted? >> yeah, james clapper is going to need those pent toe pills coming up. they are in a world of trouble. his buddy james comey is the director of national intelligence. no question he is read in on the entire spy gate scandal. the biggest political

scandal in american history. here is the problem they are all going to have. there are a number of them but i will get to the big one right here. i have strong evidence that in january of 2017 no later than that day. james comey and the fbi know for a fact that the sources christopher steele are using and claim to be russian sources with verified of evidence of collusion, they know it's false. absolutely know it's false and they go and sign on to additional fisa warrants anyway. that is a big, big problem. ed: if james clapper, james comey knew this and they still went to the fisa court and ended up spying on carter page, maybe others, big, big problems ahead potentially. dan bongino has been all over this story from the beginning. people have dismissed it as a conspiracy theory. we may be about to finally get the actual facts. dan, we appreciate you come in. jedediah: thanks, dan. pete: thank you, dan. >> thanks, guys. pete: turning now to the headlines, victim of the slenderman attack speaking out for the first time.
