9:00 pm
remember i'm watters and this is my world. [♪] jenna: hello and welcome to "justice." i'm judge jeanine pirro. thanks for making "justice" number one last weekend. thank you, i love you all. tonight republican congressman and house freedom caucus chair andy biggs plus dan bongino, thomas fit on, dennis prager and sara carter. but first the name of the show is justice and it's coming. the great nest thing about america is justice always wins
9:01 pm
in the end. we have watched for years as radicals attempt multiple takedowns of the president. each takedown was part of their political agenda. not an agenda of truth and justice. but make no mistake. justice always prevails. this week the department of justice opened a criminal investigation into the russia collusion claims of the obama administration essentially investigating the investigators. the ones who decided to open a counter intelligence investigation, then seek secret warrant to spy on an american citizen to ultimately spy on the campaign of donald trump. you know the story. but this criminal investigation is different from the i.g. report which we expect to finally see with quote few redactions. although the i.g.'s report may indeed provide a blueprints much what was done there will be is
9:02 pm
no official consequence to the report. john durham, the united states attorney in connecticut running the investigation for the justice depth is widely respected on both sides of the aisle. having worked under president bush, obama and now trump. he's not a politician. it's not in his blood. he's a truth seek were, pure and simple with an expertise in intelligence investigation. he is the ultimate lawman. prosecuting without fear or favor. compare him to andrew weissmann whose career prosecutions are riddled with ethics violations that even the supreme court condemned. the radicals on the left said the president is wrong to use his own departments of justice to go after his political enemies. but i ask you to consider this.
9:03 pm
a fisa warrant was issue offed and reuped three times. the person against home it was issued is still walking around, never arrested. so if there was nothing there, why did the fbi and the department of justice choose carter page to go after? an innocent person. and then reup that same warrant three times which requires by law additional evidence? obviously there was no additional evidence. number of two, the mueller investigation completely staffed by the most of biased trump-hating ideologues out there with enormous money and power wernt on for 2 1/2 years in an effort to convict the
9:04 pm
president of the united states with collusion. they came up with nothing. they lied to us for years about how our president was a russian asset. and that they had evidence. when it was just the opposite. cash from russia was running to the clintons. secrets from america were running from obama to putin. missile defense systems disabled so russia could attack ukraine. john brennan, james comey, james clapper, all of them worked hard to promote alleged treasonous, poisonous alliance between trump and putin. now we are witnessing number three. the resistance continues in their radical star chamber in an attempt to impeach the president in violation not only of the house rules which require that an investigation be conducted in
9:05 pm
a fair, impartial and bipartisan or non-partisan basis with the power to authorize subpoenas and other compulsory process committed by the resolution in the first instance to the chairman and ranking member acting jointly. that's not the case here. they clearly anticipated a joint, fair and impartial effort to garner evidence. but these radicals don't care about justice. in their desperate attempt to seize power they want donald trump gone at any cost because they know their clown car of democrats can't possibly defeat the man who is delivering historic metrics for this country. so in secret behind closed doors they leak what they can to destroy the president. this is not an impeachment. it's their third attempt at a coup.
9:06 pm
but the difference now, john durham and bill barr are on the case. so folks, grab your popcorn, junior mints or whatever makes you happy. the real show is about to begin. multiple criminal leak investigations are under way. the fisa warrants are being scrutinized. the investigation peter strzok tried so hard to avoid is beginning. the i.g. report will be out soon. then it's show time. for obama and brennan, clapper, lynch, rice, strzok, mccabe and the whole cardinal comey crime familiar live hop devoted themselves to not only obstructing the will of the american people, but the very foundation of justice in this great nation. god help the real conspirators in this case because in the end,
9:07 pm
justice always wins. that's my open. let me know what you think on my fab * and twitter #judgejeanine. '. justice week a group of republicans tried to get into the secret impeachment hearing. it's not real impeachment hearings but that what's they have call them. take a listen to the democrats' response. >> they are unauthorized bodies. they may have brought in the russians and the chinese. jean * here with reaction to that and more, a man who was part of that group of republicans. andy biggs joins me now. what do you have think of swalwell there? when did he drop out of his run for president. i don't think he got 1%.
9:08 pm
did he? >> i will tell you when you are trolling zero percent, it's time to step back. judge jeanine: the resentment by someone in congress to fellow congressional members, aren't you guys part of the same club? >> yeah. you know, i read the rules and they indicate these things are supposed to be open to everyone. but leave that aside. i don't understand the russians and chinese. we were all-american citizens going in there. we all have top security clearance. we have the clearance necessary to enter. mr. schiff himself said these are not classified hearings. if they are unclassified why are you holding them on saturdays when people can't be there. you are specificking it in the -- you are sticking it in the scif, the secret compartment where nobody can get to it.
9:09 pm
you can't have media in. you can't get transcripts. you have to have a democrat sitting with you. this is crazy to say they are bringing chinese and russians in when the reality is they won't let americans come in. judge jeanine: the amazing part of it is the constitution makes it very clear that congress decides whether or not to impeach. not one person, nancy pelosi. but the public needs to understand like they harper these selectively. let's talk about what's going on. adam schiff says this is like a grand jury. they leak out everything they want. when i was a d.a., i had somebody who leaked out grand jury information, i indicted and convicted them for leaking grand jury information. that many the law, isn't it? >> that's right. it's a false comparison saying a grand jury. this is a political process,
9:10 pm
grand jury is not a political process. when i was practicing law, if somebody was leaking stuff, they got indicted. they got prosecuted. schiff will go in there and he will basically take out of context what he wants to cherry pick and the american public to know. he will give a press conference about what went on in there, and you will see the stuff leaked. i know more from reading "the washington post" and new york times than i can get from there. the republicans aren't leaking. judge jeanine: if republicans were to come out to a camera and say what happened in there, i understand and lot of these claims being leaked are under cross-examination being literally decimated. why don't republicans do that? >> because they have been threatened with an ethics complaints by mr. schiff.
9:11 pm
judge jeanine: why don't you file a complaints against schiff. >> a complaint has been filed against mr. schiff. he threatened us for going into that scif. if you don't leave we'll get an ethics complaints against you. while they go nowhere, we we spend hundreds of thousands of dollars to defend ourselves on every ethics complaints. that's how tyrannical this is. judge jeanine: they can leak this information out. but unless the president's counsel is there because it's not a real impeachment hearing, they are not allowing any of tht allowing any of the quasi cross-examination. if you have a witness who hates donald trump of course he will say x, y or z.
9:12 pm
we'll never get to the truth. this is like a charade. >> that's right. we are not going to get to the truth unless you open it up. that's the only way you can have -- and you know this because you tried cases. you look at the witness, their body language. it helps them understand their veracity and credibility. they will give as you transcript and say this is what you get. that will not be good enough because i will not be able to tell from reading something how this was framed. you know, the smirk on their face as they testify. judge jeanine: the shifty eye, the inability to make eye contact. body language. one of the things that i think is very interesting is that the whole idea of a quid pro quo. let's talk about this. joe biden got the quid pro quo.
9:13 pm
he says no money, you don't drop the prosecution you don't get the money. they drop the prosecutor and they get the money. the president wanted them to cooperate on the investigation, okay? and if that is the premise, the truth is they didn't cooperate. they didn't start earn investigation, and they got the money anyway so there is no quid pro quo. will you have explain why one guy is being investigated and the other guy who accomplished and got what he wanted isn't being investigated. >> because this is partisan politics. joe biden won't get investigated base's part of their today balancing. judge jeanine: what are you going to do about this guy? >> we'll depantds handled there be -- we'll demand there be further investigation. there is supposed to be further
9:14 pm
investigation ongoing. >> you are talking about barr and durham. you are talking about the real deal now. >> so you are going to get the inspector general's report. i believe the move to a criminal investigation we have seen by ag bar is direct live related to the i.g. report. of course, mr. barr has seen this and he knows there need to be some indictments. he has given this to mr. durham and they will pursue criminal charges. judge jeanine: had in letter and schiff say these raise profound new concerns that the department of justice under barr has lost its independence and has become a vehicle for president trump's political revenge. the bottom line is when you get the department of justice to do something it's political revenge. you remember when barr came out they wanted him impeached right
9:15 pm
away. i have a whole chapter in my book about that. now that it sounds like they are going to do something, they want to impeach them as well. if america is going to have any confidence in the justice system you will have to make sure in addition to the attorney general that you don't take schiff's garbage anymore. that means if you have got to sit there all day and file an ethics complaint, you want to file? you worried about an ethics complaint? file it against them. congressman andy biggs, good to talk to you. can bill barr help save michael can bill barr help save michael flinls reputation?
9:16 pm
9:17 pm
i get it all the time. "have you lost weight?" of course i have- ever since i started renting from national. because national lets me lose the wait at the counter... ...and choose any car in the aisle. and i don't wait when i return, thanks to drop & go. at national, i can lose the wait...and keep it off. looking good, patrick. i know. (vo) go national. go like a pro.
9:19 pm
>> he will be interviewed by mr. durham as part of this non-investigation. i don't under the presented case of this worldwide effort to uncover dirt real or imagined that would discredit that investigation in 2016 into russian interference. the hand of politics and trump are being used to massage what this ongoing review, quasi investigation is. so i am concerned. judge jeanine: you ought to be concerned brennan. but what i don't understand, president obama's former cia director john brennan's reaction to being a focus of the search for the truth.
9:20 pm
dan bongino joins me now. for this guy, dan, to say i don't understand why they are even doing this. wait a minute. we spent almost three years going after the russia collusion delusion that you guys made up with your buddy clapper and comey. you made it all up. even your friend mueller said there is nothing there. now, you don't get we want to understand where it came from even though you admit there was no there there? >> the reason brennan is in a world of trouble. the primary remember, public live available report big media types before they figured out collusion was a hoax. brennan met as far back as 2015 with foreign intelligence officials passing information on trump.
9:21 pm
that's on the record. that's not a conspiracy theory. that's been widely reported. 2015, they thought collusion was real and the fact that foreign intelligence was passing information to brennan about trump, they thought it made the case look that much more sincere. only when the collusion thing was exposed as a hoax did brennan had to backtrack saying i am colluding to spy on trump with foreign officials? that's what he accused trump of. judge jeanine: i think i gave him the title of pond scum in my book when i talked about my book. clapper should have been in trouble a long time ago. every time he opens his mouth he lies and leaks. i want to talk about somebody i think got a raw deal.
9:22 pm
that's michael flynn. this week a motion was filed that pretty much slams everything the feds were doing. the claim that the 302 was supposed to be made con tell prayer was summary of an interview done by an fbi agent. apparently those 302s were changed from michael flynn, it didn't seem like he wanted to deceive. he was having a conversation to michael flynn deceived us. therefore it was an interrogation instead of a conversation. >> if there was ever an american worthy of a presidential pardon, it's michael flynn. we know brennan couldn't stand mike flynn. brennan was a big proponent of the iran deal, mike flynn was against it from the start.
9:23 pm
they were not friends. brennan had every motivation in the world to be involved in the takedown of flynn. some of the spygate figures involved in targeting trump are also involved in targeting flynn. it's now alleged clapper told a "washington post" reporter, this is the director national intelligence told a reporter allegedly to quote go for the kill shot. this is the director national intelligence. then you have comey who acknowledged publicly. judge jeanine: cardinal comey. >> he said on the record that he sent agents or to the white house knowing it was not standard procedure because he thought he could get one over on the trump administration because they were new.
9:24 pm
judge jeanine: he was proud of it. they were proud of the fact they circumvented white house rules, regulations and policy, and the constitutional requirement because he was a target of the right to remain silent. they say we just want to talk, no big deal when they had the intent from the beginning. if there aren't charges as it relates to the leaking of this information. when the head of the dni, clapper, who says we don't spy on the american people, and if there aren't charges against this guy for leaking information to the "washington post," this is an outrage. >> there are three crimes here with flynn. we know the obvious one, the leaking of the flynn classified phone call. we know now there is potential
9:25 pm
falsification of evidence. sidney powell is making a staggering claim that the fbi manipulated the interview summary of flynn to make it look like he lied when he didn't. then you have the additional crime of false representations before a court. this isn't like jay-walk. this is real stuff. somebody is going to be found to have committed these crimes. judge jeanine: apparently what they are saying is the intel operatives working with the fbi conspires to take down not just the president, but those around him. obviously there was a target on him. and the editing of flynn's 302 which are those documents considered so precious and so clear in terms of what happened after an interview, then after the fact we find out, dan, we found this out a long time ago, there were people in the fbi who
9:26 pm
didn't think he had the intent to deceive. because you think you say something that's not true doesn't mean you can't be prosecute. you must have the intent to deceive. did you know you were being interrogated? did you have everything in line in your head. or was it just i think i said that. all of these things are important before you can bring a earning are you charge. but they wanted to hang him. shame on them. and i wish him the best. >> intent matters. page already acknowledged in a text she made those edits. the only question is what those edits were. they are in a lot of trouble. judge jeanine: dan bongino. thanks for making this so clear. who was the deep state collaborating with in the early days of the investigation. tom fitton is here to tell us

joseph mifsud. it was the allegation that he was pushing the emails. but he may have been a western intelligence guy work for us. so like the fisa report that suggested there were outside sources? they were all inside sources. it looks like to me that barr and durham confirmed our suspicions there never was any intelligence on busch collusion it was made up and created by political operatives in the united states or informant of the fbi and cia. we have this endorsement of that theory in the sense they are looking at the origins of the trump investigation. and they concluded this week publicly that there may be a crime involved there. so there is no talking around it. this is why they have the coup

going on in congress. they knew this was in the offing. i don't know if there will be prosecutions in the end. but we know senior officials at the justice department, including a senior attorney concluded there is enough there to . judge jeanine: we have got this guy mifsud, and we are not sure which side he's on. but we note cia -- the fbi should only be handling domestic issues, is that correct? and the cia handles international issues. >> the characteristics a is not allowed to spy on americans, and the fbi can't target americans in the united states for political purposes which they seemingly did here. when you look at the fisa-gate

9:36 pm
indict paul manafort. >> it sure looks that way. if you don't believe me, go online and read the fbi report at judicialwatch.com. they were pushing this investigation targeting manafort. asking whether he could be charged under the foreign agents registrations act. they offered up the private access code to manafort's public storage locker to the fbi and weissmann. the locker was raided a few weeks later during the mueller investigation. of course, weissmann was working for mueller at the time. then weissmann tells the a.p. reporters. can you go back to cyprus and make sure that government gave us everything they were supposed to on manafort? this collusion is so corrupt.
9:37 pm
they should look at manafort's pardons as well. judge jeanine: weissmann is making the associated press agents of law enforcement. the associated press in bed with the left and the fbi to indict a trump affiliate. this is crazy. >> i look at this report and of course you can bet the a.p. had information on tony podesta, greg craig, the former clinton lawyer. i didn't see any of that conveyed to mr. weissmann. it was all about getting manafort. we had just gotten documents two weeks ago showing that the "60 minutes" and other reporters were calling up rod rosenstein and cheering him on for appointing robert mueller special counsel. there are witnesses of criminal

ideas without fear of being fired your job or shouted down. >> you are not to be heard. this is one of the few things one could say we have no precedent for in the united states. judge jeanine: that's a clip from a brand-new documentary film out this week spotlighting a critical issue we covered extensively on justice. my next guest called it a wake-up call about the dangers of p.c. culture and how free speech is being trampled upon. no save safe spaces, you have a right to remain silent is a must-see. joining me, dennis prager. i want to remind our viewers who are awaiting some kind of word from the white house after the white house tweeted about a big

announcement coming. but in the meantime, dennis, thanks for joining me. you have put to film what so many of us have been talking about, and that's free speech, the first amendment, and how the left is doing everything it can to shut down the free speech of those of us on the right. tell was the movie is about. >> it's precisely about that. i'm happy to announce i just literally just now learned it was the second highest grossing documentary in american history. missing out by $1,000 of michael moore's film sicko. so if this continues, it's not the money. we didn't make this for the money to begin with. congratulations is for the cause. i want your viewers to understand something that for me
9:44 pm
is a deep passion. this is the first time in american history literally the first that the free speech is under assault. there was one thing all americans agreed on. i may not agree with what you say but i will fight for your right to say it. that is dying. the washington "free beacon" just reported this week that 50% of millennials and almost 50% of americans think the first amendment should be changed and hate speech has no right to be spoken. but that's the whole point of free speech is what i think is hate speech be allowed to be spoken. this is a very scary thing because that many the bedrock freedom of all other freedoms. this movie is a wake-up call. it's really well done. i take no credit for it. i'm quote in quote unof the two stars in it. but i take no credit for its greatness. it's a great film independent of
9:45 pm
me beings in it. judge jeanine: i have been talking about this for a long time. political correctness today is the enemy of free speech. if you have say something that is not politically correct, you will either lose your job, antifa will beat you down or you will lose your friends. people of think that's okay. that the young people being triggered in safe spaces and colleges. when has this happened, dennis? >> my view of this is the following. we can win if liberals awake to the fact that the left is their enemy, not right. that's the key to saving america. liberals have always believe in free speech. the left since lenin, the left has never believed in free speech or any other free speech. that's the way the left operates.
9:46 pm
it doesn't love liberty, it loves power. so that's why this film is filled with liberals. there are so many liberals in this film. allen dershowitz says to me, dennis, as a liberal, as a democrat, as a hillary clinton supporter, as a jew, i am far more afraid of the left than of the right. judge jeanine: the amazing part of it, now you have that film out there, and you had a successful first night. i assume it's going into theaters? >> yes, exactly. there will be missouri more cities this week. then a whole bunch after that. i believe and diego, denver, i don't know all the cities. i wish i did. but it's very simple.

here to discuss that and more. investigative reporter sara carter. what do you think? will she run again? >> yes, she will if she gets the chance. it's actually a sad case. see seems like a sad opinion. the last thing she said was that she beat him before and she'll beat him again. no, hillary, you did not win the election. you are not the president of the united states. but somewhere in her mind she feels like she needs retribution. now she can try if she is a glutton or punishment. judge jeanine: president trump i am sure would love for her to run. give me another year. i could do an open on her every night. tom fitton from judicial watch was just on and he talked about the fact that the cia and fbi

stephen halpert was paid what i know from looking at the documentation from the pentagon roughly $1 million in separate chunks that were going to him to file a report. from the pentagon's office of assessment. he was working in a clandestine office at the pentagon. they were paying him and paying others. he was using this money to bring people overseas to london. one of those people was george papadopoulos. he lures him to london, offers to pay him $3,000 to where a report. he does the same thing with carter page. carter page gets an invitation to come to one of his seminars. carter page and george papadopoulos were semi advisors and you be paid for the trump

9:55 pm
we don't know the details about this recording. the italians have spoken publicly about it to reporters. he was looking for evidence in london as what the u.s. intelligence communitier. >>, john brennan's characteristics a in 2016 had to do in london. he has two countries now. judge jeanine: let me cut to the quick. he's afraid for his life. who is he afraid for his life? mifsud. >> that's what we don't know. they heard in great detail in a classified setting what joseph mifsud was concerned about. we believe on the reports coming out of italy, the reports from george papadopoulos and others that he was working closely with western intelligence. if that's the case, it's a huge huge problem. judge jeanine: that would move a barr and durham to change an
