numbers. speaking of numbers this is a game changer. the ncaa will allow student-athletes to profit off their name, image and likeness but some lawmakers are already eyeing that money for tax purposes. todd pyro has more on the landmark decision. >> we are both college sports fans. with this decision the ncaa changing its decades long practice with student-athletes about to have the same opportunities to make money as all other students. the ncaa president stating, quote, as a national governing body they are uniquely positioned to modify the to ensure fairness and a level playing field for student-athletes. the board's action creates a path to enhance opportunities for student-athletes while ensuring they compete against students and not professionals.

the move comes after publicized pressure from california which passed a lie earlier this year for bidding schools from punishing their athletes for accepting endorsement money. with other states debating bills, to earn money as well. with news of the ncaa announcement came this was a plan by richard burr to tax scholarships for college athletes who profit off their name and likeness. he tweeted this. of college athletes are going to make money off your likeness in school there scholarships should be treated like income. i will be introducing legislation that subject scholarships given to athletes who choose to cash into income taxes. the ncaa goal is to have rules in place by january 2021 but didn't go into specifics how it would oversee this sweeping change. it is hoping for uniform national law or rule that applied to all members in all states but still far away from that.

reversed by the supreme court, the michelle carter case, this could be and probably is a stronger case. heather: you were saying a key difference between the two cases as well. >> yes, this defendant was on scene. the prosecutor said she stocked him and went to the scene but yesterday a boston press release said the defendant in a statement said she was trying to stop him. it is an interesting development if true. it could go to the heart of the defense. also this particular state does not have an assisted suicide statute. they are using a general -- i have a problem using the statute because what it requires is reckless activity that causes the death. when you talk about causation

there is another person active here. not like she held a gun, squeezed the trigger, was behind the wheel intoxicated or assisted in death through iv. there was no action that caused this death. heather: are her verbal words enough action? the last two month of the relationship out of 75,000 text messages between the two she said a total of 47,000 of those text messages. as you continue i want to bring this up because you were talking about it, state laws banning student encouragement, 5 different states and these, the differences between the cases. >> we have to keep an open mind. there is no cross-examination,

no defense attorney standing up, 35,000 text messages, 60% her, 40% him but a lot of text messages coming from him as well. keep an open mind about those text messages. >> on the fact as before which is 1-sided, i am normally for holding prosecutors to a higher standard always but in this case if it is similar to the texts in michelle carter's case this is a potentially stronger case because of the fact that she is there when he committed suicide and if you look at the way they frame the case you are better off if you die, these are not the kind of facts you want to herald free-speech on. no constitutional right is unlimited and in this case it is similar to the michelle carter case. heather: when does free-speech become criminal?

>> the michelle carter case went to the massachusetts supreme court, and said that it can be. however that decision has been appealed to the supreme court and there's an opportunity for the united states supreme court to jump in here and face cannot be. heather: michelle carter served eight month and was denied early parole in september 2019 so we will see what happens. have to cut you off, much to be debated and we will see what happens. we will be right back.
