been discussed in the testimony thus far. bolton's attorney says he wants a federal court to rule on whether the white house is overall a congressional subpoena. taking a different tact, the president's chief-of-staff mulvaney defied a subpoena saying he had been ordered by the white house not to appear and mulvaney asserted absolute immunity. >> the president has had an opportunity to allow witnesses to come in who could save him or provide exonerating evidence.g every time he blocks someone, we consider that on instruction of justice. >> fierce trump defender jim jordan is now on the intelligence committee tweeting republicans only h have till saturday to request witnesses for all open hearings. adam schiff decides which witnesses testify, if any. schiff decides when witnessess testify if at all.

the president's counsel still excluded, does this sound like due process? >> so as you know, judge, from your conversations with jim jordan over the years, that tweet is a mere preview of the type of, rhetoric that we're going to hear from him over the next weeks and months. >> judge pirro: thanks so much. today democrats released more transcripts from the secret impeachment hearing including the revealing testimony of nfc official and army officer alexander vindman. the biggest take away, his attorney and house intel chairman adam schiff blocking republicans from getting any real answers. here's one example. congressman jordan. the question is, who did colonel vindman talk to after the july 25th call? vindman's attorney, i'm instructing him and i'm allowing him to say. jordan, are you instructing him that way, counsel? >> schiff: excuse me, mr. jordan. you're not recognized.

jordan: it's our time. schiff: you're not recognized andou your time has expired. jordan: you told us you were going to give us extra time. what you took from us. schiff: and you've used it. and you've used it. here with me is robert driscoll and a campaign advisory board member. robert, i'll start with you what are they tryingri to hide? why are they stopping congressman jordan from questioning? >> well, i mean, i think it's equivalent, where you say, i'm really upset about something and it just causes more tension. when youou read the transcript congressman himself says, i don't want colonel vindman to answer the question because it might reveal who the whistleblower is.

if answering the person who you talked to would reveal who the whistleblower is i think that's a fair inference that colonel vindman f with the whistleblowe. we have this strange thing in washington where everyone knows the whistleblower's name and no one will say it in this hearing apparently, or this testimony they tried to ask vindman who he spoke with and the objection was, that might reveal the name of the whistleblower. so i think for normal person would you say i guess he spoke to the whistleblower then.he judge pirro: having been in a courtroom quite often it would be very simple to say don't mention the name of the person to thell get an answer question to get a sense of motivation, you know, who is he speaking to. what do you think onwh this? >> right, absolutely. it could above handled that way with a quasi motion. in fact, what i would say is before these democrats shut down the questioning and the lawyer caught on to the fact that republicans were gaining ground there actually was some very skillful g questioning by

congressman ratliff who got a number of admissions out of vindmam, including that it was just his opinion for a lot of things. it was really his opinion on policy issues that he didn't hear the president saying a lot of what he's claiming and damaging admissions amend that's when the lawyers and adam schiff and cronies tried to block further damaging testimony. so if you read the whole thing it's actually pretty bad and makes vindman look like a clown for the position he's in, coming in with his uniform, like the gravitas is hyped him. judge pirro: and that they are constantly trying to defend the ambassador as if that's a?-- crime in and of itself is rather shocking. you've got vindman's boss saying nothing improper happened and yet vindman is not a party to the call and he's taking back all of this stuff.

>> if i were on the other side of this prepping colonel vindman. c he didn't do a great job separating out the facts from his opinion and his opinion about what might have been wrong with the call from his opinions that he disagreed about the policies being pursued or the manner in which they were being pursued. those are all very different things. as a subordinate employee, some of those things are relevant and some of them aren't. and so frankly whether or not he agrees with the policy is not really relevant. whether or not he thinks the ambassador is a good person who trump shouldn't have removed that's not the point. president trump ist the president, he's entitled to have the ambassador he wants for whatever reason he wants it so that's all kind of a side show. really, the core thing is what happened on the call and do people think it's impeachable and, let's cut to the chase here.re the rest of these things?-- judge pirro: what happened in the call is in the transcript. i want to mention before i go to you, harmony, congressman nunes just tonight, sending a letterpt to congressman schiff saying

leak and other soros people were meetingg with him. what's interesting about all of this, judge is that it highlights that this ukrainent story is about the obama white house in a significant way because you had the alleged whistleblower there. dealing on that policy, and then you have the dnc operative virtually having a desk over there. judge pirro: let me ask you kevin, you're a real whistleblower. is he a whistleblower or a lake erie. we're not supposed to mention his name so don't mention his name. i don't know what we're protected but whatever. >> no, judge, this is not a whistleblower. this person is a leaker. there is no question about it. he's not even protected under the whistleblower statutes because he went and met with schiff's staff. not only is he a leaker, he's a political operative and we know from judicial watch's great work the logs show that this person

>>tom: certainly someone representing the president would want to talk to this alleged whistleblower, and in addition to that, his communications with schiff weren't protected by the law and if classified information was communicated to schiff's staff, there may be legal issues for him. and, of course, if he was talking to people like vindman outside the ordinary course of his duties there could be other problems there as well. you know, and what is schiff doing? he's protecting himself because he's been caught up in a scandal. the idea that schiff is still running the intelligence committee is one of the most outrageous issues related to the corrupt coup that's currently happening. schiff should be nowhere near this investigation. he's compromised. ethically, and he should be conflicted out, and under investigation, not conducting an investigation. judge pirro: you know, kevin what's amazing to me, and i agree with tom totally, i think
