interpretation and that person's interpretation of the transcript that we all read. now this is now blowing up in the democrats' face, americans are tuning out in a big way. viewership of this. public shamn dropped by over 1 million from day one today two and i but it dropped again today. a number of americans watching already pales in comparison to previous proceedings. the ratings werera so bad "cbs news," i predicted this, they actually decided to pull the plug o on their wall-to-wall p coverage earlier today in exchange for regular programming. i would expect other networks will probably follow suit. according to a morning consult poll, the first hearing were utterly failed to increase any support for this corrupt, this compromised schiff show, as notw voter support for impeachment and the inquiry, yeah, that is that a new low also. other polls showing that over two-thirds of americans, they have already made up their minds on the subject but they know it all comes down to the

who decides that? would that be the senate making those rules or would it be the chief justice of the supreme court that would preside over this madness? >> it would be the senate. you would have a resolution, have to be passed by 51 votes, setting the terms and conditions of the trial in the senate. that has to be done by senate resolution. what i will insist upon to get my vote is that the federal rules of evidence apply to the case presented in the house, so president trump's defense team could objective-c hearsay. t i think about 95% of testimony falls. the other thing i wanted in the trial resolution is the ability. to confront one's accuser because if you were to call the whistle-blower in the senate, i think you have a right to do that. so that's a person who started all this, and the right to confront your accuser is basic due process. >> sean: thought of the sixth amendment to the u.s. constitution, you are an attorney, i would think that is hebasic and fundamental.

powerful people breathed a huge sigh of relief from princes to presidents, sean, i initially, like you, put the chance of this being a suicide at near zero. i also thought that the cameras were not working. but the indictments today of the two prison guards, who really were negligent at the veryca least, indicates that the cameras were working and that according to the department of thjustice, the fbi, there waso nobody, no third party went into epstein's itself. there was no assisted suicide, there was no homicide apparent apparently. i don't put it past the reality, the harsh reality, that may be somebody paid the guards to not check on epstein but it does appear from the fact that there was an operating camera in the corner outside the cell, listen, i don't want to believe it. it seems very fishy to me. the famed forensic pathologist said it was a homicide, not a suicide. still, i trust the fbi in this
