have sondland who said it was september 21st and amended talking points, that is what he told that there was this quid pro quo. >> he may say that but i don't see that this is relevant to the idea of impeachment. we put conditions on foreign aid. we have done it for a long time. the president is the chief diplomat of the united states, not congress, not adam schiff. what seems to be going on here is congress being critical of how the president handled foreign relations with ukraine. that is not in impeachable offense, this is not serious misconduct by a president. that is what you have to have if you want to justify impeachment. what these witnesses have done is made the claims being pushed by democrats, the claims are just evaporating and going up in smoke.

jillian: two guards on duty face federal charges. joining us live is federal prison warden, you heard that language that has been used, criminal enterprise, the spokeswoman clarified saying what the director referenced, more criminal enterprise, she was mirroring the language lindsey graham used. what do you make of that language being thrown around. >> it is too early to tell. it is unfortunate these officers were indicted. from my perspective that illustrates deliberate indifference and it is very unfortunate that we need to wait a little longer and see what the fbi investigation reveals more explicitly first. >> the indictment on these two, pretty interesting when you look at what they were doing. we have a timeline according to the prosecutor what was going on at 10:00 pm.

35,000 staff that put their lives on the line every day. this is unfortunate. jillian: how is this going to change so it doesn't happen again? >> the agency is doing the right thing. the attorney general do the right thing in appointing doctor sawyer to the bureau of prisons, she has been a director before. i have tremendous faith in her and she will get the agency turned around but she will need a lot of help in doing that. we will see what changes are forthcoming but surely there will be changes made at the facility to ensure this type of thing does not happen again. it is inexcusable. rob: when they throw out criminal enterprise what could that possibly mean? >> it will be very interesting. rob: thank you so much. jillian: time to check in with

iowa but struggling to resonate with minority voters. with his latest mishap of using a stock image of a kenyan woman in his outreach to african-americans can his campaign recover. and democratic strategists jason nichols, thank you for being here. it is a mishap, people have them but he is someone who doesn't have much minority support right now so where do you see it going? >> he has to work really hard into some of the things, he is making some of the right moves going to morehouse college, releasing his douglas plan but it would be an uphill climb and one of the big mistakes the campaign has made is to blame this on african-americans. they have been saying african-americans are homophobic when we know the majority of african-americans support gay marriage.

this won't help his cause. he really needs to make a better outcome, the campaign is not doing a good job of that right now. jillian: let's look at the key points of his plan for black america that includes establishing a health equity program, increasing government contracts to minority business owners, boosting federal resources for schools, reducing the incarceration rate by 15%. do you think he can climb this hill? >> i don't. we have seen this from democrats time and again. there is no legitimate effort to secure the black vote and people know, democrats cannot win a primary election or an election in general without the black vote. that is why they are concerned what donald trump is doing. donald trump has been the most effective and impactful candidate for president we have
