afternoon, hundreds of white house emails show considerable efforts were made to justify the delay in military aid to ukraine after the president already decided to withhold it, this according to washington post sources, the revelation reportedly comes from a confidential review by the white house counsel's office, let's go kevin corke, joining us now from the white house with more. kevin. >> arthel, they are calling this research by the white house counsel's office, again, this is according to washington post, they're also saying that the research was part of a review again of material, not just review, it gets deeper than that, we are talking about according to the post as we take a look at the white house this hour, review that is of the president's decision to place a hold on military aid to ukraine, now according to the post there as you said hundreds of document that is reveal extensive effort to generate an after the fact justification for the decision as well as debate whether the delay was, in fact, office of white house's counsel reportedly
1:17 pm
oversaw the record's review, mick mulvaney and acting director cited on various emails discussing the matter, revelations could prove tricky for the president, what is less clear is what the deliberations were like leading up to the decision to stall the distribution of funds which by the way it's important to note did eventually get to ukraine including actual lethal, yes, we will keep track of the story, we have reached out as you can well imagine, arthel. meanwhile over on capitol hill as impeachment inquiry continues, there are questions that remain about what steps are next for democrats and nancy pelosi has said that her party has no choice but to move forward presumably moving forward all the way with impeachment, that's still not certainty, critics argue her focus on impeachment has really hurt the american people.
1:18 pm
>> it's the cost of not doing something to the extent that pelosi waste legislative calendar on impeachment, she's not doing a bunch of things. let's start with the? a. , you start with usmca, best, braille ain't trade deal in american history, they don't pass it, it's about 200,000 jobs. >> i am still checking my phone on this hour to see if i heard back from the white house and seconds ago, the answer is no, if i get anything on the post story obviously i will promise to pass it along, arthel, back to you. arthel: stay on top of it, thank you, kevin corke. >> you bet. eric: adam schiff tells nbc meet the prez that more work needs to be done in impeachment inquiry and says that there's enough evidence to move on to the next step. >> it's important to know that we are not stopping but also important to know that and you've acknowledged this, and i find this remarkable, the evidence is already overwhelming, right, the evidence is overwhelming.
1:19 pm
eric: per reaction on mr. schiff, first congressional district, prominent outspoken in his defense of the president, congressman, good to see you. first, your reaction -- this breaking story about the emails, i mean, what does this say to you if they have emails in the white house counsel's office supposedly overseeing or looking into the legality of this? >> sure, but we do an overwhelming amount of evidence to why there's a hold on aid to ukraine, i would call on adam schiff once again to release deposition transcript of mark sandy, dedicated, career servant at the office of management and budget who came in to answer questions with regards to why there was a hold on aid to ukraine, there's an overwhelming amount of evidence, we know that it wasn't until the end of august after a political story, august 29th that president
1:20 pm
zelensky and top aids confirmed that there was aid to ukraine, we have overwhelming amount of evidence but also tells us the hold was released shortly thereafter and ukraine didn't have to open any new investigations, didn't have to announce any new investigations in order to get the hold lifted, we know that president trump was going to meet with president zelensky if not for hurricane dorian, and president trump met with president zelensky at the united nations, i could go on, spend 20, 30 minutes laying out the overwhelming evidence that shows that the president was concerned about corruption in ukraine, u.s. law requires the united states by law and policy to ensure that ukrainian is combating corruption, the president was concerned about two legitimate cases involving basi -- barisma, you know what democrats say, there's overwhelming evidence of wrongdoing by the president, in
1:21 pm
one interview he did top start whether or not he decided to move forward with impeachment. >> well, we have already subpoenaed him for documents and we are in discussions with the southern district of new york so we are pursuing it but at the same time we'd like to know what the documents have to say before we make a decision about witnesses, that is why we subpoenaed pompeo for documents and others for documents. >> that's him talking about rudy giuliani and that sort of thing, what's your reaction to that and they've wrapped this up and now, of course, the judiciary committee? >> yeah, his mind is made up. people who are pushing for impeachment have been pushing for impeachment since donald trump was elected, since he was getting sworn into office, adam schiff really does think that many americans are idiot, if you remember march 22nd, 2017, he goes onto another network, he has circumstantial evidence that president trump colluded with the russians, evidence that he hasn't yet produced, i haven't
1:22 pm
seen, mueller couldn't find, he made up a -- what he called or parity of 7-25 transcript and he said that after he got called out. turns out that his team was in contact with the whistleblower before this person had even filed the whistleblower complaint or had hired an attorney and it's gone on, open hearings where he's made claims during his opening statements and closing statements trying to write the world's greatest parity and connect dots that aren't connecting and what he won't tell you in some cases, he'll say something firsthand truth that shouldn't be doubted and then dig deeper and you realize it's actually ambassador taylor telling us that tim morrison told him that the president told sondland, give me a break, the facts are on the president's side, we should be
1:23 pm
passing uscma, we should be lowering the cost of prescription drugs but instead he's trying to pay off the people who put the gavel on the hand. >> he was asked about lack of direct testimony from the president directly in dealing withholding up the military aid, of course, you the phone call that son dland was on that was overheard. here is something that the democratic congressman said and blamed it on you, guys, the republicans. >> first they hung their hat that there was no quid pro quo and then overwhelming evidence of quid pro quo, welshing what's your evidence that the president withheld military aide, the president's own chief of staff admitted they withheld military aid to get the investigation, this crazy dnc server investigation which is part of a russian disinformation campaign.
1:24 pm
eric: finally, congressman, what would your reaction to that be and what do you think republicans can have in their own report because they can file their own report, i guess a minority decent wound would assume. >> fortunately we have 97% of the story, with ambassador sondland saying there was quid pro quo linking investigations, he admitted that it was a presumption, the president never told him that and he had no evidence to back it up even though the president of the united states had told him that there was no quid pro quo, that he was not commanding anything from ukraine, with regards to, you know, where we go from here and adam schiff is challenging the president, listen, if the president means anything, when bill clinton was being impeached, ken starr, presented case to house judiciary committee and president's
1:25 pm
clinton's attorney had chance to question, then he should -- the report that she's drafting she should present in person to the house judiciary committee and then president trump's counsel should have opportunity to cross examine him. adam schiff has answer that is he needs to provide, there's some questions that i certainly know colleagues would like to ask and the problem is the case will fall apart, it's not just about protecting the whistleblower, he's trying protect his own hide, he's trying to protect people like colonel vindman and went to whistleblower and that's where the case will continue to fall apart, the short -- the report is super thin. eric: we will see what happens in the judiciary and if, indeed, it gets to senate trial and see
1:26 pm
what happens, congressman lee zeldon, thank you for joining us this afternoon. >> thank you, we -- eric. arthel: president trump stopping short of saying whether he would sign a bill whether he would impose sanctions, we dig into the impact of unrest with long-awaited trade deal with beijing, that's straight ahead. l

president has not said whether he will sign that bipartisan legislation, this is a record number of hong kong residents turning out today to vote in elections. let's bring in gordon chang, gordon, jonathan hunt is in hong kong reporting for us there and seen and he said this is a historic sea change, tell us why. >> it is historic, the district council elections generally no one pays attention to them, but now we have record turnout and these district councils 18 of them all controlled by probeijing forces, now so far the results are coming in, they won 30 seats and the prodemocracy forces have won 269. this is politically annihilation for beijing and will have consequence that is rebush --

and the mainland. a couple of things going on, people in mainland have grievances of their own and people in hong kong are only able to push around political establishment but seem to be taking over, but the other thing is that the hard line policies in hong kong that have called protests more more than 5 straight months, they are authored by xi jinping, chinese ruler, i'm sure political enemies will come out of the wood work and use it against him. arthel: can xi jinping survive this? >> he will probably be able to survive this but maybe not. just a week ago "the new york times" published 403 pages of documents about concentration camps there, those documents embarrass personally xi jinping, somebody at the top of the chinese political system went to new york times in order to target china's leader, he'll got to be in trouble already and
1:33 pm
this is -- this is a policy misbecause these are policies that have been in place for more than half decade. arthel: okay, live there, you told me he has detractors inside the government and thinking that the people in mainland china will now be emboldened perhaps step out on their own but i kind of don't see it because it's xi jinping, who is going to make them, you know, get out of office. >> he's all powerful. that means he's also all accountable and that means -- arthel: he doesn't care? >> well, it means, though, that there's nobody else for him to blame, in the previous system before, any chinese ruler who made a mistake, no big deal, all decisions were made by consensus and now he's the only person
1:34 pm
responsible, he's the wasn't that had hong kong portfolio and now he's the leader of china, the policies have caused the protests and now he can't say, well, he's responsible because he is responsible. >> so now that the people have voted, prodemocracy candidates will win, will be in the majority, will the protests stop? >> it really depends because carrie lam, hong kong chief executive reports to xi jinping has no freedom of action. you will see hong kong erupt, people have expressed their will. if they don't make con decisions, this is just -- we don't know where this will go but we know that will become probably much more violent and the protests will become larger. arthel: i want to show your tweet from this morning, #china's leaders are stalling ashley: the trump -- #trump on
1:35 pm
trade deal and then include the link to business insider article, the tweet continues saying, suggestion, go after xi jinping on all crimes, misdeeds, raise the temperature until the regime surrenders. before i tell you how hot should the temperature get, i want to go back to the sound bite we started from president trump saying, hey, listen, i support the protestors, the people of hong kong but xi jinping is my friend and we are about to sign off in the biggest trade deal ever, can the president have it both ways. >> his approach is not going to work, president trump's approach is not going to work, his approach is consistent of 4 decades of american policies whereas basically you don't anger chinese leaders because we think we need their good will, what i was saying is, essentially, look, the chinese have been stalling on the trade deal because they think while they'll stall trump won't go
1:36 pm
after them of hong kong. you have to go after the president on camps -- arthel: should the president walk out of trade deal? >> i think so. the remedy for failed trade deals is not a new one, the remedy to increase those tariffs to the point where china just no longer is able to continue without access to the u.s. market because those tariffs are cutting off china's ability to sell products in the u.s., we need to raise the tariffs so then china has -- understands it has no choice but to stop stealing our intellectual property, stop trade violation, stop all the stuff we don't want them to do. >> we love having you here, thank you so much, we will see you very soon.

eric: we are getting preview of highly-anticipated justice department inspector general's report into the origins of robert mueller's russia probe and alleged fisa abuses, michael horowitz found evidence that former lawyer falsified fisa document related to the surveillance of former trump campaign aide carter page, but the top ranks of fbi are spared what will this mean, what can we expect, john bussey is here, john, december 9th, the big day the report drops, what do you expect? >> that's right. saidi has a story right now that says the inspector general looked at everything that the fbi did, examined the origins of the inspection of the trump campaign and relations with russia and found that there was a legal basis for them pursuing,
1:43 pm
that there was nothing that was done wrong in making the ultimate decision to examine the campaign, sufficient legal reason to do that. >> what was the legal reason? >> there was connections between the campaign and sort of element it was russian government, that there was suspicions, information going back and forth, at the end of the day, robert mueller found that the russians very much injected themselves into our election process and the trump campaign was not guilty of collusion with the russians, nonetheless, the inspector general is going to find that there was a legal basis for the fbi going forward and also, found, however, that there was sloppy work that was done, lapses in judgment according to what we are hearing about the report, mind you, we don't have the complete report, we haven't looked at the complete report, i'm not going to get until december. >> the president says that -- he says they were spying on his campaign, listen to what the
