i'm trace gallagher. democrats once considered former white house counsel don mcgahn the most important witness in potential obstruction of justice in robert mueller investigation. this decision could ripple way beyond that case. it could mean key witnesses in the impeachment inquiry could have to go before congress. think john bolt bolton, he has been openly teasing on twitter that he has something to say. but his lawyer is suggesting this ruling will not apply to bolton. and the justice department already announcing it plans to appeal the decision. new reaction from president trump in a moment, but, first the flip side. a democrat who voted in favor of the impeachment inquiry saying sunday she changed her mind. that she does not support impeachment anymore. only a slap on the wrist for president trump. democrats accuse him of bribing ukraine for political gain. the president denies that. but, today, that democratic

lawmaker is doing another flip saying now she supports impeachment again. is this a sign ahead for democrats. mark meredith working the reaction to all of this. gillian turner. impeachment from the secretary of state. john roberts? >> john: trace, good afternoon to you. this is an important case because this may not just be about don mcgahn. it may be about other people who have either been subpoenaed or had subpoenas issued and then removed or could potentially be subpoenaed by congress. the fact that don mcgahn has been ordered to testify before the house judiciary committee in the impeachment investigation could potentially affect people like mic mulvaney who has already been subpoenaed but at the behest of the president is not going to appear. you mentioned the charles cupperman and john bolton case. charles cooper who is cupperman's attorney has suggested that his case is different, which is why he wants to continue to go to

court. but, overall, if a federal district court judge is saying, look, white house officials do not have total immunity from testifying before congress, it is possible that officials like that would have to go up and testify, which is why the department of justice last night appealed the judge's ruling to the d.c. circuit of appeal and today appealed for a stay of the judge's order last night. now, the stay is based on a 2008 case involving the former white house counsel harriet miers in the bush administration. she had been subpoenaed to testify before congress. she was then charged with contempt of congress. that made its way through the courts and federal district court said she had to testify. but the d.c. circuit of appeals said no she didn't and issued a stay while the case was adjudicated. the president making his feelings about all of this known this morning saying, quote: i am fighting for future presidents and the office of the president. other than that, i would

actually like people to testify. it is a democrat scam that is going nowhere. but future presidents should in no way be compromised. what has happened to me should never happen to another president. jackson a district court judge who ruled that mcgahn has to testify disagreed with the president in his ruling saying, in part, quote: this court holds that executive branch officials are not absolutely immune from compulsory congressional process no matter how many times the executive branch has asserted as much over the years, even if the president expressly directs such officials noncompliance. the white house officials tell me no how, no way are they going to allow mcgahn to testify. ultimately, the case against harriet miers was dropped because when the clock turned over to 2009, the 110th congress was disbanded and the contempt citation went away with all of that. and no question about this, trace. this is not going to happen tomorrow. this is going to take a while to go through the

courts. so it may be that this impeachment process is all over by the time we finally have a ruling. if the district court in d.c. rules against the president, i assume that they would take it to the supreme court. trace trace yeah, and speaking of the supreme court, john, they are making a decision on the president's taxes. >> they are. and here is the order from the supreme court. a lookout of paper to hold up today. this is a case in the d.c. district -- d.c. circuit of appeals which ruled that the president's accounting firm had to turn over tax returns to the manhattan district attorney as well as the house oversight committee. the white house appealed to the supreme court. the supreme court is saying we are willing to hear arguments, you have got to get them in by december the 45th. idecember the 5th. the d.c. court of appeals ruling stands if they decide not to hear the case. and the president will have to hand over his tax returns. if the supreme court decides to grant a writ of setter serti.

a deposition by secretary of state pompeo would be potentially be helpful to him. they also say they think it might produce new evidence that the republicans could then be used to you push back on intelligence chairman adam schiff's narrative. pressed on the specifics of the impeachment inquiry in the reason trove of state department documents that revealed pompeo's confrontation with rudy giuliani. the secretary insists his department is on the up and up. >> you saw we released documents last week now. we will continue to do that as required by law and as appropriate so that appropriate oversight can be conducted. >> gillian: now, when it comes to u.s. foreign policy towards ukraine, pompeo is holding president trump's line insisting the administration's top priority has been from day one fighting corruption. >> we still have president in ukraine working to make sure that we move through the challenges that the country has had with its corruption for an awfully long time now. the state department has been working on that for a

♪ >> trace: extreme weather alert. powerful storms could affect your holiday travel plans this week. meteorologist adam klotz tracking it all from the fox weather center. adam? >> adam: hey there, trace. we will be talking about multiple storms firing up the next couple 6 days. the first one really beginning moving across portions of colorado and stretching up over the plains. big area of snow right now in this system. as a result, no surprise here. we have winter storm watches and warnings stretching all

the way from the west coast running up into the plains and getting up into the upper midwest. this is going to be the frontal boundary see a lot of the activity. locations with snow getting up to 2 to 3 feet. widespread at least 6 inches of snow in this area. out in front of this system the air is a little bit warmer, thunderstorms and unfortunately high winds. these are wind advisors now stretching from places in the midwest all the way back across texas. running you back down into the dessert southwest. some of these winds getting up close to hurricane strength. the whole system are going to eventually run up to the east coast. but as far as your future radar goes. initial system bringing snow up to the upper midwest. more systems line up out west and run back up into the plain states. that's where we see rounds and rounds of that snow. then again as you move off towards the east coast, it's going to be rain and all that wind is going to move that direction, trace. >> trace: if you are looking to ski great news. looking to fly, not so much. storms and strong winds, adam they could keep the macy day balloons grounded, right? >> we talk about the east coast and west coast.

a quick look sixth avenue, avenue of the americas in new york city where it's all going to happen on thanksgiving day, maybe. if the wind cooperates. meantime, nearly 2 million people expected to pass through chicago's airports during the holiday weekend as those storms threaten the region. the fox business network's grady trimble reporting live from o'hare. grady, how is this going to stack up to previous years? >> well, it should be another record year this year. the airline industry expects almost 32 million people to get on a plane during the 12 day holiday travel season around thanksgiving. that would be a record. it would also be up 3.7% compared to the same time period last year. the industry is also expecting a single day record with most people traveling on the sunday after thanksgiving. so that would be a single day air travel record. i talked to one of the travelers of those 3.1 million planning to get on a plane that day.

district right between salem and eugene. all 23 schools are closed meaning 9500 students will be off until next monday. problem discovered last friday at elementary school. 98 kids were out sick vomit it's and diarrhea quarter of the school along with 8 staff members. on monday 20% of all the kids in the district stayed home. so late yesterday the district issued a statement, quote: given the recommendation that students should not return to school until they have been symptom-free for 48 hours and with the short week, a district wide closure was determined to be the best course of action. this is second outbreak of norovirus in the country shut down entire school district this week. the first was in grand junction colorado. all 46 schools there are closed until monday as the highly contagious bug spread over the last few days. that impacts 22,000 students. health officials say these outbreaks are most often seen in nursing homes and cruise ships and relatively common.

people infected still contagious until 48 hours after the symptoms ease. the best way to avoid it, thoroughly washing your hands and not touching your eyes and mouth and throat. classrooms and buss are being disinfected in both these districts and schools should be open on monday. trace? >> trace: they pretty confident in the disinfectant works in buses and classes and schools, dan? >> well, it's one way to make sure that it's clean, at least. if you have all these infected kids go back to school on monday and then they could have problems again parents have to make sure kids stay home if they have any of these symptoms. >> trace: dan, thank you. a group of neighbors in indiana are buying drinks for teachers. this comes after the owner of a local bar in indianapolis posted on social media that teachers lobbying for more money should stop going to the bar instead. so, in response, some people are inviting teachers around the state on december 6th from 3:00 to 7:00 p.m. to a different bar to drink for free.

we're at the end of the dry season, so the fields are some of the dryest that we have. >> it's being called the k fire right now has zero containment and charred more than 4200 acres. burned through the night and the also a padres national forest. fueled by dry conditions and strong winds. polls have been shovels. prevent the fire from spreading even further. neighbors fire agencies are also pitching in to help this fire sending crews, fire engines and utilizing available helicopters and aircraft for water drops. >> it's been quite the fire fight. we have had winds moving up slope, down slope, across the slope. we have had firefighters engaging in structure to fence, being pushed out and run out and then turn around and come back and getting right back on those structures. >> this is map of the area that is currently under evacuation orders. you see that area where the fire started of and then the orange highlighted area.
