been reformed? >> well you have to wait a number of years after they served their sentence to know where they are on their, deradicalization journey. this was a guy who was picked up in a 2010 plot, pled guilty in 2012 and was given a 16-year sentence. in 2012, however, 2013 the laws were changed, he was given an indeterminant sentence where he would be eligible to get out after serving half of his sentence. so he received 16 years as a sentence, but only got eight. and was, released thereafter. so, a huge problem from the justice system's perspective. pete: you believe the longer he had been serving that sentence, maybe more time to de-escalate or deradicallize, or just keep him out of the public realm if he is not deradicallized.

do you think like early release is the problem or are we not doing enough to change the viewpoint of these people that join isis? >> i think it will be a little bit of both. it will be the first, i mean, if you are giving somebody a 16-year sentence, they should serve 16 years of that sentence, not 50% of it. and i think that is the big problem, the big gap that is resulted in what we see today. pete: he was given an ankle bracelet. was told he was not allowed to go to london at all. he was given an exemption one day to go to the conference on reform in prison. he goes to the early morning session, participates. then after lunch decides to pull out two knives to start stabbing people. he could have been seen as the poster-child. now he has become a soldier of isis. is there any way to identify that? >> yeah. this is a problem of, a number of individuals claiming they are

deradicallized. for some people you can change but, you know, you have to show signs of that during your incarceration. this was an individual who just didn't show those signs and it seems there is this tendency among people to claim a person is deradicallized when in fact they're not. it is true they used him as the poster boy but i'm sure they're all regretting that now, very much so. pete: i got to ask, if someone is fighting with isis, they're found to be guilty after plot in the uk, even often in the u.s., they're treated as criminal justice, criminal matter. as you know, isis, al qaeda and others are waging war against us and the west. how do we make changes in our system to acknowledge these folks are at war with us in an idealogical and violent way? >> the difference between the u.s. and the uk, and other european countries, the u.s. has adequate laws to prosecute these individuals. the material support terrorism

charge for example, is wide enough that incorporates a number of activities that fall under the support of terrorism. you're going to get a minute -- minimum of 10 years in those prosecutions. when you given 10 years you will do 10 years. in european countries unfortunately that is not the case. sentence is given, say in this case, 16 years, in reality it could be eight years, 10 years, five years and the individuals are getting off. these weaknesses in the justice system is something that european countries will have to address. pete: not the tolerance from radical mosques and radical madrassas that occur in the uk an elsewhere in europe. thank you for your insight. what you do for our country today. we appreciate it. >> thank you for having me. pete: have you heard of world war zero? that is the name of john kerry's star-studded, you guessed it, climate change coalition. sounds big and bold, doesn't it?

that -- solidified the fact that citizens can have firearms in their homes. new york and at least three other smaller jurisdictions, well, some states but some cities, are trying to take this to another level to interpret that decision and pass ordinances which indicate, which try to restrict firearms from being transported, saying they must be confined to the home. and so we -- the sheriffs of america, 3,080, over 3,080 sheriffs of america, our job is to keep the streets safe. and we truly believe that laws like this, if allowed to flourish and be passed in other townships, boroughs, cities, are going to make our streets less safe. so, frankly, we get involved in significant issues, and this is one -- ed: so you obviously believe this would start to erode second amendment rights. how do you find a balance if cities like new york are concerned when you talk about the transport of guns, that i could buy one, a gun legally, but if i transport it somewhere

else and give it to somebody who's mentally ill or give it to somebody who cannot legally purchase a gun, how do you as a sheriff balance that to make sure these guns do not get into the right hands? >> well, it's a big question, but again, we have to start with the premise that when guns are outlaud, only outlaw ares are going to have guns. we know that's simply not the case. two-thirds of defense shootings occur outside the home. this is an effort to restrict the second amendment, to keep firearms in someone's home, not allow them to be transported. when that happens -- so when criminals know that law-abiding citizens are not allowed to have their weapons outside of the homes, and right now two-thirds of shootings, of defensive shootings that are legal occur outside the home, what are the criminals going to think? they're going to know that most people are not going to be armed, and things like you saw in new orleans this morning, which i don't have the details of, are probably going to continue because people are

going to know that law-abiding citizens trained to handle firearms don't have them. and that's when it really is a bad guy with a gun is only stopped by a good guy with a gun. ed: we reached out to the mayor's office for a statement the, we haven't gotten a response yet. last question for you, sheriff, it seems to me you're looking at the idea that, look, if you restrict the rights of law-abiding gun owners, it's the criminals who end up having the guns. >> it's been proven time and time again. there have been no -- anyone who has a premises permit, which is what they call these things in new york and, frankly, i wish the supreme court would look at the constitutionality of that, there has not been a documented incident with a premises holder in new york. show you that lawful, trained gun owners don't commit crimes. ed: sheriff, we appreciate your insights. go, lsu, as you said. we wish you well in the days ahead. we'll be watching the case very closely. thank you, sheriff. >> thank you very much.
