>> a lot happening when impeachment inquiry goes to judiciary committee. how will things play out and what key things to look out for? >> the first thing was the factual part, this is the law part, so they are going to call in 4 professors and explain about what the treason, bribery and high crimes and misdemeanors means and the only problem i saw rob make a point about how exciting that is going to to be and he's right, how exciting to have professors, not exactly the easiest thing to make exciting, but joking aside and here is the bad news, the reason it's bad in this toxic climate it's like a big test, one professor likely to say i believe this meets it and here is why because alexander hamilton pointed this that and the other and the other side will say exact think opposite.

[laughter] rob: jerry nadler obviously invited the president to take part this week, this is the white house's response, we just got yesterday, we cannot be fairly to participate in hearings while witnesses yet to be named and remain unclear whether the judiciary committee will afford the president a fair process through additional hearings, republicans are saying, the president is not being treated fairly in the process, do you agree with that? >> you have competing narratives back and forth and as a lawyer who sat in conference rooms for 34 years trying to figure out the best argument, what's the other side will argue, the president has said all along, no mistake about it, rock-solid consistent, you have not afforded me due process, haven't afforded me to correct opportunity to participate, jerry nadler did something smart, if you go baseball chess game, he invited them in, he could argue, what are you talking about we are not -- here is the inside part, knowing that the president would turn it down because he's so wedded to his

own narrative, it's a smart move by nadler and we will see how it plays out. carley: impeachment inquiry prediction, you said it's not going to go to the senate, why do you think that? >> starting 6 weeks ago i predicted that and everybody was looking at me like i was crazy, it came out sort of wrong, they are going to walk away, no, that's not it, they will do it in they realize the poll is slipping really badly, b, it'll hurt them politically in terms of the 31 or so seats in heavy trump districts and may really hurt them in 2020 presidential election if they do all of that and you've heard the little hints and nuances where people are starting to say, well, wait a minute maybe some type of sanctuary motion. rob: why doesn't it go to the senate? >> no, i think that's a great question, sheer the key, rob, two reasons, number one, the senate is like a horn nest, you're no longer in the -- maybe

tease for you. former vice president joe biden is brushing off mayor pete buttigieg's lead in iowa. >> we are still beating him significantly but in terms of iowa he has had good organization if you've been around long enough you know that you still have over 65% of the people that haven't made up their mind and you still have them saying the single most important thing they need in next nominee is someone who can beat donald trump. rob: all right, but as the south bend mayor continue to climbs nationally in the polls should biden be worried because he's climbing those polls, sasha burns and mark meckler, sasha i want to start with you, pete buttigieg is the hot candidate but biden is still the leader, what do you make of all of this? >> pete buttigieg is really rising in you eye, he's a great

candidate, i think what is -- what shows with both of them with biden nationally and pete buttigieg in iowa and other places is they are both center left and that's what we need. i'd be happy with either one of them and their center-left policy. >> they are similar, mark, in a lot of ways, you're a tea-party kind of guy, you're more to the right, what do you make of the candidates and who do you think has a better shot against president trump? >> well, it's hard to say in the long run against president trump but we know that biden is floundering in iowa, we can see it because the numbers are down, pete buttigieg is way up wile biden still leading nationally, he wouldn't be focused on iowa so hard and doing no malarkey tour if he knew he wasn't in trouble right now. >> iowa democratic presidential caucus polling average, let's pull this up and you see, i mean, this is the first state, this is a very important start to the process and there's pete

buttigieg who has just come out of nowhere to take a commanding lead and then look at biden in fourth place in iowa, i think that surprises a lot of people, sasha, does it surprise you? are you iowa is such an anomaly of a state, in terms of who is going to win, iowa has a completely different caucuses are completely different from primaries and so you can vote again, if a candidate doesn't get to a certain percentage on the ballot, biden will do very well in the rural state or counties, if he were to lose iowa, it is important in terms of momentum and then you hit end of nevada, south carolina, he will likely win in super tuesday, howard dean won iowa,
