democrats report. the democrats impeachment inquiry is not organic outgrowth of serious misconduct. orchestrated campaign to upupend our political system. the impeachment inquiry and the manner in which the democrats are pursuing it sets a dangerous precedent. brian: republicans president not just saying that rhetoric or marketing. he has really unified the republican party. in fact, his constant critics, mitt romney would be un. has been quiet. susan collins with a lot on the table politically. has been silent. seems as though people have lined up behind the president for this impeachment hearing to the point where chad pergram reported yesterday that the democrats are worried about their own impeachment votes. remember, the goal was always to convince a hand full of republicans to side with them and make it look like an avalanche or tsunami as it heads to the senate. looks like having trouble getting their own democrats on board.

ainsley: a democrat from kentucky said it's not a good thing to get rid of president. it's the right thing to do but there will be political consequences. the democrats are worried. the president said it is uniting the republican party. steve: i was just going to say also according to "the washington post" this morning. apparently with the moderate imperil democrats apparently they are asking for a number of articles of impeachment. they's say they have five. this way they would be able to vote against some of them so they can say look, i stood up to the party's left flank. i stood up to my party leadership and i went against them. so i am independent. so return me to congress next year. ainsley: right. steve: same time nancy pelosi and company saying you really think nancy pelosi is going to put out articles of impeachment and have them go down and then give the republicans a talking point that there is not the kind of unity in the democratic party. ainsley: wouldn't it be difficult though if they hadn't out of gate some of

these witnesses, these law scholars that are going to be witnesses for the democrats had signed letters saying we want him impeached. we are attacking the president. saying impeach, impeach, impeach. they try to find impeachment reason here. then they tried to find one here. now they are running with this conversation. if they had just started with this conversation it might be different. republicans have been seeing it. y'all have been trying to do it so long we are tired of it. brian: attorney for the whistleblower wrote in 2017. says i'm going to expand the inquisition and taking depositions considering putting the mueller report into this. the american people really wants a continuation of the mueller report investigation and a series of witnesses. last time they tried that corey lewandowski blew the whole thing up. steve: that brian, is bad for moderate republicans. brian: you would think. steve: party leadership said once again we are going to focus it on ukraine. suddenly if they are going to a report that came out last year it just looks bad.

brian: talk about what's going to be coming out next week. it's a lot. i'm sure the impeachment hearings won't be done. the fisa report will be. it will drop on monday. hearings again on wednesday. there is a report in the "the washington post" today that attorney general barr is kind of upset with one of the premises. that is he disputes a key mike michael who are ritz inspector general finding that says the fbi launched this investigation on solid ground. certainly there was reason to launch it. that's one thing that barr feels differently on especially since he has helped durham launch his investigation. ainsley: keep in mind it's "the washington post," "new york times." they are saying they have some leaked information they are saying that horowitz, the report is going to say that it was justified. the fbi's actions to surveil the trump campaign, it was justified. steve: to get that first fisa application. according to the "the washington post." and keep in mind "the washington post" is based on stories, you know, the people they spoke to are in

some cases witnesses who have had a chance to look at the draft and so they have got, you know, they have got an iron in this particular fire. but, apparently, according to the "the washington post," mr. barr says look, horowitz just looked at the department of justice and the fbi. if he looked at the cia, that would change everything because they had more in it than just the fbi -- brian: you are saying just looked at the fbi procedure. steve: he's not. he's not durham. durham is looking at accurately. criminality, that's one of the things the president was focused on this morning. roll tape. >> there are a lot of devastating things in that report. we will see what happens. the ig report is a very important report. if what i read is correct, that would be a little disappointing but it was just one aspect of the report. we will see what happens. we will see -- it's coming

out in a few days. i hear it's devastating. but we will soon find out. ainsley: lindsey graham says consider the source. listen. >> be we'rey of "the washington post" and the "new york times" reporting on what's coming up with horowitz. they have been trying overtime, to spin this thing, to diminish its effect, to down play it. i can tell you without any hesitation attorney general barr has every confidence in the world in mr. horowitz. he believes he has done a good job. a professional job. and he appreciates the work and the effort he has put in to disclosing abuse at the department of justice. brian: we will see. one thing william barr could have done put out a statement "the washington post" story not how i feel. broke yesterday evening. steve: it's a story based on leaks. wait until the report comes out. brian: he could easily say guys, say what lindsey graham has said. ainsley: maybe it's accurate. we don't know.

capitalism. 35% say they have a negative view of capitalism. when you look at socialism, 39% positive. 57% negative. so educate us. educate mark ruffalo. how can capitalism help us? >> capitalism is basically free and individual choice. it is millions of people freely of their own will choosing to participated in the market and that's how resources are allocated. contract that to socialism which is a handful of people who are making decisions for millions of people based on power, force, and control. so the closer that you get to freedom and choice the better off people are. and the more you get to power and control the worse people are. and we have seen this all over the world. the problem is that right now in this country we don't have a pure free market system. we have too much government intervention and cronyism. that kind of stuff gets in the way, gets people confused about what capitalism is. ainsley: that's what your

devastating things in that report. but we will see what happens. look, we have a few days to wait. we have been waiting a long time. i do think the big report to wait for is going to be the durham report. that's the one that people are really waiting for. the ig report is a very important report. >> important the president waiting there we are also awaiting the results of john durham's criminal probe into the origins of the russia probe. this is separate but parallel report to the ig report. attorney general barr launch the probe. this all comes as "the washington post" reports the attorney general will disagree with horowitz when this ig reports comes out monday over whether the fbi had justification to start investigating in 2016. this is the headline. barr disputes key inspector general finding about fbi's russia investigation congressman mark meadows a republican weighed in telling fox news everybody should wait until the ig report comes out because everything else is based on speculation on information

which has been leaked. there is little doubt in my mind that it will not be one of the fbi's finest days when the report is released. no one other than horowitz and his team knows what's in the report. and they have left no stone unturned. the doj also releasing a statement, guys, praising inspector general horowitz' investigation calling it a credit to the department of justice and cautioning people saying, quote, rather than speculating people should read the report for themselves. watch the inspector general's testimony before the senate judiciary committee and draw their own conclusions about these important matters. one thing is for sure. we are probably going to to have even more partisan battles. once it's out we all get to see it, guys. brian: i know i should ask you a question. i'm not sure if you have the answer to this question. should i try it any way? >> do it. brian: do you have a sense of when the durham report will be done? >> you know, that's a good question, actually. because it's not so much, brian, a report. as it is really results. that's why i called it such. because, remember, the

inspector general report was on a specific fisa question and the origins of why the fbi started their investigation. but, when barr tapped durham, it was a criminal probe. is he a federal prosecutor. so he has more latitude. isn't necessarily going to be just one report. but perhaps a series of results. woe don't have any timeline when that's coming. ainsley: the ig report that will be released on monday and hear from the inspector general on wednesday. that is basically to find out how this fisa application how they continue to get access or the. steve: that's focused on the fbi and department of justice. ainsley: and then the other one the durham report is a criminal investigation. that's crime, right? griff: that's correct. one will look hard. the inspector general's report whether or not the fbi had enough information to launch the investigation in the first place. but, durham's probe is in to what happened after it really began and the folks

reporting johnson had been out that night drinking with a woman that wasn't his wife. you may remember johnson came under fire from president trump when he opted to boycott the president's speech to a police chief's conference. surveillance video captures teenagers off duty police officer you see it there on your screen. the california cop says he confronted the group after noticing a woman who accused them of stealing her phone. he started taking pictures of the teens when the group ambushed them. he will walked away with a concussion and broken finger. no word on any arrests. "newsweek" reportedly demoats an editor after a botched story about prumplet it comes after reporter jessica kwong was fired the president spend thanksgiving tweeting and golfing. the original article was published before president trump's surprise visit to troops in afghanistan. it was edited hours later. but the headline still focused on tweeting and golfing. kwong placed some of the blame on the editor.

brian: the supreme court weighing gun rights case in nearly a decade. ainsley: judges hearing oral arguments yesterday from second amendment add voyeur caught challenging a new york city that limits the transportation of guns outside of an owner's house. steve: with what's at stake we have fox news senior judicial analyst and host of fox nation judge andrew napolitano. judge, it's hard to have a gun in new york city. judge: it is. very few people have a right to possess a gun in their home. we are not talking about carrying a gun. not talking about police or retired police. we are talking about civilians who have the right to possess a gun in new york city. if you get that right, if you pass all the requirements, new york city enacted a regulation that said you can't transport the gun to anywhere outside of new york, to another home you may have where you also have the right to own it. to a shooting range outside

the city. that rule was challenged by a sportsman club. when the supreme court accepted the challenge, the city changed the rule in the hopes of mooting the challenge by saying well, the rule doesn't exist anymore. instead they wrote another rule that said you can go to a legitimate shooting range outside the city but you can't stop. you have to go directly there. steve: how do you know? >> look, the whole purpose of the new york rule is to make it difficult to own a gun in the city of new york. that is contrary to two supreme court opinions which you have the right and bear arms in the home. in the home is important. if the supreme court rules on this case and invalidates the new york restrictions, that will expand the right to keep and bear arms beyond the home to your motor vehicle as you are traveling. ainsley: what are these gun right advocates fighting for if they did change the rules and can go to the shooting

range. judge: new rule says you have to go to directly to the shooting range. ainsley: challenging that now. >> sure you can't stop for a cup of coffee or can't stop if justice calls. justice alito asked can you stop to visit your mother? [laughter] under this rule, as it's written, the answer is no. now, we laugh about this. but these are rules written by politicians in new york city who want to interpose obstacles to the right to keep and bear arms. brian: passed a series of hurdles to own and have a gun in new york city. why aren't they convinced that their background criteria is snuff? judge: very few people get the right to possess guns in new york city. as you say quite properly, counselor kilmeade the hurdles are there they have jumped those hurdles. that's not enough for the people who run this town. i don't know which way this case is going to go. i know the four conservatives are in favor of invalidating this and i know the four liberals are in favor of dismissing the case. yet again, it's up to the chief justifiable.

according to washington news sources thinking there is just thought enough there there. maybe we need to dial in parts of the mueller report which made the case there could have been 10 cases of obstruction of justice, turn those in to articles of impeachment. turn the fact the executive branch would not turn over a bunch of witnesses and a bunch of documents. that's one. how many will they have ultimately? don't know. ainsley: you made a good point at the 6:00 hour. you said they could come up with five articles of impeachment and vote yes on some of them and no on others. that way they could go back. democratic congress men and women could go back to their areas and say look if they are in trump country i voted this and i voted this. steve: nancy pelosi and her leadership team winding up rew. resistance from democrats in red districts. if they come up with a certain number. they can push back and say you know what? i will vote yes on this article but no on that then they look good next year.

bring the camera up. pick up my papers and go into the green room. there you go. ainsley: thank you, brian. listen to this story. standing up for our mental and women in blue on thanksgiving morning. a starbucks employee handed an oklahoma police officer with that word right there with the word pig on it. black rifle coffee heard about that incidents and they decided to do something about it tweeting can someone get us the name and location of the precinct of the officer that had pig written on his thanksgiving order for coffee so we can hook them up. they won't be needing to go anywhere for coffee for a while. the co-founder of black rifle coffee and former u.s. army ranger matt best joins us now. hey matt. >> how are you doing. ainsley: we don't like the beginning of this story but the ending was so special. how did you hear about his story. >> we obviously saw it circulating the news and all of that i do want to say in preface. i don't think the actions of

one barista defines the overall it belief system. the culture starts with the executive staff and something we have pride in at black rifle coffee is supporting the men and women who protect our country and communities. a lot of people i served with in special operations are currently law enforcement officers. my father was a sheriff's deputy foyer 10 years. this is something we are very passionate about and don't want to lose sight of the support. donating coffee is a token of gratitude for all the work they put in. ainsley: starbucks did release a statement. one barista, you are right. they fired the guy first of all and said this is absolutely unacceptable. we are deeply sorry to the law enforcement officer who experienced. this this language is offensive to all law enforcement and is not representative of the deep appreciation we have for police officers who work tirelessly to keep our communities safe. are you satisfied with that response. >> >> i mean, that's a fair statement. obviously they can do whatever they want with their company. but i will say i doubted that they will close 8,000 stores and have law enforcement sensitivity training.

so the beautiful thing about being a consumer in 2019 and going into 2020 you can vote with your dollar, you can support organizations and companies proactive in law enforcement and military veterans. that's who we're. we don't do that for a p.r. stunt. we do it everyday under the weather. ainsley: i know you have sent enough coffee so they will never have to go to a starbucks again. that was very nice of you for doing that and thank you for your service. i know your leadership team you are all veterans. 40% of your company, your employees are veterans. how do we change this culture? there are people writing pig on starbucks coffee. the people who have that mentality. how do we change that? >> unfortunately that's the cultural dynamics now in the united states. again we have to be less divisive and have to unite and really law enforcement are the guys and gals that are going out every single day and increasing the quality of life of the american public and protecting our community. i hope that more companies like us can stand behind law

right at the continue to attack us every day. censure is not appropriate and not acceptable. brian: democrats are now considering opening up the investigation and including some findings from the mueller report also say they are going to keep on taking depositions and doing interviews to expand the investigation. what's your reaction to that? that means this goes through next year. >> well, that's a grave mistake on their part if they do that. the polls are telling our fund raising is telling for the president. the president has done nothing wrong. they continue to do this because there is nothing there, brian. you know it, the american people know it. and now what do they want to do this week? they wants to bring in a bunch of academics to pontificate on whether or not the president did anything wrong. that's not going to fly with our lawmakers. it's not going it fly with the american people. and we will continue to go on the offense. this is a sham of a proceeding and we're not

going to accept it. we're not. ainsley: pam, the democrats' report on impeachment is going to be made public today. i know there are some lawmakers that have read it. republicans are putting out a rebuttal ahead of the report, the democratic report. they put out 123 page rebuttal. this is a portion of it. the democrats' impeachment inquiry is not the ohr began nic outgrowth of serious misconduct. it is an orchestrated campaign to upend our political system. this impeachment inquiry and the manner in which the democrats are pursuing it sets a dangerous precedent. the president said this is just bringing the republican party today together. what do you say. >> i have never seen our party more united. again, this whole thing has been a sham. it started in the bunkers of the capitol. shrouded in secrecy. that secrecy has continued. they sent this letter, chairman nadler sent a letter to pat cipollone our white house counsel demanding let the president come in and prove his innocence. why is he saying that while the president is at nato

with world leaders doing his job overseas for our country. the same time usmca could bring over 176,000 jobs millions of dollars to our economy is sitting on nancy pelosi's desk collecting dust because they won't do anything positive because they are dead set on taking out our great president. we are not going to let it happen. yes, we are more unified than ever, our party. steve: all right. pam, there is a big story in the "the washington post," their headline says barr, the attorney general, disputes key inspector general finding about fbi's russia investigation. and what it says is the attorney general told people he disagrees with the upcoming ig report which is in its draft form. according to the "the washington post," the fbi did have enough information to justify starting the probe to spy on the trump campaign back in july of 2016. now, at this point, these are just, you know, we don't know the source for the "the

washington post." it could just be prestory spin. but what do you think about that? >> well, you know, we have been discussing this for so long that this was a hit job on the president from day one. there was nothing there to open the investigation. we have full faith in attorney general barr so the inspector general he simply issues a report. now it's up to -- once that report is issued. it's up to the attorney general and department of justice to continue with a special prosecutor. steve: to decide if there are going to be charges. >> exactly. this is just a report. when i was attorney general. i had an inspector general. they issue reports. then on a parallel track, we will come in with a special prosecutor to look at that. ainsley: the president wants to focus on the durham report. any word on when that will come out? >> the durham report, no. we will not get ahead of that again, the durham report is more of a durham
