respect to that measure or matter during at least one day of the hearing thereon. ultimately a full house vote would be expected to fall down mostly partisan lines. last night speaker pelosi was asked if this was all about politics. here's what she said. >> no. this isn't about politics at all. this is about patriotism. it's not about partisanship. it's about honoring our oath of office. >> this, as president trump fights back telling pelosi to hurry up and get it over with so he can move onto the senate trial where the white house feels they have a better shot at a fair process. the president tweeting where is the fake whistleblower? where is the whistleblower number two? who is the phony informer who got it all wrong? so will we have a vote by christmas hard to say. key timeline is whether the white house will respond to chairman nadler's deadline by 5:00 p.m. to decide whether or not they will cooperates and participate in these next steps. if they did, that would definitely push it into the

new year. as for collins in that request by house republicans, we will see what happens, it's not likely based on what we have seen out of chairman nadler so far. brian: griff, real quick. they don't have to give minority day, they just request it. if there were minority day it would be a venting session. wouldn't get anything done. correct? >> the rules provide they can request that whether or not they do anybody's guess. they wouldn't likely have any chance to call some of the fact witnesses they wanted to call like chairman adam schiff of the intel. so it really probably wouldn't make much of a difference obviously the white house indicating they are ready to move into the senate. ainsley: president wants to call pelosi, hunter biden and joe biden and adam schiff. if the committee calls them to speak and be witnesses do they have the opportunity to say no they are not going to do it or do they have to speak? brian: come senate, yeah. griff: i don't know. that's a great question for lindsey graham the chairman of the senate judiciary

committee. we will find out if those requests are even made in the first place. brian: we appreciate you getting up with us. we want you to go back to the border where things were more civilized than washington you had to deal with the last few days. pete: unreal. they decided they are going to impeach him. how quick they do it is a question. some are saying before christmas. then you look at january, it goes to the senate where republicans are in control. and they could drag anyone they want before the world to expose the side of the story they don't think. ainsley: just like the democrats did on the house side. pete: how far do they go? hohow hard do they push to get these witnesses? january is going to be a heck of a month. ainsley: how long do they carry it out? if the senate carries it out for months in election year that could be detrimental for democrats. brian: two things bother me most about nancy pelosi's speech. come out and say it's political. don't say you are doing it prayerfully. we all know it's politics and not doing it prayerfully.

should come up and speak because even though you disagree with the president on many issues you don't think what he did in ukraine was, get this, impeachable. because of that his life has been turned on his head. ainsley: he said my call for greater civility and dialogue may have been the least successful argument i made to the committee. before i finished my testimony, my home and office were inundated with threatening messages and demands that i be fired from gw. pete: he went and wrote a quote in the hill. listen to his testimony, thoughtful, credible guy. most dangerous place for academic is often between the house and the impeachment of an american president. i knew that going into the first hearing of the house judiciary committee on the impeachment of donald trump. yet, i remained a tad naive hoping academic discussion on hills industry and the standards of it might offer a brief hiatus from hateful rhetoric on both sides. my call for greater civility and dialogue may have been the least successful argument i made to the committee. brian: i just think that

political opponents as part of the democrats' impeachment inquiry that show rudy giuliani and devin up in necessary and maybe even the president. why is he sniffing around calls of reporters and congressman because we also know that there was a reporter involved in this. here to react is former doj official ian prior. ian, i think everyone i know was caught by surprise to see these phone records entered into the record which is part of the impeachment process. were you? >> yeah, i mean, look, there is multiple constitutional problems here. just last year in 2018, the supreme court ruled in order to get phone records, and i'm not talking phone calls. i'm talking phone records from third party providers, you need a warrant because there are fourth amendment concerns. this was a decision reached by the four liberals and john roberts by the way. so irony there. just because he is the president of the united states doesn't mean he doesn't have constitutional rights. then you have his attorney and you have reporters. they have a 40 amendment interest in not having their phone call and their phone records taken without a warrant. throw on top of that fact that rudy giuliani is the

president's attorney. there is attorney-client privilege there. that's extremely concerning from a fourth amendment standpoint. and the fact that congress was able to do that without a warrant should be a problem for every american. brian: what about at&t and verizon saying i can't do this in unless i tell the other party. what about their responsibility? >> if i were one of these individuals, i would have certainly a bone to pick with these third party providers and i might haul them into court. you also have a first amendment problem here. right? if you are going after the phone records of reporters talking to public officials or their attorney, that has a chilling effect on the ability of reporters and the media to do its job. there are so many problems here with this it is beyond rationale here. brian: if you have a problem with your legal background, then what -- the average civilian is really scratching their head. i want you to hear what devin nunes said about this after all it was his records they looked at. >> sitting there with thousands of pages of metadata. somehow they went through there and found my cell

number a few times. what's even worse is that they used that, they selectively used my numbers in order to build on their conspiracy theory that somehow myself and my two staffers, former staffer, one current staffer that they don't like because we embarrassed them with the russia hoax. that's what this is all about. brian: you can understand his concern. do you know what i'm a little curious about ian? i want to know if adam schiff did talk to the whistleblower. can i see his bill? >> i mean, certainly if we apply his rules it, would be nice to get the majority back and maybe we would have that ability. but, look, this goes to the biggest problem with impeachment, which is that democrats are taking what should be the worst case scenario and turning it into a political tool. i fear to see what's going to happen going forward with this country if impeachment becomes nothing more than a political tool to go after your political enemies. brian: ian, we will have you back as you know. ian prior, thanks so much. >> thank you.

they are unhappy with what they have done. and i think it will have ramifications for them in 2020 and it will give us an opportunity to take back the house. ainsley: it looks like the house will impeach. it will go to the senate and the senate will call witnesses. how does this all play out? how long do you think it will last in the senate? how will this effect? next year if it goes to the senate, that's an election year. how will it effect the campaign? >> i think the senate has an obligation to call adam schiff to get to the bottom of what type of collaboration he had with the whistleblower. i think it's crazy that we haven't heard from this whistleblower. we should know what type of bias they had, if they had any partisan interactions. they are talking about removing a president of the united states. and turning around the will of the people. this is frightening for our country. and it's been done in a totally partisan way. remember, it was nancy pelosi who said if we go forward with, this it needs to be compelling, overwhelming, it's got to be bipartisan, none of those things have happened. and also hasn't been transparent. so this is not something that's good for our country.

don't challenge this guy's ethics. pete: this guy has said is he not voting for biden. >> sure. pete: he is a democrat. how does this cut for joe biden? >> you know, i don't think this is going to move the poll as whole lot. i think if you already like joe biden. you will be kleined to see this look he is showing some spark and fight. this is the guy we wanted to show up to the race. if you didn't like joe biden to begin with you probably don't love him after this. i think the challenge he is going to face in the national polls, while he has stayed pretty stable in early states, iowa, new hampshire, his numbers have been falling and somebody like mayor pete, pete buttigieg has been rising in the polls, capturing a little more of this excitement that joe biden, i think, was banking on having to sort of ride his way to the nomination. pete: you mentioned pete buttigieg, he has picked up three endorsements from former obama administration officials. now biden has said they didn't ask obama for the endorsement. but to see people move from obama's camp to pete buttigieg, that seems like like a slap at biden.

>> there is a ton of obama surrogates out there. austan goolsbee is one of my partners in business. he was with beto, now he is with mayor pete. is he likes this generational change. reggie is a good friend of mine. then you have vice president biden just has secretary kerry. deval patrick has another group of obama guys. there isn't a lack of obama people. one thing i would say this has nothing to do with the former president's view. this is not about where these people should be going. this is not a detriment to joe biden or a detriment to anyone else. pete: is it, kristin or confusion on the left? people just not know where to go? >> he is not able to put together the same coalition that obama put together. obama was able to sort of fuse african-american voters. young voters. a lot of the pieces of the democratic coalition. biden hasn't put that full band back together. in particular, younger voters in the democratic party have not warmed to joe biden. and with this no malarkey bus tour, is he kind of doubling down on the fact that he is quite popular with older democrats and

brian: homeless crisis in california continuing to spiral out of control. more than 1,000 homeless people died in los angeles county just last year. ainsley: well, hoping to cush the epidemic. los angeles voters approved a $1.2 billion program to build housing for the homeless back in 2016. but, by the end of this year, only 1% of those apartments will be ready to use. pete: joining us now to react radio talk show host and host of prager u dennis prager. always love having you. a billion dollars spent but it's not ready any of this surprise you? >> well, it's not just that it's not ready it's not a good idea. the more you spend, the more homeless you will produce.

that is the point here. and unfortunately, while what we have here is what thomas sol, the great economic thinker, conservative thinker pointed out years ago. first stage thinking characterizes all left-wing thinking. they never ask what will our good intentions produce? and very often they produce terrible things. so, if you build more places for homeless people to stay, 600,000, $500,000, $400,000 apartments, more people will come to los angeles, you will have more fecal matter in the streets and, in fact, one man ahead of a mission there had his leg amputated, helping the homeless because he stepped in to some of this fecal matter and got a staph infection. this is beyond belief this is happening in the united states of america at this time. brian: it's not really unbelievable. a lot of the liberal policies seem to be popular to the homeless. we seeing it in austin, texas, too. if you welcome it, they will
