1:05 am
could be anywhere from 3 to 5 articles of impeachment, once written chairman nadler could see a vote on them and he's confident the evidence is overwhelming. >> i think the case we have if presented to a jury would be guilty verdict and about 3 minutes flat. >> the president, though, was pushing back on twitter over the weekend saying, this less than 48 hours before start of impeachment hearing hoax, no do process, do-nothing democrats are changing impeachment guidelines because the facts are not on their side, when you can't win the game, change the rules, democrats say the president could present his side if he we wanted to participate but the white house indicated they would be not part of today's hearing because they believe it's a predetermined outcome when the committee votes on it, the votes only getting worse for democrats.
1:06 am
>> i don't expect any republican to vote for impeachment. >> now, if they did actually get this passed out of committee this week would go to rules committee and floor vote for full vote, historic as it would be before christmas, heather. >> carried live on fox news throughout the day, thank you so much, griff. today highly anticipated report on potential fisa abuse will be released, doj inspector general will scrutinize the fbi's investigation into 2016 trump campaign and will likely shed light on the sources behind the infamous steel dossier, todd

year. well, to fox news alert for you, saudi national charged with killing 3 members, service members while training along side of them is now the focus of the terror investigation. >> our main goal right now is to confirm whether he acted alone or was he a part of a larger network. heather: jim hanson says the military needs to rethink its vetting process for who they invite to train in the u.s. and he joins us up next. and switching gears completely, that banana duck taped to an art gallery wall, remember that? well, it is now 120,000 snack, the controversial new replacement after someone peeled it right off.

1:16 am
>> we are as we do in most active shooter investigations, work with the presumption that this was an act of terrorism, our main goal right now is to confirm whether he acted alone or was he a part of a larger network. heather: and fox news alert for you, the fbi confirms that they are investigating the pensacola naval base shooting as terrorism as we learn more about the deep-seated hatred that this gunman reportedly held for the united states, joining me now to react president of security studies and former member of the army special forces jim hanson, jim, thanks so much for joining us, we appreciate this. >> good to be with you, heather. heather: killed 3 sailers, injured 8 others, what do we know in terms of the very latest as to where the investigation is going? >> i think it's significant that the fbi has made it a terror
1:17 am
investigation. it has all the hallmarks of it. his social media postings showed jihadist ideology, showed islamist bent, that's the right thing for the fbi to do and as she said, they need to find out whether he acted alone as lone wolf or part of larger network, other members of saudi leadership had anything to do with this because they've actually allied with president trump against the islamists in saudi arabia and elsewhere, seems unlikely they're involved but could be their opposition or potentially other islamist worldwide. heather: you mentioned the possibility of other people being involved, we can pull up the information that we know about the gunman and part of the reason they are looking at other because of the second thing, he watched the mass shooting video and so they have to determine whether or not he watched those with other people also we had the possible twitter account with tweets with hatred of
1:18 am
americans and he had returned from saudi arabia in february and some say more religious than before. >> and that's a problem, that's what we have to look at is with us there anyone in the united states along with him, fellow students or others potentially enabling this and was he part of some radicalization, you know, through other means, i think if there's anyone else involved and there's no evidence of that yet but if there is heads need to roland i -- roll and the saudis do make heads roll, if they catch somebody that they will take care of that. heather: there's controversy of that and saudi involvement in this, what about the vetting process, procedure for foreign nationals, giving them training here by the u.s. military on our bases? >> i can understand why people would question that right now, green on blue incident like this in the united states where foreign soldier kills u.s.
1:19 am
service members but we get tremendous value out of the training the people receive so we can inner operate with u.s. troops and also the good will that the vast majority of them bring back to their countries about the united states. now that said we do have to make sure that we don't let a wolf in in sheep's clothing or in military uniform in this case. i think we need to look at everything that led to the approvals of this particular person coming into the united states. heather: let's move to the second topic quickly and i want your response here, president trump opening the door to talks with iran for the release of an american hostage, so how significant is this, listen to this and when we will get your response? >> maximum pressure campaign had an impact and was in part responsible for this release, the president has offered to talk to iranians without preconditions and the sanctions and maximum pressure will not be
1:20 am
let until iran ends nuclear program. >> false charges their usual change of using as bargaining chip and the president wants to negotiate with iran but only if they're going to act in good faith and that's a long shot, so i think the maximum pressure sanctions are definitely working, they are hurting and they have protests at home, they need something good to happen, we will see if they're willing to actually do anything to earn, you know, any relief from sanctions. heather: jim hanson live for us this morning, thank you, jim, we appreciate you joining us. >> always a pleasure. heather: time now 20 minutes after the stop of the hour and former fbi director james comey insisted that he followed the letter of the law in the russia probe. >> total confidence that the fisa process was followed and that the entire case was handled in responsible way by doj and the fbi. heather: what can we expect when the inspector general's report is released today?
1:21 am
attorney david bruno says anything short of criminal charges would be a win for democrats, here he is, he joins us up next, good morning what are you doing back there, junior?
1:22 am

since we're obviously lost, i'm rescheduling my xfinity customer service appointment. ah, relax. i got this.
1:24 am
which gps are you using anyway? a little something called instinct. been using it for years. yeah, that's what i'm afraid of. he knows exactly where we're going. my whole body is a compass. oh boy... the my account app makes today's xfinity customer service simple, easy, awesome. not my thing. heather: long awaited ig report into possible fisa abuse will be released today debunking fbi james comey claims of innocence once and for all. >> i have total confidence that the fisa process was followed and the notion that fisa was abused is nonsense. heather: after months of leaks,
1:25 am
what can we expect, former prosecutor dave bruno, thank you so much for joining us, it's going to be a very busy day. >> good morning, yes, it will. heather: what do you expect to come out in the fisa report when it's released? >> i think would be the steele dossier, how it was presented to the court and anyone that thinks this is going to be a bombshell, don't hold your breath, you know, because horowitz does not have the authority to charge anybody, it's really investigative, administrative investigation and there's the scope that's limited for horowitz as well, this is only fisa abuse, this is not the origin, that's durham, ag dour him and -- durham and barr, this is select and limited in scope. heather: not just limited in scope but who he can question as well? >> sure, he does not have subpoena power, he has the
1:26 am
ability to interview present employees and anybody that volunteers so, yes, there are some limitations to this report coming out today. heather: let's take a listen to this, this is carter page predicting some of what the ig evidence will be that will be classified. listen. >> there's been internal battle, we have to see how all that plays out. who were the russian informants that allow today get the fisa report? >> i don't know that we will get that, but i'm hopeful as to the information we are going to get, president trump did give bar, are the ability to declassify this information and without that i think we'd see a lot of blocked out black boxes, given
1:27 am
the authority, i think we will get a lot of information that we wouldn't have otherwise gotten directives. >> at the end of the day who do you think will benefit from this? >> i think both sides will get take aways here, certainly on all of the steele information and not telling the judges that it was paid by the dnc and the hillary clinton campaign, not telling judges that there's circular reportings, i'm interested to see what they say about circular reportings and doj and fbi used same yahoo news story to almost corroborate steele in the application, also steele was terminated for leaking, when did the feds know about that, if it was in october prior to first application, that would have been in application as well. >> it'll be interesting. there have been a couple of leaks but as of right now no one knows for sure who is this the
1:28 am
report but we will hopefully find out today. the other thing happening today ahead another week of impeachment hearings, claims that the president can be impeached for motives without breaking the law, so what exactly does that mean? >> i have no idea. [laughter] >> direct evidence, we are looking for direct evidence in the mind of donald trump and why he did what he did and we have one witness sondland who says i talked to president trump, there's no quid pro quo, i don't want anything, i want the ukraine president to do the right thing, that's the only piece of direct evidence that ever came out through the intel committee. heather: i'm sorry, what does that evidence, evidence in the mind of, you know, president donald trump? >> because there's a dispute as to why he held the aide, was it for general corruption, was it make sure that they knew ukraine
1:29 am
president and follow their positions or was it for his personal gain to take down -- heather: how do you determine what was in the mind of someone else? >> you'd ask him and i get back to sondland's point, no quid pro quo, i don't want anything in return, make him do the right -- let him do the right thing. that's what we have right now, that's it on trump's mental state during this process. heather: you have what the president has said repeatedly and you also have what president of ukraine had said as well. >> i mean, that is the biggest fact in any mind, if you're going to call this a bribe, how sit a bribe when the ukraine president was not aware that aid was being withheld at the time of the call. >> thank you so much, we always appreciate it. you are break it down for us. >> fox news for you, deadly
1:30 am
volcano, sent tourists scrambling for safety, watch. [inaudible] heather: right now too dangers for rescue crews to find those who are missing, the breaking details coming up from overnight, plus as adam schiff focuses on impeachment in homeless crisis and congressional district, jennifer barbosa is running as an independent and saying that's not the only area where schiff is letting down constituents, she's up next.

1:32 am
1:33 am
heather: welcome back, half past the top of the hour, today headlines for you starting with fox news alert, terrorism suspected as motive aspens controlla -- pensacola air base
1:34 am
plans to reopen today, 3 servics were killed in that attack. today ig report will be released, 201 - trump campaign and will likely shed light in infamous steel dossier as democrats ramp up impeachment efforts with another hearing today, impeachment vote could come as early as this week, today the first lady will celebrate the holidays with the military. she's visiting joint base in dc for the annual marines toys for tots program, the first lady will help children make christmas cards and sort toys for charity. to this fox news alert for you, at least 5 people are dead and
1:35 am
several other missing after this volcano erupts in new zealand, the explosion causing panic on a boat full of tourists. [inaudible conversations] >> go inside. heather: you can see just how close the tourists were to the eruption ash spewing thousands of feet into the air, this group let the volcano just 20 minutes before it exploded, police are not sure how many people are still stuck on the island right now it's too dangerous for rescue efforts, amazing. >> now to this fox news exclusive apprehensions along the u.s.-méxico border dropped for the sixth month in a row. data from the department of homeland security shows 42,645 migrants were either arrested or turned away in november, that's a decline of 6% since october and drop of more than 70% since
1:36 am
may, the administration is crediting new policies aimed at stopping migrants from central america. and now to some election headlines for you, 2020 hopeful cory booker is criticizing the democratic party for using fundraising quotas in order to qualify for debates. >> we should be stopping the influence of big money in politics, kamala harris campaign couldn't do what billionaires are doing in this race, putting ads to jack up poll numbers. heather: booker has until thursday to make that cut. and senator elizabeth warren qualified weeks ago, she's now putting the spotlight on her own finances, her campaign disclosing that she earned $1.9 million during time at law
1:37 am
professor over 3 decades, warren has been attacked by rival pete buttigieg for not being more transparent about her finances and fundraisers. another 2020 race of note, california's 28th district that's where adam schiff serves but while he's solely focused on impeaching president trump homelessness there amongst other things continue to rise, one woman has made it her mission to take back the seat to constituents that it's supposed to serve and that candidate jennifer barbosa joins us to talk more about that, thank you so much for joining us, we appreciate it. >> good morning, heather. >> in terms of homeless crisis we can take a look at that in that specific district, 59,000, the homeless population, part of your district, that's up 12% from the previous year and that along with 75.2% who are considered unsheltered, so what
1:38 am
has schiff done to counteract these numbers? >> that's the problem, schiff has done nothing to counteract the numbers, homeless is up 75% since he became our congressman and the fact that he's, you know, pursuing this impeachment while we have the astronomical numbers, crime is up and rape up in the city of la, assaults, arson, it's really unspeakable what's happening. heather: so the work that needs to be done there in california you're alleging is not getting done, what about in terms of impeachment inquiry and schiff moving forward, fast-tracking it and we can take a look at california, your district once again and the latest numbers we have, 49.6% of democrats are there in your district, 16.51% gop and then independents
1:39 am
basically no party preference is about 29.48% and then bring up this poll if we can in terms of impeachment, independent support impeachment, 40% compared to about 36% who oppose it and 24% who oppose, republicans 81% oppose and then democrats as we just saw the majority there in your district support 85%. >> yes, so that's the key right there, the way to defeat adam schiff in the district, we can't rely on republicans because we simply do not have enough republicans, we have to galvanize and activate independent voters, that's why -- run of the reasons i'm running as independent. heather: how do you do that, value begannize independent voters? >> i started early in march of this year, it's really just basic grassroots efforts, i go door to door every single day. it's fascinating to hear the stories that people tell, they
1:40 am
say hundreds of people tell me that adam schiff personally knocked on their doors, republican doors 20 years ago when he ran for the seat, not a single voter has a story about a republican ever knocking on their door and that's shocking to me, not one republican congressman, congressional candidate knocking on their door. heather: schiff pulled in more than 70% of the vote in the last primaries, what else has to be tackled in your district that's not being tackled while schiff focuses on impeachment? >> we hear the tremendous job's numbers, unemployment are down, in los angeles our numbers are lagging behind and we are not doing as well in terms of unemployment. so if schiff would put aside the impeachment thing for, you know, long enough to get usmca passed
1:41 am
that would help our district tremendously. heather: jennifer barbosa, we appreciate your time. >> thank you. heather: time now 20 minutes until the top of the hour and christ in a cage, nativity scene turning holy figures into political commentary and social media is sounding off, live with the outrage, good morning. could save you 15% or more on car insurance." i think we're gonna swap over to "over seventy-five years of savings and service." what, we're just gonna swap over? yep. pump the breaks on this, swap it over to that. pump the breaks, and, uh, swap over? that's right. instead of all this that i've already-? yeah. what are we gonna do with these? keep it at your desk, and save it for next time. geico. over 75 years of savings and service.

getting a whole lot of attention in southern california, the minister at claremont united methodist church, refugee family in the world. imagine joseph and mary separated and placed behind the fences of a border patrol detention center, the minister is referring to the trump administration's now separating migrant families who enter the united states illegally, the protocol separated 5400 kids from their families until president trump ended the policy last year. migrant children have been detained since obama administration, jesus, mary and joseph have been united. fox news reached out for comment but we have not received one, all right, back to you.
