the new starts now. the house is officially announcing articles of impeachment against the president of the united states. this is only the fourth time it has happened in the history of our republic. earlier today, house speaker nancy pelosi along with democratic chair leading the investigation revealed they are charging president trump with abuse of power accusing him of using his office to try to get ukraine to influence the 2020 presidential election for his political advantage. the other charge, obstruction of congress for what they call unprecedented defiance of the house impeachment inquiry. going to explain both of those charges and taken as well as what happens next. president trump tweeting one of his go to lines calling it a witch hunt. the white house says it is a baseless and partisan attempt to undermine a sitting president. the democratic house judiciary chairman jerry nadler said no one, not even the president is

>> shannon: we got a statement yesterday but we are actually hearing from the attorney general about the justice department inspector general's report on the russia investigation, what can you tell us? >> in a couple of forms, the attorney general said that he disagreed with some of the findings of the horowitz report but disagreed with the report that the russia investigation was legitimate and justified saying that he believed it was based on very flimsy evidence. today, he insisted the trump campaign was spied on and he railed against mistakes and misconduct on the part of the fbi in seeking those fisa warrants. listen to him at this "wall street journal" form. >> it quickly became apparent it was a travesty. and there were many abuses and that is by far the most important part of the report i think, mike horowitz would agree with that and also the fact that

is the senate going to do? this is going to be boring and short because it's such a clear-cut case. >> they are given the full authority of the constitution commands him to take care of the laws to be faithfully executed. providing ukrainian aid in the first place specifically requires the administration to determine the ukrainian government is taking the steps to combat corruption requesting that government to cooperate in resolving issues that point to corrupt activities between american and ukrainian officials is not only within the president's scope of authority, he is commanded to do that by the laws. don't forget just last year, three democratic senators wrote to the ukrainian government asking that they would cooperate with the mueller investigation. the only differences only the president has the authority and responsibility to cooperate with the follow-up investigations. >> shannon: it might've been, we watched double check that but i remember the letter you are

talking about. so moving forward, do you think there were any democrats on the house will vote against impeachment if this makes it to the senate? >> i can't read minds but i can tell you this, there are a lot of democrats who ran as problem-solving moderates and got elected on that promise. i think people need to understand that they are not problem solvers, by supporting pelosi, they are enabling the radical left of the democratic party to drive this entire travesty. meanwhile, the nation's business has been placed on hold for a year and the people that i talked to in my district are serious about that. >> shannon: very quickly, can you give us a gas on when this might actually go to a floor vote? >> they want to as quickly as possible and the reason is they have lost support. they are losing massive support now particularly in the swing states and among independent

but attorney general william barr pushing back and pulling the investigation intrusive. that's not all. reporting live from the justice department as we learn more. >> not even 24 hours after ig michael horowitz released the report in this building, another man that worked for this building, the attorney general found some serious problems with that report, he says that the trump campaign was spied on and the fbi may have acted in bad faith. bold claims by the attorney general. this goes against part of the inspector general's findings, the nearly 500 page report offered what some say is a mixed bag of conclusions that stated there was no political bias behind investigating the trump campaign, but that doesn't mean the fbi got off easy. they did not get off the hook. inspector general horowitz wrote "we did not find document to influence the fbi's decision to seek size of authority on carter page. but the report did find 17

errors or omissions when applying for that, today bill barr in an interview criticized borowitz and said there were no improper motives found. he was questioning that. listen. >> all he said is people gave me an explanation and i didn't find anything to contradict it, so i don't have a basis for saying that there was improper motive. but he hasn't decided the issue of improper motive. >> have you? >> no. we have to wait until the investigation by the full investigation is done. >> it is important to point out that michael horowitz has inspector general can only interview actual government employees that want to talk to him but he can't force people to testify, he does not have that power. he will be speaking before senate judiciary at 10:00 tomorrow morning. >> shannon: i'm sure he will be asked about that tomorrow.

the attorney general also talked about the report on the russia probe by john durham. any crumbs on that trail? >> michael horowitz, the inspector general cannot force people to testify. but john durham can do that. he can also put people in jail, criminally charge them, he has a much wider net in several different departments. that probe being held tight, we don't know if it's going to come in the form of a report but bill barr today who test the room with this said that that those findings should be done probably the end of spring and early summer but who knows, could be later than that but that's going to be pretty expensive. >> shannon: right in the middle of a presidential election. thank you. back to where fox top story, a historic day on capitol hill. and democrats announcing articles of impeachment against president trump. the president says he has done nothing wrong in the white house predicting the senate will fully exonerate him. democrats also announcing a deal

that we get to the end of the session, there has to be some decisions made. >> the other thing they have to do is we spoke just within, he said "they tend to focus people's minds, of course they want to get out of here and to fund the government by the end of the day on the 20th, that is when the government funding bill runs out and right now i'm meeting going on in the speaker's office with the two chairs of the house and senate appropriations committee's and also steve minasian the treasury secretary. i talked to the chair and said we can walk, chew gone, and run. there's a question about the sequencing which comes first, impeachment. the usmca, that's their advantage in the sequencing. they just want to get it done but also the senate majority leader indicated just within the hour that they won't touch the usmca in the senate until after the senate trial, which means next year.

>> shannon: that could come a lot of things up on the 2020 trail. let me ask you this, there has been some speculation that would be multiple articles of impeachment that would give those democrats who are moderates and swing districts the possibility of voting for some but not for others. now it is down to these two, are you hearing any rumblings from the so-called moderates how the members are feeling about actually coming to this vote? >> there was chatter about censure and when i spoke with him, i asked him if that was at all on the table and if they had to massage some of the moderate democrats and he said we are always massaging things but also said that censure was never truly an alternative. house speaker nancy pelosi does not lose votes on the house floor. and if those are the two articles they're going to put on the floor, those are going to be the two articles. is binary, it is a big decision, probably the most momentous decision when it comes to a roll call vote that any member of congress can take besides a vote of war and you have to be on the right side of this.

when not breaking news on the story we've been following from new york city new jersey where we learned a police officer has died during a swot standoff. he has they were in jersey city. >> very sad news to report that two officers were shot, one of those officers has died. as a matter of fact, we are now finding out that three officers in total were shot during the mayhem this afternoon here in jersey city and one of those officers has passed. two of those active shooters who were here this afternoon have

been shot by police, are one federal law enforcement source tells us that both of those active shooters are now dead. we are now also understanding that the s.w.a.t. teams here in jersey city are dealing with a third suspect who has been firing at police from this vicinity in jersey city, about a block behind us over here, a situation where they are all dealing with a third suspect. this all started this afternoon, s.w.a.t. teams and emergency personnel have been brought in through from throughout the region. all on scene, dozens of s.w.a.t. team officers, bearcat armored vehicles all called to the scene as essentially police were confronted for what we now are understanding, three arm suspects. we believe this third suspect that is still out there right now that is being confronted by police is a black male, 6-foot, dressed in all black.

according to one source telling fox news that is a situation now, very much inactive scene right now. again, this all started at about 12:30 this afternoon and that same law enforcement source tells me that that officer that was killed was an officer who confronted one of the shooters at a nearby cemetery. this all is happening at a bodega at a kosher supermarket here in jersey city. that is where these gunmen essentially found themselves barricaded him were confronting the police in and around there. right now, police are pushing people back here for a little bit saying to be careful because this is very much inactive situation just a few blocks away as police are confronting a third suspect. >> shannon: bryan llenas on the scene checking this all day for us, thank you. there is where the united states government has spent the last 18 years repeatedly lying to us about the war in afghanistan. the evidence? a stunning series of documents and interviews with people

"the washington post" obtained a collection of notes and transcripts including candid interviews with commanders, soldiers, and officials from three administrations. their words reveal that some senior u.s. officials did not tell the truth about how the war was going and hid evidence that it had become unwinnable. they did this as thousands of americans died in the war. as thousands of families learn their loved ones would not be coming home, as thousands of service members learn to live with wounds both visible and invisible to the head of that agency that conducted the interviews told the post the documents show "the american people have constantly been lied to." national security correspondent jennifer griffin digging into this, good afternoon. >> few ever believe the u.s. was winning in afghanistan, "the washington post" fought

three years to have these candid interviews about what these generals and u.s. officials knew about how the u.s. was not succeeding during the 18 year war. the post and others are comparing it to the leaked documents known as the pentagon papers which showed the u.s. government lied about the u.s. winning in vietnam. the special inspector general for afghanistan reconstruction interviewed 600 people. those interviews were never supposed to be made public. the top u.s. commander general scott miller is slated to breathe congress and closed sessions today and tomorrow. miller is the 17th general to them in afghanistan. more than 775,000 u.s. troops had deployed to afghanistan. of those, 2300 were killed and 20,589 were wounded in action according to the pentagon. the distortions began in the early stages of the war. "we didn't have the foggiest notion of what we were undertaking, one key general
