steve: welcome aboard, folks. for the people looking in right now 6:00 a.m. in new york city during the christmas holiday season, we have people who have traveled from all across the country to be with us. brian: very interesting. they decided to sleep in the studio last night so they wouldn't miss it. [laughter] brian: they are wearing the same thing as when they came in. these are their thursday outfits. steve: brian luckily they got dressed. brian: true. ainsley: christmas in new york. isn't it magical? ainsley: i love you are all staying for the weekend and enjoying it all. brian: what a great day it would be to try to impeach the president in the house. they stayed up for the last two days staying the same thing over and over again. steve: because you may have got up early you may have missed last night in the 11:00 hour they decided you know what? it's too late, we're going to go ahead and have the impeachment vote friday morning at 10:00. that infuriated the republicans. here is.

why during one of their breaks yesterday, jerry nadler and doug collins, the republican and the democrat sat down and they agreed we're going to be done with all discussion at 5:00 and then we are going to have a vote. but then as we know, it dragged on until 11:00 and then jerry nadler pulled the plug. ainsley: here's the thing. they have been in these sessions all day until 10:34 at night on wednesday. last night they thought they would have a vote at the end of the day. stayed for 13 hours yesterday. all of our congress men and women thought they were going home to their families to celebrate the holidays. steve: doug collins was going to be on the show. ainsley: we're not going to vote today. we will make you stay in washington for another night. who pays for their plane flights probably us, right? they are staying there and appear this morning at 10:00 because of tv ratings according to doug collins. because 10:00 a.m. california was waking up. steve: we love tv ratings. we are number one. cop. on.

brian: last night to the surprise of the person to his immediate left, jerry nadler, who used that little gavel every seven seconds said this. >> the committee will now stand in recess until tomorrow morning at 10:00 a.m. at which points i will move to divide the question so that each of us may have the opportunity to cast up or down votes and each of the articles of impeachment so historiable our judge, committee is in recess. >> mr. chairman, there was no consulting with the ranking member on your schedule for tomorrow in which you just blown up schedules for everyone? >> this is the kangaroo court that we're talking about. >> this is outrageous. >> stalinesque, have a dictator good to hear about that. >> unbelievable. brian: that was the voice of louie gohmert. but the one thing that got away. did you guys have a chance to see any of this? it was the same -- they said the same things to each other over and over again.

[sighs] >> this was the most thing ever. if american people wondered about this impeachment anymore? they don't have to wonder anymore. they saw what happened tonight. this committee is more concerned about getting on tv in the morning than it was finishing its job tonight and letting the members go home. they do not care about rules. they have one thing their hatred of donald trump. this crap like this is why people are having such a terrible opinion of congress. i don't have a chairman anymore. i guess i just need to go to

straight miss pelosi. what tv hit douse this committee need to do because this committee has lost all relevance. brian: two articles of impeachment, abuse of power which the republicans were pushing back hard on and obstruction of congress not going to last in the senate. really tough votes for democrats because you have a lot who got into seats that donald trump won, 31 in all. and you have about 8 who flat out said i have not committed to voting for impeachment. think about the embarrassment the historically of not voting for impeachment when your own party puts it up. let alone not getting any republican buy. in this is a disaster. ainsley: they are under so much heavy pressure from both sides to vote for it or vote against it. if you want to know some of these individuals, 31 democrats, max rhodes, he is a democrat from new york. he was against impeachment but he did support the inquiry. then have you alyssa slot kin she wrote to launch the inquiry. hasn't said how she will vote. patrick malone and conor alyssa milano who was a

moderate. tom from new jersey they all do support impeachment. then have you those two dems against even the inquiry and that's jeff van drew from your state, steve and collin peterson from minnesota. >> what doug collins said in that sound bite the american people are sick of this crap. can we see the hands of the people who are sick of this crap? [laughter] ainsley: how about when the president said you are all the elites. you are the elites because low unemployment. job numbers are great. the economy is great. and then sean hannity was doubling down on that on twitter. he was saying y'all think -- you know, you hate us. you can't stand us. talking to the democrat. and he said i am proud to be a smemy walmart shopper and i'm proud to be a deplorable. [cheers and applause] steve: tworge articles of impeachment. abuse of power. the democrats say, because the president said to the ukraine president hey, do me a favor, look into corruption over. there the other is

obstruction, not of justice, but of congress. now, that is essentially it's a separation of powers thing. congress and the executive branch are always at loggerheads. and if they are going to impeach a president over this, mark levin says buckle, in folks. because every president is going to get impeached. watch. >> every past president who would be subject to impeachment under the current articles being debated in the house of representatives john adams would be impeached. he shut down newspapers and imprisoned reporters. abraham lincoln would be beached. he shut down 300 newspapers. he imprisoned reporters. thomas jefferson would be imeemped. woodrow wilson would be impeached. great fdr would be impeached. interment of japanese americans, italian americans. german americans. john kennedy would be impeached. we would have a lot of impeachment going on under these bogus rules that the rogue house democrat leadership has put in place.

brian: just add to that when you go back in history and congressman buck did the same thing. have you got to put in perspective. caught up in the trump era. in the big picture 243 years this happened over and over again. i will add one more thing to the fray if you talk about impeachment. if this president is going to be impeached and you think to yourself they are in a rush, nancy pelosi just let down her mask and said oh, we are not in a rush. we have been trying to do this for two and a half years in an interview she did two days ago. really? congratulations. you just lost your own argument. no matter the sport we went out to win together. we didn't worry about anything else. we were united. you can't have that kind of leader like the kaepernick in the locker room or on the field. the nfl had their opportunity and roger goodell who has managed it badly seized his moment. when nobody showed an interest in colin kaepernick for the very reason i said the very basic reason, whether they agree or disagree, they didn't want that back that was it the nfl had their moment. goodell could finally say goodbye to colin kaepernick. they need to reset themselves with the base, the fans, the people who love the sport and the advertisers. brian: i think they have come back. football has had a huge year. [applause] brian: kaepernick's argument is you put it on a saturday. nfl teams are not going to send their best scouts on a saturday. you didn't give me much notice. and something with insurance was the issue. does he have a point? >> no. because the fact is the teams have enough personnel that if they are really

[cheers and applause] >> that wasn't my role as attorney general. obviously. i was the one that bridged the gap between jeff sessions and bill barr, shook their hands. one on the way out and one on the way. in that's not the role of the attorney general. i read that op-ed and it struck me as odd somebody that has criticized jeff sessions, myself and bill barr suddenly say how hard it is to criticize attorneys, i guess just republican attorney general. when loretta lynch did her tarmac meeting with the clintons there was no eric holder to be heard from in that situation. ainsley: i'm reluctant to criticize my successors but. and all of them. >> mr. holder has been out there playing in state redistricting fights and trying to change legislatures. brian: he has been effective. >> he has been effective.

is he a highly partisan person who as attorney general was there to protect obama and did all sorts of things to make sure that obama was successful. >> so, matt, there was something about law and order this week that the attorney general could have weighed in on. when you had the horowitz report 434 pages talk about how this investigation was launched. how they changed fisa applications. this was a chance for mr. law and order to come out and say democratic and republican aside i'm outraged about what took place and i have got to restore the good name of the fbi and it happened not during his reign, he was out by then. but during the obama administration. >> right. well, everyone that knows eric holder's story knows he is not mr. law and order and he didn't support law enforcement he almost single-handedly undermined law enforcement. we had the whole ferguson situation that eric holder presided over as attorney general. if you look at how this administration and this president has restored the confidence in law enforcement and the fact that we had their back and

[cheers and applause] you know, the obama administration and eric holder will specifically did a lot to undo those relationships. i worked every day on that issue. steve: we had josh hawley on yesterday, the senator from the great state of missouri. and we were talking about how he said, you know, you look at the horowitz report and it's fishy. there were fishy things happening all over the fbi and the department of justice. he wondered, you know, would it be possible that the attorney general would know about something like that? you know, an investigation into a campaign? or would low level people at the fbi and the department of justice just do that on their own? >> no. the attorney general, of course, would be briefed on that. steve: that would mean the president would know, wouldn't he? brian: president obama. >> i don't think there was any doubt that president obama knew. i think everyone knew that crossfire hurricane was going on. they knew exactly what it was about. it was about the trump

campaign and. steve: the president of the united states, barack obama knew that the fbi was investigating donald trump who was running for president? >> steve, i don't have direct evidence of that but i can't imagine it wasn't. when there is an investigation of that magnitude, you would make sure that key people, including the attorney general and the president would know that it's going on. now, were they putting their thumb on it, especially the president, i can't imagine that that would be happening, but, at the same time, there is no doubt in my mind highest levels. ainsley: durham will get to the bottom of it? >> i can't do you tis hit on durham by holder as well. saying your reputation on the line. same finger wagging that. they are scared they are going to get to the about the of it. steve: matthew whitaker, ladies and gentlemen. failed. brian: bill maher. steve: when you look at where we are today and keep in mind they were going to impeach him on the russia stuff until the mueller report came out. like there wasn't enough there. ainsley: right. steve: essentially the president says he was exonerated. now, nancy pelosi is doing this because that's what her base wants. you know, trump's base may want a vial brant economy. nancy pelosi's base wants the president held accountable for his bad actions, they say. and so they want him impeached. and so that's why they are going to have this vote at 10:00 this morning. it's going to move to the full house. she will be able to go back with her members throughout the year in the run-up to the next election and say look, we did what you wanted. we tried to hold him accountable but he was ultimately acquitted in the senate. in fact, mitch mcconnell says yesterday there is zero percent chance that trump will be removed. he said 1 or 2 democrats may actually vote with the republicans ♪ to impeach the president.

[cheers and applause] ainsley: alan dershowitz a law professor at harvard who is a democrat has said this is the most dangerous ground of impeachment ever offered because it basically says that congress is a superior branch. brian: also shows they might want to go back again and keep impeaching him which is just unthinkable. ainsley: they do that, they do that and it will backfire 1,000%. brian: people. moderates and democrats and independents say i have had it with in this f. they pay the price at the polls they will do it. if you get what your base wants, do you lose independents, do you lose undecideds or moderates? that was something even stephen colbert thought was a possibility. listen to his conversation with adam schiff. >> let's just imagine for a moment that the impeachment vote goes through next week and then it goes to the senate, he is not removed from office. won't be he be sort of super trump after that? >> the reality is he feels

[laughter] the president's past behavior is any indicator. the closer we goat to impeachment closer to a china deal. nothing can be boring. all the signs point to money and both countries want the money. it just depends how far china is willing to go with intellectual property theft. >> what's interesting with the stock market. i know a lot of have you investments. how many of have you 401(k)s? right? we are at record highs for the s&p 500. which is really the broadest

way of markets and of course the nasdaq and dow was very close to record highs. this has been very good to have this news. but, guess what? we have been near record highs during the tariff wars. i would argue if they're isn't time to fight a war when it comes to trade with china, the president picked the right time. you don't pick it when the united states is in a recession. you don't pick it when we are going through a bad time with the stock market. you know, you pick it when times are good. so then people can afford that. steve: people said he was a niwhat's your question. >> what's your prediction if trump doesn't get elected in 2020? what will happen to our economy then. >> a question for me? >> yes. >> that's a flat out disaster. i don't care which democrat was elected in 2020 but if a democrat is elected, you will have much higher taxes, much higher government spending and the climate warriors will be turned loose.

if you're serious about moving a president for high crimes and misdemeanors, you shouldn't do it unless a group that voted, yeah, you had to do it because otherwise, you have 20 years, you won the election and you stole it from us, you don't want to divide the country that way. steve: he makes a good point, it has to be bipartisan, if you want to convict the president in the senate you need bipartisan, the super majority, clearly nancy pelosi is just trying to appease her base which wants the president impeached. >> they wanted the president impeached from the first minute he was president, they tried to get him, they tried to get him -- i remember, you know, as a new yorker i was when nadler was a local politician on the west side and donald trump wanted to build the buildings on the west side.
