mcconnell says that democrats may house of representatives are trying to influence the trial. >> only one outcome will preserve presidents rather than smash them into bits and the fit of partisan rage because one party still cannot accept the american people's choice in 2016. >> mitch mcconnell talk to reporters just off the senate floor a little bit ago and he said the following, it's beyond me how the speaker and democratic leader in the senate think withholding the articles of impeachment gives them leverage. frankly i'm not anxious to have a trial if she thinks her case is so weak she doesn't want to send it over and throw me into that briar patch. here's what's really going on. some people think house speaker nancy pelosi might be pulling the handbrake on impeachment. in other words we've gone so far with this, a senate trial could really be bad potentially for democrats. witnesses, may be the bidens, may be adam schiff the chair of the intelligence committee. maybe you pull that handbrake right now and cut it off.

here's the other interesting thing, the house can sit on these articles of impeachment indefinitely. a lot of issues die at the end of the congress, that's not going to happen until january 3rd 2021. remember, they move the articles of impeachment in 1998-1998 over between two congresses. she could conceivably sit on this ad nauseam men up there's never a senate trial, president trump never has the opportunity to say he was exonerated in the senate. >> that's the point. he has been impeached so then what you get is a really prolonged status quo for the president of the united states. at the same time senate majority leader mitch mcconnell couldn't say why even bother to meet with schumer and come up with parameters for the sort of thing if you're not going to pass on the articles of impeachment. >> exactly. that's the issues. nancy pelosi has ball control. democrats in both the house and senate think the republicans in the senate, especially mitch mcconnell, have tilted the playing field and this would be

a trial that would favor the president. they might say wait a minute we don't think that's fair. were going to continue holding on. why would mitch mcconnell have any reason to talk to chuck schumer to set up a deal like they dated 1999 if he doesn't have the articles. as elder points that i think is very important. when you look at having these articles of impeachment and you don't move them over and you continued to sit in this limbo. this gives democrats the opportunity is he going to the 2020 elections and talk about how unfair they think that senate republicans are, especially mitch mcconnell who they call the grim reaper. this is a pretty interesting situation. the other thing is that in the constitution it says article one section three, that the sun as the sole power of impeachment. you can't have a senate trial if you don't have the papers. >> chad pergram on the hill, thank you very much. we thought we were going from a-b and now we are are at w. for what? what is going on?

>> that's a great question. the fact is in my judgment at least it is inconsistent with the structure of the constitution for a speaker to hold onto the articles of impeachment. the constitution does not give the speaker of the house the right to veto an impeachment resolution that's been passed by the house. the framers enacted a two-step process. step one come impeachment by the house. step two, trial and the senate. as we know it's speaker pelosi were to hold his articles indefinitely, never transmit them to the senate, then the president would be deprived of his constitutional right to defend himself and the potentially to obtain an acquittal. >> if you want to talk about of what looks fair and what doesn't, jessica, how does that square? this potentially could backfire and democrats. >> i'm interested in how long this goes on. it's only been about 15 hours. >> you heard the house minority leader, kevin carthy, saying he's not sure how it plays in the constitutional roles. this is a confrontation that's

going on. >> pelosi is in control of this and mccarthy is the minority leader right now so i'm listening to her because she's the one with the reins of control. i do not believe she's going to hold the articles of impeachment back for any serious amount of time. i think it will go through the christmas holiday and that -- >> why? >> what is unprecedented about this situation is having the senate majority leader, mitch mcconnell, on television with sean hannity and other outlets as well is lindsey graham on his twitter account and on fox news saying they have no interest in a fair trial. they've made that perfectly clear. lindsey graham tweeted last night the house is now impeach the president come i want to make this as fast as possible. we already know the president was going to be convicted. republicans are lockstep with him. i don't think there will be amid romney section here. the idea that we are said thing articles of impeachment to the senate so they can rubber-stamp the president's claim that this is a witch hunt is not something that we need to be doing. >> all of the conversation about

fairness because when chuck schumer came out and he said that they only want witnesses who are first-hand witnesses to this case who have firsthand knowledge, who are fact witnesses. i almost threw up. appeared on like that is the opposite of what happened in the house. that was the complaint from the republicans that you had all of these people testifying hearsay and now just as one example, democrats say they want opposite treatment over in the senate. what it proves to me is that it is all political and everyone is biased. none of it is straightforward. what's good for the goose is good for the gander. republicans were treated poorly not democrats are going to be treated poorly beer the whole thing -- >> does the argument about fairness from democrats about high comedy. it's nauseating. the republicans in terms of fairness, intelligence committee refused g.o.p. witnesses would not let the g.o.p. have their
