congressman jim jordan and house freedom chairman andy biggs of arizona. congressman jordan, i want to start with you. i guess we forgot to ask or somebody forgot to ask speaker pelosi if you actually pass it at lightning speed this impeachment, are you going to send it over to the senate? is that something you're supposed to ask along the way? >> again, it's laughable if it wasn't so serious. the idea that nancy pelosi is going to try to negotiate with mitch mcconnell and tell him mitch mcconnell how to run the senate? that is laughable. here's what happened, september 24th when pelosi announced they go down this crazy impeachment road, she never thought she'd lose support across the country and she never expected to lose support inon our own congress. had one democrat vote for us, another democrat voted president, and a third democrat switchcr parties because everyoe sees the facts are on the president's side.

she doesn't know what to do because they had been had in the american people see through it. >> jason: congressman bigs, what are you seeing on the floor when you see these democrats? i just can't believe we are in a scenario where the speaker is contemplating not sending it over to the united states senate? >> you and i are as baffled as to put the squeeze on your members to get enough votes to do it, you violate every historical norm to get in impeachment this way, and then she says, i'm not going to send it over to the senate?? it's outrageous. i think it's justified to say, look, transmission necessary to complete the active impeachment? i'm not sure that's a legitimate question. i think it's a legitimate question. good grief, they are not happy either.

>> jason: you are from ohio. important statement only politically but to the farming industry. the benefits of the usmca. why did nancy pelosi wait? she could've done it a year ago. why did she wait until today to bring up that vote? >> well, i think it gives them tcover for the people who voted for impeachment because it certainly not playing in our state. ohio is going to go -- it was 8.5 points for president trump in 2016. it will be stronger again because when you pointed this out, the president is getting things done, but he's been doing that in three years despite the attacks from the left and the democrats and the mainstream press. the economy growing at an unbelievable pace, lowest employment 50 years, gorsuch and kavanaugh in the court, the embassy now in jerusalem. you just pointed out, and you nafta agreement past the house today. that is getting things done and that ithat's with the american e

see, they also see this impeachment sham for what it is, a sham. >> jason: congressman biggs, the nancy pelosi that i saw, she didn't do anything until she ran it through a pollster and ran it through a focus group. is she just buying time putting where they ought to be putting a finger to the wind and figure out where they should be when you reconvene on january 27th? >> i think she's off script to be honest with you, and to be honest, i think this is the dog that caught the car. she is there, she wants mitch mcconnell to do things a certain way, she's not going to get mitch mcconnell to go a certain way. you are right, they poll tested what they should say in the floor speeches, what they should say in the language they accuse the president of committing, but when you get down to the bottom of it, she's having to go against somebody without being able to pull test it, without able to scripted, she has run up against a guy in mitch mcconnell who is basically authoritative and made up his mind. she's rudderless right now.

they honestly don't know what to do. >> jason: congressman jordan, iy have to go really quick. listen, nancy pelosi back in march sounded reasonable saying, if you are going to move with impeachment, it's got to be bipartisan, got to be overwhelming. what changed? why did she get herself back in the corner that she is g in rigt now? >> i think andy is right. no amount of poll setting, and the amount of changing the rules, setting the rules, and changing the rules that you made, no all the facts were on the president's side. when you have the facts, you can win this debate. that's exactly what happened over the last several months. she said that this was going to be bipartisan, the overwhelming support? she's got this hard left base in the party. they pushed her to do this, they try to say the right thing, but the facts beat that every singly time and that's what happened here.ti >> jason: i want you to speed quickly. i left congress, had a better

house, shoot, we didn't do a very good job of this. she tries to extort us. and use this as a tool for extortion, this idea that, well, if you don't eat your vegetables, you're not getting your dessert. as if impeachment were a reward for us? it's strange but it's not going to work, it's going to backfire badly. >> jason: also here from the democrats, there are going to be people in the senate who will defect, but i have not heard that has any legitimacy behind it, that there are any sort ofim defections, but there might be some democrats that come over and join republicans. >> yeah, i think that's right. between the two, the idea of republican defections and democratic defections, i will be far more surprised if i see a single republican defection then i will be, if we see multiple democratic defections voting against removal. why? he has not done anything impeachable, nothing in ngcriminal, nothing anything wrong. where trump succeeded where

president obama tried and failed for years, to get ukraine to investigate burisma. not impeachable, not wrong. >> jason: mitch mcconnell, you've not always been in lockstep with mitch mcconnell.>n how do you think how the senate republicans will deal with this if it eventually makes its way over to the senate? >> i think mitch mcconnell is handling this exactly right. i love his strategy on impeachment. i think he's got it exactly right, we need to hear the arguments if and when they evera present the articles of impeachment to us, and if they don't, that is fine. we'll move on to but we'll do other stuff. it'll be better for the country if that happens. to senddo ever bother those articles to us, we are going to hear arguments and d we'll figure out where to go from there. we do not have to write the whole story at the outset, but let this unfold and let's let them present our arguments to us. >> jason: senator, thank you. merry christmas to you and your family. up next, the reckoning of deep state abuse. the russia probe just getting

♪ >> jason: more developments tonight in the quest for equal justice. as attorney general bill barr sat down with our own martha maccallum and made one thing m clear, the boomerang of justice is in full swing. take a look. >> i think some of them are very hard to square with the ideaer that these were just mistakes and sloppiness. horowitz himself in his testimony i think pretty well summed it up, which is thislf could be on the one hand at the very least grow some confidence. on the other hand, it could be improper motive. he was not in a position to make that call, and that's why we have attorney john durham looking into this. one of the things that i object to is the attack from comey which is to suggest that people criticizing or getting to the bottom of the misconduct are somehow attacking the fbi. i think that's nonsense.

we are concerned about misconduct by a few actors at the top of the fbi. and they should be criticized if they engaged in serious misconduct. >> jason: breaking tonight from "the new york times," durham is scrutinizing ex-cia director brennan's role in cia findings as he continues to direct their real origins of the russia probe and the deep state's abuse of power. joining me now for a reaction is the author of the book "witch hunt," great book on the topic, fox news legal analyst gregg jarrett, along with fox news contributor stanley bruce and sara carter. thank you for joining us tonight. i want to get your reaction, because martha did a wonderful interview. there is more of the interview that will air tomorrow night on fox, but we heard from the attorney general himself, what is one of your big takeaways or thoughts, from the attorney general that we get from you?

>> the attorney general william barr has been given a significant task, we have not seen this in modern history, modern presidential history. what i took away from it is when he said to him a look, this is not about criticizing the fbi, w we know there are remarkable agents doing their best to protect us. but when you have a culture of corruption at the top of the fbi, when there is an obvious malfeasance at the fbi, they need to shed light on it, they need to root it out, and they need to hold people accountable. this is not a two-tiered system of justice, and it shouldn't be. another quick point, jason, people all over the world are looking to us now to see how we handle this, and how our system handles it.ve we have a great system. if it's allowed to work. i believe that durham and barr are going to make it work, and it's going to be significant and reflect who we are as a nation. >> jason: that's what makes

the united states different from every power on the planet, we are self-critical and we do go back and look at these things. i was struck by the specificity and the things he brought up specific in the interview that they are looking at. >> first of all from the clip, he's not buying the b.s. being peddled by james comey. none of it. and what struck me most of all was he wondered aloud to martha, why didn't the fbi end its investigation before trump ever took office when they learned that the dossier was junk and t the investigation of trump was "falling apart." he's notga really buying the papadopoulos bar talk as the trigger for the trump investigation. he suspects that is the pretext to investigate trump which is exactly the argument i made in my book. tonight, i having heard that interview where john brennan or

glenn simpson the fusion gps, or christopher steele, or any of the other actors in the intelligence agencies? i would have my criminal lawyers on speed dial because he made it pretty much clear that he is going after not only the intel agencies but private actors. >> jason: this is one of the points, tammy, that horwitz can only look at the fbi. in the fbi's insistence that the probe started in 2015, they will be looking at what is the precursor and the predicate, a bigger question that there seems to be a lot of indication is above and beyond just the fbi. >> yes. one of the things that so valuable about this interview with martha, for years we've only been hearing from one side. vawe have been literally swamped with the negativity, the one sidedness, the arguments from the media carrying democratic arguments, and the government has to worry about legitimacy at

this point. about justice, the rule of law as it applies to people in the government. finally, this interview gives us a little bit of insight that barr may be the person, finally have an attorney general who is serious about this, looking beyond the one agent who "change the fisa warrant" to get it passed himne a much broader than that, i was pretty early struck when martha asked him about why if we were worried about the interference during the election, why wasn't candidate and president-elect trump given a defensive briefing about what the nature of what russia was supposed to be doing to this election. he said he was interested in that choice to not give him a briefing that he may have been a target or the russians are trying to do this, which tells you the level of corruption involved in this house of cards that they'vels built up. >> jason: sara, that comes out in spades when you go through and read inspector general c

horowitz's report. but the question martha threw to the inspector general, he does talk about the idea that a defensive briefing is a real question mark. >> the defensive briefing is so significant that i've written about this, before i've written about this over a year ago, if they offer an defensive briefing to hillary clinton, why wouldn't they offer the same type of detailed defensive briefing to presidentou trump? there can only be one answer. if you really think this through, with all the evidence they knew,ll they wanted to spyn members of the trump campaign. if they gave them the detailed defensive briefing, they would not be able to do that. >> jason: gregg, we talked off-line about this. where is this going? >> it's on page 76 as he reminded me earlier tonight and reread it again. sally eights, attorney general, as well as obama, and the attorney general loretta lynch all recommended a defensive briefing.

comey didn't do that. why?t. obvious. driven by bias, he wanted to spy on the trump campaign and frame him on a collusion hoax that never existed. if you are looking for a bias and horowitz couldn't find it, it's right there in plain sight. >> it better be more than brennan. you cannot have one sacrificial lamb, if you well. cannot focus this on brennan or glenn simpson, we'll take these peopleofal out if they need to e dealt with within the justice system itself. it's gote to be equal justice of everyone regardless who you are. >> it's real stupid of comey to the attorney general who holds in his hands to indict and prosecute james comey. that is arrogant. >> jason: he put out his op-ed in "the washington post," printed it, put it out online before they even had read the report. i'm glad to see "the new york times," by the way, they are a year behind "hannity," at least they are trying to catch up.

it was pretty clear what she was trying to do, but then she took it down and try to change her story. >> if we saw the tweet, we misinterpreted what the meaning was in the situation? not a good look for "the washington post." also a cnn contributor, by the way., it it goes back to perception. so i go back to the 2016 campaign. a "usa today" poll asked a thousand likely voters, who do you think the media is rooting for, hillary clinton or donald trump? by a 10-1 margin, the public said hillary clinton, including clinton supporters who saw it that way. that's the perception, right? look at 2016 again, the hill does a tally. how many major newspapers were endorsing hillary clinton and how many donald trump? 57 for hillary clinton. 2 for donald trump. what did that get him, as set of you saw the eclipse that you saw before. this is devastating for the president. if that's the case, why are his poll numbers now on a 12-point

upswing since impeachment proceedings began? his gallop approval rating is higher than president obama's wass at this stage of the presidency. president obama went on to win the 2012 election quite easily. i do not think it ruins him, it strengthens him. his bases more energized than ever before and independents are looking at democrats and saying, you've done nothing. this president is getting something done and this impeachment showin was a show about nothing. >> jason:e larry, joe makes a great point. i also want to ask you in conjunction with that, is it fair to ask you this question and follow the story about vice president biden's son and these paternity suits and the lack of financial information that he has not paid? is that going too far after somebody's family or is that right to ask in this public discourse and discussion we are having this country? >> it's politics. are you telling me if donald trump's son had issues,
