workers that donald trump is supposedly because selectable to get those voters back in places like pennsylvania and minnesota and michigan, the jobs come back in terms of manufacturing, coal and gas, are average between 2% and 3%. so, they have not only paid attention to those jobs going away but brought them back and someone like joe biden saying yes i will get rid of them is certainly not going to pin the voters he needs to voters in swing states. steve: topic was about the impeachment of the president of the united states. the breaking news story on the cover of the "new york post." nancy pelosi has not yet sent over the articles of impeachment. pete: nope. steve: it's stall tale. pete: hasn't gotten around to it. steve: she says until the senate democrats agree with mitch mcconnell on the terms she is not going to do that because she wants the senate thing to be fair. in a delicious. katie: i saw chuck schumer last night in penn station. he is not talking to

mcconnell face to face anyway. they are talking on the phone. steve: interesting. remember when the democrats called out the three legal scholars on constitution to bolster their case, and then the republicans called the democrat jonathan turley. one of the democrat's witnesses was noah feldman a law scholar. as it turns out he says that the president of the united states right now has not been impeached. he writes in bloomberg: if the house does not communicate its impeachment to the senate; in other words, if nancy pelosi doesn't send it over to mitch, it actually hasn't impeached the president. if the articles are not transmitted, trump could legitimately say that he was not truly impeached at all. so there you've got the word from a constitutional scholar who appeared on behalf of the democrats and he said you know, if the democrats did what they did, but until they hit send he is not impeached.

called to this home yesterday on a welfare check, to check in on that baby girl. and once they did arrive, they tell us they did find a baby girl and she had no obvious signs of injuries. now, we are working today to confirm if this child is the same baby girl that has been missing out of austin, here is some footage of yesterday's search of an area and car they have been looking into. heidi broussard and her 3 week old daughter margo have been missing since last thursday, december 12th. she was last seen dropping off her son at elementary school in austin. her fiance says, shayne kerry says when he got home from work that day, broussard's belongings were still there including her daughter. no suspects have been made. a police haven't ruled anything out. but we are going to continue to look into and investigate whether last night and yesterday's activity at this home is directly linked to the missing person case out

steve: there have you got senator bernie sanders making one of the few mentions of the homeless crisis in america during the debate last night in l.a. as that city's escalating crisis has become a public health emergency as you can see screen right. homhomelessness in california increased by 20% in california. here to discuss the secretary of housing and urban development dr. ben carson. dr. carson, good morning to you. >> thank you. gld to be with you. steve: it's good to have you as well. we see those images, what's going on in california is terrible. you don't think they are going about fixing it the right way. >> well, you know, interestingly enough, you know, the point in time cop demonstrates that in the vast majority of states, homelessness is going down. but in california, it's gone up by 16.4%. which drives the whole number up by about 2.7% for

the entire nation. so the data that was reported by the a.p. in that respect is certified. but we're going to require, you know deep analysis. we are going to have to really use our brains to fix this and not just emotion there are a number of different reasons people are homeless. there are reasons people are homeless in unsheltered way. when there are policies that say to people can you sleep here on the street. you can sleep on this bridge. you can sleep in a public place, first of all it's not really being compassionate to do that. there is a misguided concept of what compassion really is compassion is getting that person into a situation where they can become self-sufficient and provide the kinds of wrap around services that are necessary. also, when you allow them to just sleep there and create a health hazard, they are much less likely to go to

the places that are actually designed to help them get out of that situation. steve: one of the problems is, you know, i know california has been throwing money at it. but they are not addressing the root causes which you touched on a moment ago. >> right. and you have to recognize that. so people are there because they have drug problems. some people are there because they have mental illness problems. some people have just fallen down on their luck each of these cases mechanism to ascend out of dependency and despair. we can do. this it's done in other places in the world. you look at a city like tokyo which has more people than new york city. they have virtually no homelessness. if they can do it, we can do it, too. steve: exactly. it's a crisis in california and elsewhere it is a big problem. so we are glad you are looking into it. the secretary of the department of housing and

representatives after the vote who we have had after the vote by a majority passes the articles on to the senate, carr ied by the managers of the proposed perspective trial in the senate. in other words here you have impeachment which is like an indictment but an indictment never delivered to the suspect, or to the tribunal, that is going to litigate it, so it is, i believe, that professor feld man is right and it's not impeachment yet. nancy pelosi, who has been ruthless and brilliant in her ruthlessness in managing this impeachment with no republican votes whatsoever, she resisted it because she knew how tough it would be, finally she yielded to the most radical elements in her caucus, she had the votes, she kept her caucus more or less together, and that i was very, i was admiring of that. she's the real tough lady and highly skilled as a politician,

but now the process has trapped her. she was trying to negotiate a full blown trial with witnesses. she wanted to do her best to undo the apparent inevitibility of an acquittal by the republican majority in the senate because they are the jurors so nancy pelosi trying her best to gum it up and make it more difficult for the president, who now appears to have an easy path to acquittal in a republican-dominated senate so she's tried to withhold, she's trying to negotiate the terms, have witnesses, call the president, this or that, but the process as professor feldman has now laid out has betrayed her. do not impeach the president unless and until by the senate by the manager. steve: the president has not yet been impeached. pete: according to a democrat witness written in bloomberg which is also run by a guy running for president as a democrat through christmas and new years it is impeachment

>> katie: fox news alert a dead body and a baby found alive in the sergio marccione search connected to a missing mother. heidi broussard and her newborn daughter disappeared in austin, texas last week. abc news reports that is her body and one person is under arrest. tiffany justice from our fox affiliate in houston, texas joins us live from the scene. tiffany? reporter: yeah, the medical examiner' office confirming that a body was taken from this home yesterday. we do know at this point, that her body was found in the back of a trunk inside of a car. now a pending autopsy is going on at this point. it was a volunteer fire department was called to this home on a welfare check yesterday to look into a one

month old baby girl. now once they arrived they did find a baby who had no obvious signs of injuries. now here is footage of yesterday 's search of the area, and of a car that they did find that body inside of. the austin mother, heidi broussard and her three-week old daughter have been missing since last thursday, december 12. she was last seen dropping off her son at an elementary school in austin. now her fiancee, shane carey says when he got home from work that day, broussard's belongings were still there including her car and he knew something was wrong when their son's school called saying that no one had arrived to come pick him up so at this point, austin pd have no suspects at this point, but they say they are not ruling anything out. back to you. reporter: stephanie justice thank you so much. pete over to you. pete: thank you, katie. after this long week for those who are awake and still interest ed, 2020 democrats making their pitch to voters and take to the debate stage in los angeles last night.

say they trust government less so he's right. pete: democrats give it a b. that's striking because if everyone is saying they needs to be impeached he's a criminal, he says wait, step back and he gets a b, maybe that's an admission of how they feel. very interesting. well elizabeth warren also had a lot of time talking last night, and there were critics of her tax plan and here is how she answered that. >> how do you answer top economists who say taxes of this magnitude would stifle growth and investment? >> oh, they're just wrong. >> [applause] pete: that's one way to answer. >> it resonated with democrats and they give it an a, and i think last night was a really important night because the moderates, the press had a really hard night and i really focus on those independence because that's whose going to carry whoever wins for the white house. it's not just the partisans. pete: and she's refused to admit you'd have to raise taxes on the

middle class to pay for the multi-trillion dollar schemes so at some point they're wrong and i'm right. so there was also an exchange last night we've talked about it quite a bit this morning about this thing called wine caves that a lot of us don't know a whole lot about but it was between elizabeth warren and pete buttigieg. listen. >> billionaires in wine caves should not pick the next president of the united states. >> mr. mayor, your response? >> you know, according to forbes magazine i'm literally the only person on this stage whose not a millionaire or a billionaire. >> [applause] >> so this is important. this is the problem with issuing tests you can not yourself pass. pete: so warren took the shot, pete buttigieg answered and this is how voters graded him. >> there's no question you can see that mayor pete won that exchange democrats, and he wasn't scripted on that. he didn't feel like it, it was a good response. a lot of people are saying

he does not drink. >> she told me what to order and i would order it and she would drink it. steve: you are a good friend. >> katie: bipartisanship. steve: karl, let's start with you. hits and misses of last night? >> well the big one was the wine cave exchange. there were lots of hits. we had an exchange between biden and sanders over medicare for all, but i really think that the hit, the poor pete buttigieg was just getting hammered, amy klobuchar went after him, he got sideswiped by sanders but warren went after him and what was interesting to me was not so much the attack, it was the answer, because when you have a question like that you want to come back strong and he's came back, i thought, started off pretty weak, and he ended with what could have been the strongest point. remember he starts by saying, you know, we got to talk to rich progressives, you're worth 100 times me if i took a

contribution from you would i be corrupt but he ended with what should have been the strong point which is you ran for the senate and took money at fundraisers and he should have started with that and said wait a minute you took $10.4 million from your senate campaign that you raised at fancy fundraisers all across the country and money you got from corporate ceo's and wealthy people, looking for a loophole in the law and an in with you and you took that money in two senate races and transferred it into your presidential campaign and now you're supposed to tell us how to run our campaigns and it could have gotten to the question of her credibility and her authenticity which has hurt her a couple of times in this campaign but he started weak and ended with that point by which time we'd all sort of moved on. pete: donna so that's a republican take on last night. as a democrat who comes away looking better than they did yesterday? >> well first of all joe biden is still in the lead nationally in the national polls. i think he did well, by just standing up and not being afraid to answer the questions.

i thought it was his best debate performance. i also think amy klobuchar, andrew yang, they are still at the bottom of the polls in terms of the seven on stage but i also thought they had great debate performances. i agree with karl that mayor pete could have, you know, really went for the jugular but his style and his demeanor and his character is one that i think voters appreciate. overall, i thought it was a good debate for democrats who are still shopping but we still have 45 days to go until we reached the iowa caucus and i still believe by the end of next month , we will have another front runner. >> katie: so impeachment was the first question asked last night at the debate. there's been a lot of talk about that obviously in washington d.c., the house passed two articles of impeachment, but now , one of the law professors in harvard law, his name is noah

feldman, who testified on behalf of democrats in the impeachment inquiry is now arguing in a bloomberg piece that the president isn't actually impeached because nancy pelosi hasn't given the articles to the senate. he says if the house does not communicate it's impeachment to the senate it hasn't actually impeached the president. if the articles are not transmit ted trump could legitimately say he wasn't truly impeached at all so karl, where are we on this? >> i think professor feldman is correct and he makes his argument by quoting the constitution. here is the board, baby. the house has the sole power of impeachment. the senate has the sole power to trial impeachment in article one which describes the congress. article ii describing the executive says the presidential be removed from office on impeachment for, and then lists high crimes and misdemeanors et cetera. so i think he makes a good case that the founders contemplated a process, so the media writes you've been impeached when the

house passes its measure, but in reality you're not impeached until the senate has conducted a trial and two-thirds of the senators voted to remove you from office so i thought it was a good intellectual point but look the media long ago got into the handwriting that did this under clinton and under nixon, where they basically hung you've been impeached when the house votes. the house had not yet voted in nixon's case, they did vote in clinton's case, same thing for president trump, so i think professor feldman is accurate. it's the media that's wrong. steve: donna exit question real quickly. what is nancy pelosi doing sitting on this stuff? >> she's not sitting. look i think this was a very strategic move on her part. she understands that she has to appoint managers to take the articles of impeachment across the whatever. across to the senate, and that's when the trial is triggered so i think she knows what the process

boeing, united national alliance as well as nasa all discovered there was an anomaly on this mission and that simply put, the engine burn needed for the star liner capsule to make it all the way to the space station where it was going to dock tomorrow morning, simply did not happen. the big question is to why, and the first stage engine, second stage engine, computer problem on board the capsule, there is a 9:00 a.m. post-launch briefing here. boeing and nasa will be there and hopefully answer all of these questions for us, but everybody, the flight engineers, they are now trying to assess what actually can be done. according to nasa, the boeing starliner capsule which is this is a big test flight for boeing, was hoping to prove that this capsule could have made it to the space station and back to earth safely so that early next year they could start returning astronauts flying on rockets from american soil and they say
