straight to a fox news alert, an american soldier killed in afghanistan overnight, in an attack apparently by the taliban. >> the group claims they blew up an american convoy. the death marking the 20th u.s. soldier killed there this year. this comes weeks after the u.s. restarted peace a talks with the taliban to end the 18-year long war. a convicted felon is back behind bars in connection to a chaotic shooting that left 13 people wounded. marciano white is facing a felony gun charge. it's unclear if he's the shooter. the shooting stemmed from a dispute at a memorial party for a man killed in another shooting. >> terrible tragedy and, frankly, an incredible act of cowarcowardce.

>> 12 victims are in the hospital. >> a 13-year-old charged in if murder of a new york college student is due back in court today. he was ordered to stay in custody after his first appearance last week. he testified that he watched his friend stab tessa majors to death in a new york you city ne. the nypd are still searching for a 14-year-old. >> the family of heidi broussard is speaking out you ahead of tonight's vigil for the murdered texas mother. dna test results are expected any day to identify the newborn baby found at the home where broussard's body was discovered. aishah hasnie is joining us with more. >> reporter: heidi broussard's mom released a heart-breaking statement sunday. she writes, the family is overwhelmed with grief. we're getting through as a family. we're blessed with having many

of heidi's friends to help and the community has been wonderful with their support and kindness and we're grateful to them. the mother saying the family is focused on spending time with heidi's 6-year-old son. a vigil is set for tonight to remember the austin mother. family and friends have been in shock since her body was found strangled in the trunk of a car parked in houston on friday. a baby found alive and healthy is believed to be heidi's missing daughter. investigators expect dna results as early as today to confirm that piece of this. meantime, everyone grappling with the arrest of heidi's best friend of 20 years, magen fieramusca. she is charged with kidnapping and tampering with a corpse. the question today, why isn't she facing murder charges. fieramusca is the only person in custody.

today is unacceptable and unconstitutional. she will eventually have to name managers and send this to the senate. carley: the white house and top republicans are blasting nancy pelosi as she brings impeachment to the halt. todd: how will that impact democrats next year. joining us now is jason meister. what is nancy pelosi's strategy here? >> i think this is proof that nancy pelosi has no faith in these articles of impeachment. i think she's very petrified of this actually being tried by the republicans in the senate because she knows the be president's going to be acquitted and he's going to be exonerated. if you think about it, the house democrats have made the case for months that there was crimes, high crimes and misdemeanors. they started out with quid pro quo, they went to bribery and extortion and they came up with nothing. i thinks that's what you're seeing playing out and why she's holding these articles. carley: we have new reaction

bernie sanders trotting out tim robins at a rally. todd: president trump bringing order to the court, confirming more federal judges in his first year than any other president. carley: the white house confirming more than a dozen new judges during impeachment. >> this week we confirmed 13 more highly qualified, brilliant federal judges, bringing the total to 187 federal judges, including two great supreme court justices, neil gorsuch and brett kavanaugh. carley: ken bellkin joins us live to explain why this is so significant. how much weight do these judges have in terms of the direction our country is going to go for the foreseeable future? >> these judges are lifetime appointments. they'll affect policy down the line. the average age i'm told of the

trump appointees are in the 40s. with obama, the average age was in the 50s. the judges will have an immense effect going forward. todd: pointing out the numbers, take a look at ki circuit court consistencircuit courtnominatio. look at the overall number of federal judge confirmations, trump, 187, easily beating the previous three presidents. from a policy perspective, from a subject matter perspective, what are you expecting to see different as a result of these judges being confirmed? >> i think the republican mindset is not to appoint conservative justices. i don't like the dichotomy of liberal and conservative judges. republicans are more likely to

appoint judges that will follow the written document of the constitution as the framers intended not as how we interpret it in the modern age. todd: along those lines which subject matters do you feel will be interpreted more to the letter of the constitution than they currently are being, things like abortion, guns, do those two ? >> the second amendment is sacrosanct. we're seeing a change in how we look at freedom of speech. it's incumbent to protect our first amendment rights. carley: one of the big complaints among conservatives is the courts have been weaponized by the left. that's one of the things the president talks about on the campaign trail and why he's made the judiciary such a big focus of his presidency. do you agree with that assessment? >> you know, like i said before, i'm not a big fan of the dichotomy of liberal and conservative justices. we have justice that's are trump

appointees, clinton and obama appointees. there's no too difference in how they -- not too much difference in how the rule. todd: what do you see in terms of 2020 in terms of federal judges and dare i say potentially a possible supreme court opening. >> you've got ruth bader ginsburg and briar sitting on the courts 86 years old. rbg has had health problems as of late. if trump gets another term it will be miraculous to see a supreme court justice sitting at 90 years old. carley: how do you figure the ninth circuit, with saying some are considered conservative, some are considered democratic, how causes go to the ninth circuit. >> it's one of the more activist circuits on the board.
