french teacher at the moment. >> dana: we will put it out there. where she's ships thank you for joining us. i will see you on "the five" >> lawmakers are on break, but no vacation from the impeachment fight, the house speaker nancy pelosi says the trial can't go forward until she hears how the senate will hold it, but the senate majority leader mitch mcconnell says that's absurd. also, we see witnesses after the trial after all? plus, the christian controversy, how evangelicals are taking sides after a religious magazine called for president trump to get the boot. i am mike emanuel in washington, fox news reporting begins right now. how reporting begins with impeachment in a deadlock on the house speaker nancy pelosi doubling down the withholding articles of impeachment until
12:01 pm
she knows what sort of trial the senate will conduct. senate majority leader mitch mcconnell calling that absurd. the trial will be a sham unless key white house officials testify in the trump administration turns over email documents and other crucial evidence. he had not ruled out having witnesses on the trial revealed they were in order to freeze on military aid to ukraine less than two hours after president trump's july 25th phone call with ukrainian president during which he asked the foreign leader to investigate his political rival joe biden. president trump has said the call was perfect and he's done nothing wrong. which edson reporting live near the presidents resort. >> the president is beginning his first of a couple of weeks here in florida as the process on his impeachment trial is ongoing in washington and around the country.
12:02 pm
they want witnesses at any trial the president has in the senate. they are also criticizing republicans, they need to be fair and impartial in conducting any trial in the senate. this morning, senate majority leader mitch mcconnell address that. >> do you think chuck schumer is impartial? do you think elizabeth warren's impartial? bernie sanders is impartial? bets with the charade, this is a political exercise. all i am asking of humor is that we treat trump the same way we treated clinton. >> senate minority leader chuck schumer wrote to all senators today renewing his calls for more information from the administration about withholding of aid from ukraine. it would be to turn a willfully blind eye to the fact that it would be at odds with the obligation of senators to do impartial justice according to the oath we will all take at the
12:03 pm
impeachment trial." mcconnell already rejected schumer's request to have a couple of witnesses they are including the white house budget director and the former national security advisor john bolton. >> mike: that struggle continues, we are learning more about the timeline about the white house withholding aid from ukraine. >> we've gotten some more documents, they filed a freedom of information act request that includes an email that came in from a white house budget official to the pentagon that came about 90 minutes after that july 25th phone call between president trump and the president of ukraine, and they are talking about the white house budget official the withholding of aid to reach ukraine. the white house administration says the phone call between president trump and president zelensky that that had nothing to do with the aid halt and that it was announced internally within the administration the week before. but democrats still want that white house budget official to testify and appear and be under oath for that.
12:04 pm
>> mike: switching topics, and evangelical magazine is now defending its editorial calling for further removal of president trump. >> that's right, christianity today wrote a piece that saying that trump should be impeached and removed from office, since then, the president and ceo says the magazine has received letters of encouragement, countless feelings of that but also many firm readers who feel incensed and insulted over the magazine for that opposition piece that he writes "we hold fast to our view that the wholehearted evangelical embrace of trump has been an enormously costly. but we are committed to our conversation with the men and women of good faith to believe otherwise. he already said the president is a symptom of the over politicized asian have the american church that began before president trump took office. >> mike: rich edson leading us

off in west palm, thanks a lot. let's bring our panel, former chief staff and mike lee of utah and adam green cofounder of the progressive change campaign committee. great to have you. so you heard they are in the set at peace with the rich, mcconnell saying they all have an hour or a d next to their names but is this impartiality argument overblown? >> let's get a key fact on the table, anyone who considers themselves an american or a patriot and loves the constitution whether republican or democrat needs to stand behind the constitution and wants a real trial and accountability. mitch mcconnell is right that this is political but he is wrong in saying it's about him writes about bernie or elizabeth or anyone else, it is not about insider politicians, it is about the american people and do they deserve to see the facts here it was different between this and the clinton years is in the clinton years, all the facts
12:06 pm
around the table, there was a year-long report, everyone agreed the facts were there and the only question was there should be removal for the white house has been covering up facts and denying congress and the american people a chance to give those who are in the room and know what's going on in the american people deserve to see it and frankly i think a lot of republican senators want to see it as well and he does not have 51 votes to maintain his current position. >> mike: i want to put on the screen a tweet from speaker nancy pelosi today for he says the house cannot use our impeachment managers until we know what sort of trial the senate will conduct. president trump blocked his own witnesses and documents from the house and from the american people on the phony complaints about the house process. what is his excuse now, your reaction to speaker pelosi in your reaction to the comments you heard there from adam. >> i agree in terms of the american people are the ones who should be front and center in this whole thing, which made it a little curious that the house was in such a rush that they had to get things done immediately,
12:07 pm
that everything had to be done in a rushed manner because they didn't do all of their homework and they obviously didn't get everything that they should get to. now the talking points are all about a stalemate and there isn't a stalemate, just simply that nancy pelosi has the articles of impeachment which have been voted on and just needs to send them over. there is nowhere in the constitution that adam is referring to that tells the senate how to conduct the trial, so the house can't tell the senate how to do it. would be like a grand jury saying we have everything to indict this person but we are not going to send over our grand jury report until the judge agrees to do the trial the way we wanted to be done. so that's a little bit of a challenge for everyone and i think the political ramifications are pretty steep for both sides. every day that nancy pelosi continues to be the face, the voice, and the vision of the democratic party is really tough for those who are running for president to be the nominee of the democratic party. because they don't have a vision
12:08 pm
or any oxygen in the room and that is not forward moving. they've got to make sure they stay on the message of 76% of americans think economy is doing well, chances for them to live their version of the american dream. so a lot of this is the fake fight and false choice that we regularly see in washington, look at the trial done and move on with the business of the american people. >> mike: leader mcconnell says both he and leader schumer voted for the impeachment model. >> we had a procedure that was approved 100-0 to go through the opening argument to have a written question and then based upon that deciding what witnesses to call. we haven't ruled out witnesses, we've said let's handle this case just like we did with president clinton. fair is fair.
12:09 pm
>> mike: why should it be different this time? >> i appreciate his appeal for intellectual consistency but he has been intellectually dishonest about the situation. as i said before, and the bill clinton situation, all the facts were on the table. a ken starr, the special prosecutor had done his homework and all the facts were there and therefore they could agree on certain ground rules. there has been an active cover-up aided and abetted by republicans in congress but spearheaded by the trump administration to prohibit those who are in the room and could give the american people the facts they need those facts. and mitch mcconnell is just aiding and abetting a cover-up. i think there is no one right or one wrong way of doing impeachment that we can all agree that impeachment is envisioned in the constitution, they didn't want a sham trial, they wanted a real trial. the american people should have all the facts at their disposal and should not be aiding and abetting the white house prohibiting a cover-up -- as
12:10 pm
part of a cover-up. >> mike: let me play for you what chuck schumer said yesterday. >> senator mcconnell and president trump have come up with no good reason why there shouldn't be witnesses, why they shouldn't be documents. we don't know what the witnesses will say, we don't know what the documents will read, they might exonerate president trump. or they might further incriminate him. but the truth should come out on something as important as impeachment. >> mike: your thoughts on what leader schumer had to say they are in any reaction to some of the stuff that adam has been saying? >> so we should do what mr. schumer says we should do and that is let's go through and let's start the trial, let's have opening arguments, get things going and let the senate decide then, not now and whether there should be witnesses for a need for additional evidence in there. the challenge on both sides of this is that both democrats and
12:11 pm
republicans have raised tens of millions of dollars off of impeachment as a campaign wedge issue. that's a real challenge. >> why shouldn't those who were in the room be there testifying? what is the intellectually honest answer to that question? >> did they do a lousy job laying it out? why do you have to have a whole new trial? >> it is not the responsibility of the republicans and ascended to clean up the mess the democrats created in the house by not getting the evidence, not going through the due diligence process to get those to testify to work it through the coats as they are supposed to, it takes time to go through all of those processes and because they were in such a rush to get to the articles of impeachment even so that nancy pelosi asked for the articles to be drawn up before any of the information had been handed over to the managers in the house judiciary committee,
12:12 pm
there's a little bit of a rush here in a little bit of a false argument that is being made here. >> the courts would take forever, and you know that was part of an intentional stonewalling strategy. could have taken a year, two years. i could have been know that. that is the argument. a big reason that they couldn't proceed with those witnesses is the trump administration prohibited them from showing up. >> they should go through the process and get it done, do it right. >> mike: we have to leave it there, thanks a lot. we are keeping a close eye on north koreans after they warned of a christmas gift to america and a new satellite image reportedly reveals something interesting in a military factory. for all the journalists of fox news, this is fox news reporting. liberty biberty- cut. we'll dub it. liberty mutual customizes your car insurance so you only pay for what you need.
