articles if don mcgahn testifies. the house judiciary lawyers said mcgahn's testimony is relevant to the committee's on-going investigations into presidential misconduct and consideration of whether to recommend additional articles of impeachment. robert, does this mean they will try to revive the mueller report? have we heard the end of mueller? >> i don't think so, but i think that's a battle that is to be fought many, many months down the road. january 3rd is the date that the court will hear issues relative to mcgahn's prior testimony which is grand jury information and whether or not the house can compel his testimony over an objection asserting executive privilege. no matter who wins or loses, the loser will file a petition for a review in the supreme court of

the united states. i don't know how that would be right to be reopened now. >> guy, the doj told the court t their ruling was no longer justified since the president has already been impeached. were you surprised they are begging mcgahn to testify at this point? >> i am not surprised. he was the white house counsellor. i think they made a huge mistake not following through with the logical, normal process of trying to get his testimony. now by hinting that they should have, it just makes the whole process and the hole conclusion of impeachment even weaker in my view. e >> gentlemen, i asked people on the streets of new york city

what they thought of nancy pelosi's latest move. take a look. >> what do you make of pelosi withholding the articles of impeachment, not sending them to the senate? good idea? >> [inaudible]. >> if she was sure about it. >> not impeached yet. >> i think she is crazy. >> [laughing]. >> it looks like people are not buying this delay. could mcconnell ignore in entire failure to communicate with the senate and proceed to an acquittal? >> not only can he do that, he should do that if pelosi doesn't move the articles of impeachment in the next couple of weeks. let me explain.hee the house has the sole power of the impeachment and the senate has the sole power to complete an impeachment trial.

the senate has a constitutional duty to conduct an impeachment trial. i am not saying they have to do it within 2 days or weeks, but it has to be within a reasonable time. the house has nothing to say about what procedures the senate should follow in conducting this trial. this is entirely on the senate. [indiscernible] she can't possibly do that. she doesn't move the articles of impeachment, the senate should conduct a trial on its own. majority leader it should tell this to the house, they basically have two options. you are the prosecutors and you have the burden of production and you failed to bring it forward. you lose by default.

the other option is for the senate to appoint impeachment managers, outside counsel. i think that would be more attractive. >> robert, your thoughts on this.e pelosi thought she would squeeze leverage out of this maneuver and compel mitch mcconnell to create a trial to her liking. did she get that? >> i don't think so. i don't think speaker pelosi has any leverage over the u.s. senate. i agree with the general proposition that what the house has done is what it has done. the physical paper that would be the articles is administration action. mitch mcconnell knows the rules. the rules don't allow him to go forward without the articles. the only solution is in the republicans want to pressnl this and nancy pelosi with holds the

articles, they could with a 51 vote majority change the rules. >> they told us this was sovo urgent had to be done before christmas. now nancy pelosi is just sitting on the articles of impeachment. lawrence tribe, the law professor, he convinced pelosi that she could gain an upper hand on the senate by withholding these articles. does that work? >> with all due respect to professor tribe, this is wrongs on so many different levels. i prosecuted for the doj many years. handled scores of grand jury indictments but it's similar.

we have to take the articles over immediately, the indictment could be dismissed. for them to sit on this for how long? we don't know. i don't get it. i think the president and his team ought to be very aggressive. if a trial is not held as the president wants quickly, then i think they need to either think about some kind of motion to dismiss or compel. they need to be the aggressors. you score more points on offense than defense. >> there were some reports that pelosi was holding back, waiting until she gets a democratic senate. that she might sit on the articles of impeachment for a year and beat the president head

over the head with them in the election and not allow an acquittal. does that strategy work? is that a possibility? >> it's not a possibility. as i mentioned the senate trial has to commence as a constitutional duty. the senate has to proceed. i believe she will blink. if she doesn't, they think they will proceed with a trial without her. it's not just about trump.ed it's about the constitution and misusing the impeachment power and not only impeding the ability of the president too function but enormous disrespect of a senate that is being manifested here. the behavior of the speaker is deplorable. >> this is from chuck schumer.. he's making an argument that this is about due process. mitch mcconnell said it's not the senate's job to do the house's business which is to prove the case.. they should not have to bring up more witnesses. t watch this.

that means a lot.th he is doing 2 things, raymond. he is putting more traditional judges in there that are less likely to parrot the progressive line.. they are less likely to entertain any injunction. before the 1960s it was very rare to turn over who people voted for. they will be less likely to be activists. it really means a lot to us at the state level. in california we have a super majority of democrats in the state legislature. we only have 7 congressional seats that are republicans and we have this ninth circuit. so there is no voice. i think what trump is doing is he is saying to california: if you vote to allow farmers to have water that ninth circuit won't overrule that and let water run out to the san
