♪ griff: a new study revealing more than two dozen house seats will be redistributed mainly toward democrat states due to a growing number of immigrants both legal and illegal in the u.s. on this date several gain house seats.

19 go to solidly democratic ones including new york and california which stands to gain the most? our next guest who worked on this study warns democrats are using immigration to shift the political balance of power in their favor. mark, executive director of the senator nor immigration studies, he joins us now to explain. first, mark, good morning, merry christmas to you. >> good morning, merry christmas to you. griff: this is a very fascinating state which could flip a majority from one party to the other. but in your study you find that democrat states are going to benefit who already have the majority. explain? >> yeah. absolutely. the first point to make is this doesn't mean two dozen seats are going to switch next year. this is the cumulative effect over time of mass immigration, which has political effects, not just economic and social and other effects. and every 10 years we do a census. the main point of the census is to rejigger how many house members each state gets based on where people have moved and what have

you. every state gets one. the rest are divided up by population. what we found is that estimating what the census is going to be next year, if you then take out the immigrants or the illegal immigrants or immigrants and their kids, we looked at different options, you see that it has a significant effect of shifting house members and therefore, electoral votes. griff: right. >> to states that are blue, away from states that are red. griff: let me show our viewers the number of 26. that's the key figure in your study because it shows the number of seats in the house that could be redistributed. explain that one. >> what we did, like i said, we looked at different groups of immigrants. different target groups. and if you look at all immigrants, legal and illegal. plus their little kids at home, so immigrant households. if you took those people out, mathematically from the census, 26 seats would have

shifted. in other words, immigration over the years has given 26 seats to states that wouldn't have gotten it without immigration. 24 of those house seats and therefore electoral votes went to states that voted for clinton not for trump. this has significant effect. this ♪ just immigrants voting. this is just warm body. in other words, more people, california, for instance, because of immigration, as of next year when they do the census, will have 11 more house seats and 11 more electoral votes because of immigration over the past 30 or 40 years. griff: mark kirk corn thank you for joining us. >> thank you. griff: update straight ahead over this collision. top five christmas movies you have to watch with your family this year including home alone. >> other than that, i'm in

30 democrats voted with nancy pelosi this time even though it puts their re-election in jeopardy is because she promised to keep it simple. promised to keep it two articles. keep bribery out of it, number one. and number two is not bring up the mueller investigation. now she is threatening and they're looking into possibly bringing the mueller investigation into this obstruction of justice with don mcgahn. now do don mcgahn, the ruling is come out the first week in january number one. number two what is he going to say? scheduling a date. then he has got to choose to show up or not show up. what does he say? talking about impeachment dominating january. in what planet is this good for the country? lisa: it's just thought. the "wall street journal," there is editorial about this. what it is saying by making a fuss of withholding the articles until she hears the senate's specific plan for a trial. mrs. pelosi is trying dictate to the senate how to hold a try. but the constitution reserves the power for the senate. she will be turning impeachment into the equivalent of a censure

resolution wrapped in the claim of impeachment. you are hearing a bunch of different things does nancy pelosi actually have to deliver the articles to the senate for them to take up the trial. this is what i figured out between this op-ed. we also interviewed senator mitch mcconnell yesterday. the constitution lays it out where it's the senate's duty -- constitutional duty to conduct the trial. however the senate rules dictate that the house has to give the articles of impeachment over to the senate. so that's kind of where that split breaks down for those that might have been a little confused about it. griff: it lays it out. two pieces of the constitution lays out two parts of impeachment. the households a vote the senate holds a trial. kimberley strassel explained why this is unique and ultimately going to lead to a trial. listen. nancy pelosi is also a tactician. she doesn't usually do things without purpose. there is a growing sense that she is holding on to these impeachment articles because it denies the president the ability to have an acquittal it

potentially gives democrats more time to dig things up. demands a president who has been impeached at least has a right to a trial to decide whether or not is he acquitted or convicted. brian: if you look and kimberley strassel brings up from the other point of view what nancy pelosi could be thinking of. that is two weak article of impeachment got no republican buy. in pressure those republicans in tough re-election efforts to maybe force mitch mcconnell's hand. i don't see it right now. we don't know what's around the corner as we get set for christmas and economy is on jet fuel. big goal for democrats, make the president unelectable. there is nobody on their side with the bill clinton type talent or barack obama momentum, obviously, if you look at the final 13 democrats left. most people are ignoring. listen to some of these quotes and predictions. for example, coming out of the senate. senator tim kaine says this. i think his behavior, meaning the president, will get even more extreme going into the election. >> and representative tim

evidence, just from supposition and making judgments based on i have done these before. as a matter of fact i spent last weekend with a survivor the jones town massacre. these are hard. but, yes, i do think that it has something to do with the cult or the organization, yes. without a doubt. brian: one of the children is autistic, in particular. so, is adopted and autistic. as you try to zero in on the kids you don't focus on the mom. the kids give you a different type of power in this situation, correct? >> well, they make it more difficult, very frankly. the focus here, brian is the children. they need to be addressed an brought to safety. but, the people that are keeping them away from safety are their own parents and their own associates. which it's kind of an anathema to you and to me. remember, they believe this very strongly. their religious philosophy. they believe what they believe as strong as i believe what i believe.

take off the human element of it. you know, if the umpires agree and they vote on it and they want less pressure, that's a different thing. if a pitcher is trying to get a strike on the outside corner and all the sudden he has -- you are rewarding the pitcher on a bad pitch. i think that's going to be very difficult. but, you know, if the umpires vote for it, so be it. then you lose out on the great catchers who call the game like a jason vary tech. he would block the umpire so they couldn't see the pitch on the outside corner or slightly off. so it's something that i really think the major league umpires will have to vote and if there is a unanimous decision, then i think you do it. those guys work very hard and they are not missing too much pitches.

lot of intrigue and raised eyebrows. mark what is going on with nancy pelosi and don mcghan? >> brian this has not stopped and we've been watching this all morning long as the house passed those two articles of impeachment less than a week ago and now house lawyers are suggesting they just aren't done yet this is all tied to that fight over former white house council should have to testify before congress and as you mentioned there was a brief filed monday and house lawyers wrote if the testimony produces new evidence supporting the conclusion that president trump committed impeachable offenses that are not covered by the articles approved the house, the committee will proceed according ly. now, the white house has long argued mcgahn should not be forced to testify. the d.c. circuit court of appeals is expected to hear oral arguments next week and senators from both parties are speaking out on television making their case on what they think the senate trial should look like.
