leaders from fighting for what comes next for impeachment, the democrats are arguing that mitch mcconnell allow witnesses and documents be part of the senate trial. mcconnell met with the minority leader chuck schumer last week to begin those negotiations, but the two men appear to be far apart. president trump weighing in on all of this this morning at mar-a-lago. >> ultimately that decision will be made by mitch mcconnell, and he will make it, he has a right to do whatever he wants. he is the head of the senate. people remember that they treated us very unfairly. they did not give us to process. they did not give us a lawyer, they did not give us anything. now they come to the senate and they want everything. >> the president also repeatedly criticized how nancy pelosi was playing politics with the constitution, because she is refusing for now to send impeachment articles passed by the house over to the senate. speaker pelosi defended herself on monday on twitter writing "the house cannot choose our impeachment managers until we

know what senate trial they will conduct." house lawyers are raising eyebrows rising future impeachment proceedings over president trump are still possible. house democrats are demanding former white house counsel don mcgann testify before congress. the white house has been blocking this from the testimony happening citing executive privilege, and matters making their way through the court. and house lawyers today depending on what they learn from mcgann, congress could consider additional articles of impeachment. julie, things change pretty much here by the hour. merry christmas, julie. >> julie: we appreciate it so much, thank you, mark meredith. we will be joined on the couch, talking to our esteemed panel. and i will start with you, the democrats, nancy pelosi in particular have stalled on introducing these articles of impeachment to the senate so that they can move forward on their trial. because they were looking for more evidence. is this the evidence that they were looking for, this testimony that they now want from mcgann in order to come up with a third article before they introduce their case to the senate.

>> david: this is the democrats trying to come up with an answer to a question they have not been able to ask. they tell you what the outcome is going to be. they never see any evidence of it. they have been claiming evidence for what? three years of the trump administration. they have not produced it. they started with ukraine and the latest round, but they lost the two week articles. don mcgann, by the way, the court decision is that he has to show up. so i will pull out a pundit out of business for the next week. to stop it. he does not have to testify. privilege can still exist. not to mention that he does not have to give up his fifth amendment rights. this is all just narrative spin and keep control of it. >> julie: lisa, the first article abuse of power for pressuring ukraine. the second article charging him with obstruction of justice. the third would charge trump with abuse of power and obstruction of congress. how is this different than the first two articles? what does this say about democrats looking to find more,

because perhaps they don't have enough? >> lisa: jonathan turley made this point when democrats did that really boring hearing with the constitutional law attorneys, and what jonathan turley was saying is if you go after president trump for asserting his executive privilege, it is your abuse of power. this is what presidents do. they use the courts to fight subpoenas. this is what president obama did. this is what previous presidents did. i think they are trying to impeach the president over something that previous presidents have done, but regarding this filing yesterday and what the committee counsel said, i think it will be an attempt to bolster democrats claims and try to get the testimony from don mcgann, because the judge might say, you have already impeach him. what is the point now? so they are leaving this open door, well, maybe there is more there. this is why we need to compel don mcgann to testify. >> david: and it could be policy involved as well, because what happened? they had the vote, you go home

for christmas. nancy pelosi needs to keep the narrative going. the democrats have to keep this going, because frankly, people are not going to care once christmas comes around about something they have heard about for three years, even less. so she needs to keep it going. so you float the balloon. the balloon goes nowhere. >> julie: originally democrats had wanted to seek an interview with him again with relation to the mueller investigation. it is interesting that they left out mueller in the articles of impeachment. article one and two, article three could've been mueller, but they seem to have enough in order to proceed. now they want to interview after the pack, do you think they are kicking themselves a little bit for not going forward with the mueller, and ml1 cgann is there guy now. >> capri: i agree that they are kind of hanging this concept out there to try to kick the can down a little bit more and hold

out some hope that if indeed don mcgann does testify, and actually speaks rather than invoking either executive privilege for the fifth amendment, that they have an opportunity should there actually be some revelation that comes out, they want to reserve the right to be able to circle back and proceed with an additional article of impeachment. that being said, look, i do think that the american public already has investigation fatigue. that is one of the reasons why the mueller stuff was not included in the first place. but if something comes out, and i think that there is an argument to be made to pursue it to. one other thing that i do want to touch on is the fact that president trump has said, i just recently in the mar-a-lago press conference that the republicans were not able to participate, the white house was not able to bring lawyers into the house, well, they were able to do so within the judiciary committee and elected not to, and frankly, if the folks have nothing to

hide, going testify, and i know that they don't want to make this thing, they don't want to give it more credence than they feel it deserves, but but all transparency is great, if you are innocent, throw it all out there. spent speaking of fatigue, you were talking about the american people sick and tired of hearing about impeachment. the fact that we are approaching christmas tomorrow and we believe that the senate would already be hammering this out, and now all of a sudden in the 11th hour, the democrats are coming forward and saying, wait, we have a third article of impeachment, which are dependent presented earlier, i believe. it is voting time. >> carley: if you are wondering what impeachment will look like in 2020, it will be messier and last longer than any of us expected. that's exactly what democrats said they did not want to happen, when adam schiff was asked why he was not waiting for the courts to weigh in, he said it was because he can't wait for president trump to rig another election.

so this tactic is really surprising, especially considering impeachment is becoming less popular the longer that it drags on, especially in swing states, and if you are senator running for president right now, i would be really worried if i was them, because iowa is just around the corner. >> david: that is a very key point, not just iowa and new hampshire, but march 3rd with california, when that happens on super tuesday, your candidates want to narrow down a message. want to get the feel down, because you are not that far away from milwaukee. and right now that is a problem for the democrats. >> julie: one quick point to something you had said, capri, the white house counsel had said in response to believe it was the house judiciary committee, that one of the challenges was that they were inviting the administration without providing any details, so if you are the white house lawyer, why do you want to subject the administration to a hearing when you don't even have the details and they are not, i think it was

with a lot of time either? >> capri: i would say to the democrats, both sides have had an opportunity to negotiate that, because again, due process, even though impeachment is not the same as a court of law, we should have the cushion pole and the negotiations that both sides have an opportunity. >> david: by the person in charge of that was adam schiff and jerry nadler, and they both didn't answer. so the democrats created their own problem. >> capri: it is not a good look for democrats. and frankly a couple of weeks in britain, the democrats need to look a hard look at the british election as a cautionary tale of liberals moving too far to the left and circumventing the outcome of an election being present. we don't want to go down that same path. >> julie: we will move on, coming from a democrat, by the way. congressman alexandria ocasio-cortez says that u.s. is not what she considers an advance society. why she said it and what she

ago if we cut interest rates down and over 30,000, it would be a great year for america. >> lisa: what do those retail numbers tell you about the strength of big economy? >> david: they tell me that there is confidence out there. i look at some points that matter. you see household income go up overall for middle-class americans, those are really the big spenders. online, lower cost of goods. the cost is important. they look at the dealers that are out there, they will move more, the retail environment is better. he saw $6 billion on thanksgiving day, or the day before, or the day after. these are all the parts that are functioning in the economy. the average person is buying, millionaires and billionaires are buying. and that means the company will produce more. so expect retail in the first quarter of next year to be

significant. speak to julie, i see you shaking your head yes. >> julie: i think about the unemployed people that used to be unemployed in the last administration and no of jobs. not only jobs, but they are making more money. and small businesses are doing better so that they have more money to hire people. it is just a matter of time before health care maybe gets their act together so that these companies can thrive. that is the big issue moving forward. i believe in the economy is health care. health care needs to get fixed in order for the businesses to survive and be able to afford their place. >> david: what is one of the biggest areas of growth? health care hiring in the last two quarters. >> lisa: that has been the case for decades. capri, what is the argument for democrats? gary cohn and kevin hossler wrote in "the wall street journal" noting how lower income earners are seeing wage increase and $6,000 increase for income because of the tax cut, so when the economy is so strong, what is the argument for democrats?

>> capri: we need to acknowledge their strength of the economy. democrats again cannot just focus on running against donald trump. we need to talk about other things that people may be caring about like health care, immigration, et cetera and have a plan for those things. and always makes it harder when you are democrat or running against a strong economy. that being said, i personally do not care who is to blame or not to blame with a strong economy. it is about mere americans and you mention the staff about online buying. i take this from the middle of the country, how does this reflect on main street? we hear brick-and-mortar stores closing across the country, but interestingly enough, i was looking at the international council of shopping center saying that 90% of americans are actually going to be shopping in a real store and that will account for almost 5% of growth year on year. that is good for main street too. i don't care who gets the credit as long as americans are doing well. >> david: they said that trump was going to end the u.s.

economy, politico 2016, and of everything. so trump either gets the credit or the blame depending on who is talking. >> carley: the unemployment rate at 3.5%, stock market soaring, poverty down. usmca, the first phase over the china trade deal, recession fears are also dwindling, but to your point, how are then democrats on the campaign trail going to counter this? and during the debate last week nearly every single candidate that was asked about the economy flat out denied that americans are doing well, which is patently false when you consider that income is at an all-time high for families. but it is going to be very difficult to try and sell americans something else when the thing that they have right now is working. >> lisa: david, and imparting words? >> david: parting words i will take for my friend larry kudlow. if you want to see tax cuts go on phase two, keep republicans

with the president, give them the congress. there is a movement on that. if you want to get rid of the tax cuts and job cut, give the democrats the economy. >> julie: i will say the tariff needs to change a little bit. anybody getting hit hard because of the terrace when it comes to distribution. >> lisa: the china trade deal will help consume bidders brick-and-mortar and online. i'm going without. and her earrings are inspiring me to do a little bit more of that. moving on to more serious topic, the taliban and reportedly claiming responsible to you for yesterday's killing of an american green beret. the impact this could have on an already fragile peace document. plus the president's response to north korea ominous talk of the christmas gift. the united states amid solace negotiations. this figure we will find out what the surprise is paid we will deal with it successfully. we will see what happens. everybody gets surprises for me.

>> capri: fox news alert, the pentagon keeping a close eye on north korea which has made ominous noises about a gift for the u.s. as the clock ticks down to the deadline for a nuclear talks. and lucas joins us live from the pentagon. >> hi, julie, speaking from mar-a-lago, president trump says north korea's christmas gift might not be a lump of coal. >> may be is a nice present, may be he sends me a beautiful vase as opposed to a missile test. i may get a nice face. i may get a good president from him. you never know. >> official say north korea might not test a long-range missile for the first time in two years as many are speculating, but they could test

opponents with missiles even if shorter ones are filed. one describe the intelligence as "murky." north korea testing over a dozen short missiles after testing none last year, unlike the nuclear missiles, north korea has never tested a long-range solid fuel missile. bret baier asked mark expert about it this month. >> how concerned are you about the solid fuel rockets? >> solid fuel boosters do provide a degree of efficiency and mobility, and gives you a less morning as liquid fuel rockets, but it is another thing that we watch because it reduces our warnings, if you will. but we have very good intelligence on north korea. >> president trump's former national security advisor john bolton offered some of the harshest criticism of the overtures to pyongyang saying "we say it is unacceptable for north korea to obtain weapons.

that is more rhetorical than a real policy at this point." bolton calls a danger to more than 28,000 troops "imminent." highlighting the dangers to commercial aviation, the fda has put out a warning of any potential north korean missile tests in the last few days. guys. >> julie: lucas tomlinson, thank you. peace talks between the taliban and might be derailed after the group took credit for killing a u.s. it service member yesterday. coming from the "washington examiner" sighting at sources. the pentagon is identifying those soldier as 33-year-old green beret sergeant first class michael goldman. the pentagon also telling the examiner that today have shut down talks in the past. it is as far from good faith as you can get, even if the taliban did not do this, the fact that they claim it is troubling. you have to ask, why would they claim something that puts them in a bad light?

the u.s. peace talks with the taliban and resumed earlier this month after president trump called them all following an attack that killed a u.s. soldier and 11 other people back in september. 20 service members have now been killed in afghanistan this year. that is deadly since the u.s. ended the combat mission in 2014. the question is where do we go from here. the taliban cannot be trusted. the reason that the president called off talks was because 11 service members were killed. and here we are once again. one service member killed, and also talks of troops being pulled out of afghanistan by this administration. where do we go next when it comes to afghanistan? >> david: sometimes you have to look at the reality of where you are, one, that taliban is not one group, so multiple actors exist even against each other. that's a problem with dealing with a triable situation in afghanistan. we have the ability to redeploy if needed. we have a way in. so it is time to consider getting out of afghanistan. there will have to be some

footprint ability to get in and out, or maybe while we are there. but we have to face that the northern alliance failed many years ago. and afghanistan is a tough place to be for anybody. so our job is to make sure that we can go back when we need to. but there's something else that we never talked about. there are other actors outside of afghanistan, iran, pakistan, others, various elements within pakistan. india has a reason for stability, work with them. get rid of the bad elements, reduce iran's influence, work on outside influence and then frankly, be able to go back when you need to. >> julie: let's go back to september, one u.s. soldier, one military personnel was killed, 11 others killed, and that was enough for the president to solve peace talks. the "washington examiner" is saying will happen again. but you stalled peace talks come up then what? >> lisa: that is the problem, president trump would like to get out of afghanistan, the reason why he is having these talks with the taliban, but it

makes it difficult to have any sort of peace summit or peace talks when there is no peace. that's what the taliban is exhibiting. i think for president trump too, on the heels of the afghanistan paper from "the washington post" noting just the government dysfunction. you have all of these officials as part of the federal review, they got the information from the foia request, just numerous official saying really dangerous things. like saying we were devoid of a fundamental understanding of afghanistan, we did not know what we were doing, by bob crowley, and army crew said that we were looking at the best picture possible, so dysfunction in regards to afghanistan. so i don't envy the president. i don't know what the right answer is. >> capri: a cease fire is the first step. if you were going to go on a path of trying to negotiate with a group of individuals that are frankly -- >> david: , but that is the

problem, you have tribal groups. >> capri: about what they talked about was good faith being exhibited through a cease-fire to give them opportunity during a cease-fire to actually negotiate. we have seen 2500 civilians killed just this year. >> carley: the president has obviously said multiple times that he wants to end the endless wars, but i don't understand how you could end a war with a group of people who are clearly still into the idea of waging war against you. and this is a campaign promise that the president clearly wants to check off his list. but the desire to end the war is so one-sided, when you have ramped up attacks on u.s. soldiers for two times now as the peace negotiations are underway, so, i think under the circumstances, there is no way that the president can take it as seriously and negotiate a peace deal with a legitimate terrorist organization. >> lisa: i don't think for the white house, i can't speak for the president, but i don't think it is because of the campaign

promise, otherwise it would've happened by now. but i think that he sees that there is no solvable answer as he established on the couch. what is the solution? there will probably never be peace in afghanistan. and i think they want us to wonder why. >> julie: you have to wonder why is the taliban and taking responsibility, what are they trying to get out of it? they are pulling on strings and trying to get some reaction out of us. but let's just look at what a senior fellow with the foundation for defense of democracy said when weighing in on the taliban taking credit for the latest attack. and this is what i will quote for you. the taliban has been very clear in the statement that it is going to fight until we leave, and they feel attacks like these basically increases the pressure on the u.s. to get out. if they could get us to leave via a humiliating peace treaty, they will take that. if they can just get us to pull up and leave, they would take that too. increasing u.s. casualties only house. this is one country out of so many that are testing the president right now.

we are not going to leave. but the president talked about potentially pulling some troops out, and this is the reaction paired what is the next step? >> david: this points out how intelligent they are about how it works in american politics, and he is right. they pay attention to this that political attention is different. we are now fighting season and shutting down as hunter hits most of afghanistan. so they will take action against people and come out of the passage. so all of these are factors in what happens in afghanistan right now, and to look at, i wish the president would do one other thing, which is spend more time talking to field commanders who are there and afghanistan. nothing against the pentagon, but more field commanders need to be in this discussion, because they were down there. they were down there in the. they were down there with a lot of friends of mine. you need to hear from them. >> julie: we are going to move on. new fallout over an anti-trump editorial in the magazine founded by the late billy graham, why his son

condemned the article. they take issue with the far right zealot claim for being supports for the president. they say their take their civil duty seriously. the president came out when he found out that graham voted for him, he was very grateful for that. it is interesting. we have fox news poll that i want to put on the screen to show how mv and feel about the president. 67% of white evangelicals do not believe that the president should be removed from office or impeached. that is the vast majority, so it sort of contradicts this publication. >> david: i have two views, one, i think it was a sensational story put out to try to get attention. i've been in the newspaper business long enough, ran a major magazine, i see that point. i hate to tell it, but i think that is it. however, evangelicals care about many issues just like all americans do. and they care about the economy and the national security, they

care about these issues. and i have worked for marla mattox, the man who hosted the longest running christian talk show in america. these are the people who think just like every day americans and see the success that we talked about with the economy and they don't want it done based on some portrayal of an evangelical. that is often told by the left. far right, you're an evangelical, no, you are an american. you have multiple points of vi view. >> julie: christianity today wanted attention and sell magazines, they have our attention. what will christians do? will they vote the other way for somebody pro-abortion? no, they won't. it is a moot point to publish this. >> lisa: that his challenge, evangelicals look at the other side and say that they support a potion, even joe biden supports taxpayer-funded abortion. but if you are the president, you care about this, because you look at exit polling in 2016, the percent of white

evangelicals went for president trump, you look at the electorate, one for register voters are white evangelical christians, one-third of republicans, oh, my goodness, gracious. i'm going to get this out. so one-third of voters that lean republican or are republican are white evangelicals. i got that done. so it is an important part of the electorate, the point that i was trying to make, carly, help me. >> carley: the story i said it yesterday and i will say it again. it makes me so sad, because it shows that politics can do damage to something as pure as christianity. and i don't really know if christianity today was trying to get attention by writing this, mark galli clearly put a lot on the line here, because he knows that his readers are evangelical and a lot of them could disagree with him. what he is looking at is the president as a person. things that he sat on the campaign trail about john mccain. things that he has done in his

personal life. as my mom always said, love the sinner, hate the sin. and that's how the evangelical leaders feel about the president where they see him as descending our traditions and our culture. >> david: the constitution. >> carley: but it is religious freedom as well, and the ultimate being pro-life. >> capri: yes, christianity today is a prominent publication amongst the evangelical community, but this is the opinion of one editorial writer, not a dissertation and a stance of the entire group as a monolith. the evangelical community is looking more towards the actions of president trump on judicial appointments, for example. many of the executive orders that are protecting and are in line with their values. and i think that that is -- i don't think that will change by one editorial. >> david: took carley's point, the overlapping the difference between hate the sin --
