someone else's claiming victory today following a different failed attack on the trump administration. iran's president hassan rouhani pledged to kick all american forces out of the middle east. but like nancy at the 11th hour, when push came to shove, he blinked. around cruise missiles, by his own admission, were just a slap in the face, they want a lethal strike. democrats were predicting this was all going to end up essentially as world war iii. >> the president, by blowing up diplomacy, has led to great chaos in the region, and that is why we are at the brink of potential war right now. >> those lives may be at risk because of the fallout from this junction. >> let's all hope that we do not get to an open conflict with iran, because that'll be a very serious war that will make the iraq war look like a minor scuffle. >> laura: now, to some, this sounded like wish casting. they almost hoped trump would act rashly and ramp up tensions.

lack of information presented by the administration regarding a specific, imminent threat. >> there was no raw evidence presented that there was an imminent threat. >> i was utterly unpersuaded about any evidence about the imminence of a threat that was new or compelling. >> laura: um, are they all lie and? mike lee is essentially saying the same thing as all of these democrats, a conservative from utah. >> it is a top-secret hearing, but i don't know what they're talking about. saying for one moment to the american public -- they don't have to be in that meeting -- more than 600 american soldiers have been killed by this individual. they killed an american. they took down a drone. they bombed tankers, they bombed saudi arabia's refinery. they took after our embassy. and somehow, it's also escalating something? i think the way the president handled this was masterful. it's like a chess game, and these people don't even know what they're talking about.

>> talking about leveling al-assad air base. >> saying they have leveled in al-assad base in iraq and have killed 30 u.s. troops. >> wire repeating this propaganda of iran in a moment of concern for the nation? >> i don't condone that, i think the time of war and hostility, we should confirm things before we report them, and we should definitely not taking the word of iranian state media. i am not here at all saying the iranians are good actors. i am saying that we have guardrails in the united states that the president of the united states needs congress to authorize the kind of force that he used last week, killing the iranian general. and i think, you talk to the leader about the war powers act resolution coming before the house and the senate, and when you listen to mike lee today, and what he was saying, i think that is going to have a little juice, not only in the house,

but also the senate, controlled by republicans. >> laura: thoughts on this are a total outlier. i like mike and he is a smart guy, but the idea that the president makes the call that there is an imminent threat to the united states, we have a chance to take out someone responsible for literally hundreds of deaths, american soldiers -- everything they were doing, the fact that he did that was a good thing for our soldiers, the victims of all that violence. dan, americans should be celebrating the death of soleimani, not wondering, what if we had waited 30 days for a resolution, or nancy pelosi okayed it? i think that is a joke constitutionally. >> that's the constitution! >> laura: first of all, talk to george washington about what he would think an imminent threat to the united states as determined by the chief executive officer -- okay, dan, go ahead. >> let's do a quick principles check on chris, because i

majority? >> it's just the rules. the senate can do that anytime it wants to. what moves all of this is simply the rule -- under its current rules, the senate moves forward with setting up the rules for an impeachment, or the trial itself, until the managers have been appointed and the documents delivered to the senate. all the senate has to do is change that, and they can do it pretty much any time. >> laura: last night, i think i was talking to ted cruz over in the makeup room, and he said they need 67 votes to change the rules in the senate. he's a pretty smart guy, and he says it's not that easy. your thoughts? >> well, the current rules for impeachment do say that you need 67 votes to change the rules. my point is a little different. interpret the current rules as here is what we do when we get articles of impeachment exhibited to us by the house. there are no rules for what

happens when the house and peaches the president, which they have, and they don't bring anything over and exhibit the articles of impeachment. in my opinion, what are called the impeachment rules in the senate don't cover the situation we are in, and i believe they could establish new rules by majority vote and say this is what we are going to do in this situation come unprecedented, and we are going to move forward. >> laura: in other words, it's better for them to do it now, to act now, before the sun to the articles overcome if they ever, correct? >> well, once you send the articles overcome what you don't have to worry about changing the rules. speaker pelosi is pulling this maneuver that is very unserious and very dangerous and really shows that she doesn't take in this process seriously at all -- >> laura: all right, i want to -- okay, i want to move on.

the democrats, i think they found themselves, maybe a brand-new talking point. >> the idea of the clinton precedent, which is really not applicable here, if we had a clinton precedent to apply here, all of the witnesses will testify, even before the trial begins. mitch mcconnell is being very selective in the application of the clinton precedent. >> the clinton trial was very different. they are saying it was the same rules, but all of those people had already testified. >> laura: babar, is that all correct? >> is nonsense! none of those people testified in a house impeachment hearings, this is another example of how the democrats, in their zeal to go after trump, care nothing about precedent, nothing about the truth, nothing about the rules, and what is happening here, the danger moving forward, laura, goes far beyond simply this impeachment. it shows the american people that the democrat party and the speaker of the house of

representatives don't care of the hunt rules and make it up as you go along. >> laura: senator graham, lindsey graham, is thinking of crafting -- well come he's crafted a resolution calling out for lucy to send the articles of impeachment to the senate. it's a flagrant violation of the separation of powers, and he calls on the speaker to immediately i a point managers d send impeachment to the senate. it's a nice sentiment by lindsey, but doesn't really have any sway whatsoever? >> i don't think it gets us anywhere, and i don't think it's a flagrant violation of the separation of powers. i don't like it, but let's face it, the constitution says the house has the sole power of impeachment, the senate has the sole power to try it. nothing in the constitution says nancy has to send was over. so i prefer the option of the senate just saying he's been impeached, i mean, speaker pelosi said the articles

passed, she banged her gavel, so he's been impeached. we don't have to wait for them. it's not like an indictment. we don't have to wait for them to send it over. we've given them a decent amount of time to send it over, they aren't doing it. let's create a new set of rules for the situation and let's have a trial. >> laura: or call it a default judgment, but that doesn't vindicate the president. the president needs to be vindicated and have this thing acquitted. >> speaker mcconnell needs to find out how they handle it, because it is the president's legacy on the line, not mcconnell's, not humorous, not pelosi's. >> are republicans tonight closer to uncovering a new deep state compares a? there is, at this hour, an active investigation going on in the ink intelligence community inspector general for his handling of the ukraine whistle-blower complaint. house intel republicans have serious concerns -- and they should -- over inconsistencies

in michael atkinson's closed-door impeachment testimony. i would show you exerts of it, if i could come of adam schiff refuses to release it. of the 18 closed-door impeachment interviews, it's so curious that atkinson's is the only one being withheld. the question is why? here now is house intel ranking member devin nunes. congressman, was he hiding? >> what's h what he's hiding isy simple, the origins of this are shady and don't make sense. from the time the whistle-blower came forward to the ig, didn't have any first-hand knowledge, the form letter changed, was backdated, things we had to hear from the whistle-blower and then didn't have to hear from the whistle-blower, and the media and democrats hoping we forgot about -- it's kind of funny this is no news come of it at the time, we have the letters right

here, in my hand, we sent a letter, september 30th, to the ig. he responded in an inadequate way on october 8th, and we said look, right now, we have to focus on this impeachment, but this strategy, we are going to come back to this. he knew we weren't happy with the response, so we will be sending him a new letter this week, give him another week to respond. i will tell you, someone is not telling the truth here, and that's why they don't want this testimony out. >> laura: can the senate do anything here? >> they could call the iga and come up with the question will be these transcripts. they need to be released to the public, and why are these the only transcripts not out? >> laura: it's interesting to see figures rushing to atkinson's defense. watch. >> atkins he did, the best i could tell, exactly what he was supposed to do that comported with the law, and the

whistle-blower complaint -- himself or herself complied meticulously with the law. >> well, the law, if you believe this or not, there is no such thing as the law. they are trying to claim this was the case, and yet the forms didn't show that. and then, only when questioned by the media did the form get changed, and got backdated. if it wouldn't have been us for asking the questions originally, they would have gotten away with it. >> laura: it's a different set of facts. you do the same thing when it came to the mueller investigation. you were pressing and pressing and pressing, and then they started vilifying you. >> if they think i'm going to go away, i'm not. >> laura: you didn't before. it's deja vu all over again. >> they might think because i don't have subpoena power that there's going to be some issue, but we do have other powers. we can run this investigation and get other people to come in a testified.
