tragic. we reported earlier that pentagon officials increasingly believed having reviewed the latest intelligence analysis that iran shot down the airliner by mistake using one of the s15 gauntlet mobile defense launchers in their arsenal. that missile defense launcher would have likely been put on alert to defend the u.s. possible response to the iranian missile strike on americans in iraq. speak to somebody could have mistake on the other side. it was flying, not our system, it has nothing to do with us. it was flying in a pretty rough neighborhood and someone could have made a mistake. some people say it was mechanical but i personally don't think that's even a question, personally. >> the as a 15 and other russian-made missile systems are programmed to lock onto anything metal that looks like a missile. the ukrainian civilian airliner crashed 2 minutes after takeoff

while still it's in. on radar they could have easily been mistaken for an incoming missile. the essay 15 and other air systems like it have a manual and automatic mode. if in automatic mode it could have fired without a human being ordering the strike. the iranians would likely turn on the missile defense systems, expecting a u.s. response. protecting its airport and strategic locations in tehran would be expected, right. >> bret: what we know, and what we have to know that have monitored that publicly which is classified, you can hear from u.s. officials and the canadians that there is a confidence. but he mentioned the iranians are pushing back on all this? >> that's right, denial so far from the iranian leadership. if iranian authorities have been unwilling to hand over that black box recovered from the wreckage of the relatively new boeing passenger jet and there were no radio calls from the cockpit before the plane suddenly fell out of the sky suggesting an explosion.

imminent attack. do you by that? >> listen. here again, they are doing the wrong issue. rand paul and ir into different places on this. rand paul as i understand it challenges the attack on general soleimani, i don't. i have accepted as a given in the circumstance that they may well have had legitimate authority to do what they did. my concern deals with what we do with iran forward and that response by vice president pence does not address my central concern. it is important that congress authorized the use of military force, when we engage in any kind of sustained military action, that's what i'm concerned about and that's what our brief errs were so dismissive of yesterday. >> bret: do you think we are at war with iran now? >> we are in a position where we easily could get into a war with iran and that's where it's especially important that we have a debate and a discussion. that's one of the ways we avoid

>> you know what else goes right back to george washington? george washington's view that the president's inherent authority can be exercised without congress insofar as it's necessary to deal with an imminent or presently occurring attack. but it does require their approval of congress. focusing on the constitutionality of the war powers act is completely missing the point. the war powers act is best understood as a procedural mechanism, whereby debate can be advanced and accelerated in congress to weigh in on the war power come and weigh in on whether or not the executive branch is authorized to take certain sustained military actions. >> bret: last thing, on impeachment, do you think this will go quickly and how do you think it will go? >> the president of the united states has not done anything impeachable or criminal, he hasn't done anything wrong. president trump succeeded where president obama tried and failed for years to convince ukraine to

>> bret: breaking news, yet another rocket landing in baghdad after multiple rockets were fired into baghdad's green zone last night. try against continuing coverage on the ground in baghdad. >> good afternoon. just about two hours ago a rocket was fired towards valid air base which is just north of baghdad that does house u.s. troops. this follows last night's rocket attacks into the green zone off to the left. we heard a lot of sirens going off saying, incoming, incoming, and that was to warn the u.s. embassy personnel and others around that there were all rocket ongoing. a little of this after president trump tried to take the written back from the region of war. not responding militarily to those tuesday night ballistic missiles which were fired towards al-assad air base in

>> bret: what are we learning about the 176 people on board? >> well again, a staggering number, 176. they come from a number of different countries come among them principally the ukraine and canada. there were 82 iranians on board, 63 canadians, 11 ukrainians and three british, among those 176 and that includes 15 children. that tehran to iran flight is very popular. it passes through key key avenue and it's one of the more popular planes on that route. passengers on board even showed concern about traveling that night. one woman called her husband from that plane and said she felt very unsafe because of what was happening in the region. the ukrainians have sent their team of f experts over to iran, and are trying to get access to the crash site but the iranians at this time are refusing

since may. a friend of dulos who once served as his lawyer also facing criminal charges now. laura ingalls has been reporting on this and is standing gnomic outside the courthouse in connecticut. >> fotis dulos will be spending the night in his connecticut home after being held in custody on charges of murder, felony murder and kidnapping. he walked out of here today and posted 7% of the $6 million bond, an amount the judge refused to reduce due to the new and more serious charges against him. fotis dulos had nothing to say to reporters as he made his way to a waiting car after being fitted for his new gps device which he has been ordered to wear while he is under house arrest and waiting for trial. the judge also issuing a protective order barring dulos from having any contact from their five children, their nanny and their grandmother who is their guardian. his ex-girlfriend, michelle

troconis charged with conspiracy to commit murder also made her bond today but according to reports she went straight out of the courthouse and to a local hospital after suffering some type of medical escort gnomic episode. kent mawhinney, a former lawyer who represented it dulos and his civil case were all taken into custody tuesday, also charged with conspiracy to commit murd murder. dulos' says there is nobody and no weapon and they look forward to defending their client in this case. meanwhile, lawyers for a troconis and mawhinney have not commented. >> bret: and we are learning more through their arrest warrants? >> we are learning a lot through the three arrest warrants which are significant and it does paint a much darker picture of what happened to jennifer dulos that police believed took place inside of her home. we are learning that information through the warrants. police recovered 22 items including clothes, garbage bags, cleaning products and zip ties

that they believe are discarded by dulos and troconis the night jennifer managed. as far as the connection to fotis' former attorney, kent mawhinney, police say that two members of a gun club that he once belonged to and recently had access to told police they found an empty grave on the wooded ground that had a blue tarp into unopened bags of lime just two weeks before jennifer's disappearance. when police went to check it out they discover that hole in the ground had been filled, covered up with twigs and rocks and had been made meet. so those three people will return here to court next march for the next phase of the criminal charges. >> bret: laura ingle, live in stamford, connecticut. president trump defending the killing of the top iranian in general. how some 2020 democratic hopefuls are responding, ahead. ♪
