♪ have a nice day. jillian: monday morning already. goes so quick. rob: if the weekend was any indication, it should be about 85 degrees. jillian: maybe 90. we'll see. good morning, you're watching "fox & friends first" on this monday morning. i'm jillian mele. rob: i'm rob schmitt. today, more than one dozen saudi military trainees are expected to be sent back to their home country. jillian: this comes amid the pentagons' review of all international military students following the deadly shooting at the pensacola naval air base. rob: todd piro joinses us live with the dods' shocking findings. >> reporter: none of those being expelled are accused of assisting the pensacola gunman, according to reports, some were believed to have connections to

extremist movements and several were accused of possessing child porn. you'll recall the gunman was training at the naval air station when he opened fire, killing three u.s. sailors. in response, a dod spokesperson highlighting major changes, quote, in the wake of the pensacola tragedy, the department of defense restricted to classroom training programs foreign military students from saudi arabia while we conducted a review and enhancement of our foreign student vetting procedures. that training pause is still in place while we implement new screening and security measures. at the time of the shooting therthere 852 saudi soldiers training in the u.s., out of more than 5,000 soldiers from 153 nations. here's our nation's top military and security brass explaining the changes. >> the department has taken a number of steps to ensure it doesn't happen again. i've signed out directives that

address enhanced screening of all of our foreign students, that address credentials, weapons policies. >> pensacola showed there had been errors in the way we vetted. i think out of caution we're taking these actions to pro detective service men and -- protect service men and women. >> reporter: we expect to learn more about the changes at a press conference later on today. jillian: president trump warning the world is watching as protesters are shot with tear gas and live ammo in iran overnight. crowds sent running after rallying against the regime for shooting down a ukrainian jetliner. president trump said, quote, to the leaders of iran, do not kill your protesters. iran admits to accidentally shooting down the ukrainian plane killing all those on-board. justin trudeau spoke out at a vigil for those lost in the

crash. >> i want to assure all families and all canadians, we will not rest until there are answers, we will not rest until there is justice and accountability. jillian: iran initially denied shooting down the plane. rob: ba baltimore police commissioner will be questioned by top city officials after at least five people are killed in eight separate shootings. the city council president will meet with the commissioner and other leaders today. scott, a democrat running for mayor, issued a statement, in part, this violence is heart-breaking a and must stop now. harrison insists the employment is doing everything it can t l hol--everything it can to hold criminals responsible. dozens of police officers holding a procession overnight to honor the life of a detective hit and killed by a car.

jillian: griff jenkins is live in washington as president trump says the impeachment should be dismissed. >> reporter: good morning. after more than three weeks, speaker pelosi is ready to send the articles to majority leader mitch mcconnell. he has not ruled out calling witnesses. the president is slamming it, calling for dismissal, tweeting this, many believe that by the senate giving reaccidents to a trial based on the no evidence, no crime, impeachment hoax rather than an outright dismissal, it gives the partisan democrat witch hunt credibility that it doesn't have. speaker pelosi says it's up to the t senate to ensure a fair trial and dismissal is tantamount to a coverup. >> i always said i would send them over. there shouldn't be a mystery to that. the leader of the senate, mitch mcconnell, has signed ona resolution to dismiss the case. dismissing is a coverup. dismissing is a coverup.

was doing. this all started with hunter biden. jillian: after weeks of delay, nancy pelosi says democrats will vote this week to send articles of impeachment to the senate and republicans say hunter biden should absolutely be called to testify if witnesses are included in the trial. rob: so what can we expect in a trial? joining us to break it down, everything from pivotal votes to party strategy, former deputy assistant attorney general, john malcolm. thanks for coming on today. as it stands right now, something similar to the last time we saw an impeachment trial, right? >> well, yes, the rules are certainly going to be the same, whether there are going to be witnesses or not is the big question. that remains to be seen. in the clinton impeachment trial, there were kind of, sort of witnesses. there ended up being three witness whose testified via videotaped deposition but that decision wasn't made until after the lawyers on both sides had made their arguments and senators got to ask questions of them and that's what's going to

happen this time. jillian: can you talk about the role that the chief justice will take? >> yes, very little role. so the chief justice is not like any other trial, it's not like a trial at all. the rules of evidence don't apply. the chief justice is there for one reason. normally, the vice president is the presiding officer of the senate and is there to break ties but the founding fathers thought it was unseemly to have the vice president preside over a trial in which if the president was removed, he would become the president. so they said all right, if we can't have the vice president do this, we'll have the chief justice do this. he will make rulings but every ruling that he makes is subject to argument and being overruled by a majority vote of the snat senators. i think -- senators. i think the chief justice will make himself as unobject true sievobtrusive andpossible. rob: the gop is in control of the senate. it's fairly close, 53

republicans, 45 democrats and two independents, mostly acting as democrat as well. people like namely susan collins, also mitt romney, could make those numbers even closer in some ways. >> that's right. so every ruling as i just said is subject to being overruled by a majority vote. the decision ultimately about whether to call witnesses and which witnesses to call, that will be made by a majority vote. you have some people on both sides of the political aisle, the democratic side, folks like joe manchin and doug jones, on the republican side, lisa murkowski, mitt romney, susan collins, where you don't know exactly which way they'll go. if they decide to call witnesses, that open things up considerably, you could get john bolton, hunter biden, adam schiff. the big vote is to whether to call witnesses and which witnesses to call. jillian: can you talk about the porches of party strategy -- importance of party strategy. some are wondering the

democrats' strategy, considering it's fan s taken so long to geto this point. >> it's hard to know what the strategy will be. it seems to be inconceivable that the president will be removed from office. it would require the vote of 67 senators. it will be designed to muddy the president up, much like the republicans did with president clinton. they say he did something wrong, you may not choose to remove him. rob: john bolton called it a drug deal. the democrats would love to have him testify. how do you think that will play out? >> you're supposed to conduct an investigation and then bring the charges and the trial takes place in the senate. if you open it up to hunter biden and john bolton, you're saying we didn't finish the investigation, let's continue the investigation in the senate. i don't know whether the senators are going to put up with that. my guess is john bolton, who is very independent, strong-minded

of taken for granted grant jay a caldwell. i want to show the numbers, washington post shows joe biden with a tremendous lead in the black democrat vote, 48%, the next closest is bernie sanders. why is this happening, in your opinion? >> well, if you ask any african american of any age, you say what are you excited about with joe biden, they usually say barack obama. truthfully, joe biden hasn't contributed anything positive to the black community which would garner this kind of support outside of being barack obama's vice president. you know what, this is where it's particularly disgusting for me, because i don't believe joe biden's worthy of any black support considering him being the architect of the '94 crime bill which was disastrous for black families, talking about it created the mass incarceration generation, created problematic family structure for so many

african americans and i think this is why it becomes problematic for african americans that will vote or support someone simply because of their association to someone else. rob: richard, your response? >> look, i think that's a very interesting take on it. i think if you talk to black voters, they will tell you they want a candidate that will speak to their issues, a candidate they know and respect, someone who they see in their community and all of those apply to vice president joe biden. they seem to apply also to bernie sanders. that's why he's second in the poll. black voters are looking for familiarity. the notion that black voters should be -- like that we should be mad about black voters feeling this way, i think that delegitmizes the voices of black voters. overwhelmingly, we see they vote for democratic candidates because they feel like democratic candidates stand up for their values and issues and they feel like democratic candidates speak to what's

happening in their communities. until republicans can change the rhetoric toward african american communities, you're not going to see changes in those numbers. rob: on the other side of the spectrum, pete buttigieg, who has the lowest approval among black voters, here is him over the weekend. >> i think your facts are a little wrong. >> [ indiscernible ] >> this is not the best way for us to have this conversation. rob: is what's happening to pete buttigieg specifically by black lives matter at this point, is it fair? >> i think it's a matter of him taking care of home and he hasn't done a good job of doing that. i want to respond to richard's point. when we're talking about deleg delegitmizing the black vote. when jesse jackson ran, black voters have shown and demonstrated the power they have within the democratic pa party to put a can a date i candidatee

without support from any other major demographic. when black voters give support to democrats they don't get a return in terms of policy. in 2020, we see there is some progress going on for african americans and i'm talking about the first step, where thousands of people were released from jail, 90% in opportunity zones. we can have a debate. >> no policy -- >> we're talking policy. rob: let's hear from richard. >> i understand the argument, notion that we can have a debate about policy. i go back to the previous argument. we never had a conversation about how voters in mississippi vote republican and democrats say it's not in their best interest. to say an african american voters are voting against their best interest, that delegitmizes their voice. i don't think there's any american voter that's illegitimate to make that argument. to answer your question on pete buttigieg, i think what you can
