jason: the democrats don't want to talk about the thriving economy and the progress the president's made x he's done so despite the impeachment charade that's been going on. senator, i have to ask you, because on tuesday you're going to have to be there sitting at your desk. the big question i think a lot of people are asking is will there or will there not be witnesses. how will this play out? >> well, we have agreed as the republican conference that we would move into the phase one of the impeachment trial. and that is to take up the record that's presented by the house. so evidently, they had enough information in this phase one, they put together the articles of impeachment, they voted on them, they sent them to the senate, to we will look at that record. that record should stand on its own. and at the end of reviewing that record, we will have the opportunity to decide whether or not we want to see additional information and additional witnesses. but you know what in they had a strong argument on that record that's being presented to us, we shouldn't need additional witnesses.

rachel: is that why this is happening? tell us. >> when you look at the timeline of events, what we do know is cnn released anonymous source report on monday making the claim that bernie sanders did say this in 2018. then on tuesday on the debate stage, he was asked whether or not he ever said that a woman couldn't be president. he said vehemently that he never did say that. and then on wednesday we have the trickle effect of this audio being released of that very awkward and terse conversation between warren and sanders followed by a lot of commentary on cnn about whether or not bernie sanders was sexist. so, obviously, this is a very bad coverage for him, and it's all based on anonymous sourcing and based on elizabeth warren who, by the way, has lied about her race and also about her job opportunities saying that she is the one who is telling the truth. i think we can at least ask is this fair reporting. rachel: right. if you watched the cnn coverage, it was almost exclusively anti-bernie and very much taking the side of elizabeth warren.

pete: bad politics for him. here are some of the crimes that no longer require bail in new york. criminal negligent homicide. second degree manslaughter. third degree assault. burglary i can't say it. stalking. someone stalking you, they get arrested out on bail. the consequences are wide and far. >> instead of the handcuffing of criminals. they are taking the handcuffs off and essentially handcuffing lady justice while this is going on and you were talking about it earlier in the show with regard to ice detainers. 92-year-old woman sexually assaulted and killed by an illegal immigrant. so the sanctuary city policies of new york city combined with so they are not honoring the ice detainers. combined with cashless bail system seeing things go in the wrong direction. what we won't talk about giving driver's license to illegal immigrants. now passing a new law for automatic voter

registration. so illegal immigrant is going to go into the dmv, go in to get a driver's license and in the process is set up in which they are going to be automatically registered to vote and the democrats. pete: delightful. >> claim that's not the case. but the process is set up where you will absolutely have illegal immigrants getting registered to vote. pete: your take on where impeachment is right now? >> well, i think we know how this is going to end. what you have is basically the biggest sore loser temper tantrum we have ever seen in the history of our country started in noe 62016 when they were crying and walking out screaming at the sky they needed coloring books and comfort puppies and you remember when during the campaign they were asking republicans, the president republican congressional con democrats will you accept the results of the election? will you accept the results of the election? it turns out the reason why they were asking us this question, i guess, they had no intention on accepting the results of the election.
