>> well, we had license plates in oklahoma, right now we have over 98 of them, they go to different organizations, to schools, nonprofits, to different things and i want to do something special for our veterans groups so i selected two veterans groups that president trump has actually donated to directly and so these license plates would be 35-dollar fee, it's an option that people can pay $15 would cover the cost and then $20 of it would be split between the two groups that are doing the fantastic jobs not just in oklahoma, based out of oklahoma, they are doing great things across the country for our veterans. heather: now the two groups are folds of honors, warriors for freedom, how did you choose these particular groups? >> so the money would go to them, however, oklahoma law says that you have to get a minimum 10 preorders for the plate to go

into production, they didn't meet the threshold, i thought there may be a better way to get more funds through them, through this process but the reason i selected those organizations is because president trump directed to them, in the past he donated $200,000, that's how i selected the organizations based out of oklahoma. >> two great groups. heather: tell us what is left in the process. >> it would have to go through legislative process, oklahoma legislature, senate bill that i filed with senator, it would have to go through the senate first, over to the house, passed by the house on to the governor for his signature and then after all of that the tax commission which is responsible for oklahoma tags, oklahoma license plates, they will start working on a final design with whoever president trump designates to be able to negotiate that, work

just the latest attack on the second amendment so is he right, here to debate constitutional attorney, democratic strategist laura, thank you both for joining us this morning, appreciate it. >> great to be here. >> good morning. heather: i will start with you, let's begin with that question s the president right? >> yeah, the president is right, i mean, when you try to ban an ar15 or close a shooting range that violates the constitution, the supreme court has been clear about this time and again, i don't think that there's much split in the circuits on this, the ar15 is a weapon and common use and the supreme court said that weapons that are commonly used, they trigger and so you can't just get rid of them. heather: laura, you don't agree, why? >> ar15 is a common that's commonly used, commonly used in mass shootings, what we are talking about here in a legislation that they are considering is widely popular and supported by virginians who

elected democrats to get this done across the board with top issue for them before the election, we are talking about background checks, supported by 80% of americans and that includes a lot of republicans to get to that number, we are talk ing about -- means making sure that your daughters ex-boyfriend with restraining order doesn't get weapon in his hands and your grandchildren don't have to fear when they go to school when somebody mentally ill fear when they go to school, common sense gun laws that vast of americans believe in and far right that disagree. heather: let's take a look a gun control measures that have been passed in the senate and i will get you to comments on this and laura what was saying, allow localities to ban guns from public events, sb69 restricts handgun purchases to one per

month, sp70, transfers of firearms. >> first i will in response say that we shouldn't be talking about what's popular versus what's constitutional, this isn't a popularity contest when it comes to constitution. when you talk about trying to protect women against abusive voices, what about protecting women against other perpetrators, it's a great equalizer for them. instead of focusing on background checks, focus on the ban that can purchase one weapon a month. if you were to purchase one newspaper a month, people would say that would be in violation of first amendment, why doesn't the same apply to the second amendment and when we talk about -- >> it's a different amendment. >> we already have laws in every state that allows for the civil commitment of those who have mental illness. when you take a red flag law

which is ex parte, you take aweapon away from somebody but don't give them mental health training, why don't we enforce law that is we already have, if somebody has mental health, confined for mental health as would be the case with civil, they don't get allowed to have a gun, that's not the same thing as flag law. >> amir, with record numbers of mass shootings, with loopholes in the head flag laws which is what the red flag laws are trying to close, we are not talking about constitutional issues, ar15 were banned for a number of years and gun violence went down during that time, even recently when governor northam declared state of emergency the courts upheld that because they said there are limits on the second amendment, it doesn't cover everything, we all know we can't bring a gun on the plane, we all know that there are common sense restrictions to gun

heather: impeachment trial has officially landed in the hands of the senate, the process already heating up as lawmakers battle over whether to allow more witnesses to testify, so what can we expect next, james rogan, manager during bill clinton trial and he breaks it down, thank you for joining us, we certainly appreciate it. >> good morning, heather. heather: compare what you have seen so far and what you expect to see tomorrow to what we went through 21 years ago and you specifically were involved with? >> i really don't know what to

tell you, you might expect that coming up, i can only talk about my own experience and to show you how naive we all were the house managers went to the senate 21 years ago to try the impeachment trial against president trump, we were under the impression, we were actually going to be able to try a case that it was going to be akin to what we think of as a trial, you have a judge, you have a jury, you call witnesses, you present evidence, i had prepared i think a 14 or 15-page outline of what the trial would look like for house judiciary committee, when we got to the senate we found that it was a totally different deal. they hear what they want to hear, they would tell us on a daily basis what to prepare for the next day and it wasn't anything like a real trial, the other thing that you should expect is that in a real courtroom the judge as i'm a judge, you know, you make rulings during a trial and the

rulings stand in the senate if the chief justice is called upon to make a ruling any senator can stand up and essentially object to the ruling and then the senators and if a majority of them vote to overturn the ruling, they overturn the ruling and so the senate is essentially the judge and jury in a very major way and they decide what they will hear and what they won't hear and what they will do and what they won't do and lawyers on the other side don't have much to say anything. heather: all of the investigation, all of the witnesses, that was supposed to be completed in the house and as you were just explaining, they are just supposed to take a second look at all of that? but now sounds like they will be calling new witnesses potentially? >> that i don't know and as a sitting judge i can't comment on a pending matter, it's against ethics but i can tell you from

my experience 21 years ago the senate decides if you're going to have witnesses, if you're going to have witnesses, who will be the witnesses and in what form they testify, they wouldn't let us call any live witnesses and they made us submit a list of who we might be allowed to take depositions from and then they voted on that and they told us also if you give us too many names we will vote the whole thing down and so it was a very restricted, it was very restricted proceeding and it was kind of bizarre for me as a former gang murder prosecutor and former trial court judge at the time to watch my jury tell -- tell the lawyers what you may and may not do and how you will do it and in what capacity you'll do it. heather: what about any insight since the time frame that you expect this to go as compared to what happened with president clinton? >> again, i don't know, i don't think anybody knows what to

expect in the current matter and i can't comment on it anyway, i had a time estimate to put on the entire trial for the people, for the prosecution's case of about 2 weeks, we never got to do that, the senate would never let us do it, instead we spent about 4 weeks essentially talking to the senate about what a trial would look like. so we never got to really try the case, we just did an awful lot of talking in the senate. heather: well, that gives us something to go on and compare it to, thank you very much for joining us, we appreciate it, we will see what happens tomorrow. >> thank you, heather, thank you for having me. heather: thank you, 8 minutes until the top of the hour, forget about hoping on the band wagon, rob lowe isn't rooting for a team just the nfl, and retired naval officer putting on a show-stopping performance, the captivating rendition of the national anthem that stunned the capacity crowd in kansas city.
