>> a little billy joel to get you moving this morning. you are watching "fox and friends first" on tuesday morning. thank you for starting the day with us. it is going to be a very busy one. all eyes on capitol hill as donald trump's impeachment trial officially begins, the president calls on republican reinforcements to defend against the democrats. kevin cork joins us from statuary hall with what to expect today and the lights are on in the capital. >> indeed they are on. we are ready for business and an important day in washington as we look ahead to the senate trial. the impeachment trial of the president of the united states, 67 votes is what would take to remove the president for office, incredibly low that that will happen but the president's attorneys are pushing for a quick acquittal. let me tell you what the

president says about this process, he's talking about chuck schumer calling him once again crying chuck, the two sees asking for fairness when he and democrat house members works together to make sure i got 0 fairness in the house. what else is new. on capitol hill it is not just republicans but the president's legal team but says this should never have happened in the first place. >> donald trump should not be on trial, he should not have been impeached by the house. he has a team that is in a sense chomping at the bit ready to go because this is our first chance to defend -- with actual due process. >> a member of the present that legal team. house managers issuing a statement that reads in part the framers deliberately drafted a constitution that allows the senate remove presidents who abuse their power to cheat in elections, betray our national security

and ignore checks and balances. the general consensus in washington is this will be a fairly speedy senate trial no more than a couple weeks but we heard ted cruz say it to take 8 weeks or more if witnesses are called. shannon: we will depend on you. great to see you. arkansas governor asa hutchinson was in impeachment manager during the impeachment hearing and he said democrats fight for witnesses prove they don't have the open and shut case they have been promising the american people. >> the house is in a bind because they sent a case that was not fully investigated, all the witnesses were not interviewed, they didn't go to the trouble of making sure they had a case fully developed and so now they are coming over to the senate and saying finish the job, we knew witnesses over here because we didn't pursue those diligently on the house

side. whenever you do not have substantive crimes set forth in clear detail in the articles of impeachment and rely on abuse of power alone, that is empty without underlying crimes. that make sense to the american public whenever the constitution refers to high crimes and misdemeanors. >> hutchinson says mcconnell's rules resolution is similar to the procedures that played out during the clinton impeachment trial. much more on all of this coming up but it turns out donald trump will not be watching the impeachment trial from washington, moments ago the president landing in davos, switzerland for the world economic forum. in just over an hour he will take the world stage for a speech on the booming economy, he will encourage businesses to invest in the us. he will meet one on one with several leaders including the

new european commission president, the first woman to hold that position by the way. the us embassy in baghdad is on alert after three rockets hit nearby. so far no one has claimed responsibility for the rockets in the green zone where government buildings are located. there are no reported deaths. this comes as antigovernment protests in baghdad are escalating. at least three protesters were killed monday. iran officially swearing-in a replacement for iran's most powerful general, soleimani. esmail ghaani his vowing revenge for the us air strike that killed soleimani. >> they hit him in a cowardly

peacefully protest anti-gun bills after days of speculation about possible violence. griff jenkins was at the event and spoke to the protesters and joins us now with more. >> reporter: it was a very large crowd and a peaceful crowd and we have the official numbers, 22,000 total folks, 6000 on that capital ground, 16,000 in the streets. in this live shot we talk to the crowd. it was very boisterous. here's what they had to say in their message to the governor. >> legislation leads to accomplished stage. we have to protect ourselves, and individuals right to protect themselves. >> he's looking out for certain groups of people. >> leave us alone. >> if you don't come out and get active and let them know how you feel they can do whatever they want. >> he is starting this fight

to all this and let's bring up some of their responses and i will get you to weigh in. the goal of whitewashing the president's corruption is what this is about. mcconnell and trump want to ignore sort of intent chris coons is more like a cover-up that a fair trial. what say you? >> like the democrats have been doing since september this has been a complete circus and an optics battle and they are expecting now less in the senate and mitch mcconnell is trying to have the process work fairly with both sides which can't be said for how the house managed the inquiry so it is ridiculous the democrats are objecting. what mitch mcconnell is doing is wanting to have the resolutions go illogical phases, the first phase would be each side has 24 hours over the course of two days to

present opening statements which is the same amount of time as the clinton impeachment, rather than over three days over two days into the clinton impeachment they didn't use all their time. this isn't a complex case for either side. they can certainly do that. shannon: so the time allotted for both sides is the same but the length of days has been reduced to wouldn't that since democrats want to call additional witnesses which remains to be seen allow them to get their witnesses sooner? >> in theory yes but this is the democrats wanting to prolong this and have an optics battle and parade and circus rather than actually looking at a trial and looking at from a legal perspective which is what the president's team is doing. definitely treating this as a constitutional inquiry and something that has to abide by the rule of law, how they fare fundamental process, have due process which was denied the president during the course of the house inquiry. the democrats are not treating

it fairly and are treating it entirely partisan because during the clinton impeachment the process, the resolution was voted on unanimously so here we are seeing the democrats are just pushing back against anything mitch mcconnell wants to present and are going to offer amendments and pushing back in order to make this a partisan stance like they have from the beginning. >> the president called on a number of house republicans to bolster the event and we can bring those names of for everyone at home. what role will all these folks play and understand they will not be on the floor giving testimony. they won't be presenting statements. >> they will be presenting arguments on the senate floor. the president's legal team is very robust, a number of people, myself included presenting arguments on the senate floor but certainly helping on the team, we are

defending the president in the media, we are part of the team and these members as part of the president's legal team have been his staunch advocates, have been in the trenches during the house inquiry, they know this record better than anyone else, inside out so i was pleased to see they were named to the president's legal defense team because they have been part of this team, defending the constitution, defending the president, they will continue doing that and especially, people like mike johnson from louisiana, he has such an amazing history and career of being a constitutional lawyer and he knows the process, he knows the record inside out and will be a continuing advocate for the president. >> all about the constitution. thank you so much for joining us. we will see what happens moving forward. will there or will their won't be witnesses, that remains to be seen. carmen gregor calls donald

clampdown on migration flows from mexico to the us by forcing asylum-seekers to wait in mexico when the cases are decided. the president threatened mexico with economic sanctions if it failed to do so. the mexican president offered jobs in mexico if they entered the country in a peaceful way but by sunday mexico's immigration agency said many of those who had complied with the government's instructions would be sent back to their home country. in the discussed fusion, the statement through this spokesperson, quote, trump's threats led to a revision of what was going on at the southern border from mexico wasn't acting as a retaining wall. all risks were identified and mexico is adhering to the law. right now the trump administration has agreements with guatemala, el salvador and honduras to send migrants seeking us asylum to those countries. those asylum agreements are being challenged by the aclu. shannon: thank you. an update to a couple other

responses, and elizabeth warren saying amy klobuchar and i are undefeated from elections and undefeated in new york times endorsements. and a nice short sweet. in terms of the different polls that are out right now, in this base, is there something going on and behind-the-scenes that impact biden down the road? >> everyone knows the party does not want bernie sanders to be president, they did everything they could to keep him from being the nominee. they wanted joe biden. maybe endorsing joe biden would have been too obvious. elizabeth warren is higher in the polls than klobuchar. endorsing her will hurt bernie sanders and in the end helps
